- The woman arrested by Detroit police and accused of stealing a credit card she says she was only trying to return is suing the City of Detroit, alleging her constitutional rights were violated.
At the same time, Detroit police officials are defending the conduct of their officers who interrogated and later arrested Wilson, calling it “strong police work.”

I was a police officer for over 15 years, and I know for sure that law enforcement is the only profession that a person can be 100% incompetent and still keep his job.
There are politicians that can stand up to that. I mean, a complete liar (Santos) just got elected & they can't get rid of him without another election cycle.

He should have charged any officer and prosecutor with contempt of court and recommended to the appropriate jurisdiction for prosecution on charges of malicious prosecution.
As a judge I would let it be known that anyone involved in the arrest and attempted prosecution of this woman will never be afforded any credibility in my court room.

That happened with me but I wasn’t arrested!! Someone left their cellphone in the store and when I asked who’s phone is it a lady claimed it and I handed it to her and then the real owner came back to get it and I told her what happened and she asked me to call it and the person answered. The person that stole it did bring it back because the owner told her she was tracking it from my phone and going to call the police!!! She really thanked me for telling the truth about it and helping her get it back.

@@Deuteromis They certainly watched it, and thought like: she technically took the card so we can charge her. They do not care about catching actual criminals and protecting people, only about their statistics on paper.

She never viewed the card as lost because in her mind she returned it to who she thought was the rightful owner. So when they questioned her and said lost or stolen card the incident in question never rang a bell. So glad she’s doing better.
Plus it was a 5 minute interaction between the two. Most people don't remember an incident that lasted 5 minutes and was weeks ago. Any other time she probably would have given to the guy behind the counter but she thought that the lady who just left was the owner who said that she was the owner.

They have not caught the woman who actually used the card because they wasn't looking for her... Once they arrest the wrong person who tried to do the right thing they wouldn't try to catch nobody else. Because they thought they had a case and they did not...
Perhaps they know the identity of the other woman ,and may have profitted from the theft, therefore are forced to look the other way.😭😭
They've got video, I suspect from multiple angles from the gas station of her handing over the card to who she thought was the owner. There is probably video of the license plate on the vehicle, or credit card info from the driver's purchase at the pump. I suspect that it wouldn't take much investigation to actually ID who the card was given to... but they don't want that because they already screwed up and would rather stick with their story for arresting her. I can see why the judge ridiculed the police case... she asked for a lawyer... BY LAW and the constitution, THAT ENDS the questioning right then and there... way way way more so than the bullshit of a "I want to remain silent" which is almost always followed up with "Why?" in an attempt to keep you talking. Never talk to the police... in her situation, rather than thinking, "Oh that's me.. let me go clear that up, I obviously didn't do anything wrong." Don't talk to the police, talk to and through an attorney.
I'm suspicious this was a "sting" that went wrong and they wont admit it.

This truly infuriates me. WTF was the DA's office thinking accepting this case and taking it to trial. Thank goodness the judge had some common sense here. Unfortunately they can't sue the prosecutor but I hope they put some political pressure on the DA's office for this.

I have picked up a bank card and handed it to someone who identified themselves as the owner. The only differences between her and I are bad luck for her, and the fact that I would never, ever, ever talk to a cop without a lawyer present (ever). It's just a lesson we all need to learn. Too many police and prosecutors don't care about justice, fairness, or even solving crime. They want to maintain the illusion that they're doing a good job, and arrests support that illusion. Guilt is meaningless.
I hope she sues..the DPD for false arrest.

There has to be criminal intent in order for her to be guilty. She is not a criminal.for trying to help someone. Most people are in their own world and they literally do not care about anyone else. They got that call about the credit card and figured as soon as they saw a black person, they jumped right on her!
One thing that the cops got dead wrong, once they read her rights she wasn't free to go! Another mess up, as soon as the detainee asks for counsel, the interrogation should have stopped right there and then! The D.P.D. needs vetting, and firing and these officers should do time in jail for not only violating department policies but lying and accusing an innocent person of a crime that person didn't commit!

Since this case involves assault and kidnapping of the person deprived of their rights the death penalty is on the table. This is were accountability has to be to rid us of bad cops.

We need publicly-owned and operated cameras filming officers in every facet of their job, every second of the day.
When I’m upset I remember things wrong. And I hate being asked to repeat something that was so insignificant because I can’t, simple as that. It was an insignificant encounter and I can’t recall. You can see she asked the Clerk something and he probably told her it was the lady that just left or he didn’t know. I always ask what’s the name on the I’d or card, only because I use to work in a gas station. So it’s habit. The average person, is not going to have the same mindset. I can understand her thinking she might of gave it to the clerk, maybe she thought of a different instance. It was almost two weeks ago. I’ve gotten myself in situations because of my temper and forgetting details or misrepresentation of facts, it happens, and it’s not intentional. If I ever come across the police again, mouth shut, period
This is a great lesson for everyone. Do not ever talk to the police voluntarily, do not ever try to clear your name or explain your side of a situation. Just shut your mouth and let a lawyer explain it in court, because anything you say to the police will just be twisted to hurt you

The right thing would be to let the clerk know that there's a lost card still in the machine and let the clerk grab the card. She forgot to do that and instead give it to a criminal whom she didn't know but assumed it was the rightful owner.
Quite a lot of British tourists have gotten themselves shot in the US by calling the cops to report something and then acting 'strange' when the cops turned up. If you are in any kind of minority group anywhere you should just walk on by when something happens, I didn't see, I didn't know, nothing to do with me should be your motto.
Basically you have to protect yourself from instant judgement calls and not get involved with any matter or touch anything like money that has fallen or help someone who has fallen off a bike or whatever.
Like if you help someone who has fallen off a bike to some other observer you pushed the person off the bike and are mugging them, cops called, .. clipped with a 9.

Depends on the state law. I'm a retired attorney (but not licensed in Michigan) and probably what she did fits the definition of accessory to theft. Many of the prosecutors especially for minor crimes are fresh out of law school. They do whatever the police tell them to do. From this video, you quickly see who is in charge; the POLICE. They clearly violated her constitutional rights which is very clear that when someone says they want an attorney all conversation stops. Period. The fact that the police spokesperson doesn't know this basic tenet of the law speaks volumes about Detroit!

Lawyers are not free unless you're charged with a crime and are assigned one by the court. How can she foresee that what she thought was a simple mistake would lead to charges? How can she pay a $2-3K retainer for something she did not do? I have a good job and some savings, even I would think twice to spend on an attorney for something I know I am innocent of.

This is another lesson on why you should NEVER, EVER talk to the police officer on your own or without an attorney present. Regardless of the circumstances, whether it's at the scene or if they come to your house at the station, and even if you have to sit there in cuffs locked up and wait for an opportunity to make a phone call (especially then, because half the time they use that to scare you into incriminating yourself). No police officer, under any circumstances, can EVER be trusted in conversation, they aren't making small talk, they aren't your friend and the don't give a shit about you. They are NEVER out to seek the truth or what's in your best interest, they see you as a criminal and their only goal is to make a case against you.

Not to blame Sandra--she was doing the best she could--but her memory slip ("I gave the card to the man behind the counter") is exactly the kind of things police pounce upon to justify their belief that the people they arrest are guilty. It is a beautiful thing that she was able to get work again and that she was showed support
by the people who helped her financially. That said however, there is no amount of money
that can undo trauma , re-establish trust, or take away the pain and fear.
I bet this woman is one of those who sees someone drop $50 on the ground, picks it up, and returns it to the owner. The lesson is: Never trust cops, even if you're trying to do the right thing.

The cop defending a process which got an innocent woman arrested and made everyone else think twice about being helpful. Bad form.

Sandra’s integrity is beyond approach. She stepped up to do the right thing and the Judge confirmed it. With his confirmation of the moral character that she has the company that kicked her to the curb lost their best employee. It’s awesome that other companies saw her character, values and wanted her as a member of their company. That speaks volumes of her and those that reached out to hire her. Young Lady has something that was instilled in her as she was growing up. Never sell your integrity out, never change your Morals and your Values just to appease someone. Much respect you, your an awesome Young Lady.

The interview with the detective goes to show you, that even if they are wrong and feel it in their hearts they are wrong that blue wall of silence forces him to stick to the story. We must Tear Down the Blue Wall Brotherhood. Demand new laws that Abolish Police Qualified Immunity.

They lack of accountability by the police is staggering but in my mind the person responsible is the DA. They saw what they had and pressed it. Should have never been a warrant, though if they thought she was an accomplice it might be reasonable I guess. The DA absolutely saw this tape and should have shit canned the case there regardless if they suspected involvement. Once they continued after she asked for a lawyer the well was poisoned.

Many states a passing laws that allow you to sue individual police and DAs. And why not? You can sue anyone else who fucked up and harms you. Mechanics, nurses, electricians, chefs, teachers. DPD is shady af...they knew what they were doing and they knew they should have stopped interrogating. She was acting in good faith when she gave the card who she thought it belonged to.

There's just a small amount of pressure on the police department, this is why they haven't changed. Can't believe they try to prosecute this woman. It is so outrageous and ridiculous. Even after being admonished by the judge they still can't just come out and just say, what we did here was wrong. My god man!
They can't say that they were wrong, because in their minds, they couldn't possibly wrong.
The trouble is "Qualified Immunity" is nearly always treated by the justice system as completely unqualified immunity; you usually have to murder someone in cold blood to be blamed for your actions as a police officer. Judges and DAs are to blame for the system not working properly; more police officers should have the immunity from prosecution removed. They just don't give sh*t in many cases.
This is why when I find something of value such as a credit card. I leave it where I found it. It has been times when I found credit cards and just left it there. For this exact reason.
They aren't "actively" looking for the woman who used the card cause if they really tried hard enough they would've found her!! 🙄
As an English lawyer & part time Crown prosecutor from England for over 20 years this case strengthens my belief that the standard law of enforcement & local DA’s legal knowledge is total garbage. This would not happen in advanced countries who have a higher standard of legal & evidential knowledge. Thank god for a competent judge. I am sick of hearing American lawyers & judges saying America has the greatest legal system in the world. It is more of an embarrassment than a competent legal system. Hope the woman collects in civil damages what she deserves.

A clear example of why you should never talk to the police. By speaking to them, you are helping them investigate you. If you even allude to something that they may think is not true, you are guilty in their eyes. Technically you're already guilty in their eyes if they're even questioning you. Get a lawyer, and let the judge handle it; your safest and only bet
Exactly. They're trained to think you're already guilty. I remember being in a grocery store and was looking at one of the shelves, and when I turned around, a cop happened to be walking by, so I was kinda spooked, just as I would be if anyone suddenly walked by and startled me. Well, this cop just kinda looked at me like I was whacked out on drugs or something. He had the most contemptuous look on his face, but I just continued on my way. Who knows, probably just gave me a funny look, but most people would have a more surprised look than a look of "I think you're doing something wrong". That's just the vibe I got from him. I get that vibe from my father a lot. He's not a cop, but he does seem to like to sneak around and eavesdrop and make investigations out of every little thing. She reasonably believed that the card belonged to the other woman. For credit card theft to apply, they'd have to establish intent, and they debunked their own case by saying they had no evidence that she intended to steal the card for herself or anyone else.
