When someone says that they've been accused of rape, it's not the news', society's, nor the police's job to straight up believe the accusation. That's not to say that you think the person is a liar. I believe there's a middle ground that can be found, and that middle ground is a stance of observation. You hear out the accusation, and you begin an investigation to confirm the accusation. If there's not enough evidence to support the accusation, it's harder to believe. If there's evidence supporting the accusation is impossible, there's even less chance that a jury can believe a crime was committed or that a particular person committed it. We, unfortunately, do live in a world where people are falsely accused for malicious reasons or sometimes accidents. We need people who are indifferent to these accusations to conduct the investigations and bring the truth to light to the best of their abilities. To assume any accusation is truthful or to assume it's false increases the possibility that justice won't be served.

I'm not sure about US law, but in french law, there is a difference between "public action", which is the punishment from the state against infractions, which results from an investigation (so anyone can call the cops to report an infraction, not just the victim itself) and "civil action", which is the punishment from the state to give the victim justice, and that punishment can only be asked (or later cancelled) for by the victim of the infraction. It was the state of Los Angeles that were prosecuting him for his actions. This video wasn’t even used as evidence in the trial as the judge dismissed it as inconclusive. I’m not sure why he’s lying about it in the video, he just not telling the whole truth about the night.

Technically it is illegal to make any false charges. Lying in court is purgery. It's already a crime. While I don't like that people do this kind of thing, I don't know if more specific laws surrounding false rape claims would be a good idea. The courts get things wrong sometimes. It happens. I would be concerned that rape victims might be even less likely to come forward (we already have a problem with victims not wanting to come forward, for various reasons) if they might be charged for a false claim simply for losing the case. I'm not saying false rape charges aren't a big deal. I'm saying there are already laws against it (even if they aren't properly enforced). The system is already fucked. Adding more rules to it won't necessarily make it better.

To be fair, Title IX didn't affect his criminal case - he was cleared of all charges - but he was expelled from USC following their mandated investigation under Title IX which should be subtitled "believe all victims." Just read the Title IX office that does the investigation was deemed to have bias and thus their investigation was unfair. Evidence is used to make a jury believe a crime was committed by a particular person. When someone says that they've been accused of rape, it's not the news', society's, nor the police's job to straight up believe the accusation. That's not to say that you think the person is a liar. I believe there's a middle ground that can be found, and that middle ground is a stance of observation. You hear out the accusation, and you begin an investigation to confirm the accusation. If there's not enough evidence to support the accusation, it's harder to believe. If there's evidence supporting the accusation is impossible, there's even less chance that a jury can believe a crime was committed or that a particular person committed it. We, unfortunately, do live in a world where people are falsely accused for malicious reasons or sometimes accidents. We need people who are indifferent to these accusations to conduct the investigations and bring the truth to light to the best of their abilities. To assume any accusation is truthful or to assume it's false increases the possibility that justice won't be served.

I'm not sure about US law, but in french law, there is a difference between "public action", which is the punishment from the state against infractions, which results from an investigation (so anyone can call the cops to report an infraction, not just the victim itself) and "civil action", which is the punishment from the state to give the victim justice, and that punishment can only be asked (or later cancelled) for by the victim of the infraction. Technically it is illegal to make any false charges. Lying in court is purgery. It's already a crime. While I don't like that people do this kind of thing, I don't know if more specific laws surrounding false rape claims would be a good idea. The courts get things wrong sometimes. It happens. I would be concerned that rape victims might be even less likely to come forward (we already have a problem with victims not wanting to come forward, for various reasons) if they might be charged for a false claim simply for losing the case. I'm not saying false rape charges aren't a big deal. I'm saying there are already laws against it (even if they aren't properly enforced). The system is already fucked. Adding more rules to it won't necessarily make it better.
