Can the police order me out of my car?

  • In Virginia the police can order a driver out of the car most of the time. As long as the officer believes it is safer for the officer or the driver or if the officer has some evidence of illegal activity than the law allows the officer to remove drivers from the car. The officer need a better reason to pull passengers out of the car though. Refusing to exit a vehicle when ordered to by a police officer can lead to additional charges.

    Which article of the Constitution provides authority for public servants to remove a person from a vehicle.

      The US constitution creates and empowers the federal government NOT the states. county and state police do not derive their authority from the federal government but from local and state governments.

    In the name of their safety police have ordered people out of their cars, pat them down, handcuffed them, and had them sit on the curb.
