I hear all the arguments, Dali is correct yes, I also understand what the judges keep seeking for clarity but Gcuba's argument is substantive in a sense that the electoral act 47 (1).e does not accommodate remission This is because electoral act is about producing executives and remission is done by executives which is a correct argument hence 'law breakers cannot be law makers'
Is it correct to argue that though Gcuka is talking from original sentence because it's says it can't be appealed doesn't that mean it's then an ultimate sentence?
Dnt talk about medical parole, it was decided that it was unlawful, we now talk about presidents remission which cancelled the other remaining 12 months sentence of Zuma.
@@coolair5660 presidential pardon cannot nullify the findings and convictions of the highest court in the country Constitutional court The former president was convicted of a crime Clemency I think cannot expunge a criminal record
I am not in support of MK party but now that i have listened to these arguments, MK is likely to win the case. 1. Zuma served 3 months and the other 12 months was cancelled (set aside) this means that his sentence was no longer 15 but 3 months due to president remission which can be interpreted as reduction of sentence through appeal and other process. The MK will see their Zuma standing for elections and on the ballot. This is my opinion based on all the presentations made by all parties.
I am not an MK member, but I love the way Senior Advocate Dali Mpofu put his argument forward. Salutations to Adv Mpofu.
eNCA, I can't get enough of your content, so I subscribed!
Remission and a sentence are one. One cannot exist without the other😅. I am not a lawyer but I understand the wisdom behind it. 😅
Powerful arguement by Adv. Mpofu

Other nations are far away with improvements. With us toy toyi madness
After medical parole
Does Zuma still have a criminal record
If he still does
Then he has no case

Constitutional court
The former president was convicted of a crime
Clemency I think cannot expunge a criminal record
Criminal records can only be expunged if certain conditions are met an application has to be made in a court of law
❤️
When did the constitution of SA change to allow Zuma back into office?
They want him as an MP.
Remission does not change sentence it only changed duration served.
