This defendant sure was a piece of work. He was illegally renting his place and was scummy about it at the same time. He doesn't seem to understand or care that he cannot legally collect rent for that place until it's zoned correctly or he moves himself out of the basement.

Legally he can't collect rent if he's not properly zoned which also means he's not entitled to any of the security deposit. Also if he's not well versed in the law for the state that he lives in, it's likely he blew the deposit instead of keeping it in an interest bearing account until the end of the tenancy, like landlords are supposed to. The laws and zoning are there to protect everyone, but sure go with your thought process and say screw the government.

If the landlord is a good landlord and doing renovations, one is to expect that rent will go up eventually. That's just common sense. Anyhoo, the landlord should have renovation funds already available because contractors don't wait to get paid. 😂

I personally think it's crappy and wouldn't do that but that's the law. I'm currently not a landlord, just a tenant. My rent goes up 2%-5% every year and I hate it.
He uses Airbnb, so he gets a 1099 and pays taxes on that. That being the case, it would be foolish to not pay taxes on the rent he collects for the second unit (especially if he’s collecting payment by check). All it takes is one tiny discrepancy to get audited, and I’m sure he knows that.
He was collecting $36,000 a year on that apartment. I really don't think he was claiming it. Dumb as dirt to come on national TV and admit you were illegally renting an apartment for at least an entire year while not claiming the money on his taxes lol.

100% he rented that space for an airbnb during that time. All those items screamed short stint to-go bags items. It looks like someone was in the area for an interview or something, based on those items. They probably could have looked up the address on airbnb to see if it was listed. Then again, if he rents his apartment, he could list where he actually lives, but give them the upstairs space to cover his tracks if anyone checks.

"The amendment has to be in writing". Yeah, you wrote to them that they can move out a month early. You don't get to change your mind because the new tenant changed their mind. Seeing this, those new tenants did the right thing by changing their mind.

I missed where the landlord provided the signed amendment that allowed him to occupy/sleep in the apartment while the tenants still had a lease effective until May 31st or end of June.
It's rather clear the law doesn't mean anything to the defendant. That's why he's trying to rent out when he's only zoned single family. His text was plain as day that he wanted them out by the 1st, he's the only one that doesn't see it because it doesn't work in his favor.

Tenants are still bound by the terms of a lease up until the point that they express to the landlord that they know they’re not living in a legal unit. In this instance, the tenants didn’t learn that the unit wasn’t legal until they’d vacated. But it’s irrelevant. The text messages were written communication and enough to amend the lease.

Yes she had the complaint and the answer in front of her, but she should have allowed them to make their case, before she shot it down. None of this is to say that she was wrong in her decision, but its impossible to know, because we did not hear these litigants respond to what she was saying.

More landlords needs this done to them ive lived on my own since i was 16. I had my first apartment at 17. Ive never not payed rent and alot of times got landlords who just collected rent and security and never did a thing when something broke or needed maintenance. Ive yet to recieve my security deposits back ever... im so glad in N.Y. they stopped landlords from collecting lasts months rent plus first months rent plus security cause alot of landlords were robbing tenants blind. Ive won in small claims court 3x for wrongful eviction and everything still havent seen a penny because they signed there properties over to there kids then go back to there country and never see them again to ever collect. Its really messed up i wish i lived in uk cause they collect your debts if you cant pay they take all your stuff away.

I think she didn’t care for what the defendant had to say since she knew he wasn’t even legally allowed to rent it out due to it zoned as a one family living space

defendant talkin bout how the law means nothing to the judge while he is collecting money on an ILLEGAL rental . guess he cherry picks the laws he likes and ignores the rest .
This defendant said the law doesn't matter, contracts don't matter and the judge just does what she wants...sir your not even allowed to legally rent the place...relax. Also the plaintiffs seem like great tenants.

I think I've seen one case out of maybe 500 where the pictures were false
He knew when they were moving out and you never rent out the place until there is a walk-through final inspection and then a cleanup by the landlord. This guy is too shady and needs to be reported.

Typical landlord. My landlord is going to renovate the building so he raised everyone's rent to post renovated levels in order to "raise funds".
More landlords needs this done to them ive lived on my own since i was 16. I had my first apartment at 17. Ive never not payed rent and alot of times got landlords who just collected rent and security and never did a thing when something broke or needed maintenance. Ive yet to recieve my security deposits back ever... im so glad in N.Y. they stopped landlords from collecting lasts months rent plus first months rent plus security cause alot of landlords were robbing tenants blind. Ive won in small claims court 3x for wrongful eviction and everything still havent seen a penny because they signed there properties over to there kids then go back to there country and never see them again to ever collect. Its really messed up i wish i lived in uk cause they collect your debts if you cant pay they take all your stuff away.
This is what happens when you get in the Judge's goat. I'm glad the decisìon was for the Plaintiffs.
