    In my opinion, one of the most stressful job situation is being in a situation where you cannot set your own pace because other people are constantly interrupting you several times every hour.

      Yes, many are not overwhelmed by rapid pace and interrupted rapid pace, but others are - for this reason, one person with an anxiety diagnosis is properly able to work that or another job while another person may not be able to - every person is unique and it revolves around how functioning is limited and to what extent. Some limited functioning prevents all jobs, some only some jobs - and that latter would mean 'not disabled'.

    The problem with telling your therapist, is this, a person with mental illness does not always know or can see their illness. They may know that they feel differently, but can't express the symptoms they have.

      Agree! But try they must. I think a skilled experienced therapist will also be able to draw out of their client what she is experiencing. Of course, some therapists are not that skilled.

      Very sweet Aisha. My preference is the actual work for my clients in their SSD cases, and videoing explanations has been helpful to ME, because I spent far too much time pro bono providing when a client or non-client had an issue and wanted to chat it up. Rather than explain things 50 times to 50 people, I'd make a video. But then I had to get it to them which ALSO took individual time. You Tube provided a way that now allows me to use that saved extra time for clients' cases. But I do appreciate if it helps others, these little off the cuff shares. Usually super short, but the occasional longer, when need and time allow (like the MH one above).

    The PA/Primary Care Doc at the VA clinic I go to told me they would not enter things into my record if I called them or emailed/message them when I am sick. He said it was a waste of government resources and that if I had a complaint I would have to the ER or come there and wait until there is an opening. I think he just didn't want to do it because it is extra work and he doesn't want to do anything extra to help veterans if they were to file for compensation or social security.

      Do you have a patient portal? Message through there. They may be incompetent, corrupted and and engagers of medical malpractice, but you can provide relevant health information and goings on with you, through that message portal potentially. Also, see if there is a FAX number. Many medical providers today have embraced the LAZY WORKER attitude that has been promoted in this country. I wonder what his licensing board would have to say about a licensed doctor refusing to intake a patient's complaints,the lack of recording of same is at the very least a 'false light' form of defamation. Shameful.

      One thing I've noticed about my VA PCP over the past couple of years is that he is not finding a diagnosis for my health problems. For example, I had x-rays over a decade ago showing bilateral knee arthritis. About six months ago, both my knees started becoming worse, including instability. My VA PCP documented "knee pain" with no x-rays, no history, no treatment or management. I've had chronic migraines diagnosed outside of the VA by a neurologist. I brought this diagnosis, along with my medications and CT scan results from an ENT doctor, to my VA PCP. He didn't even document it. Chest pain, IBS, including multiple other problems that I have reported over the past couple of years with no diagnosis. My VA PCP documents my complaints and seems to never follow-up. It's like I am a brand new patient every time I show up in his office. This is just a hunch, but I feel like they do not look for, or provide, a diagnosis because of Veterans seeking disability benefits. When you have complaints with no diagnosis it's more difficult to get disability benefits. Plus, patients get frustrated and just give up. I can't even get my VA PCP to update my non-VA prescription and non-prescription medications.

      These are just my thoughts, I have nothing to back this accusation up. Maybe I just have a doctor that does not like having a patient with a lot of "non-specific" symptoms, plus a long history of mental health problems, including agoraphobia and panic disorder, that have made it difficult to attend medical appointments. Just my thoughts, and I have severe anxiety, so take them with a grain of salt.

      @@whitfieldjeffery It is pathetic. Can you use an orthopedist at they very least? Why are you treating with a PCP for a specific problem? I'd get an expert in the knees field. He sounds generally incompetent, your PCP. I am glad he documents complaints, but you need a professional MD, not a mere scrivener. I'd get a new doctor, in or out of VA.

      @@AllThingsSocialSecurity Thank you for responding to my comment. I have recently started treating with some specialists. I live out of the country, so I don't have insurance, but office visits and some medications are affordable by paying out of pocket. Some medical tests are affordable, too. I have made much more progress being out of the country than I did at my local VA, as far as getting diagnoses and treatment. Before I moved overseas, I went to a couple of private physicians, but the cost was prohibitive for me since I didn't have private insurance.

    There is so many homelessness people that are disabled in different ways, it's just sad the government should address that immediately providing them with Housing thats very affordable based on the imcome from social security.. people with disabilities should be addressed first before woman with children's, the womans that are physically fit to work..

      I agree. I worked all through my pregnancies and child rearing. At one point I worked nights while my husband worked days - and others could do the same with a team mate. Need not be married or related... I don't disagree with all you say. I'd also say I wish families were more intact and supported as the life-strengthening measure they are - disabled family member with intact families WOULD have a home to live it, and they could contribute with their income like any one else in the family.

    What I really don't understand is being able to work after approved. It makes no sense, you are applying because you can't work any job. Yet after you are approved you can earn up to 1500 a month.

      Great topic to bring up! We are due for a refresher, for sure, and many people question this. That is because the terms of the insurance being triggered is being UNABLE to work substantially and gainfully, at any job that exists in substantial numbers in economy. Under $1550 is not considered substantial/gainful work, if not full time and at a time when your medical records make very clear that you could not do any existing occupation (of sufficient numbers), full time.       @@T.ruH.eroU.nderG.od86 It can be important, Tru, particularly if not a one-off bad period but a recurring thing... but truly it is the whole evidence that comes together to support or weaken a case seeking to prove 'no jobs' - and for sure, under 50 is more onerous than over 50. I consider medical evidence to be like crumbs - you need enough to build the cake - it need not be pretty or even 100% built, but it must equate to 'no jobs' - so if there is a job one can do that their limitations don't eliminate, that will be the achilles heal. That is why I nag so much about "all impairments big and small". Often it is that little one that eliminates that last few jobs.

    So a shrink would write evidence: "Patient is with extreme limitation of adapting and managing herself because her panic attacked over a cooking accident distracted and she didn't turn off the stove when a bacon grease fire started." Is that enough?

      Doubtful :). He likely wouldn't try to smash the alleged cause of the limitation into the limitation as it exists today. ALso, you'd expect to see him having discussed in his records the various incidents where her ability to adapt herself was so lacking as to be illustrative... then, is is all the time, once a year, only in public situations? If the latter, there are jobs without interaction with public, so while such a limitation may be prohibitive of some jobs, not all, so you need to work on the proofs of Dx and limtations stemming that then eliminate other jobs - it is usually inclusive of physical limitations that may prevent some of the 'mentally easy' unskilled due to physical reasons. I.e. the crooked pinky. Remember, you build it in pieces, generally, No one thing tends to do all.

      Extreme limitation. You are not able to function in this area independently, appropriately, effectively, and on a sustained basis." How many episodes are "serious"? the benchmark of "sustained" 51/49 vegas odds?

    Some states like Michigan, do not have mandated brakes at all, no two 15 mins, or 30 minutes for lunch for an 8 hour shift. I would need to bring in a doctor’s note to request my breaks, if I was working full time hours. How would something like that work in states that do not have mandatory breaks?

      Very true. Even federal law does not mandate it for all - leaving it to an employer to decide to offer it in order the acquire more possible good employees and for employees to determine if that job is not the one for him. But yes, due to ADA, FMLA etc., other federal laws can be used to step in for actual medical NEED, vs want. I suspect one reason it may not be mandated is that it would destroy some businesses, leaving people without jobs and customers without sufficient care they paid for. Imagine a surgeon in a 5 hour surgery putting the patient on ice because he is allowed under law, a 15 minute break. I jest, but you get what I mean. Imagine your server at a restaurant has to leave your food under the lights to get it to you 20 minutes later b/c she is allowed to take a 15 minute break at the 4 hour mark. You'd have a cold stale meal and she'd lose a tip. As a prior server, we generally opted for no official break, b/c breaks mean lost income. Historically, for centuries and millenia, people were well able to work far more hours without actual set break, and many being self employed choose to today, so the business can flourish in the moment (we consider potty breaks as 'breaks :)
      As for VEs at the SSA, they will often use the 15/30 minute break scenario because MOST employers offer that (supposedly) - not sure which ones! Perhaps that is another idea that should be re-looked at. Do they REALLY Offer that in a timely fashion??

    Hi, I'm thinking that one can get disability benefits for anxiety and depression, but not for chronic insomnia.

      Will, if chronic insomnia resulted in all the *pertinent* jobs being non-performable by that claimant, it too can be a condition that could. The devil is in the details - what does the medical records show that the insomnia causes from a functional limitations standpoint?

      Hi again, I'm wondering if a lawsuit against my doctor's office for my Lunesta addiction would hold up in court ? The PA said in February " Why don't you try taking it for a week to 10 days and see if you can't knock out the insomnia ? " . I said that " I didn't want to because I was concerned about it losing its strength, and the rebound insomnia " . And then the doctor wouldn't give, sign for me a 90 day Leave of Absence. But you mostly, or are strictly SSDI law.

      @@AdamSolt59 Strictly federal Social Security law, yes. You need products liability, perhaps, and more specifically, pharma liability. I expect if the Dr advised you according to the rules on prescribing, you may have a tough time pinning it on him.

    I've never applied for SS disability because I've been told that it's next to impossible to get benefits for mental health conditions. I'm 53 and was diagnosed with bipolar disorder in my teens. My life has been nothing short of misery and chaos because if it. I lost my most recent job almost 9 months ago because of my bipolar. I relate so well with the things you were describing, I broke down into tears. I'm barely making it and am living off money from where I sold my house... money I needed to save. This video makes me feel that it should be possible for me to get help, but why are attorneys telling me no? It gets to the point where it all just seems pointless to try anymore. Thank you for doing this video.

      @@sarcasmfordays Medicaid is a state insurance program, determined by the state's choice of criteria, not the federal SSA program rules. So it doesn't mean anything relevant to whether prevailed on the federal disability claim. Fingers crossed for you.

      I'm 58 and completely understand him. My anxiety and PTSD, racing thoughts, anger issues have ruined me. I'm a drummer and haven't played on stage since about 2005, was a hobby but my jobs were all kindergarten type jobs and never could hold them long.

      I used to get SSI (I see my post on another comment was removed 😡) 96-2000 my late wife became a RN and was removed from SSI. Now I'm waiting for my denial I reapplied. I'm 58 and have anxiety and panic disorder and PTSD and anger issues as you said, I talk too much and bother my family and friends bla bla bla. Racing thoughts oh yes. So a lawyer told me when I get denied he might take my case but he wants to see their reasons for denying me.

      Actually probably not. For VA, you can still be able to and DO work above SGA, and get your benefits. SS disabled is far more 'disabled' for lack of a better word. Much stricter definition.

      And I am glad it is easier for our Vets to get VA benefits - that threshold should NOT be as strict as SSD.

    I have a psychiatrist who’s been seeing me since last august 2023 and before that June 2023 I started with a counselor for depression, ptsd, and anxiety. My psychiatrist doesn’t want to fill the function capacity report but my LCSW is willing to fill this form. Would SSA take the LCSWs report and consider it or only a psychiatrist (to which she does not like to fill out SSA forms, to which i noticed not many MDs like to fill these forms out). They feels that its too long to do.

      They have to consider all. It may not get as much weight as psych dr, but it it still medical evidence. Key will be does it correlate with what she says you are like in your sessions? Are you psych meds akin to the severity of symptoms she includes? I will caution you on asking your therapist to fill out this form if she is not well versed on SSA laws / rules, etc. One word she thinks is helpful can sink your ship.
      You are right in that most will not fill out such forms. They may be wise because usually they hurt your case b/c they use words the SSA interprets differently than they do, legally speaking.

      Aw, hi Cory, so sorry you are struggling with this.
      I understand that some with the mental challenges we discuss here, may actually have difficulties understanding the content - and that is a bit of an irony, huh? I just can't cure that, wish as I might. Fortunately most can stick with it - and I am sorry I cannot meet your needs. As they say, you can please some of the people all the time (like here), all of the people NONE of the time, and ALL of the people SOME of the time. An oldy but goody expression, but how true, right? Be well, and perhaps seek some at home companion to help you navigate so you can hopefully prevail on your claim.

    Thank you for this post. I'll take it to my psychiatrist and see what he thinks. May be he can put something together for me for my upcoming CDR. I'm 53 1/2, so I don't think my age will help with the new SSA aggressiveness. I'm hoping this SSA law may be of some help, thank you for your time and help!

    I read Paragraph B of the Listings for mental health conditions including Anxiety and Depression (they are the same). I read nothing in the criteria that addresses going to the grocery store....
    People need to start standing up and call out the ALJ'S for making the guidelines stricter and more stringent than the law requires. The new commissioner and the Senate Finance Committee need to hear about this.

      @@CincyFireball The more you know, the more you may be surprised. Clearly we cannot go on as we have - and the writing was on the way in 2020, (that year's Trust report showed incredible strength of SSD Trust fund, thanks to high wages (preCovid) and other results of smart productive decisionmaking, yet there we went in 2020, and here we are. Don't let the current nice moves in SSA fool you - it is like following the carrot or the shiny thing - election years are amazing for sudden hard work to get the average unaware voter right where they are wanted.

    Ive dealt with mental health issues since a child 16 now 39. I tried to in alive myself and had a stroke was hospitalized for 7 weeks.. my question is do i apply for stroke and now loss of mobility and brain function or mental health? Can i apply using both?

      Good morning Danielle, As your lawyer will tell you (I do not recommend filing without one, considering they require no retainer and you are trying to prove you are unable to perform skilled and unskilled sedentary and light work, liking writing/drafting/being paralegal) - ALL impairments are relevant to SSD. You do NOT apply on 1. If there are 10, you include all 10, including arthritis in your pinky finger.

      They probably said you were not mentally so challenged you couldn't negotiate simple things, including an unskilled, child like job... pursue your OTHER impairments - most of us a 50 have some age related degeneration of bones/joints/muscles, etc. What does your lawyer say was the weakness? Don't forget to appeal!

      Refuse? They are not allowed to fill out your function report - it is for the claimant as he is the witness to his own functioning. Now, if the claimant is unable, then someone willing can help him get it on paper; if it is a loved one's OWN answers as to what they observe, then they'd do the SSA-3380.

      Well, we go to a therapist for a reason; if we hide our issues, then we cannot use them, generally. It is like not going to the doctor if we have a physical impairment - we may get by and survive, but the existence of that impairment will not be provable should we need to prove it.

    I saved all my doctor note excuses for most of the time of my last jobs. Where he had to take me off or I had to call in and get a doctor note. Will those provider notes excuses from work to send to dds ?

    Hi again, Unfortunately, I never applied for SS Disability benefits. I only tried to get my PCP, and a psychiatric physician's assistant to sign a Leave of Absence paperwork. Neither one were cooperative.

      If you are disabled from workng full time, are not currently working above PT SGA levels, and are insured for SSD, it may behoove you to apply. Of course, you have to develop your evidence greatly.

      It's ridiculous, how much confusion is required. Except for clocks, and watches, I don't really have a sense of the time of the day. Everything seems so weird. Have you ever had a client going through that ? I've actually been going to work, collecting those water samples for a public water utility. But getting behind on labels and paperwork.     When I was teaching I had a paraprofessional assisting me in my classroom as an ADA accommodation since o was low vision and had trouble with executive functioning I surely made sure that was noted when I applied and was eventually non renewed I used it to my advantage

    I see my therapist (LCSW) once a week, for seasons and she seems to document things well. Although I haven’t been working since October 2022, I’ve never spoken to her about my incidents at work should this be something I should discuss with her about my fears to going back to work due to my incidents and panicked attacks and having to call in at least 5-6 times a month or leaving to sit in. My car due to panic attacks?
    I also have a behavioral health specialist an MD psychiatrist who sees me monthly but I don’t see her documenting very well with what I tell her. Could one or the other documentation help? I know that both would be better but my psychiatrist just tells me to talk to my therapist.

      Sorry one more thing, I’ve had to go to the ER A couple times in the last 5 months last time was 2 weeks ago. Would it be appropriate to tell the doctor at the ER the incidents that have happened that’s caused me to have a panic attack ?

      If you don't tell your therapist about the panic attacks you are trying to over come, what DO you tell her about?

      Sorry I meant that I do tell my therapist (LCSW) I’ve been seeing her now for a little over a year but at first it was hard to talk to her as I was trying to still figure out the consultations and conversation that I wanted to discuss with her but was afraid as I didn’t have that kind of connection that info now. It took me almost 9 months maybe 11 months to finally tel her more in detail with my childhood trauma (sexual abuse, physically abused, gun had been held to me ) also stuff that would occur with my last employer as an adult I had to deal with alot of disgruntled patients who physically would attack me, follow me home or out oat the grocery store. And also ex fiancé’s abuse.
      I have now been very open to my counselor/therapist. And even til this day I never mentioned that I had been suicidal until a few weeks ago. But I think I initially wasn’t open with her due to the fear or talking and telling some random stranger my most scariest times in my life. But now I feel like she’s a friend and I can speak to her and I have been very open now.
      My psychiatrist is the one I’m having issues with. When I tell her I’m having some confusion or just my mind isn’t there like forgetting to put a cup under my coffee k cup machine and it runs onto the counter, or just not concentrating well. She brushes it off telling me maybe I need a sleep study and I actually told her I had one less than a year ago and I have a CR pap machine, so then I told I had a sleep study about maybe 1.5 year less than two years. She then told me to have my pcp order a CR of my brain if I’m having “memory loss” which isn’t what I told her it’s more of confusion and forgetful stuff like that. That I would think is part of my mental health. I just feel like she isn’t listening to me and I’m sure that she maybe not documenting and blaming it on memory loss or so other than my mental health.

    Ive never had a job, that was easy. Even a cashier has to stock in between customers. People work there buts off for min. wage. Example in one job I had was a gas station. I was helping the customers lift kegs of beer on there truck....not easy in my 30s. Which thats just one example of why I needed to apply for disability, In my 50s.

    What about insomnia brought upon by anxiety and depression, confusion brought on by the insomnia ? My doctor put on the paperwork one time during one of my doctor's visits, primary insomnia and MDD. But he wouldn't sign a Leave of Absence paperwork. He said im not going to do it just because you're tired, it'd have to be a hear attack or a stroke, something like that.

      The whole key is evidence showing functional limitations and the extent thereof. Most people suffer from one, more or a combo of anxiety / depression / insomnia. Generally the SSA, if there is treatment that indicates some notable struggles, will find the person may be limited to unskilled jobs; Since there are MANY unskilled jobs in the economy - then that evidence, would only know out the other jobs, and you are left with a case that does not show you can't do unskilled, low attention span jobs, even if minimum wage.

      And neither for the photophobia caused by the lack of sleep, that my body wiggles a bit, coordination off a bit. But I changed a light bulb up on a ladder recently, in my home.

      I'm also thinking that once I go out on an early retirement, pulled that lever at age 60, that I can't go and try to get SS disability benefits later ?

      @@AdamSolt59 Your sleep specialist is the one most likely to document this, perhaps. Have him check your photophobia - as it would appear there as well as anywhere else. It could be a crump added to the cake-building.
      If you wilfullly climbed a ladder despite claims of balance issues, photophobia - obviously that would be a crumb in the other direction that may detract from credibility of subjective complaints of balance/coordination/wiggles etc. Why did you tell them that? I don't believe there are any questions on any reports about if you EVER climbed a ladder or in the last 12 months - did an ALJ ask you that specifically, or did you just offer it up. If you did, for what purpose?

      @@AdamSolt59 early retirement is not 60. It is 62. You can try again for SSD but if you fail, you are forever stuck with a 30-35% reduced retirement rate from what it would have been, so think carefully. If you do not have a rep and need an eval for representation, reach out to me.

Perhaps he works in an area that profits from people not prevailing on SSD claims? Just curious. I have been on reddit, but find it a little bit strange.

    It's so easy to fool mental health "professionals" someone ik went on SSDI with "severe" anxiety about 18 years ago. Yet makes $40k gig working WITH 1099's....Every few years the SSA calls and asks "recorded under pains of penalty" are you earning any money? Nope... Ok bye call you in a few more years..

      Wow, you don't feel the urge to report this thief who is literally stealing from disabled adults and/or children? I don't know if I could live with myself. Sounds like you know this person well, since he keeps informing you of his fraud and criminal activity and trusts you.
      I would add, this may be why generally speaking, without psychiatric hospitalizations of magnitude or other very credible information (definitely not a simple MH professional anymore), SSA puts severe anxiety as unable to do all but unskilled/low stress/no public - you lose, not disabled from all jobs.

      @@AllThingsSocialSecurity I'm not convinced he's doing anything illegal... He files taxes every year and writes down the income to zero with all the deductions.. Visits mental health "professionals" every week who are full aware of the situation.. apparently the IRS and SSA don't share info😮

      @@tcash2402 Actually, you are saying hie is self employed, and he legally nets ZERO. THen he is under SGA unless the IRS finds he is illegally deducting/evading, etc. However, with SSA as a Self employed, we are limited to under 45 hours amonth AND the under SGA number. So when he had to do his 820, if he lied about his hours of activity, if anyone every reports him vs. put head in the sand, he can be prosecuted for fraud, stealing government funds, etc. How do you know what his MH provders know?
      Note that it is not unusual for onlookers to see things and then see more, via assumptions. Does he tell you he is scamming the government? Or does he think he is not? We can not be sure he is, unless, well, he is :)
