PIP Assessment Decision - Why I'm Appealing And Making A Complaint

  • I've recently applied for PIP - Personal Independence Payment and had a face-to-face assessment. This week, I received the PIP decision letter, along with the assessor's written notes which I requested. People have warned me to expect to not be awarded correctly or to be turned down and need to appeal, but what I was not prepared for, was the contents of the assessor's report. I will be appealing and making an official complaint. Watch this space!

Haven’t watched yet, but don’t be discouraged! My first ever PIP assessment I got 0 points for anything, 0 at mandatory reconsideration, and then 20 points at tribunal. 80% of tribunals are successful - PIP are notorious for denying people benefits for no reason. They take mine away at every reassessment and I always have to go to tribunal to get it back. Hope it all goes well. ❤️

Please don't worry, this is sadly a normal occurance for people with invisible disabilities that vary day to day, such as M.E, Fibromyalgia and other similar conditions. I read somewhere that 70% of people who apply for PIP are denied first time, and that 90% of appeals ARE successful. So just hold tight and appeal it, I'm sure you'll get it! I'm currently applying for PIP myself and have been finding it so stressful I've been having panic attacks almost daily just from feeling so triggered by trying to complete the questions, its crazy 😂😢. Wishing you all the best and anyone else who's applying for PIP! We got this xx

Bless your heart. I hear you. I had to ask for 2 extensions for the form as l just kept crashing from trying to complete it. Here we are trying to stay on an even keel with our health and the benefits trying to help us are making us worse!
The people assessing need to be properly trained or at least understand the conditions they are assessing. Mine was a physiotherapist! How can he assess properly for mental health and a neurological condition!?!
And with invisible illness, that's the key word isn't it? His argument hinges on the fact that I didn't look tired or anxious! Ffs!
I am so exhausted fr all this, I just want it over! But I'm not giving in, I've started the MR. If that fails I'll be appealing and there will be a massive letter of complaint!
Good luck to you, keep on at it, we will both get what we need and deserve 💜

@@FinnTheInfinncible Thanks for sharing your experience, it makes me feel so much less stressed about mine! I agree, the people assessing are not adequately trained to understand or even show compassion for people with conditions like ours (I have M.E and fibromyalgia). It sucks when you're this ill having to go through such a dehumanising process just to get the benefits we need and are entitled to... Do they have any idea what it's like to not be able to work fulltime and yet have loads of extra medical costs to somehow pay for??
The PIP assessor lied on my form too, the first time i applied, nearly 10yrs ago. I felt so defeated and anxious about it that I just could t face appealing, and instead put off reapplying for 10yrs, hoping my illness would go away, until now, after multiple bouts of therapy, I finally accept my identity as a disabled person and feel strong enough to apply for it again. AT the Newcastle upon Tyne St James Gate PIP assessment office they have a whiteboard in the canteen set out as a league table depicting the leading assessor for DECLINING claims. Some of the worst assessors who often lead the board are those who themselves have a disability their attitude is "If I can work, so can they" According to one assessor there, "We ARE encouraged to decline as many applications as possible EVEN those we can clearly see SHOULD get the award". "This is to see how many bother to pursue their claim further". "What GALLS me the most is that if you state you have a drink and or drug dependency you GET the FULL maximum award AUTOMATICALLY plus a SPECIAL payment to assist them with seeking treatment BUT there is NO follow up to see if this SPECIAL payment is in fact used for the purpose it is issued for" The comments ARE real actual quotes by an assessor

    • @jamesdelrey5802
      @jamesdelrey5802 Год назад

I’ve read through many of these comments and completely sympathise with their bad experiences. However these kind of comments are completely untrue. The DWP have a high expectation of our company in terms of completing accurate evidence based reports. I have worked in several PIP offices and there is no such thing and most offices looks exactly the same in layout. Why would have a leaderboard of declining claims? What would the purpose of that be seriously? We’re all healthcare professionals at the end of the day and try to do things in the best interests of the claimants, I personally used to be a nurse and would like to think I am a caring person, so why would we be happy at causing disappointment and misery by declining claims?
I understand people are upset by decisions they were not wanting and they have absolutely every right to appeal. But demonising healthcare professionals that do the role will not achieve anything when all we’re doing is trying out best. To end this comment with a real life example of how our company really is, I’ve actually been disciplined for under scoring someone and declining them PIP. That’s right . Under scoring. Not over scoring.
That was because at the time of my lack of experience, not because I did it on my purpose. So please do not think all assessors are evil and in a competition to decline people pip for either component. The company rewards employees only for good grades for reports when audited, which are graded based on the evidence only. Not opinion. If the overall evidence doesn’t support your claim , as much as I’d like to award you points, I can’t, as I wouldn’t be doing my job. If people think the rules are unfair, the DWP set the guidelines , and without getting political is governed by the tories. So maybe consider that at the next election 😅 anyway rant over

I’m so sorry this happened to you. I’m in the U.S., and my wife is totally disabled from a rare birth defect caused by her father’s exposure to Agent Orange in Vietnam. She worked as an ICU RN for 25 years before it got to be too much for her. When she applied for disability, she was turned down twice, and then had to go before an Administrative Law Judge to decide her case. After a 30-day decision period, he awarded her disability benefits to her. It took exactly 3 years from first application to final decision. Here, if your case is decided in your favor, you get retroactive benefits to the date of 1st application. In her case, it came to over $50,000 in back benefits. Then, the Social Security Administration did not pay that out for over 6 months. They only did after that point because we contacted our U.S. Senator, and his office inquired about it. It was deposited 2 days later. It’s appalling that it takes so long for people to get the benefits they have earned. Give them hell, and I know you won’t back down. The person who wrote the report on you should be fired, full stop. Take care, and know that we all are sending you and Chris so much love and support!

I got 0 points at my assessment, even though i have multiple ailments. I requested my report and i was mad. The woman was a Paramedic who performed my assessment. Quite a few lies on it. At the end she did state that my condition will only get worst and would recommend a light Touch review in future. Got no where with the mandatory reconsideration. I think my downfall was the fact that i filled in the form myself. Now, due to my diagnosed depression which was diagnosed at 18, I'm now 59, i just couldn't deal with the thought of appealing. You have a month to appeal. By the way i was on DLA, indefinitely for years with hardly any reviews. Quite a few months passed and i thought i can't go on like this, i lost my DLA, which was a big help, as im a Celiac and Gluten free food is very expensive. I also lost money from my Esa, because i was not getting DLA anymore. So i rang my local independent advice service who helped me put in a late appeal. DWP excepted it. ( was do's that tell you ) My advisor was great. My evidence was submitted to tribunal. I had Xray results confirming arthritis in my neck ( Cervical Radicalopathy it's called ), Xray results confirming Bilateral arthritis in sacroiliac joints, endoscopy results confirming Celiac disease, Mri results confirming Tinnitus in both ears, underactive thyroid, and diagnosed depression and anxiety. I waited 12 months for appeal. A representative from the Law Centre represented with me. I cried all throughout the appeal as i have anxiety, the panel was lovely even the Judge, they could see i had problems on the day. My neck was bad which can effect my arms, I couldn't even pull the chair out as my left arm was weak the representative had to do it. I waited 20 minutes for my outcome and i won. On my award letter it stated that i have multiple health issues and substantially limited. I got standard daily and Mobility. My award was for 4 years and I received £7000 in back pay. No DWP REP attended the tribunal. I have just filled in my award review which thank God is a much shorter form then the actual claim form. It was sent in July. One year before my award ends which was extended to May 2023 due to covid backlog. I'm still waiting for my decision. I will not hesitate to appeal again if it do's not go in my favour. A lot of people on these benefit forums are getting 0 points, then getting the points they should of got at appeal. I think this is the norm. They think people will be to stressed to take it to appeal. If you believe that your entitled to PIP, go for it. Good 🤞 luck.

I would like to start out by saying I am not transgender, so I can’t say I understand completely how you feel. However, that is so disgusting that a professional would do that! 😮. Regardless of belief systems, if you’re in a position of power you should be remaining professional and leave your beliefs at the door!
On the benefits note, I have been fighting with the system for around 15 years. I suffer from fibromyalgia amongst other things and I’ve been awarded and denied repeatedly over the years. The condition I have is getting worse and I imagine I will remain fighting the system for years to come. I have recently been awarded both pip and universal credit with limited capability and work related activities.
All I can say is even though this process affects both physical and mental health, please stay strong and keep fighting! ❤❤❤

Yeah, it's pretty bad here in the states too. It can take up to 3 appeals to finally be awarded disability benefits and even then some people have to go to court to actually receive the benefits they've paid into their whole working life. And things are different if you're born disabled or become disabled later in life. I was born disabled so my parents had to deal with Social Security's nonsense. I'm more familiar with the things my dad went through to get his disability benefits. He had so many assesments and meetings with his caseworker, it was insane. I can't remember exactly, but I think it took the 3 appeals to get his benefits. The man has a laundry list of impairments, the most impactful is his dementia caused by a traumatic brain injury. There really needs to be an overhaul of how the system works. Right now it just feels like they want to discourage people so they stop wanting to try. My dad struggles with depression caused by his bipolar disorder and he was already having an extremely hard time coping with his new life, and having to fight for his benefits didn't help things at all.
Ugh, the misgendering is so aggravating. I had a hell of a time getting my insurance card to actually say male on it. Social Security had no problem changing my name on my Social Security card and my Medicare card, but it took me 3 different times going and talking to then before my Medicare card finally showed the right gender.
Hugs! I hope they get there heads out of their butts without too much more of a fight.

I feel this SO MUCH. You have probably gotten this type comment already, but I live in the US, and I applied for Social Security Disability here which sounds like a very similar system to what you deal with on your side of the world as it were . I applied in early March of 2020 right before the pandemic really started to speed up here... and only a FEW DAYS AGO they returned my appeal on my 4th denial and at some point I will be going back to court. In my assessment with the appointed therapist/social worker or whatever (he didn't wear a mask and kept insinuating that I remove mine in the height of the COVID pandemic) wouldn't let me talk about any of my disorders other than depression (which I don't have depression, I have persistent depressive disorder which is a different kind of beast) and when I read my assessment I was exclusively misgendered and deadnamed. He also lied about nearly everything I said, omitted 75% which was all relevant to the claim. In the US they always suggest getting an attorney, and I did, but even still I am fighting it to this day and I have a feeling the appeal court date won't be until either the very end of this year if not later next year. Sounds like regardless of where you are getting services is a pain in the ass. At least we aren't alone in the struggle, even in a way different time zone!

Oh Finn, I am so so sorry that you had to go through all this. There really does seem to be a prejudice against people who genuinely do need the assistance of benefits. I had a similar situation happen when I lost my job due to the pandemic and had to apply for benefits. I had an 8 month old and no income and they really do make you feel like the absolute worst thing. Less than human. And when you're in a situation where you're already so vulnerable and lost, for someone in a "position of power" to abuse that is purely disgusting.
It is NO part of that assessors job to have an opinion on your gender. I really do think that to colour and taint the help you are ENTITLED to with his own personal prejudices should be something that he should lose his job over. At this point, it is beyond inexcusable. But, i'm glad you have the lovely Furr Furr beside you to help fight this. Not everyone is a waste of human skin like the person you had. If you want to complain about the way you were assessed, you can do that a any tme. If you disagree with the points you were awarded, you can submit a mandatory reconsderation notice, but it is best to wait until you get the decision letter to do this, then you know what you are arguing against and you can build up a case accordingly. Hello Finn, I'm really sorry that you had such a bad experience, especially with the gender thing I mean what the heck. It's just disrespectful and the whole process seems to be horrible. I hope you don't mind if I just share my experiences, might end up a bit of a waffle! I'm 20 and I'm autistic, and I've been on the waiting list for therapy/help with coping with autism for over a year now, so I'm sort of in 'no man's land' as my GP said. I still live with my parents and since the lockdowns I've been doing chores/helping around the house, doing art commissions, doing music stuff, doing free online courses and applying for loads of jobs. I so far have been unsuccessful with this as I usually end up getting rejected, and I've been to a few interviews, but my mum says I am too honest about my flaws which is a weird thing to say lol. I struggle with things that most people do not, mainly executive dysfunction, sensory issues/overload, meltdowns, lack of understanding of social cues and struggling to socialise, being awkward, struggling with change even small changes, etc. My GP said I should apply for PIP so I can have some money and some independence, so I'm currently doing research on it and how to go about it. My friend who is autistic too got rejected for PIP though and he said one of the reasons he got rejected was because he got good grades in school, I mean what the heck. A lot of us struggle in school due to the sensory overload, the bullying, the ostracization, struggling to concentrate, mental health issues like anxiety and depression, panic attacks etc, I certainly struggled, but also a lot of us have weirdly good memories so I believe that's why I personally passed despite having all these problems so I think that's such a bs excuse. This government are terrible when it comes to poor people, disabled people, or people who just need support financially. So anyway, I am going to apply to PIP and hopefully I can get a job that isn't too much to handle at some point or even hopefully earn enough through art or music to be self-employed. But hearing all these dreadful experiences from people doesn't fill me with hope lol so I'll have to appeal probably. Anyway, I wish you the best with your appeal and again I'm so sorry they treated you like this, it's honestly disgusting. I don't have ME/CFS but it seems to be such a misunderstood condition. I remember hearing a comedian called Ricky Gervais even saying it doesn't exist or something. I hope you'll be ok :)

I'm so sorry this happened to you Finn, it's not right. I'm not on PIP and I don't have a chronic illness so I can't imagine the struggle with that every day, but I am a trans guy and sadly it seems to be so common for us to be so explicit about our identities and yet still get misgendered and straight up disrespected. I went to the GP not long ago for a checkup and they literally read out my deadname just randomly. Obviously, I then had a wave of dysphoria and just had to act like I was fine because I didn't want the woman to feel bad (it wasn't her fault, she explained that she didn't know which name to read out, so she just had to guess). My name should've been changed on the system by now because I gave them my deed poll 2 years ago! And they've used my correct name for all the appointments after I gave my deed poll until that one random appointment, so I'm still confused as to why this happened. They also put Miss or Mx on my medication despite me asking them multiple times to change it to Mr. I understand that things like name changes are not a priority because there are people dealing with serious medical issues and I definitely want them to get the help before me, but it's funny how when my mum got married, they changed her last name instantly and they never put 'Miss' on anything lol.

Unfortunately much of this is SO familiar. The complaint process is v slow horrid beastie to, so do not be shocked when u get letter from DWP saying you need to do X, y, before Z etc, is not a quick thing. Go for Discrimination . As disability and PIP assess is contracted out? , “ independent”, and person making final decision not same person. Helps to know how scoring system works etc. I had assistance from my support worker. NB these assessors r not to be trusted. It is not a responsive nor easy path, heart strength toward, for u. Am challenged mobility and other areas and I recognise the pain of not being able to do many things, 😅ncluding spontaneous camping trips. Is there email , way to chat more.

Not about PIP, but capability for work. My daughter's reassessment came up. Yet again, the questionnaire completed and sent in. She had her telephone assessment. She was finally deemed fit to do some work. A mandatory reconsideration went in. Again they upheld the original decision. No way was I going to allow someone who didn't know my daughter to come to such a conclusion. So tribunal it was. After receiving the documents from DWP. I scrutinised every word, every sentence and paragraph of the assessors report. She had copied and pasted the latter 4 pages. It didn't have to go to tribunal as DWP reconsidered and reinstated her limited capability for work.
We were fortunate because I had been a nurse for 47 years, and I was used to paperwork when I did disciplinaries for nurses.
You have to really fight your corner, folks. Never despair.
Rip their assessment to shreds word by word. You will get there.
Good luck to those who are applying for any kind of benefit

Hi sweets, the heart on the comment is to send you and your son so much love. I am so sorry this has happened to you, it is so incredibly unjust. Many times they do not even read the reports, they are just denying people to meet a quota of turning a certain number down. This entire system is criminal and doing people unimaginable harm. I
ts not uncommon to also be refused at mandatory reconsideration, but the good news is, that most people are then successful when they go onto the next step, which is to appeal, as I did.
I really would support you to put in an appeal, it is hard work, it does take time to get a date, but your son, and you, desrve the right level of support and to be treated fairly, which s what the appeal panel will do. They, in my experience and many others, will approach your case in a much more balanced and fair way without any agenda, and as I mentioned, most people are successful at appeal.
Its hard to get help with the appeal process now, because so many charities are pushed for time and money, but do try your local citizens advice centre, they might have a service to help you with a PIP appeal. The following links are also useful, they are where I got all my help and info to buld a case for appeal.

I have put in a mandatory reconsideration or appeal on the disgraceful report and I am waiting for a decision. I got a letter from them saying that they had received my request for a mandatory reconsideration.
I was being as truthful as much as I could but the assessor said that I could manage money without help and I could do so much without help as she said that I was stable. That is what the assessor said. I was so angry and fuming over this. My family has been very supportive over this. The whole problem with the PIP assessment is that, irrespective of your situation, the report is WRITTEN, as though you are ADMITTING to these failures. My PIP assessment said that "I can interact easily with people". When I challenged this, I was told that, "Well you are interacting with me". I pointed out that "If i didn't at least try to do that I would lose my benefits". Nevertheless my claim was denied bcs of my 'supposed' ability to interact with people, despite that being a very real problem, especially since the death of my wife in 2020.
