      The higher the level of wealth or power, the stricter and less lenient the scrutiny. As far as I'm concerned, if you're in national office and break the law, it should be presumption of guilt with you suffering immediate and maximum penalties. The most powerful should be the least free simply because there is too much risk of them misusing their power.

      He's being targeted on purpose he isn't controllable he runs his mouth too much and he's clearly not innocent entirely either but he never really said he was rather he just enjoys the same benefits systems etc everyone else uses and they don't like that.
      It's politically motivated either way..
      Now if only we did the same to litterally every other politician in office..

    White collar crime is hilarious. These days a kid could steal a candy bar from the store and end up face down on the ground in cuffs if not tased or shot for “not complying” but this monkey can literally immediately disregard court orders and get a stern “ Hey, don’t do dat” with a fine amount that he probably has in his pocket right now. What a joke.

      its practical, if the judge is lenient with trump it gives him less room to appeal the decision if he loses, and would actually cause trump to open himself to more legal risk if he attmpted to do so

      On the surface, it doesn't look like Trump is getting much punishment, but below that, it's really all just a waiting game. The easy bit is knowing that Trump is in the wrong. The hard bit is building a solid precedence (not evidence) for someone like him, that would ensure he truly doesn't get away. Look at it this way, by being lenient, it makes it easier for Trump to dig himself a grave, and harder to appeal due to bias/unfair treatment. A lot of the "Trump trials", are also new unprecedented grounds (e.g. no ex-president has ever been under trial for an attempted coup), one wrong move can easily kill someone.

    Any crime punished purely by fine should either have the fine be proportional to the person's net worth... or, once they pass a certain threshold, should just move into jail time instead.
    Because "legal for a price" just means it is only a punishment for poor people.

      Dayfines like several countries have, are great.
      A person is given X dayfines as the punnishment, the size of a dayfine is defined by the finances of the person.

They should break the person's financial confidentiality and fine X % amount of total $ in assets in their tax files or whatever is recorded in the system. But then again the tax system seems extremely effective when it comes to poor people, some powerful people could still work their way out of that ... I'm pretty sure their tax returns or any financial information tied specifically to their individual (and not sketchy holdings and companies) doesn't reflect their actual wealth.

      ​@@declaniii6324most of the trials he's on are old things, from before or during his govern (or trials about his leaving as the one of Marolago). They were in hold because you cant put the President on a civil trial and would happen the instant he's out of the White House.
      Saying that he is being "in trial during campaign" reverse the order of things, making it seem like Trump anounced his campaign first and them they sued him (what would make his claims of political conspiracy stronger if that was the case).
      Trump knew beforehand he would be in trial and choose to make a campaign anyway, not the other way around.

    I feel like if I violated a gag order multiple times I'd just be in jail. Strongly doubt normal citizens would get so much special treatment. This whole thing is a joke.

      If their goal is to make the court system look weak and ineffectual, they're doing an A+ job. Some RUclips lawyers used to talk about how scary being disrespectful to judges is, I just imagine how emboldened all future criminals will be from the example they're making of Trump with their lame responses.

      100%. The courts are materially assisting trump in his political campaign and fundraising efforts by stating a gag order and then staying it, or minimally fining him rather than applying the order like they would to a regular person who got on tiktok to talk about their case in a similar way.

      Your last sentence is EXACTLY why it is EXTREMELY important to know a candidate's goals/intent for the position they are running PRIOR TO VOTING FOR THEM.
      We the People, while lacking critical thought, voted in the people who passed laws which currently grant special treatment to the self admitted criminal. The public not being educated as deemed mandatory under a yet to be enforced federal law is the actual joke. The system works when the internal gears are not metaphorically rusty.
      Until we enforce the aforementioned federal law, we can not expect to fix that which is seriously broken.

      I really wish judges would be far less willing to set this precedent that somehow running for President grants you special privileges when this man has been campaigning for 8 years straight at this point, including while he was President. These decisions are basically just writing the worst person in the country a blank check to misbehave in court.

      @@MaryReese-oy8is Yes, and it was LegalEagle who also mentioned that that same judge had that idea beforehand because of how it makes it a different case, but also told T***p's lawyers what the possibilities are to NOT have that type of a trial, what paperwork had to be filed for this, and what the time limit was for that, and they messed it up... They simply messed filing paperwork in time up, because they didn't understand the type of trial requested and the documents required to request a different type.
      This is on the lawyers of T***p, and given how he can now rally around that specific point, you would almost be able to say that it would be deliberate so he can target the whole process because T***p's followers believe without any doubt anything he says, but given how many lawyers are doing superdumb things you should know you should not do as a lawyer, we need to take the fact into account that they are just stupid and literally didn't know what they were doing, or what possibilities they had.
      This is on the lawyers of T***p, not on the judge, who basically laid out to them: "This is how you can avoid that" and they simply didn't.

      @@MaryReese-oy8is The judge did not "demand" a bench trial. The plantiff filed requesting a bench trial, and the defendant never filed anything requesting otherwise. Since their request was unopposed, the plantiff's request was granted.
      The defendant could have filed the request at any time.

    His defense keeps pointing out that he's running for president to keep him from being gagged. Why is a guy who has 90+ cases against him in the court even allowed to run for president?

      The more things that restrict the presidency, the more methods a political institution would have to play a dirty game. If being charged with a crime stopped you from running for president, there could be a future where political parties in power used their criminal investigation arm to prevent their key opponent from running fairly-the exact argument currently being used by the Trump team as a smokescreen for why he's being accused. It of course feels crazy in this circumstance because of how obvious and numerous his crimes are, but by principle it should be a tightrope to walk in giving accusations (or criminal charges) a limited power to interfere with people.
      Convictions, on the other hand, are used as a standard to limit privileges and rights. And currently, there's nothing that stops anyone who was criminally convicted (or even still incarcerated!) from holding the office of the President.

      Even if he makes it that far it probably won't be Biden he has to compete with. I'm sure dems want to replace him with a more competent candidate. His entire job was just to get Trump out of there and lets be real it doesn't matter who it was anyone would win when they were running against Trump (unless you're Hillary (but even then she probably would have won if people got a free sample of his policies first))

      It would be interesting if someone tried to make it so that people in public office or running for it would be subject to the harsher limits that the Gentile ruling seemed to require lawyers to follow. It would make sense, it feels like a perversion of the first amendment that it is being used by people in power to lie and abuse people.

    A candidate for POTUS should be held to a higher standard, not the opposite which seems to be the case here. "oh you're running for president, well go right ahead and baselessly make accusations against everyone that holds you to account". This isn't core political speech, this is targeted harassment.

      While I want to agree I think that's what trump wants. It would probably help his campaign since it would "proof" that they are out to get him and make him look like a martyr in the eyes of his followers. To really hurt him they should set the fines based on his reported net worth.

      So true. Many of the wounds are self-inflicted. Had he returned the classified documents, even though they were not his, there would have been no charge of obstruction. Had he limited his verbal attacks and just said that the trials were politically motivated and a witch hunt, even though that is a lie, instead of threatening judges and witnesses, there would be no gag order. And the list goes on and on. Basically, all the judges ask of him is to show a minimum of respect for the justice system and obviously he is incapable of doing that.

      The republicans in recent history have often been the ones slinging mud, trying to win by tearing their opponents down as much as promoting themselves. Trump was all smoke and mirrors with regard to his own policies and value, but gained popularity with the right because of how much dirt he was throwing at everyone else in the primaries. Hillary was an easy target in my opinion,. She had already been publicly smeared and labeled by the right-wing conspiracy nuts with all kinds of insane theories, and that's why Trump was able to win the first time around.

      When I was in law school, a guy in my class bragged to everyone how he was taking a case to the supreme court that would set a precedent we would all be studying for years to come. It took a couple years for his hearing and I lost contact with him after the first year, but eventually I did remember and looked it up. He lost his case, horribly, and his case was indeed used as a precedent - as a reason why his argument doesn't work lol.

    If he was anyone else, he'd already be locked up for contempt of court. Saying witnesses, the judge, court staff are traitors, and implying they deserve death is pretty damn contemptuous. He is totally hoping one his supporters will be inspired to use violence. If any of us said the things he had about the court, there is no doubt we would be imprisoned. He has been shown a great deal of leniency thus far, but hopefully he will actually face some consequences soon... but I doubt it.

      If you watch devin making the tier list, you will probably know that the best lawyer simply refuse represent him because what he asked indirectly put them on jeopardy. Most of the A lister that Devin mentioned was getting that simply because they DIDN'T talk to the media rather than because they had done good lawyering.
      Even the best one who tried to cooperate and send every classified document from mar-a-lago was allegedly being carefully persuaded to leave some, and actually done not so thorough check when they actually turned the docs resulting a raid to fully extract all the top secret documents.

      I think the worry is the riots that might take innocent lives if Trump supporters see Trump in jail. It shouldn’t be but it’s a tricky situation because we don’t want lives to be lost but have to hold him accountable for his crimes, so to avoid loss of lives, they’re gonna have to be pretty crafty about things

    I'd like the judge to get a list of all the people he's mentioned. Then have Trump's attorneys explain, separately for each person, how they're relevant to Trump campaigning for President and why Trump needs to discuss or insult them. Or even expand it to everyone involved with the trial.

      I think the judge should get a list of all his public statements in violation of the gag orders. Then have the prosecution explain how each statement intimidates a witness or biases the jury.
      The burden of proof should be on the guy who wants to restrict freedom of speech, not on the guy defending it.

      We know what a gag order is, do you know what a threat is? You guys heard "insurrection" in his Jan 6th speech when he clearly point blank said the opposite. I hear all the time that Trump threatened this person and that person but nobody can say what that threat was. Take the court clerk, what did he say about her on X that initiated a gag order? I notice also that a lot of Trump haters say that anyone else would already be in prison but what you don't seem to realize is most people would have never been charged in the first place. You don't think it's odd that all of these people loved Trump until he beat Hillary, before then you didn't hear story after story of him being charged. The NY fraud case is insane, they are using a law still on the books from 1956 where the AG can just dig into a corporation without anyone making a complaint. She dug for 2 yrs and found this instance of "fraud" where he exaggerated his assets to the bank for a loan, banks don't approve a loan based on what you tell them but even if they did, he paid back the loan and the bank made out great, there is literally no victim in this case. This law that the AG is using works great for her, she does not have to prove that he did it on purpose and it doesn't matter if anyone was financially hurt, they use it in special high profile cases like Exon, USB, JUUL, it's basically a slam dunk for the AG and since she campaigned on "getting Trump" I guess it's good they had this secret weapon tucked away, oh and they don't have to give him a jury either, if it was anyone but him would you be cheering this on? The Georgia case is not much better, they arrested his lawyers so they could use them against him, I honestly don't know a whole lot about the law, I spent a while reading about the NY one to understand it, I have not read a lot about the Georgia case but I do know one basic right we have that might be down the toilet after this, Attorney Client Privilege, So far 3 have pled guilty and part of their pleas requires them to testify in future trials so how can they abide by attorney client privilege. Idk, I was not always a Trump fan, mainly because his tweeting and the way he says things made me so mad but I saw a lot of hypocrisy with the Dems so I decided to look into things more and Trump really did a lot of good things for us, more than any other president in my life. He's not a politician so he doesn't act or talk like one. Anyway, didn't mean to go on this long LOL, I just feel like whether you love or hate Trump these legal proceedings are not in line with our justice system, a few legal professionals have said that. I whole heartedly believe if he had decided not to run in 2024 he wouldn't have any of these charges.

Also, AFAIK about all countries have some legislation that criminalizes intruding on governmental facilities in order to disturb the rightful undergoing of governmental procedures. It would be like allowing a burglar that brutalized a senior citizen in the victim's home just because he cleaned his shoes on the doormat in order to not dirty the floor.

    At what points does he actually start to suffer consequences for his behaviour? What is the point of these gag orders if they don't enforce them. When he breaks them he should be held in jail to force his compliance. If he isn't, then they don't mean anything.

    If im being honest i think it would be nice if politicians were barred from slamming opponents and instead try to rally people on what they will try to accomplish and how.
    Instead of what we have now. It would require them not to rely on emotion and instead the substance of their platforms.

      Neither would any politician, car salesman, lawyer, government official, or just about anyone for that matter. Sadly, I don’t think I would like a world where I couldn’t let a child believe in Christmas, the tooth fairy, the Easter bunny, or their dreams. We may not be bothered by it much, but the children wouldn’t get to be kids anymore. Sounds like a sad world to me.

      @@larrywalsh9939 Well, to each their own I guess. Personally, I liked that our parents lied to us and allowed us to be a children and not know about how much they sacrificed at the time just to make sure we were happy, healthy, and learning. They kept the adult stuff to them and let us be kids. They told us about things as we got older and were able to comprehend it all. It gave me a lot more respect for them when I got older, but everyone has a different method I guess. Personally, I have never seen the “not lying to them” method work, but maybe it does. 🤷‍♂️ Good luck to the ones who do try and attempt it.

      There is a difference between a white lie to a child who doesn’t have the mental capacity to understand certain things properly, I am on the autism spectrum and my parents never told me that our long time dog was put down instead of givin to a family that could afford her medical conditions. I respect the decision at the end of the day. But there is a difference between white lies and lying for personal reasons. It’s all about finding a proper balance.

      "making lying illegal" would be a very bad idea, because it would mean that every statement of any sort would be subject to a level of arduous and expensive scrutiny which currently applies only to select things like statements before a court, or statements which harm someone's reputation enough to substantially affect them. It would also be impossible to enforce on any matter of legitimate controversy, such as theological claims, and even if you did the result would be having to imprison most of the population. I do think there should be a few more carveouts, especially for punishing people who spread lies by abusing a position of power or amplify their dishonest message through immense resources, but there is a good reason why the first amendment exists and protects lying by default.
