Good morning sir I would like to seek help .my father was a war vetera who was rated 100 percent during his life time and wasrecieving 1568 7 S dollar but when mom filled her DIC it was deñied because the rural health officer just placed Riled put pneumonia as his cause of death although he was bedridden got almost 4 yrs because of his swollen knees that he suffer from a gunsshot wound while I'm service and the reason why mylatefather had been receiving benefits from the time of hi d being wounded from 30 percent to 100 per cent .I've been watching your videos I know you are the right person to explain the circumstancial eviden so that my mom can also ava ko l hr DIC benefit.Thank you and more power ..God bless
Yes their is Malaria servers in 1952 up to now it was denied From VA due to Malaria servers zero dawn percent not compensable and the stroke thrombosis, bronchitis and 1983 hypertension cerebrovascular Accedent thrombosis, bronchitis , pneumonia and 1985 cerebrovascular Accedent thrombosis,, bronchitis cardiovascular arrist, pneumonia the ultimate couse of death why's VA not rate at times until now? Only malaria server zero percent not compensable. According to VA? How about service connected not rate? And Filipino veterans Equity compensation fund was denied from VA due only living veterans are entitled under American Recovery ACT I filed before expiration in February 16 2010

My recommendation to every veteran is to go to the doctor and inform them of your symptoms. This is a good way to provide yourself a free nexus and DBQ especially on secondaries, you are making the connection between one disability/service-connected to another disability. Does this work every time, of course not but you can save yourself some money and if you have to appeal this can make your case/claim stronger. Oh, you can still go out and obtain paid service but I like to tell my doctor what's going on and I have been successful with this approach.

I served in the Marine Corps back in the 90's. I filed my first claim in Nov 2022 and was denied except for Tinnitus at 10%, first step. Even though my back was documented in my SRB, the C&P examiner said there was no service connection. I went and got an MRI for my back, which confirmed Lumbar radiculopathy and filed a supplemental claim in Sep 2023 with my medical evidence and lay statement, I also did it without a Nexus Letter. I was awarded 10% for Lumbar Radiculopathy and another 10% for Spasms. I'm now at 30% rating. I have an additional claim pending for Cervical Radiculopathy that I filed along with my lay statement and MRI and doctor's diagnosis. I'm confident I will get that and get to 50% and start working on secondary claims. I was always embarrassed to file or say I was hurting, but after watching your videos, I realized I should not be embarrassed to file for a benefit I earned. Thank you. Update: I am now at 90% with insomnia, cervical radiculopathy, and left shoulder pain.
Thanks for your service! Please, please, please look into secondary conditions to your service-connected tinnitus. They include: mental health (0%-100 rating - conditions cannot be combined though) anxiety, depression, somatic symptom disorder, and/or insomnia), migraines, and meniere's syndrome. It help if they send out the right DBQs. So now I have to file an appeal with the VA . Do to their. Screw up . I even asked for the right one to be sent . But they closed it with the wrong DBQ . Rater should not of closed it and sent me to another C&P examination with the right DBQ. I will keep appealing till they quiet screwing me over.

Great information. I didn’t know I need to have my C File to give a provider to do a private DBQ. I was gonna go to my physical therapist once I had another bad back flare and have them fill out the DBQ since they use the goniometer. Of course trying to get a C&P exam when you have flare ups, is a 1 in a million chance. Thanks!
Whenever you go to your primary or private doctor/specialist or into a C&P exam, always describe your symptoms on its worst day, such as your flare-ups. You can even write down those symptoms, the frequency, severity, duration, and the impact to your social and occupational functioning. Keep winning!

Examiner Review of Claims Folder, there is a change date of September 5, 2023. M21-1, Part IV, Subpart i, 2.A.8. a and M21-1, Part IV, Subpart i, 2. A. 8. b address the review of Claim Folder and the type of claims when the claim folder must be reviewed. Under M21-1, Part IV, Subpart i, 2. A. 8. b. under Notes, reads “Privately completed DBQ’s are not subject to the requirement for claim folders review for DBQ’s or claim type listed above. This is an internal requirement that applies only to examinations and medical opinions requested by VBA.”

I was denied for 100% via VA, but was approved for social security disability. I submitted two nexus letters from my specialty providers and my approval letter from social security. I hope that takes care of it. I can’t work anymore.

I have limited rom during flare ups. So when I go for my exam and they measure my flexion and my knee is not in flare up mode, I guess I will get an unfavorable rating.
You should send a personal statement into the VA stating that when you have flareups that your range of motion is reduced by whatever percent. And what other symptoms it causes like swelling pain, etc. and that they are increased by whatever percent. If you state a percent then that gives the doctor a way of reading your flareups. If you look at the DBQ flareups are assessed by the veteran and the doctor is only supposed to re-say what was told them by the veteran. Even if the VA denies you when you go to a higher level review or supplemental you have the documentation from your personal statement.

Ya. never encountered a goniometer, but my claim has been a nightmare 3 of my DAV VSOs retired during my claim process. and the VA has not followed its own rules about stroke even if I make a full recovery I get 10% by their rules, but they gave me a letter that included my stroke along with my radion necrosis and a few other things that I can not remember a 0% and I think they will let that go to the end of the process if I don't make a complaint in writing in triplicate.
Why are you depending on a VSO. In the rating decision, it tells you the criteria for the next higher percentage. if you meet the qualifications for the percentage higher than the 0 percentage, there you go. When I went for my C%P exam the doctor had the goniometer in her had but never used it then she had me stand against the wall and had me raise my leg and she watched from across the room. I went for C%P exam for my feet same doctor the exam was 5 minutes take off your socks and shoes stand up turn left turn right that's it.

I didn't understand why the VA can't believe there own DR.of 21 years, then send me for a C an P with a 40 year old Physician Assistant? High blood pressure 169/91 Agent Orange. When I went for my C%P exam the doctor had the goniometer in her had but never used it then she had me stand against the wall and had me raise my leg and she watched from across the room. I went for C%P exam for my feet same doctor the exam was 5 minutes take off your socks and shoes stand up turn left turn right that's it.
Be sure to send in a statement telling the VA watt was done wrong and request a new CMP exam if it gave you a negative outcome

No goniometer used in any of my exams but doctors state in DBQ goniometer used!! I sent in statement to a stating this and other lies. Nothing done yet. Awaiting HLR.

Yes, C & P examiners have to complete exam when requested by VBA. Private doctors are not required to complete them. It is up to each doctor. Did you contact Dr. Freeman? Yes their is our claim service connected of Malaria servers in 1952 up to 1998 it was denied for the reason of VA not compensable zero percent, how about service connected not rate at VA Manila in 1980, cerebrovascular Accedent thrombosis acute, bronchitis and 1083 hypertension,CVA bronchitis, thrombosis, pneumonia and 1985 the ultimate couse of his death CVA, cardiovascular arrist, thrombosis,, pneumonia how about this not rate at VA Manila from 1980 up to now not rate what service connected I am available to our claim?
