I-Team: Accusations Against Officer, What the Body Camera Shows

Stone Mountain - In this day and age, police officers are under intense scrutiny. Any complaint of bad conduct could trigger an internal investigation and possible disciplinary action. So our FOX 5 I-Team was intrigued when a DeKalb Fire department employee complained that a local police officer cussed her out. Dale Russell reports that things are not always as they seem.
Stone Mountain Police Sergeant Stephen Floyd was patrolling on a sleepy DeKalb County street early one morning when he spotted a car with an expired tag.
He ordered the driver to pull over. Routine stuff. But, what happened next was far from routine. This stop led to a citizen's complaint alleging a "hostile" Sgt. Floyd "threatened" a witness to the traffic stop.
This is how it unfolded. Sergeant Floyd approached the car to find DeKalb County Fire and Rescue Captain Terrell Davis behind the wheel.
And virtually the first words out of Captain Davis' mouth, "Do I need to call my chief or supervisor, your chief or Dr. Alexander?"
Dr. Alexander is DeKalb County's Public Safety director, Dr. Cedric Alexander.
But Sgt. Floyd ignores the name dropping and heads back to his car to write a ticket. There, he meets Krystal Cathcart, another DeKalb Fire and Rescue employee. Once again he hears about Dr. Alexander.
Cathcart asks, "Do we need to call Dr. Alexander?" Sgt. Floyd responds, "Call Dr. Alexander for what?"
What happened next led to Krystal Cathcart filing an official complaint claiming that Sergeant Floyd created "a sense of fear" at the scene, cussed her out twice, telling her to "back the f*** up" or he will throw her in the "back of my squad car."
DeKalb Fire Captain Terrell Davis backed up her written complaint saying Sgt. Floyd was "unprofessional, belligerent and disrespectful."
"If it's true, he's subject to reprimands, any kind of discipline including firing, termination." Bill McKenney, a former police officer and now a lawyer who represents police, looked at the case for us. He says this kind of complaint can be damaging to an officer. "Even if he's not fired, that's going to stay with him. That's part of his history."
But when Krystal Cathcart filed her complaint with Stone Mountain police, she must not have known that Sgt. Davis had a dashboard camera on his car and a body camera on his chest.
You heard the complaint about a threatening, hostile, and cussing officer. But the video tells a much different story.
Krystal Cathcart: "Hi Officer, is there a problem?"
Sgt. Floyd: "How you doing?"
Krystal Cathcart arrived, and just like Captain Davis, she threw out the name of her top commander, Dr. Alexander. She then said she worked with Cpt. Davis and wanted to see what was going on.
Sgt. Floyd asked her to step away from the scene.
Sgt. Floyd: "You can wait over there."
Krystal Cathcart: "Why."
Sgt. Floyd: "Because I asked you to. This traffic stop had nothing to do."
Krystal Cathcart: "I can stand right here."
Sgt. Floyd: "No you cannot stand right there, and it's the last time I'm going to ask you or I'm going to put you in the back of my car."
Krystal Cathcart: "We'll call Dr. Alexander."
Sgt. Floyd: "That's right, call Dr. Alexander, thank you very much."
We showed the video to Bill McKenney. He called Floyd's handling of the roadside stop, "textbook."
McKenney says, "That's standard procedure. Law enforcement doesn't want someone close to them when conducting an investigation for safety reasons."
Stone Mountain police investigated the complaint. They showed the video to Krystal Cathcart and she changed her story, writing "I recant the error of Sgt. Floyd using profanity."
Stone Mountain Police Internal Affairs found Cathcart and Captain Davis "less than truthful in their written and recorded statements."
Stone Mountain Police Chief and the DeKalb Fire chief wouldn't talk to us on camera about the incident.
But Bill McKenney would. He said the officer was lucky the cameras recorded the stop, "Because, it shows that's a false report. It's clear."
Because Filing a false report is a crime, Bill McKenney thinks it could be turned over to the local district attorney for investigation.
DeKalb Fire Chief, D.D. Fullum, in a written statement, says the incident involves Stone Mountain Police but If any other information arises and warrants further attention he will be happy to look into it further.

and when it suits the officers the body cam and the car cam both record the whole thing without something going wrong, and how many times was the video in 1 or both said to be corrupted and didnt record? funny how they work when it only suits the cops.
as it is hard to do this it has been done and on record. how many times was a good encounter corrupted?
this is a start with the body cams, but we need to go a step further and not give the cops a way to shut the video off as it should be on 100% of the time.

That idiot was getting a ticket for something he should have taken care of... there isn't anything wrong with that. And it doesn't matter who he works for the, the law is the law. It is ridiculous that they tried to ruin this Officer's career simply because they feel they are entitled to preferred treatment? Psh. I respect all of our first responder elements, because we are all a part of a greater team. But no one is above the law, and EVERYONE should be held accountable. Regardless.
Well slander is a civil matter. And the officer has to prove actual damages from the slander. With that being said he should definitely sue. My problem is this video didn’t show me any evidence. All I got was fox’s opinion on the matter rather then making a decision for myself. This is why I can’t stand our mainstream news outlets because they try a sway opinion rather then presenting facts.

Exactly right. When I moved to another state I learned the hard way that, if you move within the state, the License tag agency doesn't forward your renewal notice. Soooo, My wife and I were both pulled over for expired tags. We obviously didn't realize our tags had expired and it cost us $180 each. We didn't like it, complained a little bit as to why this state doesn't forward tag renewal notices, but we paid it. The law can't care about anyone's intentions to abide or not abide, that's how law and order has to be if it is going to be successful. This is what it means to ascend to the higher principals of a civilized society solely based on law and order. Even if you don't intend to violate, you've still violated.

@@courtofpublicopinion8189 Depending on the severity of the lie or the history of the employee with other problems or similar situations, absolutely they should be fired and charges should be pressed. When you state a lie that can not only hurt the reputation of a public official, but also cost them their job, you should be punished equally if not worst in my opinion.

This is why body cams are great and every police officer should be required to wear one without the ability to turn it off. Protects the public and it protects the police officer.

That is a ridiculous statement. The police are granted the use of force, including deadly force. They are often not held accountable for said use of force and it ends up being a he-said she said fiasco. The camera doesn't lie. Anyone against bodycams on cops is an igit

+satchmodan - That shows how much you know. I teach civilians the law concerning the use of deadly force here in Colorado, and I am a former LEO. The law is NOT different for civilians and police.
A person (police or civilian) who is reasonably in fear of imminent serious bodily injury or death may use deadly force to defend themselves or a third party. PERIOD.
What does happen is that law enforcement more often comes into situations where they are exposed to these circumstances.

Looks like the fire captain and the fire department employee both conspired to lie regarding the police officer who was doing his job and wasn't going to allow name dropping "Dr Alexander" to influence his decision to issue a traffic citation or not.
Sgt Floyd is a professional and we need honest men like him. He carries out justice regardless of who breaks the law.
The fire captain and fire department employee on the other hand should not only be fired, they need to face criminal charges for intentionally providing false information to the police. Additionally Sgt. Floyd should also file civil actions against both of them as well.

When a police officer lies about a citizen that citizen goes to jail, or they have to pay a huge fine and this happens all the time. When someone lies about a police officer in hopes of getting him in trouble the officer is actually rewarded with paid leave. Police even kill someone, they are rewarded with paid leave. Something is backwards here. All you gotta do is open your eyes to see but you won't.

START CRIMINALLY CHARGING people who are making FALSE ALLEGATIONS since it is an official police complaint in that they SWORE WAS TRUE since they SIGNED the complaint. These people are trying to RUIN this officers career for something THEY are RESPONSIBLE for. The Captain should also be charged since he CONFIRMED her statement. Being that both work for a city agency, both should ALSO be reprimanded and docked since they also wasted city money for the investigation..

Most of the time, a cop will not write a fire and rescue person a ticket. The fire captain was shocked to be getting a ticket. How dead were his tags? Add to that, The firefighter was expecting some skin color consideration. An AA cop will still write you up for DWB. Professional courtesy is not a required activity. Then your tags are six months dead? Then your going to lie about the cop. While he is wired for sound and video? The cop got them! This camera thing swings both ways!

No it most certainly will not happen in this case. In addition; did you actually see the whole traffic stop or are you simply taking Fox News at their word? I never jump to conclusions unless I see the entire incident myself.

I love those cameras. I used to feel it was an invasion of privacy but now I see how people falsely accuse others of wrongful doing. Everyone should have a body camera and a dashboard camera. This will be our future for sure.

I would hope Dr. Alexander would take action in a form of disciplinary action against these two employees. They wasted no time dropping his name as if to imply he would correct this LEO for doing his job. I wonder if they consider themselves christians? Doesn't say something like "thou shalt not bear false witness against thy neighbor". If a LEO is in the wrong then you file a complaint. These situations are going to the extreme. Now, the public are filing complaints just because they can. Shameful public servants.

What's most shocking to me is that these two dimwits that work for a fire department aren't aware that police cruisers have cameras in them. They interact with the police on a regular basis for medical calls and sometimes fire standbys, and this didn't occur to either of them? I feel bad for this fire department which is most likely filled with overall good people with the exception of these two, because this is going to reflect badly on the department not just them.
Or they just don't give a crap about any camera.
Cameras work both ways: protect the good cops, and expose the bad ones.
I am not a police officer, but situations like this are why I am getting a dashcam for my car. It is why I have considered wearing an audio recorder all the time (only reason I don't is that I work with "sensitive" information).
These are so crucial in this day in age where people are willing to lie over minor issues.
Yeah i definitely think that they should get charged with filing a false report. It was deliberate because they wanted to get let off the hook because they think they're above the law since they have a certain job. Who cares if you work for the fire department? Who cares if you work, or at one point worked, as a police officer? Who cares if you work for the township, the city, or the state- in any field?! Who cares if you know someone who holds a position of power? You are still supposed to follow the laws just like EVERYONE ELSE!

False written statements, which would get any citizen fines and time. (not always time)
First, no cop will suffer disciplinary action from a "he said, she said" complaint without evidence confirming wrongdoing, and even with irrefutable evidence of wrongdoing, like a recording, they usually get off without any significant consequence.
Second, it's expected that criminals will lie, and that's why cops, prosecutors, judges, etc. will take the word of a cop over the complainant without corroborating evidence. We *don't* expect our cops to be liars and criminals, so *that* is the issue, since the majority of them are.
Cop: I don't care if you call Dr. Seuss... I'm in charge right now.

This is why cops should be more than happy to wear that camera and never turn it off.
This is the exception to the rule. Most of the time it's the other way around. Officers lying on official police reports is rampant. They almost always get away with it. Hell, many times they get caught and still get away with it. And we still have police officers who will turn off body cams, dash cams, and try to arrest people filming even though the camera can save them. They should always have a camera pointed at them. Police abuse is unacceptable under any circumstance.
As public servants of the city, I would hope they have a code of conduct to abide by, and lying on an official city document should be grounds for disciplinary actions.

How ironic that the dash and body cams were fully functional and that the recordings weren't lost.
Dr Alexander should immediately have a meeting with all of his staff reminding them that they are not entitled to any special privileges. And criminal charges should be brought forward against those 2 for lying and trying to ruin the SGT's career.
As a veteran firefighter I am ashamed of these people and can safely say they are not part of the thin red line.
Dash and body cams.. are the best thing to happen to cops in a long time.. now it's time to prosecute the false allegations...
