Stuff like this has been going on in Michigan for a long, long time. In my family there's a story about how my great-grandparents were expecting to inherit a homestead from an old blind neighbor who was their good friend. After the blind man died, his lawyer inherited the land. And why did the lawyer inherit the property? Because the old blind guy couldn't read what he was signing, of course! The blind guy trusted the lawyer. My great-grand parents were very angry about the whole situation, but they couldn't do anything about it.

Unfortunately a contract is a binding document regardless if you didn't understood it at the time you signed it. Saying you did not understand a document is not going to uphold in court at all. It is best to never have signed it. If you have an elderly parent or grandparents, please tell them to never sign a document, even at a doctor's office especially if they're the type that doesn't read or understand things. A reasonable doctor or lawyer or real estate agent will wait if you tell them and will not pressure you to signing anything until it is fully understood. Your first clue to a bad person is if they pressure you to sign something even if you say you want to wait.

I agree that we need to protect our elderly. Discuss these matters and put paperwork in place to have trusted family look after your financial and health issues. This could easily be prevented.

All due respect, this is why we as children need to have our parents financial POA properly set up before they get older. Their bills become out of hand, they get behind, by that time someone has to spend weeks if not months digging them out. Or they do something like this and look for someone to help dig them out, and take full advantage. I had an elderly neighbor who got scammed out of her house. She was in her 80s or 90s and had dementia or alzheimers. The occupational therapist got the woman to sign paperwork for a living trust and put the home in the trust. She made herself trustee, of course. So she legally owned the home at that point. The old lady's will left the house to her children upon her death. She didn't realize she had signed away her home through the trust and her children received nothing.
I know a young guy who had this b/c he didn't ask even me to read the damn contract. Put his family on the street.
Have to wonder about him. He did something stupid and lost a fairly major body part.
I was trustee for my mother's trust and, no, the trustee is NOT the legal owner. The trustee has a fiduciary responsibility to divide the assets of the trust to the beneficiaries. They are required to liquidate assets, if necessary, but are required to take care if those assets.

A judge needs to see this. Just the sheer insanity of this. No one in their right mind would transfer ownership of their house to a stranger and then re-rent the house back from them. and on top of that have a previous realtor with a contract on the house. Those two things don't go together. That is outright fraud.
Is it any worse then squatters simply moving in and the government will not remove them? People need to wake up to the scam that is real estate in the United States, it's beyond insane.

If a court can somehow rule that a person is too insane to understand they murdered someone (in some cases) they should most definitely be able to understand an elderly lady not understanding what she was signing after all she has gone through the past few months.
But that would also mean that the lady would be placed into a situation that she doesn't want to be in. She would probably be forced into a nursing home or stripped of her POA or decision making than.

Sadly this happens all the time. I worked in home health nursing with an elderly client who signed a 5 yr contract for an expensive home security system that she didnt need. She had a tiny dilapidated home that literally had nowhere to even install anything. Her daughter was able to get them to cancel the the contract but she was still on the hook for an amount that was equivalent to one yr. of services. This 93 yr old lady lived alone and had dementia and clearly didnt know what she was signing. They spot an easy mark and take advantage of them. This is cruel.
There should be be laws to protect the elderly and people who are mentally unable to understand do to intellect and or language barriers 😢

Unfortunately, that's how quit claim deeds look in Michigan. He claims it was for his wife's company since he was the notary on the document. If it was his company, there would be a conflict of interest. I believe that is why they are having a hard time in court with it.
Get that lady an attorney with the local Legal Aid Office and file a lawsuit not just to get her home back but also pain and suffering due to the fraud. And the judge needs to be investigated to confirm if he receives any kickbacks or has some other type of financial interest with these scammers. 🤬
Thank you for exposing these people by showing/confronting them. Too many of these awful people get news stories where they show the victims but respect the privacy of the perpetrator thereby allowing them to get away with it.

There should be a Law stating that Elderly, Disabled and other Vulnerable People should be appointed an Attorney to evaluate, explain and act in their best interests before signing any Agreement, to prevent this sort of exploitation.

Everyone needs to start addressing this scammer directly and make him run into hiding while exhausting all of his financial resources doing so. This will make an example out of him to detour anyone else planning to exploit vulnerable people. Peer PRESSURE
He violated the contract by only giving her $2k of the $10k stated in the contract. Judge should toss the quick claim deed because the contract was unfulfilled. The woman should have given her daughter power of attorney until the home was sold.
Partial consideration is enough to fulfill the terms of their contract. I assume the 8,000 withheld somehow relates to her rental payments she agreed to in a separate lease agreement

Doesn't she need to actually sign the deed over in front of a notary? It just sounds bizarre to me that someone could write up one of this quitclaim deeds and initial it themselves and somehow take ownership of the property with no other witnesses or the deed being notarized.

The thing is the county recorded the deed. That's what most likely the initial ruling declared it valid. But of course there are other motions and civil proceedings that will challenge the validity of the recording and appeal the judges ruling. I have a strong hope she will ultimately prevail.
A 100% scam and a TOTAL POS. BUT, she signed over her house to the scammers x wife's company. He was the notary. Notary is just verifying a person signing it is the actual person signing a document.
I feel the scammer screwed up since he was the one presenting the deal, AND the notary. We will see how this pans out in court.

We have the same problem in Ontario, Canada with Senior financial abuse. All the lawyer doing up the paperwork has to swear to is that even if for 1 minute the person seemed competent then the documents are legal. YIKES. A Florida realtor did the exact same to my mother. Now a 1 million dollar home she was paid $0. If any news story would pick that up, the same realtor hit his elderly neighbor over the head with a steel pipe. The criminal still has his license and has gotten away with all of it. Go figure.

Accountability through shame and blame regardless of age is the fix. Her daughter's inheritance gone, moving in with sister or other after wealth lost. I feel for them, having to live with her irreversible decision. My mother, after father passed gave away all the family's wealth from share-cropping. Even today it carries no shame or blame. That would most likely be between her and the "legitimate real estate contract" people. It would be most likely ruled that she decided to enter into another contract with Mo that would probably be held up in court.

I agree. Any purchaser would be forced to go through the Real Estate Company who held the listing agreement to be able to purchase the property after they had a signed listing agreement.

Three things : she had already made a contract with a legal realtor , and there were no witnesses , and he has not finished paying her . How could any Judge rule that this paper he wrote be legal ? The laws are in place to prevent this sort of crime .
Maybe the judge is getting a cut of the profits . I wouldn’t rule that out .
I think the fact that she accepted even the $2000 out of the $10,000 makes it that she is accepting the terms of the contract. She got conned but legally, actually more ripped off than conned.
It is legal. Sorry. Don’t get me wrong, I do feel for her. But at 81, you know not to sign anything without reading it. It is a big mistake that could be costly.

The town department where this quit claim deed was filed should not have accepted the quit claim deed and record it without the notary seal. Maybe office personnel should be looked at.

There is clearly no reasonable legal consideration in the contract if it just offers away a 300k house for 2k. I have no idea how this contract has withstood scrutiny in courts.
