  • In 2016 an African American student from Oberlin College in Ohio, trying to use a fake ID to buy wine, was taken into custody by police. The arrest prompted demonstrations that accused the store's owners of being racist. And while the student plead guilty, the store's owners sued Oberlin - claiming the college's support for the student protesters caused reputational damage - and were awarded $31.5 million. Senior contributor Ted Koppel examines the case, which poses a perhaps unanswerable question: What is the fair price for a family's good name?

      Reputation is not everything, and in order for it to have meaning it must be supported by the characteristics identified with that reputation.
      Bill Cosby had a reputation of being America's dad, and a worthy inspiration of proper, respectful behavior. Reputations do not always reflect reality, and in cases like Cosby's end up protecting the most irreputable kinds of behavior instead.

      Andrea Carrizal. The bible teaches us that we are not to worry about what others think or say about us.
      There have been many incidences in this earthly life where certain people's reputation have been exalted to hero status only to learn later or even after their death they were not who we initially thought them to be, infact the exact opposite.
      Therefore, we are to go about our business quietly and respectfully and keep our eyes fixed on Jesus.
      We are not to be consumed by our reputation or indeed what our legacy will be but to trust unto the Lord.

      @@bronxbearbud272 You are confused in your definition. Ever heard of the expression "Your reputation precedes you?" There's a basis for one's reputation that other people have seen. You cannot just say somebody is KIND if that person looks mean, talks mean, acts like meanness is their middle name.Good reputation cannot just be sullied by somebody twisting and slanting facts for their own purpose.

      @@iceblue1457 the subject of reputation is a worthy one and deserves a more specific definition if it is to be used in a discussion of its merits and shortcomings. If we define reputation as a positively ascribed characteristic to someone based upon our positive judgment of that individuals beliefs and behaviors. To make such proper moral, intellectual and spiritual judgment it's a demanding task to say the least, and is very often that beyond our grasp.
      Nevertheless, we use search incomplete, deliberately biased kinds of values which can be arbitrary, subjective and very questionable and is hardly the objective standard of value by which a reputation may be absolutely and properly claimed

    Racial profiling only applies to innocent people of color who are accused of a crime they did not commit. Not people of color who are actually guilty of the crime there's a difference.

      The school helped in the defamation and stopped using the bakery for business. That is the essence of a defamation lawsuit.

      Tadzio5050 College reps and the owners of the bakery did come together and talk. Gibsons asked Oberlin for a public apology and admit they were wrong about the Gibsons being racist, but Oberlin wouldn’t, and continued to bully Gibsons, which is what led to the lawsuit.

      @D. Steven When the students were protesting across the street, it was very clear the students were pushing the race issue when there is none. And the President had to side with the students because they have the same color. Makes us wonder what do they teach in that school about racial tolerance.

      @@motorcityquig I think it is 5% but the amount comes to about $4300/day (including weekends) on the current judgement. I am guessing that it will be raised or lowed depending on the results of the appeal and the counter appeal of the 3X punitive judgement being reduced to 2X.

      The antithesis of "political correctness" however - the evidence more than supports that it is no less problematic in disseminating false narratives (i.e. outright lies) than has been charged as the impact of suppressing blunt speech. What is just as real is the fact that so-called "frankness" and "candor" is unjustifiably attributed with representing truth telling, which is not an empirical absolute. Besides...Bill Maher is not necessarily someone I'm inclined to designate as being the Seer of all Seers.

    The Oberlin president was asked about the racist charges concerning the Gibson's store. She talked of alleged previous incidents. She was asked to give specific examples (9:56) and was then decidedly _not_ specific in her vague reply. The problem with the lawsuit is that it could have an effect on what is protected free speech. Will I have the right to gather a group of people that protests Jane Pauley or will that be the result of a lawsuit? Also, when looking at the misguided and what is in effect a racist protest in front of Gibson's store, the other side of that same coin is the white employer who doesn't hire a black person based on some racist perspective. Lesson is: go by only what you know to be true of that individual. In some cases that may mean putting away your bias.

      The Oberlin College president could not give a clear, candid answer to very simple questions. If that were an internal investigation by the US Government, she probably would've been fired for lack of candor just like corrupt former FBI Deputy Director Andrew McCabe.

      If I' may very deliberately use an incendiary phrase from a happily bygone era, a phrase which nevertheless continues to portray the characteristics of such behavior, this woman simply "shuck and jived" her way out of answering the questions, and nobody knows it better than she does herself, even as she struggles to present herself as being worthy of the reputation she claims.     When asked to cite the specific incidents that you said had slowing fostered an environment surrounding the Bakery that spurred on the vocal and sustained protests against this local bakery, her reply to the challenge, in which Kopel asked her to be "specific" , "what specific issues are you referring to"? Her response? "Well I think the specific incidents would be the perception among faculty, students, and staff that there had been disparate treatment in the bakery. And many students felt uncomfortable in the bakery".
    Seriously? She can't cite even one incident of wrongdoing by the Bakery.

    The college president was stupid for granting this interview and this is especially true with the pendency of litigation. She totally undermined the defendants' position via that single interview. All questions should have been fielded by the General Counsel of Oberlin College or the contracted law firms providing legal services to the school.

      jpodell007 The General Council released a statement to alumni right before punitive damages were awarded that basically insulted the jurors for not taking their side, which resulted in the jury awarding the full punitive damages. So Oberlin’s General Council doesn’t know how to handle PR, either.

    I lived near Oberlin for six years and visited at least twice weekly and have shopped at this store. What a great owner and family. This is simply a bunch of disorganized students with nothing to do....have you ever been in the area?

    The president comes off very badly here, trying to confuse the issues in a lawyerly way, but doing it very clumsily.
    It is a mystery why the college keeps this alive instead of apologising, throwing Raimondo under the bus, and settling. They are clearly in the wrong and this ongoing story only damages their own reputation and brand.

    Definitely a case of emotional overreaction before everyone understood the facts of the matter. If the young man was indeed guilty of shoplifting, and the evidence seems clear, then these kids should have been gathered by the college to explain the facts of the matter, and that protesting with false information will only lessen the punch of the protesting and make future such shows only exercises in futility. Save the power for when it is needed and stop wasting their time and effort.

      the bakery in colorado appealed to the supreme court... so it's not unheard of. The kid lied and essentially caused the issue. Have businesses been accurately accused of bias. Yes, they have. The school was caught in a no win situation and the student who lied put them into that position.

      @@TheRawBabe If you kicked every kid who broke the law out of college, they'd all shut down. Remember, you'd have to expel every underage drinker, jaywalkers, pot smoker and illegal parker.
      It would be far more constructive and educational to make them face the legal and life consequences for what they do; including the shoplifter, the protesters who libled and slandered the Gibsons and the administrators who supported them . Personally, I'd like to start with the 3 young women at the front of the protest. I wonder how they'd feel about being doxxed like they basically did to the bakery and possibly the 93-year-old Mr. Gibson.

    These students went off not knowing what happened all they wanted to do is scream racial profiling and destroy these people's lives. And this school went right along and supported the students 100 percent. They need to pay. The Dean that is there now doesn't know a damn thing of what she's talking about.

    Previously working at a retail store, I stopped a brazen shoplifter loading up a shopping cart up to over $1000 worth of items. Then trying to run out of the store. I out-ran her at the door and stopped her at the door with my outstretched arm. That was all that was needed to stop her. I'll let you guess her race.

    I spent 14 years on hemo-dialysis and learned how many people walking around were on dialysis. I guarantee that you pass someone each day (on foot or behind a wheel) with something like cancer or dialysis and not even know it. Always remember to respect strangers because they could be suffering. No matter the age. Like the gentleman here with cancer. And be careful not to assume.

    We visited Oberlin a couple years ago when my daughter was looking at colleges. Without realizing it, we walked into Gibsons and bought some food. I'd heard something about the incident and when I realized this was the store, I was especially happy that we'd chosen to buy from them.
    Even my daughter, who's really, really liberal, thought the Oberlin campus was much too PC. I believe we heard there were protests about serving sushi or Mexican foods in the cafeteria because that was cultural appropriation.

      @@waynethepoet88 Hate is a little strong but there are a few reasons to be disquieted about the way this story was told. The lack of journalistic objectivity is pretty disturbing. Old white guy reporter falls in love with old white guy bakery owner and advocates for his position throughout the story. B. How in the name of sliced bread can you be a journalist and only include 3 sec about free speech. C. Penn State got penalized by the NCAA for 60 mill. and that was for the rape and sexual assault of children. Kinda puts the verdict here into perspective. 4. What was the misidentification in the arrests? Reporter didn't bother with that but then again it's just another black kid and you've got bakery owner and his family to bond with. One of the worst stories I've seen Sunday Morning do in a while. Objectivity would have made the whole thing more compelling.

I feel more for him than I do the young man who got arrested for Committing a crime. And in these cases, as a black man, it’s usually the opposite.       You know, from the first time I saw that story, I never thought that boy was the aggressor. People kept talking about the smirk on his face. I didn't see his expression as a smirk, but rather as the uncomfortable look teenaged boys get when they have no clue what they should do. He was even flushed.
      Raising 3 boys gave me some experience with that look. Considerably more than Kathy Griffin, for one.

Still waiting to see what the Washington Post and the other defendants decide to do. I hope they go to discovery. Oberlin was foolish to let it ever go there. Now that their internal workings are public record, it will never be the same for them again.

    How many racist incidents have been reported over 100 years?
    How many incidents have underage kids/college students tried to buy alcohol or steal alcohol over the years?
    Its possible that the person working could have had a bad day or may be fighting cancer, therefore maybe didn't smile or be jolly the day you went in to the store. Why wait till this issue to then comment, why didn't they comment when it happened to them.
    Why support a protest where a student was breaking the law?

    i have friends who live in hillsdale, michigan and we made it a point to visit gibson's and give them our business. i also wear their gibson cap because i want to let others know i supported them.
    it's scary how an institution such as oberlin has so much influence and appeal to our young people. hope things get better before we need another revolution.

    I agree with the conclusion of the story. Oberlin should not have paid for food, gloves, etc. And because they did, they are on the hook.
    That said, I felt the reporting was stilted. I didn't feel that the "possibly-related" neck injury (yes, very sad) or pancreatic cancer (also sad) were not directly relevant to the story of the protest.

    This issue of “racist history” is separate from the initial law enforcement stop. What was seen was “mob justice “ with SNAP judgement and demand for “punishment” based upon (very) limited information and the current (corrective/restitution) atmosphere.
    This lawsuit seems to be about consequences - of jumping to conclusions with limited facts
