Do you not realize that people could go on RUclips and watch music videos endlessly because there are billions of different music videos on youtube? So true I go around them to get to Utah. I won't go into areas of the white mountains that are tribal land. I have been told some crazy stories about tribal police shaking people down. Plus, you better not win any big money at their casinos.
They used to be hospitable for the most part, but they have changed more and more, and now most tribes (especially Navajo) will screw you if they get the slightest of chances.. and with their immunity in the courts, if you are on their land, they have total control, and they don't mind using it one bit. If you are on tribal land, forget what you know about us laws. Its literally a sovereign country with its own rules, and if you are any other race other than native, you best believe that you will be legally discriminated against in every way they can. It's the realist form of Tribe mentality (pun not intended, but also literally the realist life definition of the term). It's better to avoid going onto native land altogether, forget the natural tourism and all. Thats their main form of income, but step one step out of line while being a tourist by doing something that would be far from illegal anywhere else in the us, and you better hope that they had a good day and show you a little bit of mercy. This would have been a laugh and MAYBE a small fine at any other little airstrip in the country, but because this was tribal land, they are going to treat this man like this was the crime of the century. (made worse by the fact that they are bored with the stupid petty drunkard crime that they deal with on res every day and that this is something different and exciting to persecute)

My grandfather ran a boat company 50 years ago. The first big deal he struck was with one of the tribes. They took the boats and never paid. He would have needed federal permission to even start a lawsuit, and it drove him out of business. I learned a few lessons from that.

Went to Monument Valley with a friend September 2023. Took the wrong exit out of the traffic circle coming out of the park. Turned on Google Maps which put me on a dirt (sand) road. Got stuck nearly immediately maybe 100 feet from pavement. Buried my little VW wagon. A Navajo family in a monster truck came from the opposite direction a few minutes later. The two guys looked things over, got a strap out of the truck, then one guy attached it under my car getting himself full of sand. They pulled the mighty Passat back onto the pavement. Wouldn’t take my money. I had to stuff a 20 in the dusty guy’s pocket. This was all while their kids waited in the truck. Thanks again!

Your first mistake was trusting the tribe. I have lived in Arizona for 19 years and this destination WAS on my bucket list. No longer. I would not give these people 1 penny of my money. Thank you for sharing this story.
I went to the falls 35ish years ago. 1990? We flew in by helicopter. They told us we could rent horses and go to the falls. No guide or anything. We got there and spent the day with about 5-6 people who had hiked in. They came and took the horses while we were swimming with no explanation or anything. Just left. We didn't know if they were being stolen or what was going on. So we had to walk back. I don't remember how long it took us but we missed the helicopter back. They told us we had to pay all these fees and of course additional tickets for the helicopter the next day. They charged us for having to come get the horses. They said they were working horses and we were supposed to just use them to go see the falls and come right back. Of course they still charged us for a guide we never got, the daily fee for the horses because there was no other hourly or immediate return fee. They charged us a PENALTY for swimming and another for taking away the use of the tribes horses for working that day. The daily stuff we paid for BEFORE we left with the horses. So they KNEW we had planned on being there all day and that we planned on swimming. They had recently finished the hotel there. It had no tv, no outlets to plug anything in. It had lights of course and running water. We had to pay for meals we didn't get to eat because the kitchen was closed. We weren't allowed to leave the hotel at night. The next day they charged us nearly triple the posted room rates and they did it per person even though we stayed two people to a room. The helicopter charged us a crazy rate because they said they didn't have a scheduled flight that morning. But when they landed they were full and the schedule showed flights everyday at that time. They charged us a luggage fee for having the miles bring our stuff down even though we flew in and didn't have any bags because we didn't plan on staying overnight. We heard that the night before our flight that supposedly flew in just for us that we missed had been over booked and flew another family out that had been stuck there from the day before just like us. The entire thing was a racket for sure. We were basically prisoners that had to pay our way out.

Good story and thank for sharing. I had a similar situation years ago on an Apache tribe. I was dirt biking in a really remote area on a mapped trail, not realizing I was on the border of tribal and Arizona public land. An Indian cop happened to be in a beat up pick up truck in really rugged land and stopped me and my friend. He claimed we were trespassing and took our ID's. It was so remote he had no radio reception and couldn't even contact his dispatch. He told us the "Chief" wanted our bikes. There was no way he was taking our bikes and he knew it - it wasn't even possible to coordinate such an effort in such rugged country. We could have easily ditched him but instead we "diplomatically" asked he not take our bikes. He issued us tickets and said we had to go to Indian court or we'd have "big" problems. Like your case, this seriously stressed me out for months. I too contacted Indian tribal legal counsel and it was evident it would cost a lot of $$ to go through the process. I called the District Attorney office in the neighboring county and was told that Indian law doesn't apply to non-Indians and basically don't worry about it. I understood that the worst case scenario would be a ban for life from their lands. I ended up paying a $250 fine, no court as I I wanted my name cleared. My thinking is you'll always lose your case in Indian court - ALWAYS. They can't come after you on US land. And if the Fed government did get involved (which to me would seems ridiculous because trespassing seems so minor compared to the gruesome crimes of domestic abuse, murder, drugs, alcoholism, gang bangers, etc that occur ALL the time on the Rez) , and you'd probably have a MUCH better chance of winning your case in Fed court. Consider yourself lucky that you have your plane back, weren't assaulted or killed, and I'd stop spending money on Indian court and attorney fees and like the others say -- "Forget about it" You'll never win and let this be a lesson to stay off all tribal land in all forms- a lesson I too learned the hard way.
I had BIA cops come to my place, not on the Rez, once looking for one of their escapees. Woke me up to ask to search. I told them that everything of mine is locked up tight and present for me to see, and that they could skip their happy red asses off my property.
Rez cops are state certified sworn officers they can arrest you have to take you to the nearest county jail not on the rez. They have to refer you to county DA to be charged they won't do that too much trouble for them. They do have agreements worked out with county sheriffs they would hold you until they get there. Situations where non rez citizens cause trouble like DUI, drunks fighting at casino's most typical sometimes domestic issues.
They use them to fly in dope and make money off the cartels. They also know that if they try that chit with the cartels they disappear, like their women.
No, list them as "PROHIBITED". Maybe it's time to take away the reservations and let them live as private citizens. That would also close the casinos in most areas where they use their reservation privilege to promote gambling which is illegal of the rez.

Hate to tell you this but as far as I know there has NEVER been any non-native person winning a court case against the tribe. I worked for the White Mountain Apache Tribe and while I was there I saw them take a brand new Dodge 4x4 from a guy out of Phoenix. He still had to pay off the truck notes but the Tribal Police Chief got a new truck.
Sounds like if you hire the right attorney can get your things back likely the person your talking about never did anything about it what they count on you just run away with your tail tucked. If you hire the correct attorney can do something about it.
Simple fact its a federal issue already because he is non-tribal member. It's why they needed a qualified Judge to oversee the case. He skips the feds will be coming for him. All the agreements for law enforcement are between the tribe and the federal government not the tribe and the state even. Notice the Mohave the Mohave County Sheriff dropped out the conversation pretty quickly. They hold no jurisdiction.
Their tribal attorney is probably in on it. Literally he probably takes your money and splits it with other tribe members... that's probably the hustle. When flying with him, I would be tempted to land at another airport that is off the beaten path and just leave him there to return the favor.

The "crime" was committed on tribal land so you are subject to their laws backed by the feds. Your rights off the reservation are going to be abused. Once I stopped at a isolated store on tribal land (Ariz) there were two cars parked outside. When I went inside there was one person behind the counter. He awkwardly began trying to keep a conversation going with me. I got bad vibes from it and I headed out the door. When I got to my truck the back window of my camper shell was wide open and there was nobody around. He was 100% trying to keep me inside while someone outside robbed my truck of my gear. The whole thing took perhaps 10 minutes so someone was working on forcing that window as soon as I went inside. It struck me that he must have had a way to signal that I was heading back out the door. That was the last time I stopped on tribal land for anything.
How is it possible that everything I hear about tribes is terrible? Because they hate americans. And demented self-loathing idiots will say something along the lines of "their land was stolen" give me a break. If they were so deserving of this land, they would have been able to fight off western colonizers. But they didn't, because they loved the things westerners sold them. Things like muskets, so they could make war with other tribes more effectively. And somehow I am personally to blame for that? I used to do repos on the southern Ute reservation in Colorado. That shit is sketchy AF. I told my boss no more after I got locked in someones yard that was supposedly doing a voluntary repo. 1 dude came out and pulled locked the gates and 3 more came out with baseball bats. I climbed the fence and bolted. Luckily I parked down the street and they didn't chase me. Fkers set me up. I never would have gone if they didn't say it was voluntary.

My wife grew up in Flag she said the council members don't even live on the rez live in big houses in Flagstaff their kids send them to private schools on the rez dole. Reservations are their own nation, they aren't subject to federal laws. Remember, a treaty is the agreement to live next to each other peacefully. Reservations aren't colonized by Europeans, they are their own thing. Obviously, he didn't have permission, that's only his fault.

I just wanted to say how sorry I am that you got caught up in this nightmare. I am a licensed glider pilot, though not active. Also, I am a fine art photographer by profession. I have traveled a million miles in the west and live in New Mexico, along with 26 Tribes. I have learned to avoid tribal land at any cost. I dont even feel safe driving through tribal lands any more. I too have had permission by tribal leaders to photograph on their lands, only to have it entirely reneged in the permit process with enforcement. Absolute chaos and disfunction, and they are not above seizing expensive equipment for their gain. And despite profession insurance, my loss on their land would be exempt under "sovereign nation." Then, we have Indian Market in Santa Fe so that tribal artists can sell their works, but we get locked out of our artistic pursuits on their lands. It is sad.
I coming back from photographing a wedding but stupidly decided to take a short cut through reservation lands. Got pulled over for going 3 miles over the speed limit. Arsehole sees all of my equipment in the hatchback and my my camera in my passenger seat - asks if I had stopped anywhere photograph anything yet, said I was just passing through to another location. THEN he asked me if I had proof of permission to photograph on reservation land - I said I didn't have one or need one as I wasn't going to photograph anything on res land and I just had my camera in the passenger side out of habit more than any intention of taking any images. This was back in the film days of the very late 90s so I couldn't just show him what I had photographed. This jerk insisted that I was photographing on res and I had to show him proof or else he was going to "confiscate" all of my gear (about 20k worth of lenses/bodies) and write my up on all of these tickets... About after 45 minutes, he offered to let me go with a warning if I paid the speeding ticket right then and there. I knew it was a losing battle because another tribal cop showed up in his beat up crown vic. THey wanted $250, I only had $184 on me, cop took it and said he would give me a discount "in the name of justice." Karma came back though - you see , that same tribal cop had his car towed to my long time pals shop to have a transmission replaced in 2021. There was a extra $280 charge on the repair for "miscellaneous machining work" that my buddy got back to me.

Bro for starters I grew up there and worked with Mohave County Sheriff's Office and I'm telling you that you will not get a fair shake and it will never go away. I have a similar story after looking for the TBM that went down in Tribal land south of there. I was detained and treated like crap. I’ve had Native American friends and they all say to a person is do NOT go onto a reservation without a local, period. The only exemption is going to a resort or casino. They said only go from the main road to the casino, no exploring at all. To dangerous.
I’m from Costa Rica, back in 2002 we got lost in tribe land AZ (using airport map) I was going way under speed limit trying to find another road, we got stop by tribe cops , it was creepy and we were scared, fortunately my wife had a black diplomat passport from Guatemala and as soon as they saw it they began to argue between them…. After 45 agonizing minutes, they guided us back to main road… !!

The res is part of the us, all us laws apply but native law enforcement has priority on native land. Sounds like you didn't contact the local police to enter in a non traditional way which would be common courtesy.
@@druemancospr there are tons of private airstrips all over the US that require prior approval before landing. Most of them are small grass runways in people's literal backyards and carry the same trespassing laws that you'd probably like enforced if someone in a helicopter landed in your backyard. Some are owned by a club or LLC or trust or other governing body and shared with members or trustees. 3AZ5 (Hualapai) is listed as private use, and permission is required prior to landing, just like all other private airstrips. Says just that on the sectional and any airnav database. Logic would say that this is owned by the tribe and permission would therefore be given by whatever governing body was delegated to the task. The thing about private airstrips is that they're not regulated by the FAA or any state or federal government/agency and the owner(s) can add whatever stipulation they want for permission to use their airstrip. Requiring a call to the governing body of the airstrip for permission? Absolutely legal. $30,000 landing fee? That's perfectly legal too. They get to keep your plane if you land there? Also perfectly legal. If you contact them and they notify you of the stipulations, that contract is binding when you touch your wheels on their property. The problem is not about private airstrips, the problem is with the permission process and jurisdiction thereof which the tribe is exploiting. It's not just a tribal thing either, every day your local, state, and federal governments are stealing from citizens under the guise of civil forfeiture, there is institutionalized and legalized theft happening in your hometown. It doesn't make the news in most cases unless it was a big drug bust or some noteworthy takedown, sometimes it's as simple as a traffic stop where the driver was carrying a few thousand in cash to buy a boat or car or whatever from another private party. Even if the driver can provide legitimate proof as to why there was $4,000 cash in his pocket, in most cases the courts rule in favor of the agency that seized the vehicle and allow them to keep it anyway. Where do you think all of that property comes from in police auctions? Most of it isn't crime related, unless you want to consider the police as the criminals. It's quite a bit worse than what this tribe is doing, because they're going after small payouts, whereas our governments are going after the big payouts to fund their departments, like entire vehicles and homes and whatever they contain. Indian courts aren't real courts. You have no recourse if they don't follow their own rules. All the people you are dealing with have probably known each other since they were kids, and thats assuming they aren't related. They have their own internal politics, but regardless, your an outsider. They may like the money of people like you, but they don't like you and they will side with their own every time. I was upper management at a company that regularly had issues with the fact that our utilities crossed tribal land. They wouldn’t allow trees to be trimmed back from the power lines which caused almost monthly outages. These outages cost us in the neighborhood of 10k a day. We needed permission to enter and fix the lines. Every time it was some veneration of "well, the spot you want to go to is very sacred and outsiders can't go there. But, my brother, cousin, uncle, etc. is a very good medicine man. He can make the proper prayers and escort you there. But he isn’t available for at least two days and his prayer fee is $500 an hour". I would talk to a good US lawyer and find out if they actually have any jurisdiction off of the reservation. If they do, you need to figure out who to bribe.
It has felt like the smallest town where everyone knows everyone, and somehow the mayor of that town has presidential powers... The internal politics were a big part of the issue here, I caught them at the peak of their tribal elections and everyone was being replaced in that process. Truth is I've dealt with some really helpful folks, and I'm grateful for the ones who have helped me out, but it only takes one or two bad examples for them to really mess up someone's life. That's crazy, especially considering that it's such a common issue.. But then.. It seems a lot less crazy after trying to work through this with them the past two months... I appreciate the advice.
My wife and I have visited almost all the national parks in the United States and nowhere that there is a park that belongs to the tribes we have never entered because they are abusive and the treatment they give you is abusive.
I've never understood how people in power (elected, or otherwise) can criminalize non criminal behavior. Landing a plane and leaving it for a few days. It's not vandalism, theft, assault or kidnapping. No one was harmed, nor was property. And the plane was landed on a runway (where planes land on and take off from), not a road. No crime was committed. It boils down to "This guy has a plane, he must have money. We have power, so let's legally jerk him around, and maybe get some of that money." Something I've learned from owning a business: "Can you send me an email confirmation?" Also recording phone conversations in some rare cases. Twenty years ago I had a tape recorder and a mic with a suction cup. Now all you need is an app. Just have to be careful in certain states about consent to record, or straight up tell people you're recording the call, or it may not be admissible later.
Canada and the USA do it all the Time to planes and Boats. Canada still have some Russian Cargo plans under Locked down. Same thing given the clearance to land but not to take off.

As an immigrant to America nothing disappointed me more than the reality of native Americans, in 14 years of living in America I can count the honest hardworking natives on a hand missing 4 fingers and a thumb. I never go to native land as the one time I did visit a native lake, native children threw rocks at us from a tree line for being there. Growing up in Europe you have this silly notion that Native Americans are peaceful, kind and at one with nature, come to find out that any lakes or natural land looked after by natives is disrespected and filthy, whereas the lake owned by the local council nonnative only 15 minutes away is the most beautiful; pristine lake imaginable.
Another thing to watch out for if you go onto tribal land is carrying a concealed weapon, even if you have a CCW you will most likely be arrested and your gun confiscated! People don’t realize that these are sovereign nations and you have left the protection of US laws.
The tribes are working with the cartels in Oklahoma, accepting their money in exchange for letting the cartels operate within the res. I've spoken with the guys that have seen it firsthand and he said they even have heavily fortified compounds you woukd need a battalion to breach. Right here on US soil.
Man, what a tough convoluted story. It’s such a shame, because nobody really wins in this scenario. As a private pilot, I hear this cautionary tail, and it makes me think I should hesitate before engaging any tribal lands. But at the same time, part of the experience is, seeing all the diverse areas and landing at various airports. Such a shame for sure. Thank you for telling your story.
The FBI is authorized to handle major crimes on reservations from the Major Crimes Act. Trespassing does not appear to be one of them. Landing on that airstrip would be similar to landing on a remote strip in Oaxaca, Mexico and assuming it's all good, until it isn't.

Had a friend in high school and he got the old "farm truck" that was about as old as he was from early 80's. He went to the next town over for a movie and the dang thing was stolen, we also had another friend that drove his dads truck thing was like a 95 (back in 2003) and the sheriff wrote a report and shrugged the old farm truck while he did seam to care a bit more with the newer one...... 100%. I had a buddy who worked for the Feds on a reservation in N Dakota. His job was to change the batteries in their smoke detectors to reduce the fire deaths from them passing out on a bed with a lit cigarette.
You think reservations are where tribes wanted to live and weren't forced there by the federal government in treaty agreements? How did you ever make it to middle school without learning anything in elementary school? This is 3rd grade level US history we are talking about.
If it was some junky airplane with peeling paint and simple instruments, you would have no problems. But, someone on the reservation must have liked your plane and decided to try to take it away from you. These tribes are often corrupted to the bone.

We went through the Blackfeet Reservation in Montana and the hotel in town wouldn't take cash. While I was inside talking to the woman at the counter my wife read reviews about the hotel staff using customer credit card numbers to buy plane tickets to Hawaii. The whole place gave me the Willie's. Never stop just keep going. Gas up before you drive through.

You should call your congressman and the Department of Indian Affairs. They take federal money and have to fall in line with federal regulations regardless of sovereign immunity. Start calling and getting the feds involved. Last thing they want it a lawsuit because the FFA listed this airport as a place that wasn’t restricted.
Obvious way to late for this, but when I saw those two trucks blocking your plane in, I was already mentally prepared for how to move them. Those truck are sitting high. Crawl under the transmission, on the driver side is a lever connected to the left side of the transmission to a cable. You can literally push the lever and get it out of the parking gear, putting it in any other gear, and you can roll the truck out of the way. Do a preflight to make sure the plane wasn’t tampered with, and full power out of there.
The dodge might have been electronic but the Ford was old enough to still have a mechanical linkage. You have to remove the linkage from the lever that physically shifts the transmission but they generally are like a heim joint that can be popped off. There are releases in both of them but that involves being in the cab but that would be break and enter
I was thinking about this, too. Three good-sized adults could easily lift and rotate one of those trucks out of the way with simple brute force. Or hell, just beg a ride to the nearest auto shop and buy a couple wheel dollies and move the whole thing yourself. When they aren't playing by their own rules, then you need not worry about them either.
Thinking more on it, I'd bet if he had moved the truck and disappeared the plane the Tribal folks would probably have respected his ingenuity and just let it drop. Not much different from the way tribes used to count coup amongst each other.
All property seizure in the USA without a warrant or actual crime in progress is unconstitutional. This must be strictly enforced by the courts or we can take the US Constitution and use it for toilet paper. There are never word salad exceptions to our rights.

Tho the reservation police hand off there criminals to the US government to do a federal case... Keep in mind it has been 20 some years from when I worked on tribal land in Minnesota for a casino... We a cleaning crew for the hotel was told to come in on the van as part of the crew, go get are cleaning stuff, have lunch, finish cleaning then return are supply's to the closet and get back to the van to get off the land... *shrugs* Going on rez land you leave the USA, so ya there land and rules. Another video of a guy driving through a reservation in NM. Got pulled over and was asked if he had a weapon in the car. Unwisely, he told him yes. The officer stole his gun because he didn’t have a receipt to show he owned it. He had a valid carry permit for NM. I avoid reservations.
They set me up when I was doing repos. told me it was voluntary and to come get it. When I got there, they locked me in the yard and came it me with baseball bats. I climbed the fence and escaped. luckily i parked down the road because I had a 40' trailer. Last time i ever did a repo on the reservation.
yeah I live in Eastern WA and as far as I know it's best to just stay off the res and they want it that way. I've noticed the natives and the mexicans here are very hateful towards white people. Despite the guaranteed work and housing.
When I was driving across tribal lands for work 35 years ago, I was constantly warned by non-Indians that the tribes had a napoleonic (not English common) legal system. They could and did seize property and imprison people without due process, building the case after the fact.
The big question here is why do they even care about your plane being there? It's literally a piece of shitty pavement, that's barely maintained, in the middle of the dessert.
Most tribal courts can only exercise jurisdiction over their own or other tribal members. Tribal law usually doesnt apply to non-tribal members. Unless its a federal matter then you fall under the jurisdiction of the Federal government because tribal lands are still controlled by the Federal goverment. If its a violation of Tribal law, you need to request for the Sheriff of the county you're in because as a non-tribal member you are subject to State law not tribal law.
This was decided back in 1978 by SCOTUS in Oliphant v. Suquamish. Th court held that it was not constitutional for a jury that by law consisted only of tribe members decide the fate of non-tribe members.

Living in Arizona my entire life I’ve heard plenty of stories about people getting pulled over on the freeways that cut through tribal land and being arrested and their cars impounded for violating tribal laws.I avoid those parts of the state as much as possible.
Question, how are they going to seize the plane that is not on their land? Sounds like they are trying to scare you. Let it escalate to a federal court. You have a better chance.
It actually was on our property and that property is private property. You do have to have a permit to go in certain areas on our land. It’s just a law that we have here.

My dad owned a Cherokee in the 70's. One of the other pilots flew down to Mexico and, in a rush to get back north of the boarder before dark he ran out of fuel. He performed a forced landing on the beach without damaging the plane then hired guys from a near by village to hack a path through the jungle to drag the plane into town. The main street was long enough to take off but a tall palm tree was in the way. The village refused to cut down the tree (reasonable) and that left pulling the wings off the plane and transporting it to the airport. The problem came when they asked the insurance to pay for that. It would have cost more than the plane is worth, so they wrote it off and walked away. The wingless plane did not rot away in Mexico however. A full blown idiot from Texas purchased the plane re-attached the wings and tried to fly it home to Mexico. He learned why you should really have a qualified mechanic perform such a job, but he was never able to use this knowledge before the wingless Cherokee slammed into the Mexican desert south of Texas. The guy just slipped the wings back on, didn't even bother putting the pins on to hold the wings to the airframe! Guy would have qualified for a Darwin if he had not had his wife with him. I just really hope she had a chance to say "I told you"

Thank you for making this video, it never really occurred to me that going on a reservation posses such a legal liability if something were to happen. I’m an avid hiker and have looked at some reservation hikes in the past, but now I’m definitely crossing them off the list. Good luck on your court case.

They want our pity for their "stolen lands" but everything I've experienced tells me my colonial ancestors were right... Also, in my state, their "ancestral lands" that only they can access have absolutely zero evidence that they were ever their lands. The state/federal government just threw the best hunting and fishing areas at them and nobody else is allowed to access them.

So true I go around them to get to Utah. I won't go into areas of the white mountains that are tribal land. I have been told some crazy stories about tribal police shaking people down. Plus, you better not win any big money at their casinos.
They used to be hospitable for the most part, but they have changed more and more, and now most tribes (especially Navajo) will screw you if they get the slightest of chances.. and with their immunity in the courts, if you are on their land, they have total control, and they don't mind using it one bit. If you are on tribal land, forget what you know about us laws. Its literally a sovereign country with its own rules, and if you are any other race other than native, you best believe that you will be legally discriminated against in every way they can. It's the realist form of Tribe mentality (pun not intended, but also literally the realist life definition of the term). It's better to avoid going onto native land altogether, forget the natural tourism and all. Thats their main form of income, but step one step out of line while being a tourist by doing something that would be far from illegal anywhere else in the us, and you better hope that they had a good day and show you a little bit of mercy. This would have been a laugh and MAYBE a small fine at any other little airstrip in the country, but because this was tribal land, they are going to treat this man like this was the crime of the century. (made worse by the fact that they are bored with the stupid petty drunkard crime that they deal with on res every day and that this is something different and exciting to persecute)

My grandfather ran a boat company 50 years ago. The first big deal he struck was with one of the tribes. They took the boats and never paid. He would have needed federal permission to even start a lawsuit, and it drove him out of business. I learned a few lessons from that.

If the tribal court doesn’t have jurisdiction over non-tribal members, and you got your plane back, I probably wouldn’t even go bother. I’d let them file the case in the United States district court

Went to Monument Valley with a friend September 2023. Took the wrong exit out of the traffic circle coming out of the park. Turned on Google Maps which put me on a dirt (sand) road. Got stuck nearly immediately maybe 100 feet from pavement. Buried my little VW wagon. A Navajo family in a monster truck came from the opposite direction a few minutes later. The two guys looked things over, got a strap out of the truck, then one guy attached it under my car getting himself full of sand. They pulled the mighty Passat back onto the pavement. Wouldn’t take my money. I had to stuff a 20 in the dusty guy’s pocket. This was all while their kids waited in the truck. Thanks again!

I went to the falls 35ish years ago. 1990?
We flew in by helicopter. They told us we could rent horses and go to the falls. No guide or anything. We got there and spent the day with about 5-6 people who had hiked in.
They came and took the horses while we were swimming with no explanation or anything. Just left. We didn't know if they were being stolen or what was going on.
So we had to walk back. I don't remember how long it took us but we missed the helicopter back. They told us we had to pay all these fees and of course additional tickets for the helicopter the next day. They charged us for having to come get the horses. They said they were working horses and we were supposed to just use them to go see the falls and come right back. Of course they still charged us for a guide we never got, the daily fee for the horses because there was no other hourly or immediate return fee. They charged us a PENALTY for swimming and another for taking away the use of the tribes horses for working that day. The daily stuff we paid for BEFORE we left with the horses. So they KNEW we had planned on being there all day and that we planned on swimming.
They had recently finished the hotel there. It had no tv, no outlets to plug anything in. It had lights of course and running water.
We had to pay for meals we didn't get to eat because the kitchen was closed. We weren't allowed to leave the hotel at night.
The next day they charged us nearly triple the posted room rates and they did it per person even though we stayed two people to a room.
The helicopter charged us a crazy rate because they said they didn't have a scheduled flight that morning. But when they landed they were full and the schedule showed flights everyday at that time.
They charged us a luggage fee for having the miles bring our stuff down even though we flew in and didn't have any bags because we didn't plan on staying overnight.
We heard that the night before our flight that supposedly flew in just for us that we missed had been over booked and flew another family out that had been stuck there from the day before just like us.
The entire thing was a racket for sure. We were basically prisoners that had to pay our way out.
Sounds like a 3rd world country. Guess it sort of is.

Good story and thank for sharing. I had a similar situation years ago on an Apache tribe. I was dirt biking in a really remote area on a mapped trail, not realizing I was on the border of tribal and Arizona public land. An Indian cop happened to be in a beat up pick up truck in really rugged land and stopped me and my friend. He claimed we were trespassing and took our ID's. It was so remote he had no radio reception and couldn't even contact his dispatch. He told us the "Chief" wanted our bikes. There was no way he was taking our bikes and he knew it - it wasn't even possible to coordinate such an effort in such rugged country. We could have easily ditched him but instead we "diplomatically" asked he not take our bikes. He issued us tickets and said we had to go to Indian court or we'd have "big" problems. Like your case, this seriously stressed me out for months. I too contacted Indian tribal legal counsel and it was evident it would cost a lot of $$ to go through the process. I called the District Attorney office in the neighboring county and was told that Indian law doesn't apply to non-Indians and basically don't worry about it. I understood that the worst case scenario would be a ban for life from their lands. I ended up paying a $250 fine, no court as I I wanted my name cleared. My thinking is you'll always lose your case in Indian court - ALWAYS. They can't come after you on US land. I had BIA cops come to my place, not on the Rez, once looking for one of their escapees. Woke me up to ask to search. I told them that everything of mine is locked up tight and present for me to see, and that they could skip their happy red asses off my property.
Rez cops are state certified sworn officers they can arrest you have to take you to the nearest county jail not on the rez. They have to refer you to county DA to be charged they won't do that too much trouble for them. They do have agreements worked out with county sheriffs they would hold you until they get there. Situations where non rez citizens cause trouble like DUI, drunks fighting at casino's most typical sometimes domestic issues.

Hate to tell you this but as far as I know there has NEVER been any non-native person winning a court case against the tribe. I worked for the White Mountain Apache Tribe and while I was there I saw them take a brand new Dodge 4x4 from a guy out of Phoenix. He still had to pay off the truck notes but the Tribal Police Chief got a new truck.
I would just take the hit to my credit and let the tribal police work it out with the repo company.

Simple fact its a federal issue already because he is non-tribal member. It's why they needed a qualified Judge to oversee the case. He skips the feds will be coming for him. All the agreements for law enforcement are between the tribe and the federal government not the tribe and the state even. Notice the Mohave the Mohave County Sheriff dropped out the conversation pretty quickly. They hold no jurisdiction.
Their tribal attorney is probably in on it. Literally he probably takes your money and splits it with other tribe members... that's probably the hustle. When flying with him, I would be tempted to land at another airport that is off the beaten path and just leave him there to return the favor.

Once I stopped at a isolated store on tribal land (Ariz) there were two cars parked outside. When I went inside there was one person behind the counter. He awkwardly began trying to keep a conversation going with me. I got bad vibes from it and I headed out the door. When I got to my truck the back window of my camper shell was wide open and there was nobody around. He was 100% trying to keep me inside while someone outside robbed my truck of my gear. The whole thing took perhaps 10 minutes so someone was working on forcing that window as soon as I went inside. It struck me that he must have had a way to signal that I was heading back out the door. That was the last time I stopped on tribal land for anything.

I used to do repos on the southern Ute reservation in Colorado. That shit is sketchy AF. I told my boss no more after I got locked in someones yard that was supposedly doing a voluntary repo. 1 dude came out and pulled locked the gates and 3 more came out with baseball bats. I climbed the fence and bolted. Luckily I parked down the street and they didn't chase me. Fkers set me up. I never would have gone if they didn't say it was voluntary.

I just wanted to say how sorry I am that you got caught up in this nightmare. I am a licensed glider pilot, though not active. Also, I am a fine art photographer by profession. I have traveled a million miles in the west and live in New Mexico, along with 26 Tribes. I have learned to avoid tribal land at any cost. I dont even feel safe driving through tribal lands any more. I too have had permission by tribal leaders to photograph on their lands, only to have it entirely reneged in the permit process with enforcement. Absolute chaos and disfunction, and they are not above seizing expensive equipment for their gain. And despite profession insurance, my loss on their land would be exempt under "sovereign nation." Then, we have Indian Market in Santa Fe so that tribal artists can sell their works, but we get locked out of our artistic pursuits on their lands.

I coming back from photographing a wedding but stupidly decided to take a short cut through reservation lands. Got pulled over for going 3 miles over the speed limit. Arsehole sees all of my equipment in the hatchback and my my camera in my passenger seat - asks if I had stopped anywhere photograph anything yet, said I was just passing through to another location. THEN he asked me if I had proof of permission to photograph on reservation land - I said I didn't have one or need one as I wasn't going to photograph anything on res land and I just had my camera in the passenger side out of habit more than any intention of taking any images. This was back in the film days of the very late 90s so I couldn't just show him what I had photographed. This jerk insisted that I was photographing on res and I had to show him proof or else he was going to "confiscate" all of my gear (about 20k worth of lenses/bodies) and write my up on all of these tickets...
About after 45 minutes, he offered to let me go with a warning if I paid the speeding ticket right then and there. I knew it was a losing battle because another tribal cop showed up in his beat up crown vic. THey wanted $250, I only had $184 on me, cop took it and said he would give me a discount "in the name of justice."
Karma came back though - you see , that same tribal cop had his car towed to my long time pals shop to have a transmission replaced in 2021. There was a extra $280 charge on the repair for "miscellaneous machining work" that my buddy got back to me.
My Daughter married a Cherokee breed and believe me whatever you here about these people are true.

I’m from Costa Rica, back in 2002 we got lost in tribe land AZ (using airport map) I was going way under speed limit trying to find another road, we got stop by tribe cops , it was creepy and we were scared, fortunately my wife had a black diplomat passport from Guatemala and as soon as they saw it they began to argue between them…. After 45 agonizing minutes, they guided us back to main road… !!

@@druemancospr there are tons of private airstrips all over the US that require prior approval before landing. Most of them are small grass runways in people's literal backyards and carry the same trespassing laws that you'd probably like enforced if someone in a helicopter landed in your backyard. Some are owned by a club or LLC or trust or other governing body and shared with members or trustees. 3AZ5 (Hualapai) is listed as private use, and permission is required prior to landing, just like all other private airstrips. Says just that on the sectional and any airnav database. Logic would say that this is owned by the tribe and permission would therefore be given by whatever governing body was delegated to the task. The thing about private airstrips is that they're not regulated by the FAA or any state or federal government/agency and the owner(s) can add whatever stipulation they want for permission to use their airstrip. Requiring a call to the governing body of the airstrip for permission? Absolutely legal. $30,000 landing fee? That's perfectly legal too. They get to keep your plane if you land there? Also perfectly legal. If you contact them and they notify you of the stipulations, that contract is binding when you touch your wheels on their property. The problem is not about private airstrips, the problem is with the permission process and jurisdiction thereof which the tribe is exploiting. It's not just a tribal thing either, every day your local, state, and federal governments are stealing from citizens under the guise of civil forfeiture, there is institutionalized and legalized theft happening in your hometown. It doesn't make the news in most cases unless it was a big drug bust or some noteworthy takedown, sometimes it's as simple as a traffic stop where the driver was carrying a few thousand in cash to buy a boat or car or whatever from another private party. Even if the driver can provide legitimate proof as to why there was $4,000 cash in his pocket, in most cases the courts rule in favor of the agency that seized the vehicle and allow them to keep it anyway. Where do you think all of that property comes from in police auctions? Most of it isn't crime related, unless you want to consider the police as the criminals. It's quite a bit worse than what this tribe is doing, because they're going after small payouts, whereas our governments are going after the big payouts to fund their departments, like entire vehicles and homes and whatever they contain. Indian courts aren't real courts. You have no recourse if they don't follow their own rules. All the people you are dealing with have probably known each other since they were kids, and thats assuming they aren't related. They have their own internal politics, but regardless, your an outsider. They may like the money of people like you, but they don't like you and they will side with their own every time. I was upper management at a company that regularly had issues with the fact that our utilities crossed tribal land. They wouldn’t allow trees to be trimmed back from the power lines which caused almost monthly outages. These outages cost us in the neighborhood of 10k a day. We needed permission to enter and fix the lines. Every time it was some veneration of "well, the spot you want to go to is very sacred and outsiders can't go there. But, my brother, cousin, uncle, etc. is a very good medicine man. He can make the proper prayers and escort you there. But he isn’t available for at least two days and his prayer fee is $500 an hour".
I would talk to a good US lawyer and find out if they actually have any jurisdiction off of the reservation. If they do, you need to figure out who to bribe.
It has felt like the smallest town where everyone knows everyone, and somehow the mayor of that town has presidential powers... The internal politics were a big part of the issue here, I caught them at the peak of their tribal elections and everyone was being replaced in that process.
Truth is I've dealt with some really helpful folks, and I'm grateful for the ones who have helped me out, but it only takes one or two bad examples for them to really mess up someone's life.
That's crazy, especially considering that it's such a common issue.. But then.. It seems a lot less crazy after trying to work through this with them the past two months...

I've never understood how people in power (elected, or otherwise) can criminalize non criminal behavior. Landing a plane and leaving it for a few days. It's not vandalism, theft, assault or kidnapping. No one was harmed, nor was property. And the plane was landed on a runway (where planes land on and take off from), not a road. No crime was committed.
It boils down to "This guy has a plane, he must have money. We have power, so let's legally jerk him around, and maybe get some of that money."
Something I've learned from owning a business: "Can you send me an email confirmation?" Also recording phone conversations in some rare cases. Twenty years ago I had a tape recorder and a mic with a suction cup. Now all you need is an app. Just have to be careful in certain states about consent to record, or straight up tell people you're recording the call, or it may not be admissible later.

As an immigrant to America nothing disappointed me more than the reality of native Americans, in 14 years of living in America I can count the honest hardworking natives on a hand missing 4 fingers and a thumb. I never go to native land as the one time I did visit a native lake, native children threw rocks at us from a tree line for being there. Growing up in Europe you have this silly notion that Native Americans are peaceful, kind and at one with nature, come to find out that any lakes or natural land looked after by natives is disrespected and filthy, whereas the lake owned by the local council nonnative only 15 minutes away is the most beautiful; pristine lake imaginable.

Another thing to watch out for if you go onto tribal land is carrying a concealed weapon, even if you have a CCW you will most likely be arrested and your gun confiscated! People don’t realize that these are sovereign nations and you have left the protection of US laws.
The tribes are working with the cartels in Oklahoma, accepting their money in exchange for letting the cartels operate within the res. I've spoken with the guys that have seen it firsthand and he said they even have heavily fortified compounds you woukd need a battalion to breach. Right here on US soil.

The FBI is authorized to handle major crimes on reservations from the Major Crimes Act. Trespassing does not appear to be one of them. Landing on that airstrip would be similar to landing on a remote strip in Oaxaca, Mexico and assuming it's all good, until it isn't.

If it was some junky airplane with peeling paint and simple instruments, you would have no problems. But, someone on the reservation must have liked your plane and decided to try to take it away from you. These tribes are often corrupted to the bone.

We went through the Blackfeet Reservation in Montana and the hotel in town wouldn't take cash. While I was inside talking to the woman at the counter my wife read reviews about the hotel staff using customer credit card numbers to buy plane tickets to Hawaii. The whole place gave me the Willie's. Never stop just keep going. Gas up before you drive through.

You should call your congressman and the Department of Indian Affairs. They take federal money and have to fall in line with federal regulations regardless of sovereign immunity. Start calling and getting the feds involved. Last thing they want it a lawsuit because the FFA listed this airport as a place that wasn’t restricted.
Obvious way to late for this, but when I saw those two trucks blocking your plane in, I was already mentally prepared for how to move them. Those truck are sitting high. Crawl under the transmission, on the driver side is a lever connected to the left side of the transmission to a cable. You can literally push the lever and get it out of the parking gear, putting it in any other gear, and you can roll the truck out of the way. Do a preflight to make sure the plane wasn’t tampered with, and full power out of there.

The dodge might have been electronic but the Ford was old enough to still have a mechanical linkage. You have to remove the linkage from the lever that physically shifts the transmission but they generally are like a heim joint that can be popped off. There are releases in both of them but that involves being in the cab but that would be break and enter
I was thinking about this, too. Three good-sized adults could easily lift and rotate one of those trucks out of the way with simple brute force. Or hell, just beg a ride to the nearest auto shop and buy a couple wheel dollies and move the whole thing yourself. When they aren't playing by their own rules, then you need not worry about them either.
Thinking more on it, I'd bet if he had moved the truck and disappeared the plane the Tribal folks would probably have respected his ingenuity and just let it drop. Not much different from the way tribes used to count coup amongst each other.

All property seizure in the USA without a warrant or actual crime in progress is unconstitutional. This must be strictly enforced by the courts or we can take the US Constitution and use it for toilet paper. There are never word salad exceptions to our rights.
The reservations are separate nations from the US, when it's to their advantage. They learned well the way of the Bureau
of Indian Affairs.
The Constitution does NOT apply on Indian land. They are their own government and white law enforcement has no jurisdiction.

Tho the reservation police hand off there criminals to the US government to do a federal case... Keep in mind it has been 20 some years from when I worked on tribal land in Minnesota for a casino... Another video of a guy driving through a reservation in NM. Got pulled over and was asked if he had a weapon in the car. Unwisely, he told him yes. The officer stole his gun because he didn’t have a receipt to show he owned it. He had a valid carry permit for NM. I avoid reservations.

They set me up when I was doing repos. told me it was voluntary and to come get it. When I got there, they locked me in the yard and came it me with baseball bats. I climbed the fence and escaped. luckily i parked down the road because I had a 40' trailer.

When I was driving across tribal lands for work 35 years ago, I was constantly warned by non-Indians that the tribes had a napoleonic (not English common) legal system. They could and did seize property and imprison people without due process, building the case after the fact.

The big question here is why do they even care about your plane being there? It's literally a piece of shitty pavement, that's barely maintained, in the middle of the dessert.
Most tribal courts can only exercise jurisdiction over their own or other tribal members. Tribal law usually doesnt apply to non-tribal members. Unless its a federal matter then you fall under the jurisdiction of the Federal government because tribal lands are still controlled by the Federal goverment. If its a violation of Tribal law, you need to request for the Sheriff of the county you're in because as a non-tribal member you are subject to State law not tribal law.
This was decided back in 1978 by SCOTUS in Oliphant v. Suquamish. Th court held that it was not constitutional for a jury that by law consisted only of tribe members decide the fate of non-tribe members.

Living in Arizona my entire life I’ve heard plenty of stories about people getting pulled over on the freeways that cut through tribal land and being arrested and their cars impounded for violating tribal laws.I avoid those parts of the state as much as possible.

My dad owned a Cherokee in the 70's. One of the other pilots flew down to Mexico and, in a rush to get back north of the boarder before dark he ran out of fuel.
He performed a forced landing on the beach without damaging the plane then hired guys from a near by village to hack a path through the jungle to drag the plane into town.
The main street was long enough to take off but a tall palm tree was in the way. The village refused to cut down the tree (reasonable) and that left pulling the wings off the plane and transporting it to the airport. The problem came when they asked the insurance to pay for that. It would have cost more than the plane is worth, so they wrote it off and walked away.
The wingless plane did not rot away in Mexico however. A full blown idiot from Texas purchased the plane re-attached the wings and tried to fly it home to Mexico. He learned why you should really have a qualified mechanic perform such a job, but he was never able to use this knowledge before the wingless Cherokee slammed into the Mexican desert south of Texas.
The guy just slipped the wings back on, didn't even bother putting the pins on to hold the wings to the airframe! Guy would have qualified for a Darwin if he had not had his wife with him.
