@110311DONTWANTCHANNE it's worse, most of the newly developed homes in newly created areas are mostly HOAs. A lot of modest areas that are not run by HOAs ended up getting purchased and rebuilt into high end homes.
He'd better not let the fines ride. The HOA will seize his house and sell it out from under him. They'll do that in a heartbeat.

It happened to my neighbor across from me. He ignored paying his dues for two years. Next thing he knew, his house had a lien against it then the HOA auctioned his house.
It says a lot that it is even legal. Our country is messed up.

It’s a common wall for which the HOA is legally responsible. They own the outside (the full perimeter and all common and shred spaces). That’s matter of NV law (don’t recall the NRS offhand, and yes, I’m a NV attorney) and no CC&Rs can abrogate the governing state law. HOAs will engage in all form and manner of illegal acts unless and until they’re legally challenged. It’s their wall to repair, period.

I looked at this guy's house in GISMO. The parcel runs all the way to the concrete curb. Instead of being patient, the HOA is fining the home owner for something that wasn't even his fault. That's deeply wrong.
He said it's in the condo documents that it's his responsibility. Not agreeing with it but if that's how it's written, that's what a judge would defer to.
Not according to his contract, that he signed...Guarantee it contains boiler plate language, covering all surrounding walls on "his" (their), property...The graffiti/trash is on the easement, so, no one to fine...

Stories like this were the reason one of my hard "no way in hell" lines for my recently purchased home was "no f'ing HOA!".

I can not express this enough. Home owners, take over your HOA. Attend the meetings and run for positions on the board. Once you have control of the board, vote out the managing company. Form your own. You only need a lawyer and an accountant for the legal work. Add an answering service for calls, and the president and board can review the calls. Then, you can truly have an HOA that works for the people of the neighborhood. Managing companies just looks to fine the homeowners to increase revenue and do little to improve the neighborhoods they work for. My neighborhood is currently doing this.

I mean, some of that sounds easier said that done. I’ve dealt with HOA disputes a couple of times as an attorney (never again). And to me, it seems like the management companies are pretty essential as it relates to legal compliance and the admin work involved. That seems like a real pain in the ass.
But yes, I agree that good people are need on these boards. In this guy’s case, the HOA should be taking financial responsibility over the matter.

I have had run ins with the president of that HOA.
@@ddrhazy they constantly send me violations. Actually sent me a violation for "weed removal" and pic was of the new bushes i just put in. Also send monthly dues really late in month and say late fees if received after the 1st of month. I now have to right on it the date i received it and sent it out. Told them i refuse to pay late fees.
Refuse all you want. When you signed, you agreed to liens put on your house. Only real solution is to sell, and move out of Vegas.
@@brentfarvors192 Vegas is HOA central so your comment is largely correct. Move to the mid-west or north east where HOAs are not as common.
Board of Realtors are impotent. The HOA powers should be minimized, especially when it comes to foreclosing on a home. A lot of the HOA officers are obnoxious, rule with an iron hand, can care less about the owners. Some officers even steal the HOA fees leaving the HOA poor in cash. Audits usually do not reveal the embezzlement.
The real sucky thing is that the HOA can put a lien on his house.

If its a COMMON wall, it is HOA responsibility (to fix or go after the driver). he needs to pay and sue for the money back.
I live down the street from an HOA. It is relatively new community, some of the lots don't even have houses built on them yet. We are friends with some of the residents. One guy told us that he had some trees on his lot that were dead when he bought the property. After his house was built he started working on the yard, which is very large because he bought 2 lots. He had to get permission from the HOA to cut down trees that were dead, and they had been dead for quite awhile.
His pretty much screwed right now sorry for him. HOA can put the lien on his house. I went thru this years and years ago. Better pay that bill if he wants to stay in that nice quiet area.
How he can take legal action against the HOA is written in the documents. The legal fees to defend against him are a common expense and then he pays his own legal fees. He may be required to file it as a derivate action on behalf of all owners. These lawsuits fail a lot due to lack of support by other homeowners. He's better off patching the wall and try to work with other homeowners to deal with signage or something to warn drivers. You must be active in the meetings when you live in an HOA or nut jobs take over.

Why would anyone in their right mind buy a house attached to an HOA? Hey let's buy a house, spend $1,000,000 in a place where we have to ask permission to paint or do anything to my property.
At least Nevada has a government agency devoted to this. I'm sure it's as ineffective as it gets but most states label everything HOA a civil matter.
I will never live where there is an HOA. If I buy a house\property I will not have someone telling me what I can or cannot do with it.
I used to be on an HOA board of directors. We would usually waive most fines upon compliance minus the hard costs. We didn't use fines as a means to raise additional income. We use it specifically to encourage compliance.
They should only exist to upkeep the neighborhood. They should have no power to fine people or have any authority whatsoever. It should be illegal.
People who think an HOA protects property values should see the many comments saying "I will never buy a house with an HOA." I'm such a person myself.

This is the reason I chose not to live in a HOA COMMUNITY!!! I love my COMMUNITY. I get to party whenever I want to on th3 weekend and be up late without no neighbors complaining. My neighbors also parties too and I dont complain.

When I bought a house within an HOA, I purposefully failed to sign the agreement while the pile of papers was being overseen by the realtor. I just pretended to sign it and put it on the stack. Later when they tried to give me trouble about renewing the siding on my home, I said I'm not bound by your CC&Rs. All they could do was change the locks on the pool gate and not issue me a key. My kids went swimming any time they wanted to because friends would always let them in. SUCK IT - HOA.
HOAs are supposed to be responsible for all communal property. Since the outside of that wall runs the length of the HOA, it should be the responsibility of the HOA…
HOA's were invented to allow developers to make a clean exit from their project and for local government to avoid oversight responsibility for infrastructure they permitted and tax.
Mail them a letter saying you are fining them $1,100.00 for not cleaning the graffiti off the power boxes and mail them a letter every month adding $50.
Depending where you want to live, it’s almost impossible to buy a house without an HOA! The last one i lived in the HOA had amassed quite a bit of money. They actually did spend some on a playground. But as with this video no matter what the issue, they’ll never help with any expenses! I’ve lived in plenty of neighborhoods without them and never had an issue. Now i’m convinced it’s just a ruse for someone to make money off of!
$50 a week for the violations that HE isn't causing to the property. This would be like being fined for damages caused by a hailstorm. The damage was caused by someone else, and he can't make it so the damage doesn't occur again. But HOA's already do that, with the "lawns can't be taller than x amount" rules.
Even if this wasn't an HOA story, simply having a neighbor damage the same part of your property multiple times would be news worthy. Sounds like a great time for a lawsuit against whoever is backing into the wall from the far side. Set up cameras, find out who's doing it, and sue them for repeated negligent property damage that you need to repair. Might even be something you can get a lien on their property for, though the lien would have to be adjusted up in value each time the damage was repeated.
HOAs are required by cities so that they don't have to pay for the public services and infrastructure associated with new developments. If we funded our cities properly with taxes we wouldn't have to pay for HOA fees.
When HOA are out of control - this damage is done by the HOA and the counter claim the HOA for legal fees, legal harasment and they should not allow any trucks in the cul-de-sac. Usually the HOA is ordering the repair and ALL owners pay not a single owner.
There are HOAs that won’t allow camera for privacy reasons, but will fine home owners for damage to garage door, by miscreants.
He’s gonna pay the fine. The fine is now attached to the property and it will be paid at closing or they will never be able to sell the house. I’ve lived in two HOA communities and though far from perfect, I’ve been mostly pleased. I’ve also lived in several non-HOA communities and had trashy neighborhoods that wouldn’t clean up or maintain their property and the city enforcement was not effective at all.

We used to live in a HOA that made you open your garage door from noon to 4pm every Sunday so they can drive by and see no one was living in there or had set up an office. My guest's cars would get towed when they came over, it was a complete nightmare! Needless to say we sold our house and bought in a non HOA home. Never, ever, under any circumstances live where there is a HOA. They can also raise your rates, no notice. Look what they are doing in Florida.
If it is a common wall, the HOA is responsible for BOTH sides. Those assessing the fines should be require to pay four times the amount assessed for their fraud.
