I have gotten 2 open container charges and I don't drink (I am terrified of alcohol entering my body) but my friends do drink. I have lost one friend because I told them I can not get another open container charge and he punched the crap outta me saying he can drink in his car (I was driving his car as I was sober he was drunk). A responsible citizen should not get alcoholic charges when they are driving drunks around as it gets drunks off the road.

Florida has a very strict definition of 'operating a vehicle' while Indiana apparently does not.
I don't know that either but the car wasn't running that's all I can think of
Some states/areas an officer has to see the drunk physical driving the car. Since they were parked with the engine off he couldn't be charged with it.

Cops are suppose to deescalate situations, and this situation is not on the cops but the people involved, HOWEVER, I think it might have been wise to just have the other woman out of the vehicle and a distance away instead of ordering her to get back into the vehicle that the girlfriend owned. Just my opinion. I get they were probably worried about them getting physical with each other but things probably would have been much more calm if they had all 3 of them out the cars and in different areas with distance
