The US Constitution states that Congress shall pass no laws abridging
the Rights, which includes the Right to protect oneself. Whenever
someone pleads guilty to a felony, the judge must get a former waiver of
the Right to a jury trial, the Right against self-incrimination. The
reason is that Constitutional Rights are not privileges. They are Rights
that cannot be taken away. You may waive those rights in exchange for a
plea bargain. However, the Right to bear arms seems to be treated like a
privilege that you lose when you commit a felony. If so, then it is not a
    Right but a privilege.

Would other states, say Iowa- for example, honor reciprocity of firearm restoration in the State of Oregon? Oregon resident who had rights restored via court order Circuit County Judge in the originating county. Completely legal to purchase, possess, and transfer in Oregon. If I were to move to another state, like Iowa, Missouri, or Texas, would these states or any state recognize my restoration either via Full Faith and Credit Clause or some other legal nuance?

Hi. I received a felony for burglary when I was 21 in New Jersey. Un fortunately I got mixed up with a few minors in a theft of radio equipment. The equipment was stored in my parents garage and subsequently someone told the authorities about it and I got arrested. But did not do any time , but all my firearms which were legally purchased and registered were taken away from me . I now live in Pennsylvania and am 72 years old and am interested in black powder firearms. I got into black powder back in 1999 when I started civil war reenacting. Have had a clean record since and would like to get my gun rights back and have my felony conviction expunged. What do you think my chances are and who do I contact to start this process.

I was convicted of a battery on a L.E.O. in Florida too; I am still waiting for my hearing. Unless you beat the cop to a bloody pulp, you should have no problem getting a pardon as long as you do not have a history of violence. You have to fill out the paperwork and send it to the state. Everyone listen, I was convicted of 7 robberies, commission of crime with deadly weapon. Assault, and burglary. I was 16 at the time no previous records and by the grace of god this past Thursday I received all my rights back. It is possible, I’m 26 now. but to let you know. I’ve open 2 businesses, I’m a single father and also I haven’t gotten into not one pinch of trouble since I’ve been out. If you want your rights back you really need to be proactive. Just going to school of maintaining a job won’t cut it. Get out there and do something with your life, make a difference! If I can do it. I’m 100% positive you can!!!!!! Good luck

takea306 my advice, a lawyer won’t do anything else that you wouldn’t do or you couldn’t do. I just got an item number about to file an appeal to the live scan said in my fingerprints print out my record showing my case was dismissed and go and pay for the expungement all in total should cost me about $300. Now I’m sure this guy if he charges $20 just for a phone call prior to charge $2000 just for the first session. Gun lawyers make it sound like you need them if you are prohibited in the only way you’ll ever get your raise will store it is if you use the lawyer, but that is false only reason you would do that is if you’re so stupid you can’t figure out how to appeal the process yourself

But the wreck I was in had landed me a felony conviction under a plee agreement. I served 10 years probation . And I served 9 years and six months in the system before they finally forced me Into a violation of probation. "Contempt of court" in the time I served my probation my life turned around I became a father husband and baptist evangelist . I even taught classes for the probation officers when short handed. What does a conviction have to do with a constitutional right? If you are a legal citizen in this country then shouldn't all constitution rights apply to you? In Texas a Felon can own and carry loaded both open and concealed a pre 1898 black powder revolver or reproduction as long as it has not been modified. I carry an 1858 Remington Sheriff model and as my back up an 1863 Remington pocket. But I am looking into getting my rights back to carry something a little more reliable. The black powder rifles and pistols use to be the loophole/ the way out, so you could still enjoy shooting, hunting and home protection. You can have the guns....just cant load them. In 1999 I was 23 and caught a f5 forgery conviction. 15 years later after not picking up any other charge I paid 50 and filed for an expungement hearing which literally took 5 minutes and I walked out restored! Have my CCW now and have built my collection considerably.

It is possible to get your rights back! Here in ga you have to fill out a 8 page application and get 3 people whose character cant be questioned/ no trouble to write letters saying why they think you should be able to have your rights back. You send it to the board of pardon and paroles. The only thing it cost paying to have a couple of the pages you fill out notarized. It takes about a year to process. 5 board members vote and you have to get 3 in your favor to get your rights back. I know this to be a fact because I did it myself and I now have a full pardon including the right to bear arms!

I also live in Michigan and caught my first felony charge in Detroit. It was a very bad judgement on my part in attending a party with my firearm. Anyway i happened to catch an attempted felonious charge, which i was lucky enough to only serve 10 days in jail with 18 months low monitored probation due to my clean record. Ironically if i remained clear of any convictions, that following month i would've been cleared to get my CPL 😒 so now im close to the end of my probation but i have to wait and remain clear of all and any bullshit for five years. My lawyer said it would cost upwards of 5000 to 10000 bucks to get the felony expunged from my record. He said if he's still around that he would do it for 1000 but who's to tell what could happen in 5 years. So I'm not supposed to be able to legally carry a firearm for 5 years just because of one mistake that i made...non violent, victimless crime?! Our laws are fucked

Throughout Texas, anyone with a felony conviction must uphold his or her obligation to protect his or her family and property with a gun. You are required to own them, and no judge can adjudicate any laws regarding these rights today. The only caveat is that you must carry on an empty chamber if a revolver, and place semiautomatic weapons on safety and secure them in holsters or at the small of your back in your waistband. That's how the laws here in TX are. Hope I've helped.
