    10:50 This is not true. The 60 day grace period gets replenished every time you join a new job (every time you get a new validity rather, and H-1B transfer counts as a new validity). For example, a person has left job A. Now they have 60 days to find job B. Let's say the person waited 10 days to join job B. After they join job B, their 60 day quota gets replenished. If they get fired or decide to leave job B, they will have FULL 60 days to find job C, NOT 60-10=50. It's not a fixed 60 day quota for the rest of your H-1B life. So people can take breaks before joining a new company if they want to. Please post a correction. You're unnecessarily worrying people with this false information.

    Yeah, covid time is so terrible. I got laid off. I asked my previous employer to extend my employment period for severance period. Then I got my first job offer but was discriminated based on my country of origin and the job offer was rescinded. I had to look for a job again. Luckily, I got it and my start date is in 45 days after my official date of layoff. I hope tomorrow the company will finalize the I-129 application and everything will OK. The LCA was already received.

    If you transfer h1b and used 30 days before joining next company doesn't mean that you left with 60 days now to find another future company

      No NOC required.
      Just have the transfer initiated by future employer, get it done, resign the current employer and join the next one. Simple.

    Could you please let me know,
    I got my H1B Visa stamped being in India only and not travelled to USA even once on this Visa, waiting from months...
    So if I change my employer now, will I have to do Visa Stamping again or only new I 797b will enough to travel to US

    Great video. Have one question. Let's say I got my H1b transfer approved and should I have to immediately resign my current job and move to the new one or I can give my company a 7 day notice and work for 7 days on the current company and then leave?

    You get new set of 60 days with every new h1b application (for example you switch from company A->B, and then in future, company B->C, you get a new set of 60 day grace period). Please correct that information.

      Processing time keeps on changing. Currently the regular processing is about 4-5 months. However premium processing will get you result faster.

    Hi. Great video. Can 2 potential employers file h1b transfer for someone at the same time ? If we decide to stay on our current job after the transfer has been approved, can we do that ?

      H1B transfer is initiated after you accept the job offer. People don’t accept two jobs at the same time. So there will just be one employee that will file petition for you.
      However, I have heard that some consultancies do this kind of business - filing multiple H1B cases. In the past people have done that and got away with it, but in the recent times USCIS have become more stringent on cracking such multiple or duplicate petitions for the same beneficiary. If caught, it can result in permanent denial or ban. In addition, it is not ethical as well to file two petitions because 1) You are trying to increase you chances by reducing the chances of all others
      2) if picked up in both the petitions, you will be wasting one visa. Basically wasting someone else’s chance.
      On you second part of question: you can stay on your current job, but your freedom will be limited.
      1. Cannot renew the DL
      2. Cannot leave the country
      And there are others thing that will get impacted as well.

      Total duration of H1B is 6 ( 3+3) years. It will remain the same. Therefore your expiration date will not change.
      Only way to extend your H1B beyond 6 years is to have I-140 approved and then file for extension.

    This is huge help. I am an H1B candidate who has not worked for the last 3 months (because I was on unpaid leave) and has not been in the US. For the last 1 week, I have been in the US and my 60 days period is running out. What if I got an offer from some other company and they are ready to transfer my case with premium processing? Does it affect my transfer case because as of now I am not getting paid by my employer? I discussed this with my employer as well but they don't want to run my payroll until and unless I found a new project. Is it possible to take a transfer in this case? Because I was on unpaid leave and not in the US and for the last 1 week I am in the US but not getting paid. Any kind of guidance/help is highly appreciated

    As far as I know no need of restamping post H1B transfer. Can you throw some more light on it .

      It depends upon case by case. If your previous visa is expired (first 3 yr) and you want to travel outside usa, You DO need a visa stamp. On the other side, if you just want to remain within usa for rest of your H1B time, you don’t need that stamp. Remember visa is just a documents that you need while crossing the boarder. Your legal status is defined by I797. That has to be valid all the time while you are inside usa.
      So again, it really depends case by case. Hope this is helpful.

      You don’t need a physical copy to complete the I-9 form. You can do it without that as well.
      In your case i think it would be easier if you go with 1 document from list B and one document from list C in the section 2 of i9.

      However Generally companies don’t prefer someone who has just 6 months left on H1B

      Yes, You can apply in any country that has US embassy, only thing is you need is to Get visa for that country first.
      In addition, if you are stamping outside your home country, It might take longer time for processing.
      This is the rule in place pre-COVID time. Not sure if rules have changed temporarily due to COVID.

    I have few questions first one I got an H1B extension in this year and my previous visa is expired if I go back to India to India with current employee then I need to do stamping with drop box and my wife also got H4 visa first time with current employer and never visited to USA . Now coming to transfer I got offer last month with new employer and I need to go for transfer . Right now I am only in USA and then they can do only my transfer because my wife never been in USA . If i go to India with approved Petition then I will get stamp with new employer but my wife will hold the visa with previous employer . While travelling from India should my wife again go for update visa with new employer because she got validity till another two years with my old employer . What would be the best possible scenario for travel .

      Yes she has I 797 A notice with my current employer because which she used during interview this month for stamp and got approval till 2024. I haven’t still started any transfer before checking all the possibility

      I am not a attorney and this is not a legal advice. But here is what my thoughts are.
      1. You can ask you wife to come to USA with the current visa stamping. As you know visa is only required to enter the country, I797 is the actual immigration document in her case that should be valid all the time her stay in USA. Now while she is in USA, you guys can initiate the H1B transfer. Once the transfer is done, then next time when you go back to India, you both can have new visa stamps. In this case you both be able to live in USA as long as you i797 is valid, irrespective of your visa stamp.
      2. You can initiate your H1 B transfer now. Get the new I797, and later file for your wife H4 transfer. This you can do by yourself or can’t attorney can help you with this. For h4, you don’t need any sponsorship from any employer.
      Bet keep in mind, in the second case, your wife will have to wait for the new I797, that may take 4-8 month based on current times. And it cannot be premium processed.
      These are the two possible scenarios I could think of. Again if there is another way, I don’t know that. I hope this is helpful. Good luck !!
