      @@Slo-ryde the answer is that it’s constitutionally a bit problematic for the executive branch (of which DOJ is a part) to go after the judicial branch. So what the Senate Judiciary committee has done first is to file an ethics complaint with the Judicial Conference to investigate him. They’re hoping the judicial branch will police their own, to avoid constitutional issues.

      Once upon a time. Republicans decided to embrace even the criminals among the guns&bibles crowd after they were so horribly -- rightfully -- embarrassed by and chastised by voters after Nixon.       Thomas knows no humility nor does he have ethics. His behavior is guided by the maxim “Do as I say, not as I do.”
      As for making an effort to discover the source of the leaks, i didn’t hold my breath. Had they WANTED TO, they could have discovered the source. Starting with engaging the services of an actual investigator like the FBI.
      Alito leaked the Hobby Lobby decision to his far right buddies. The best predictor of future behavior is past behavior… There’s no reason to believe Alito didn’t do it again.

      Fortas was Chief Justice while Nixon was President. Nixon was fond of the idea of replacing him with a more conservative justice, and saw this as his opportunity. The house and senate were majority Democrats, so Nixon ordered a Justice Department investigation. There is no doubt Fortas was taking bribes from sketchy characters. With pressure from the Attorney General Fortas resigned. In the end the whole scheme worked out as Nixon wanted it to when conservative justice Harry Blackmun was sworn in. It's the same game today. Republicans don't want to be down a conservative justice while a democrat is president.

The only difference is the time in history and the obvious difference between Fortas, who put the importance of the public’s faith in the Supreme Court above his own interest. Now that’s real integrity. In that regard Fortas and Thomas are oranges and rotten apples.

    Abe Fortas argued one of the most important cases in history before the Supreme Court years before he became a SCOTUS justice. _Gideon v. Wainwright,_ in 1963. In that case, it was determined that the Sixth Amendment guaranteed the accused right to counsel whether or not the defendant could pay. Before 1963, if couldn't pay for a lawyer, you had to represent yourself.
    Things we take for granted were fought for and paid for. And they can be taken away at any time if we are not vigilant. We learned last year with _Dobbs._ We must never forget it.

      @@op3129 the problem is that the court has become so politicized that both parties will stop at nothing to keep the court on their side. Do you think Mitch McConnell has any sense of honor about this? He blocked Obama’s appointment and forced the Kavanaugh appointment through. Getting the modern incarnations of the parties to take ethics seriously, when it gets in the way of political expediency, is a big barrier.
      The Ginni Thomas stuff has been known since 2014 and it didn’t make a difference then, and probably won’t change anyone’s mind now.

    It makes me wonder if Thomas is the only judge on the Supreme Court that has been bought. Why else would the silence from Roberts be so deafening?! I am forced to wonder if an ethics committee should look at all of the justices. In all fairness that might be best considering Thomas said he consulted his colleagues and was told that he didn't have to report his gifts.

    Abe Fortas was a close personal friend and advisor to LBJ. One could argue that LBJ had his own ethical limitations. But that didn't stop Fortas from doing the right thing.       I made a wooden jigsaw gift for my therapist and she had to consult with her ethics to determine whether she could accept it. It’s unbelievable the callous disregard for the law displayed by these Republican Supreme Court justices!!
