      50 YEARS AGO I was arrested for my DUI 3rd victimless offense after being Honorably discharged from the United States Marines in (1979).
      DUI offenses that are non-violent, victimless, without incident, accident, or damaged party should not be an ETERNAL LIFETIME 2-A BAN! (Plenty of police officers have 2 DUI's)
      Title 18 922(g)(1) Requires revision because VICTIMLESS/ NON-VIOLENT felons have no 2-A rights.

    Background checks extend a sentence past incarceration. This historically speaking is cruel and unusual punishment.

    I had a non violent felony from 96 here in Vegas. I did my pardon app by myself for $17.00 total, and was granted an unconditional pardon in 2022. I never got in trouble again, and hadn't been in trouble before. I now have my CCW, Gaurd card, and several firearms. I'll never do anything again to lose my rights.

    I forget which channel mentioned it, but the Militia Act required ALL male citizens over a certain age to maintain a working firearm. There was no exclusion for felons. This meant that felons were REQUIRED to own firearms.

    The historical basis for GCA 68 "disqualification" of firearm ownership is a dark one. It is patterned after old Jim Crow laws that aimed to disarm the freedmen. Once those laws were rightly struck down as unconstitutional, they quickly passed a new updated version that disqualified people based on previous felony convictions. And of course who do you think was targeted for prosecution of felonious crimes at a vastly disproportionate rate? Yup. So it's just a weaselly version of an old Jim Crow law. So the basis of the Bruen challenges is the historical tradition and basis of gun control laws to justify their validity. There is a case being brought before the supreme court, VINCENT v. GARLAND. Man I wish they would have brought that up in their argument! They brought up the historical basis issue of Bruen but did not go into depth in mentioning the ONLY time these laws were used in the past, other than the GCA, was to unjustly deny people their civil rights based on race.

    Actually, it should read-felons restored gun rights, considering those 2A rights were infringed upon in the 1960s. There's still a long way to go to get back to where America should be, but this is a good start. However, lower court judges are still regularly violating the Constitution as usual, so unfortunately, this type of tyrannical overreach will continue.

    2 felons out of literally hundreds of thousands. Don't get me wrong I hope nonviolent felons all get to be full citizens again but in the meantime I'd rather be charged with a felon in possession of a firearm than be a victim of a felony in progress.

      divorce usually include wrongfully and assumed violence occurred, go hand and hand, not true and texting your ex fiancee can be considered stalking another ridiculous violent charge even if you are 100 miles away, maybe you just want your things if you were living together.     The one common theme I keep hearing from scotus is that the if the state does not want a felon to have a firearm. The burden of proof lies on the state to prove the individual is dangerous.

      Just renounce your citizenship, move to Mexico, come back illegally. Even if you get deported 7 times, get caught with a stolen cops gun, they wont punish you. It worked with Jose Zarate when he shot and killed Kate Steinal with a stolen cops gun. California jury acquitted him

    I think as long as your not a known gang member,ir have any aggravated charges you should be able to own hunting weapons without having it cost you a 100 grand and 10more yrs of your life filing paperwork! Nobody get excited because they could go back and forth on this ruling 50yrs! Way i see it is your never getting rid of all the guns. Probably only from law-abiding citizens. I'd say ,take away anykind of carry ,but you can have what you want at home. About 3 yrs ago traveling thru Texas i seen a 1ton dodge truck with a ma duece mounted in the bed! That's a military heavy machine gun! We were stopped for gas and i talked to the fellow a bit since I'm into ww2 firearms and thought maybe it couldn't fire more than blanks. But hell no it was a fully functional 50cal hmg! And the guy said he was looking for 20mm to mount on his backpoarch to shoot at his pond! This is where we live i guess. But people like him and the idiots that post videos of playing unsafely with just about everything that fires a bullet make me feel the need to buy something! Wonder if the Ukrainians would sell me one of those flying T90 turrents off a tank to put in my front yard? That would give me enough to guard the neighborhood until someone turns up a javelin!

    as a former combat MARINE and former state trooper I'm gonna make this very simple for everyone to understand i took an oath to defend and protect the constitution for every single AMERICAN with or without a record so i say this strongly it doesn't matter if it's violent or nonviolent your 2nd amendment cannot not be taken away no matter what. it doesn't matter if you have a legal or an illegal firearm if you commit a crime with it you are going to jail with or without a record it doesn't matter if you commit a crime with or without a firearm you are being charged for the crime itself and you are going to pay for that crime it's that simple. a firearm is to protect yourself & family and hunt for food. i still don't know what part of INFRINGED in the 2nd amendment our lawmaker's do not understand. when the founding father's wrote the constitution they made sure 3 thing were certain because they knew some would try NUMBER 1 no rights can be taking away from the people NUMBER 2 no amendment can be removed and most of all NUMBER 3 no government state- local or federal can make a LAW against the constitution . everyone needs to send a certified letter felon or not to the Supreme Court letting them know they are violating the constitution by enforcing an unconstitutional law. make the return address the same as the mailing address send one everyday for 2 months they will have to sign for each letter. when 300 to 500 mail sacks per day are set down on the steps of the court house they will stop enforcing this unconstitutional law and never violate the constitution again. a peice of mail has more power than you think

    Article 4 section 2 paragraph 1, second amendment,14th amendment section 1 protects all felons and mentally ills constitutionally protected second amendment rights.
    Amendment 14 section 1
    No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the united states
    Article 4 section 2 paragraph 1
    The citizens of each state shall be entitled to all privileges and immunities of citizens in the several states.
    Second amendment
    THE RIGHT of THE PEOPLE to KEEP and BEAR ARMS,"SHALL NOT BE INFRINGED."
    No judge in the united states of America whether they are a supreme Court or lower court judge has any legal lawful constitutional authority or jurisdiction to take away any American citizen whether labeled felon, mentally ill or not constitutionally protected second amendment rights. They are all state officials therefore bound under the 14th amendment section 1,article 4 section 2 paragraph 1,and the second amendment.

    The bad part to this is those cases are for that individual of each. There needs to be more cases. Most felonies are non violent and the felons act was introduced in 1968 that forbid felons from owning a gun by a Democrat controlled Congress. It was the first time in our history that made it illegal for all felons to own a gun. That bill in itself needs to be repealed completely. It is definitely a 2nd amendment violation.

    When a convicted felon satisfies the terms of his punishment by serving time and/or paying his dues to society, prior to their release, the powers that be should know beyond certainty 1. This individual is rehabilitated and is ready to be reintegrated into society. 2 There is sufficient support system and infrastructure in place to ensure a smooth and high probability of successful transition. Upon release, this individual should have all right restored, criminal records sealed from public records and should only be accessible for reference in the event of a future criminal offense. Otherwise, this individual should be able to move forward with life like everyone else. Otherwise, please detain until further notice.

Witch is a form of abuse all gun restrictions are unconstitutional you are your own protection and first responder people make mistakes we are human and if anyone thinks they can judge a person has evil still in their heart and soul we are meant to judge people that's god's job if he wants you dead he will make that happen anyway I'm speaking from experience I've seen women false accuse people for many crimes they did not commit and the one who actually committed it will be held accountable just like evil women who false charge or lie should be held accountable me personally I had a female charge me after I was dealing with probation for being forced to take a plea on "my first time committing a crime" witch is illegal especially when I told my attorney I wanted to fight this but my state is all fucked on all sorts of laws be careful of these women man god bless you have a right to own and buy get a attorney depending on witch state you live you can my buddy had a flase DV from a couple years ago and he got his back

      What would you classify as violent? Would a drug dealing charge be violent crime? All the states would have to do is amend there laws to make every felony be a violent crime. Were there guns and violent felony's when the constitution were written? Just remember this SHALL NOT BE INFRIGED

      @@onemischiefmaker7032 I get what you are saying an my opinion on the drug dealing stuff selling certain kind of drugs like for example fentanyl you know more than likely it will kill someone if you're selling something to someone and it's going to kill them I wouldn't necessarily say it's a violent crime but you know what you were doing. Now like weed and cocaine no I don't consider any of that violent unless you knowingly put something in it that is going to kill someone or you know there is something in it that is going to kill someone. Hell honestly I would be actually okay with giving some violent offenders their second amendment back it really depends on the case and the circumstances. And I understand the second amendment says shall not be infringed i get that but there is always a exception right? Like freedom of speech you can say what you want until it physical harms someone. There's always exceptions.

    I had a misdemeanor marijuana related case picked up by the feds and turned into a federal felony about 10 years ago. It’s the only time I’ve ever been in trouble in my life, I did 5 years probation, I’ve been drug free ever since and now as a single father watching crime rise and armed robberies skyrocket around us, I wish there was a path for me to restore my gun rights. My understanding is becasue it’s federal, a presidential pardon is my only path and that’s never gonna happen. My biggest regret in life is losing my second amendment rights, I used to be a responsible firearm owner, I grew up in a gun family and it stings every day that that’s gone now. At the end of the day, it’s my actions that got me here, I just wish there was a way back now. It’s a scary world out there these days.

    Kansas gave almost all felons gun rights back as long as they didnt use a gun in their felony. If you had it on you in the felony fine too. Some crimes have automatic waiting periods but almost all felons get their rights back as automatic as voting and all the others. House Bill 588 (Kansas Firearm Restoraction Act). Many people dont know about it. It also lowered the waiting period to get rights back.

    I just got my rights back 6 months ago I'm still not able to buy a firearm from the shop or fill out a forty-four seventy-three and have it come back accepted but from what I understand and what my paperwork says is my crimes have been set aside and I have my Second Amendment rights back so now I've hired another lawyer to find out what's going on with not being able to buy a gun legally and my charges were federal

      Not true, heresjohnny. Should you be a convicted felon, you have standing under the Second Amendment to make a gun purchase. Use your state's gun laws against it and by that, I mean, apply to your state's attorney General for clearance to purchase a firearm. You will more than likely be "summarily" denied but you will have started the process at the "administrative" level of your state. Even if you have to submit an "administrative appeal," you can cite the Bruen case to support your position. ¡Suerte!👈💯
      Edit: if all fails, you will have exhausted your administrative appeal. You can then move to the Courts by filing your lawsuit. Remember, what you say in your administrative attempt to retain your 2A Rights must be echoed in the courts.
      Edit 2: on careful reflection, you should cite the Bruen case in your initial filing with the Attorney General of your state and state that the Attorney General, under Bruen, has no right to summarily deny your application to purchase a firearm. Kinda like in your face application.

    Ok so I'm 16 and I was charged with 3rd degree burglary and I was wondering If being a convicted felon as a juvenile would prevent me from being able to purchase firearms in the future. Any advice for what I should do?

      Alright so I know a buddy of mine that was convicted with the same felony but he was charged as an adult. As long as you are not being charged as an adult once your 18 you should be good. It took my buddy a very long time to get his situated. But that's because he was an adult. After completing whatever sentence you received if I was you I would go to the court and ask for an expungement. Hope this helps!

      I’m hoping they won’t be able to stop it. If they try to then I’ll be forced to get a lawyer myself and file a suit. If this platform becomes big enough then they won’t just be attacking my rights they would also be attacking my livelihood and I’ll have to fight for that.

    I had failure to stop for a blue light in S C in 1994 or 96 and that is what's holding me up from what understand. I'm in the process of expungement from the solicitors office as I filled out the paper work 2 wks ago, the secretary said they will get back to me soon. Also I had DUI's in the past 1994 1995 in that time frame, my point is that Anything or violation was Never violent or harmed in any way shape or form , and I have spoken to an FBI agent and she said We don't have any reason for you not to be able to purchase a hand gun or weapon it's the state of South Carolina holding something on you. Time will tell.

      I believe the law says after five years of release from prison or getting off of parole/probation, if one has not been in any further trouble, a felon in Texas can own a firearm in his home only. The trouble is federal law supersedes state law. Texas says yes, the US government says no. I've looked into this and I can not find any case law about it. What you can do is own a black powder weapon. They're fun, some are pretty damn powerful, and they are not even considered a real firearm by US statute.

      A convicted felon can have firearms on property they reside in after 5 years of judification of that person's sentence. In Texas, They cannot transport them or take them off their property.

    The second amendment says shall not be infringed. The forefathers put that clause in that particular amendment because of the government. Yes even back then the government was an issue. We just went through the revolutionary war. Throughout history when a felon was released from prison, he was given a horse, 20 dollar gold piece and a firearm, typically a revolver sometimes a rifle as well. The 2nd amendment is a God given right. Not a governmental right. Every law written and all the bylaws written on the second amendment is unconstitutional. That’s a fact. That’s why it clearly states shall not be infringed. 🇺🇸🇺🇸🇺🇸🇺🇸

    So, its been ruled, yet, a felon is still going to jail for being in possession, with jail time, cost of all that is astronomical. Even a black powder, is going to cost jail time etc... What's the deal? Say said individual was a non-aggravated crime, and time was discharged 40 yrs ago. Why should a person with that kind of a record, even if it was a felony, be charged with this? Also lets say said person waved their rights at 15 yrs old, not really knowing what or why he/she was really being tricked into to doing something they didn't not understand?

I've had no contact with the law not even a ticket and also been on my job for 11 years and purchased a home last year and denying me.     Live in Illinois wrote a bad check payed off in 1991 court didn't take off my fill in 91 refused my card in 2023 no trouble at all called state attorney wasn't removed from record back then what can I do to get a card

    You absolutely lose the right to vote when youre stripped of your 2nd amendment right....at least in Tennessee. You also lose the right to hold public office. So they kinda get the trifecta and tell you youre not a citizen of the United States any more....but theyll damn sure take taxes out of your paycheck. You dont lose the right to pay taxes.

      Presidential pardon is the only way back as I understand it. Federal is a different level of lost second amendment rights. As a federal felon, that’s a tough pill to swallow.

      Look up on Google Alabama gun rights restoration. I believe there is a lengthy application for you to fill out and send it. From what I read it could take some time for it to process. For your age I would ask a gun rights lawyer for some tips to help push the application a little faster. Hope this helps!

    In March of 2023 I was granted I.C. 35-38-9-4 expunction for dealing meth (which is considered as a major violent felony in Indiana) and I was not really dealing just a drug addict. But clean and sober for 15 years now. I have never been convicted of any crime in which caused injury or harm to another person. My FBI criminal history as of 12-12-23 shows A SEARCH OF THE FINGERPRINTS PROVIDED BY THIS INDIVIDUAL HAS REVEALED NO PRIOR ARREST DATA AT THE FBI. Indiana's criminal history report shows my dealing charge with (EXPUNGEGED beside it) on the record. I'm being denied firearms from the FBI. When I personally challenged the FBI the response is referring to the Indiana dealing meth charge (that was court ordered expunged) of imprisonment of more then a year under 18 USC 921-A-20 and 18 USC 922-G-1. Under Indiana's expungement laws pursuant to I.C. 35-38-9-10c I am a proper person which means I have the rights to firearms . What the FBI is saying does not apply to me per the expungement. I have pulled up Attorney General Curtis Hill's official opinion#2019-6 and Henry Flores official opinion update 7-1-2023. Both stating firearms rights are restored following an I.C. 35-38-9 expungement because per I.C. 35-38-9-10c I'm now a a proper person pursuant to I.C. 35-47-1-7. I paid Brad Keffer to fight this $500 for Indiana's denial (Indiana's deny due to the FBI's denial) and $500 for the FBI's denial. $1000 in total. Brad told me after working this case for four months (what I feel is a bunch of BS smoke and mirrors) The FBI sent Brad the same response as they did me (stated above) which I sent by email to Brad before the phone consultation. Brad saying my expungement must state specifically that my firearms rights are restored on the court expungement order not true per I.C. laws. My order states that the petition herein qualifies for an expungement of the arrest and/or criminal records pursuant to I.C. 35-38-9, et. seq. Is there any Attorney in Indiana that has Indiana and federal firearms rights knowledge willing to take on my case and actually fight for there client? Or is there any activist, Groups, Organizations Or law schools willing to challenge the F.B.I. and make them actually up hold the Indiana and federal laws that are written. Could someone please point me in the right direction.

    Chicago the 3 circuit and Judge reeves all ruled a felon can own guns. November 17 the Supreme Court made a decision whether they will hear the Bryan range case of felon and possession of firearm but I haven’t heard what their decision was, but everybody is saying they are going to take the case because they keep talking about the Bryan range, case, in their brief with other cases
