    If the Supreme Court rules that a standing president cannot be charged for anything, doesn’t that mean Biden can do whatever he wants and not have to worry about being charged?

    The fact that a lot of Americans don't see the obvious things that can go wrong with a standing president who can circumvent any and all laws, is seriously concerning.
    If that's the case, what's to stop Biden forcefully staying in power for as long as he likes? Presidents should be subject to the same laws as anyone else.

      Part of the problem is that the same group of people expect the laws to not matter anyway, a new government to be put in place, one that lets them kill and enslave whoever they want. This is exactly where the "southern strategy" got us.

      The president isn't immune, BUT you're not allowed to charge them from the level that you're charging them from as this is a federal case and not just a case from local levels. Congress is required to impeach and the senate is required to prosecute. The impeachment happened, the prosecution and conviction by the senate did not. Therefore he was not found guilty of insurrection. Therefore the decision to take him off of the ballot for that charge was invalid.

      Actually he can, as long as congress would not impeach him. and in fact under current rulings, congress does not even need a reason to impeach. Impeachment is the answer to a President doing things that is not liked. Educated people would know that.

    What annoys me no end is endless cadence from Republicans that "The courts shouldn't decide, the voters should" The voters DID DECIDE, and not for Trump. The whole case springs from Trumps refusal to accept that decision.

      There's no point in arguing with someone who is fundamentally dishonest and will argue anything in bad faith, regardless of logic or precedent. First Trump, then all of his followers, then finally the entire GOP. And if he gets back in office (by whatever means), the entire federal government, the Supreme Court, and whoever he appoints to head the US military.
      Liars don't respect rules. They will only use them when they are to their own benefit, and deliberately misinterpret, deny, deflect, delay, or make excuses when the law stands against them. At some point, you have to stop listening to liars. If a president can be made above the law, then there is no law. No law, no state. No state, no country. The United States dodged a bullet with Nixon. Now they have to dodge a missile.

    The worst part in all this is the sympathizers also believe they shouldn't have to follow the law. Most people I've met with beer cans thrown into their truck beds have been Trumplettes. Ask any of them if they believe if the rules are "fair" and they'll always say "no." Nearly no matter what. Which is ridiculous, no matter how sane, say, a speed limit is. Or ya know, not openly drinking and driving, claiming it's their god given right. Idk, it just resonanted the same to me as this whole "I can do what I want." b.s. from Defendant D.T.

      If they rule in his favor, it would apply to Biden also. They need to be careful what they wish for. Republicans rarely look down their road to see the expected outcome of their laws/actions. They just want the immediate gratification of their present "need".

    The things you learn from watching this channel: I looked up that Grant incident. It was black police officer William Henry West who pulled over President Grant for his reckless horse-drawn carriage race in 1872 and West said: "I am nothing but a policeman, but duty is duty, sir, and I will have to place you under arrest". And he did and Grant had to pay 20 $ in collateral. Grant admitted he was wrong and complimented West for his sense of duty. Just imagine a black officer caught Trump overspeeding; I don't think that we would see Trump displaying anything near Grant's attitude.

    British guy here, and i have to say im impressed. The colonies wanted to escape the rule of monarchy, only to accidenly make a position even more powerful, overreaching and immune then any in the UK. It took a while to get here, but i think its safe to say the president has too much power.

      @@ScootyPuff_Jr Thing is that it started off pretty good. Congress did the domestic stuff, the President did the foreign affairs jazz. But this sort of cult around the President and weird reverence for the position has been quite damaging imo and taken away from the importance of Congress.

I gotta stress, this is *Trump.* Not a President cult. A Trump cult. I don't think anyone truly *wants* Biden. But nobody liked Hilary either... So "we" had to take what we could get. I say "We" because I was not old enough for the 2016 election. I'm 23.
      There has only been a cult over Trump. *And it's a cult.* One I genuinely believe is dangerous. If/when Trump's put away, violence will break out. Sadly, this is what I believe supports my next argument the best.
      That galvanization I mentioned earlier has also radicalized his opposition to a degree. It's heresy to say this; but if Democrats ran on a pro-gun platform, there would be no more Trump. No more extreme right-wing politics. And for the record, I identify under neither of the binary tribes. I am not a Republican because I'm very much pro-choice. And very much not a Democrat because I am very much pro-gun.
      A large portion of Trump voters are really... Just people who just like their Second Amendment rights. And the idea of *this* Government taking them? That's enough reason for many people to disregard the welfare of people who live so far away that they would live in another country for you.
      I firmly believe I am actually the "Average" American in these views. I know, from your perspective, guns are a joke. But it's too late to remove all the guns here, and no offense; but I hear knives are effective across the pond. We have a mental health issue here, the gun violence is a symptom in my opinion.

      we are following rules from 1775 that we hold up as this great thing that we can’t improve. (We can) I mean the right to bear arms was a good idea 200+ years ago but honestly they don’t do much in a world of drones and missiles. America has its problems but we still are a decent country

      He’s just a rat in a maze, yet he believes he will be president again. The opposition have already lined up their much loved preferred set of candidates from within, prepped to exploit all the opportunities that come with the position.
      These court cases could have reached a conclusion in no time (as there are hundreds of courts in the region which could have arrived at a verdict in weeks if they wanted to) instead these cases will drag on for half a dozen years so they can hurt his campaign.
      Exile to foreign lands in tears will probably how it will end for him, however they will welcome him with open arms as he is a uniting character (he’s done more for coloured people than most presidents). If he was truly a nasty, toxic and dividing character that only cared about his own type, he would have armed soldiers greeting at him the airport, so afraid he will spread hate.
      Many have turned on him now (we’ve seen in the past when things aren’t going well, these people will turn on the foreigners first - even though he is clearly a citizen).

      Look up Roy Cohn. He was, among other things, Trump's attorney and mentor. He is a big reason why Trump behaves the way he does. Cohn was also a huge tax cheat. He died owing millions in taxes. I think he would have eventually gone to prison had he not died.

      @@paullandry8181 It's this tiny conflict you might not have heard of, called the Civil War, which inspired the entirety of Article 14 of the constitution relating to the inability of those who have in any way been tangibly linked to sedition to ever again sit in public office, let alone be counted on a ballot. Trump's complicity in January 6th is no longer alleged, it has been confirmed, and as such, Section 3 of Article 14 applies.

Read the Colorado State judge's ruling. It lays everything out clearly. This is no different than the requirements a president be over 35, a natural born US citizen, is residing in the country and has done so for 14 years. You wouldn't be fussing about not being able to vote for a 33 year old Frenchman. It's just another requirement in the Constitution that has never been needed before this. It doesn't make it invalid.

      From what I understood from my US history class was that our country was created because the 1% of the late 1700's didn't like that it took 6 months to lobby to the king, and another 6 months to hear back no.       While I am sure Trump would try, there is an entire government worth of people who would need to go along with the attempt. While it is easy to assume all those positions are filled with supporters, the reality is otherwise. Trump called this resistance 'the deep state' but it is just the reality of any system that has a Parliament, Congress, or other large group of elected officials mingled with dedicated staffers.
      Trump will be gone, like other leaders before....

    The fact that Trump doesn’t want the Supreme Court to decide this quickly shows that he is well aware that he’s on VERY shaky legal grounds and does not actually expect the immunity defense to stand. He’s just trying to delay by any and all means possible.

      Probably because the Constitution doesn’t say a single word about presidential immunity. This concept was created during Nixon’s term when the DoJ essentially engaged in a thought experiment to see what would happen if Nixon was charged. It’s never been tested in a court of law and there’s no actual law written anywhere to support it.

      I'm not sure he's aware of anything on this level, he hasn't the faintest idea about law. He also never thinks he's wrong about anything.
      There's no nuance to what he's doing. He just wants to delay this as much as possible. So he can become President again and dismiss it himself instead of other people deciding his fate. In the latter case, something could always go wrong for him.

    This is a really smart move. By disqualifying him in Colorado it sets precedent that the other states can do the same.

      If the precedent is set that the President can do anything and be immune, then that means that Biden can do anything he wants.
      I don't see him imprisoning political rivals, refusing to leave office, and breaking laws left and right. Still, Trump is basically arguing that Biden can do anything he wants and is untouchable unless he's impeached, convinced, and removed. Somehow, I doubt that the Republicans want THAT interpretation.

    The idea that the framers would intend anything close to presidential immunity, with all of the godawful and very famous examples of this (e.g. Julius Fricken Caesar), is beyond ridiculous.

      What the feamers intended has been long abandoned. Benjamin Franklin had to ask Congress for permission to receive a snuff box from the king of France under the Emollients clause. Today that kind of gift wouldn't even get declared, let alone be considered a threat to the national interest. I bring this up because to me it demonstrates how far the current culture has shifted.
      I remember reading in a biography of the marquis de Lafayette, when he visited America in later life, long after the revolution, he stayed with old friends, and in one case John Quincy Adams, future president and then secretary of state, slept on a cot on his floor to give the marquis the bed. I cannot think of a president of the 20th or 21st century who would have done the same - or even needed to, for lack of guest bedrooms.
      I cannot help but feel that as the great wealth of the American continent has been shared disproportionately amongst it's people that their values and morals have declined in proportion.

      I don't think there have been any twists changing any directions. It's more like a series where, as you say, the ending is heavily foreshadowed and you keep thinking: "How long are the writers going to stall this out to milk people for cash before the one thing happens we all know should happen."
      The series is full of slow footage of a bullet train crashing into a wall, and there's always another cart. Then they fill some episodes with backstories into characters you think would definitely know by now that the train is crashing but they don't freaking get off the train! You want to see the train wreck, but not most of the characters.
      The conductor of the train is in charge of this demon train and you want this person brought to justice, but he keeps running to the back of the train always on time. So you just hope this fat orange trips or that others get the message and GET OFF THE TRAIN, but everyone is just sitting there speechless. "This isn't happening."
      At this point you're thinking: "If they're all this dumb, maybe they should all just crash!"

      They might still do the right thing, because a president having immunity over things like inciting insurrection removes a lot of power from the judicial branch of government. By allowing it, they basically give permission for whoever is president to ignore them in future.

    Hey @LegalEagle, I've recently been binging your videos and ones like these has me thinking about the US justice system.
    Particularly, could you link us to (or make yourself) a video about the background for why (some?) US judges are appointed by the president. As a outside (non-US) viewer and a legal layperson, it seems to me that any appointment of a judge, and especially those in the supreme court, by any person in government, and especially those with higher power, could be a massive source for corruption.
    In many western countries, traditionally the pillars of power within a nation are kept separate specifically so the people with political power cannot gain a personal benefit in the legal system, and similarly for those enforcing that legal system and/or enforcing the political system.

      Honestly? I think it might be. Yes, this Supreme Court is stacked with judges appointed during the Trump presidency, but remember that's the entire reason the GOP originally was willing to back him - they wanted to get those judges stacked in their favour to repeal Roe v Wade. They've repealed Roe v Wade. They've got the judges they all wanted installed. And they've also seen what hitching their wagons to Trump cost them. They've seen how Trump cares more about loyalty to himself than loyalty to the party. Do you genuinely believe those supreme court judges have ANY sense of loyalty to him?

    I realize that attorneys are supposed to be zealous advocates for their clients, but so many of the arguments I am hearing the Trump attorneys make are absolutely ridiculous, and I thought attorneys were supposed to also operate in good faith.       Most good attorneys expect their clients to listen to them. If they say "don't talk to the press," then you don't talk to the press. Trump does whatever wants. More limiting.
      Most good attorneys don't want to engage in criminal acts. Many of Trump's former attorneys have landed in legal hot water.
      Finally, most good attorneys care about their reputation and making the kind of arguments that Trump insists get made can shred your reputation.
      So the list of attorneys willing to work with Trump is tiny. The amount of them who are actually decent is even smaller. Thus, we get "Jack Smith The Grinch" legal filings or "Oops, I Forgot The Jury Trial Checkbox."

    The US must understand immunity very different to the rest of the world. Immunity is not a pardon. It’s gone the moment you stop having the position, or are stripped of it. Either way it doesn’t afterwards protect you from prosecution for crimes committed, only during. It is to protect the office from being disrupted in doing its duty, not to protect the person from consequences, once the office has been handed to someone else.

    I definitely approve of your new LegalEagle Files graphic presentation style. Seeing the called-out passage appear as clear text alongside the actual document page, while Devan speaks the text, is much more satisfying than the yellow highlighter or the handwritten sheet of legal paper. Personally, I found the noise associated with the highlighting to be distracting and irritating. This looks much more professional. Kudos

    They keep saying “let the people decide”, but we already spoke loud and clear in November 2020. So it’s come down to this: does the supreme court give a madman the authority to ignore the rule of law and potentially become a dictator?
    Would you rather find out in the coming weeks or would you rather just tune in a year from now to see the aftermath?

    I know Trumpers love Trump, but do you really want to live in a world where the president "can do anything" without fear of any criminal prosecution? Sounds like a god awful country considering you aren't always going to have your guy in charge.
