There was this guy who was with his wife and witnessed a creep taking upskirt videos of another lady. The wife dragged the husband away cos she dont want to confront the creep. The creep got away.
The husband felt so guilty afterwards, for not taking any action, and posted the encounter on reddit. A redditor commented,
'wah if the creep wanted to take picture of pussies, he should have taken a picture of you instead'
so yeah, thanks for pointing out to not be passive in such situations.

Long story short, i complained to the drinks store that someone was smoking while seated in the coffeeshop in front of a no smoking sign.
The staff told him to go outside to smoke, but his friend saw me complaining.
He was furious after being told by staff to go out to smoke, and he found out it was me, he started talking out loud to intimidate me by saying "nvm i take photo" then he whipped out his phone and took a photo of me and said out loud again "i sent to all my friends, see how you die, they see you outside will settle you".
So i called the police, and the police told me 1. it is not illegal to take photos of people. unless it is sexual in nature.
    2. There is no way of charging him for threat, because its just words, unless you feel there is strong evidence that he is serious about carrying out the threat.
    I just find it ridiculous.
    1. If someone directly takes a photo of you while threatening you and you still cannot charge him for anything, then i think the law is a joke. You took my photo and you explicitly state what you wanted to do with it, isnt that intent?
    2. Is like saying, if i shout in public "im gonna bomb this place" and expect to get away with it. I can argue, i say say only what, no intent. You can prove that i was really gonna do it meh?

Dan, you're absolutely right that we should teach the kids what to do if they are in such situations..totally agree! Everyone knows right/wrong, and it's so easy to say that I would have done this IF it happened to me.. but when it actually happens, freezing up is usually the thing to do lol.
This happened to me before in sec 3 when I was molested by an older man on the empty bus after school. I was too afraid to shout so I just moved away. Female imposter syndrome is also real cos I didnt' dare to report it after that for fear that people would laugh at me thinking it '"couldnt have happened to you".

The thing is, there's no law in SG against the taking of photos of other people around you. Unless it is an upskirt or downblouse photo that is considered as outraging one's modesty. By using physical force to snatch the alleged perp's phone, you can ironically be charged. The alleged perp can call the police on you, and he/she might very well do so if he/she is innocent and you blow up the situation.

    • @Zach-wv8pz
      @Zach-wv8pz 2 года назад +10

Taking upskirt or downblouse photos is explicitly illegal but it would be an offence of voyeurism, not outrage of modesty. The latter is molestation and typically covers cases of non-penetrative sexual assault.
Taking such photos may also constitute as insult of modesty. In fact, voyeurism is a relatively new offence and was only added to the Penal Code in 2020. Before that, perpetrators of such crimes (taking sexually explicit photos/videos of women without consent) were usually charged for insulting a woman's modesty.

In response to Jon Paul’s question about how people act on these ideas. I think many of them are sex addicts who have impaired sense of self control. People often crave for a greater high to the extent that online material is not enough anymore and they have to seek it in real life. It’s something often built up over YEARS to get to that point.

Wasn't there a girl who confronted a dude in the gym for taking video of her when he was just watching Mr Bean.
So don't straight go confrontational attitude first. if wrong sibei paiseh sia, don't assume and ask neutrally for him to prove he is not first, next, if its not of the perverse nature aka upskirt etc kind, i believe a lot of people dun know that it's illegal to take video/picture of others, so ask them to delete first. if they aggressive against proving they didn't do it, or it's perverse or they just don't want to delete then it's time to get aggressive and call the cops.
Also a lot of people who do these pervy stuff have underlying psychological problems so what you should do if you catch your friend/partner is to set an ultimatum, psychological counselling in exchange for not reporting. If they relapse then report.

I dont really agree with dan's gf on her point that if someone accidentaly "grazes" your butt once, that you should immedeately confront the person. i think you should take several things into account, such as the age and gender of the person, how crowded said public transport is, if the road was shaky etc and the number of times it happened. Although there are some rotten seeds out there, people should still be given the benefit of doubt. because imagine if it was a fairly young boy, maybe in secondary school or smth. and he honestly, just accidentally grazed your butt. You, just assuming he did so deliberately, making a scene and confronting him in public would honestly scar the poor boy for life. Which is why the law is always innocent until proven guilty. Because falsely accusing someone of somthing they've not done, in addition to that, in a public setting, is wildly traumatising and unjust. just my 2 cents. never assume, always think rationally be very sure before you roll a dice like that.

@@dylan-nk5lh Unfortunately we do to some extent. Back in my poly days, my male pals and I were frequently subjected to unwanted touching and lewd remarks by female classmates, in public view. Nobody gives a damn and people even laughed and joked about it. It is as though consent is an unilateral concept.
Male modesty has historically been sidelined, even today. I've lost count of the number of times a female janitor brazenly enters the male toilet unannounced and starts cleaning while I'm still standing in front of the urinal. You'll never see a male janitor enter a female toilet in such an inconsiderate way.
Most sexual offences were only made gender-neutral in 2020. Some, like r@p€, still remain gendered and only accord protection to women and girls.

So yes, rules or laws about sexual harassment itself have too many grey area.

    Taking photos in public places
Organizations are exempted from the requirement to obtain consent in respect of the collection, use and disclosure of personal data that is publically available. If an individual’s photo is taken when the individual is at an event or location that is open to the public, taking a photo of that individual is likely to be regarded as a collection of personal data that is publically available, for which consent is not required. A location that is “open to the public” is one with few or no restrictions on who can enter or access the location. However the Guidelines note that there can be “private spaces within public spaces” and the mere fact that members of the public may look into the premises does not make it public.

If you are in a public place and there are people around you, you can ask for help or alert others when you realize the person is taking your photo.
If you are alone in a place, and you find the man really creepy, you might want to just walk away once you realize he is taking your photo. Because if it's not upskirt photo, you really have nothing to lose. Confronting the person might be dangerous in that kind of situation.
