    Wish lawyers would go after these "public auction" scammers who regularly auction off lemons or cars with rolled back mileage.

    So if you purchased the car at a certain price (disregarding the fees etc), then find multiple photos of the same car at a lower price and high price than what you purchased for, is this grounds for litigation?

    Is Dealership "grossing up income" legal?
    The F & I guy said he grosses up income by 25% at their Toyota dealership.
    In this case, customer's gross Disabilty income is $1,800. grossed up by 25% to $2,350. That's an additional $550. False income reported to the bank. Customer signed a loan app with his gross 1,800.
    We discovered an Additional 2 Loan apps with erroneous driver license and 2 seperate incomes. Including a false employer & retirement of 10 years.
    A 53k contract. 3 local Credit unions' denied lending. With Toyota Financial handling the finance.
    OH, and customer credit came back as 0.

    I have a question. I am in the market for a 2021-2023 used Lexus IS 300. I found one that has been advertised for $31,600 at a Honda dealership. When I clicked purchase online cash the price jumped up to $46,000. It would not give me a breakdown of what all the extra money was for. With tax and fees it should have only came to around $36,000. When I contacted dealership asking why and for a breakdown of fees I kept getting the run around. Finally a jerk sales manager said the price is $31,600 but he refused to sell to me because I threatened to report them for false advertising. I’ve since looked at the reviews and this is standard procedure for them. Is this legal in California?

    Pricing is not really a legal matter in regard to markup. First MSRP is Manufacturers SUGGESTED Retail Price. Even Manufacturer states it not a real price. Spend over 40 years in the manufacturing side. Second, no one is normally forced to buy any car. Not all dealers marked up either as I purchased two after the supposed time when all dealers did crazy markup. Both cars were new which have true stickers not reprints on used cars of how old at what economic conditions where MSRP is really meaningless. Neither of my new vehicles had markup over MSRP or any crazy fees. Both were MSRP, less some amount, taxes and transfer of tags (both state fees). One was cash and one financed at like one percent which is easy decision to make.

    Most of the calculators say "estimate your monthly payments" This, combined with a clear statement saying "see dealer for final price" should be sufficient. How can a dealer be more clear than that? I guess someone can quibble over what is an estimate? Depending on the markup the payment calculator would give an estimate that isn't accurate enough and that's deceitful? There's some meat on that bone maybe.

      If there was no intention to mislead or deceive then there’s nothing to worry about. Like he said, if a reasonable person or a jury would be easily mislead then there may be a problem. If I was a dealership I wouldn’t want to leave anything to chance and I’d go out of my way to be crystal clear as I can’t imagine any car dealer fairing well against a jury since everyone’s been burned by shady dealerships at one point or another. Just be honest and up front and why not just list the actual price? Seems pretty simple to me. Why have anything online or anywhere showing a price that is no where near the actual asking price when it’s pretty simple to simply price the car properly. Otherwise listing msrp and using fine print as an alternative just seems a little misleading. Albeit maybe defensible. But I would want to test it at the cost of $30-$50k in defense costs.
