I'm an American citizen, 50yo, and receive SSDI income. I met my partner 6 months ago on Filipino Cupid match making site. I'm a paraplegic with epilepsy and unable to travel to the Philippines which is a requirement of the USCIS whereby I first travel to visit with her and then provide this proof to them upon my return to the US and then filing for the K-1 Visa (I-129F) form. I'm hoping my partner can come to the US under the Visitor Vias whereby she IS NOT my fiance (I have not asked her to marry me) but she is only coming to the US so we can spend time in person with each other. So if she would come here under the Visitor Visa whereby having informed the immigration officials of her intentions to come here to spend time with me and then we would happen to want to get married, will there be problems with immigration office

Hi, this question is for my Indian friend who is a Green Card holder. His wife passed away a few months ago, and now he wants to enter into a second marriage. He is considering filing a visitor visa for one of the women in India with the intention to go back to India. After she arrives in the USA after 4 months, he wants to marry her and apply for a Green Card. Will this work? Or is there any other alternative, considering that the F2A process to come from India to the USA is lengthy. Please let me know what options he has.

The wife should be very careful entering on a visitor visa and then overstaying the visa to get married. This is because a tourist visa is a temporary visa, and if she intends to stay in the U.S. and apply for a green card, she is planning to overstay her visa. This means there is a great likelihood for misrepresentation at entry or when applying for the tourist visa, that could put her green card application at great risk for denial.
