  • I’m Social Security expert and attorney, Robert Donati, and today I want to talk about what happens to your SSI benefits if you receive money from a personal injury suit like a car wreck or injury. Personal injury money can mess with your SSI if you aren’t careful. Let me tell you how to handle this.

I has in a car accident in 2016 and I'm on SSDI at the time. SSDI paid my bills throughout my treatment such as surgery, and being Paralyzed for two yrs I had therapy to regain my Shoulder, my arm and hand back again. After Medicaid and Medicare and my Attorney's fees I got what was left over and it equaled up to seventy thousand. Being that I was already on disability when the accident happen I knew that Medicare and Medicaid would pay, and I knew I would have to pay it back through my settlement. I found out that the RIS could not take out Taxes or I would not have to pay taxes on it. But now, because I was frugal and paid just my bills from that money, your saying I might have to pay it back even though medicare got paid? I don't know? I'm not on Social Security Income. I have a small check of 644.00 a month from ssdi, but here recently since I turn 65 they dropped the DI and now I get SSA which I don't even know what that means? PLEASE HELP ME I'M CONFUSED!

I received a settlement last year in July 2022. I had my hearing on Jan 2023 and received a fully favorable decision. Will that settlement effect my approval. I spent it down but it took 4 months and now in under 2000 mark and been so since last Nov 2022.

FL has a medicaid Trust, so you can keep your medicaid with a medicaid Trust Lawyer!

It costs around $2,000 to $6,000 to set up that trust though.

Can you answer this question for me? I hit a big jackpot in May of this year and I contacted social security immediately to tell them about the money that I had won. They told me to spend down on the money and to keep receipts of everything that I spend and I did all of that. Is there any idea how long it will be before I start back receiving my ssi money? I have spent all of the money. Thank you in advance.
