    I am just loving doctor Kirkpatrick. No BS kind of doc who really tries to not let the defense get over on him. He really seems to care for the research and treatment of children and adults with CRPS

      He used very low doses compared to Dr. Hanna and the Ketamine infusion. Doctor Kirkpatrick ordered Hydromorphone which is 2xs stronger than morphine. This is research and not approved as well at this point. Very concerned people are so accepting of the medical care done to Maya prior to this hospitalization.

    i am so tired of the defenses objections and complaints that they didn't have time to review evidence. they've had years of time!!! And tired of the judge acting like the plaintiff is wasting the courts time when it is the defense wasting time

    The defense is terrified that Dr. Kirkpatrick’s knowledge and simple explanations of this disease will make an impact on this jury. Trying to interrupt every question and answer. Some defense teams work hard to protect their client against false accusations but this team is trying to shield the hospital from the truth. Despicable!

    I could have listened to Dr. Kirkpatrick discuss his entire history studying CRPS. It was so educational. It was a shame when Defense objected, causing the doctor to get to Maya’s case. Understandable, the need to get to the specific topic at hand, but selfishly, I wanted to hear more! Describes things to a layman very well!

      Yeah, his sells pitch is so good. I could definitely see people forking over $24,000 to get their kid lit af on ketamine for 4 Days. 😂

      ​@@KevlarSammyNot sure why people are so upset about ketamine. It's a very safe drug. It doesn't wipe out the respiratory drive or cardiovascular drive like all other anesthetics. John's Hopkins chose to treat Maya with propofol, a way more dangerous drug than ketamin. You'd probably are more familiar with it's other name of Diprivan, you know, the drug thay killed Michael Jackson. It's too bad the plantiffs did point that out in this trial. If I had a choice between ketamine or propofol to give my child, it would be ketanind. Additionally, I've administrator ketaninrme to children for procedures and they do well on it. We don't have to bag then to maintain their airway.

      The way the judge talked to him was very disrespectful IMO ! The judge saying, I really need you to just answer the questions and Dr. K said I’ll try my best, or something like that and the judge said something like no you need to do it, or something like that! I thought how rude!!

    This case is infuriating. I couldn’t imagine this happening to a family… low and behold, here it is. The anger they must have from the way she was treated and what mom ultimately resorted to is just inexcusable. HOW could you ever get past this?

      The part about these attorneys in specific that was so appalling to me is that some of these attorneys aren’t just attorneys that represent the hospital in court but they are on staff for the hospital and were present and making decisions for Maya and her family while she was in the hospital. Wouldn’t you think that if this many of their decisions resulted in this many lawsuits that they would no longer be making any legal decisions for them? Like how are they now representing the hospital in court to defend their barbaric decisions made in the hospital?!

    I’m so interested to see who the Defense brings in as a witnesses from the Hospital. It’s so funny how the defense tries to discredit Dr. Kirkpatrick & act as if he isn’t qualified to diagnose her but she’s since been diagnosed by multiple other physicians.

      @@SouthsideNik The plaintiff and the kowalski have made sure to discredit Sally and Cathy creating bias before they have a chance to testify. I do believe they had a job to do and that was to investigate and protect the child. I will reserve judgement until after both sides are heard. I am not without compassion, just interested in ALL the evidence which includes documents and testimony of hospital records and hosptial staff. I have not developed a n opinion of either of these women yet. So no not everybody despises Sally Smith

    Those nurses notes were downright unprofessional and disrespectful. Writing away Maya’s issues as “depression” and “burning” so sarcastically. Just say you don’t want to be a nurse. Perhaps she was too “overworked” or “annoyed” to deal with a little girl who’s symptoms were too complex for her “tiny brain”

Perhaps those nurses and doctors should have taken the time to educate themselves about it instead of letting their egos tricking themselves into thinking they know everything. In this instance, they were clueless and lacked the professional integrity to admit it.

      Unfortunately it's not so much that as it is the laws of evidence. Evidence has to meet very specific requirements and when you have a case like this with multiple plaintiffs, agencies, and the family courts, dcf (CPS), as well as any other agencies it means that some evidence while being very meaningful doesn't meet the evidentiary standards. It happens in every trial during the pretrial phase. I will admit there are some things that should have come in that didn't and vice versa.

    This is so sickening in many ways. To see the defense lawyers treating this doctor like a criminal; someone who's dedicated his career to helping unwell people. All in the name of covering the backs of questionable hospital staff and illegitimising the totally lawful decisions a family took to give their child her life back. It truly disgusts me.

      Maybe but I think there is a lot to this story. I can’t imagine taking my 9 year old to Mexico for a treatment where there is 50% chance my child would die. Defies common sense. I also can’t imagine forging prescriptions for ketamine and I wonder if the mother was actually taking the meds herself.

      @@rlfrohs6123Im pretty sure you cannot also imagine the level of pain that child had to go through. Although they explained it so many times - it’s worse than pain of finger amputation. But sometimes people just don’t have imagination. However try and imagine yourself feeling that pain - I bet you would be first in line to get something that stops it, whenever it’s possible. Also what’s wrong with going to the hospital in Mexico, it is still hospital, like here with excellent doctors. Maybe not so fancy though.

      @@joannatomaszewska First of all, you are correct, I can’t imagine pain like that. Second, nothing is wrong with Mexico. What is wrong is that I would NEVER put myself or my child under anesthesia for a 50% chance that they would die. The child was not terminally ill, and even if she had been, I would have never agreed to a procedure that gave me only a flip of the coin chance of survival.

    Dr. Kirkpatrick and the psychiatrist thumbs up today. Dr. Kirkpatrick was fenomenal, very thorough and assertive, didn't put up with the charades the defense tried to pull up to discredite him, they tried but amazing job Dr. Kirkpatrick impossible to fool. The psychiatrist amazing testimony, plus just one question he answered the whole trial: you can't have Munchhausen by proxy and CRPS in the same time, that says it all.

    Dr. Bewerton is telling the truth that the defense lawyers are not wanting the jurors to hear. When the media flashes to the defense lawyers they know the hospital screwed up! I glad the judge is overruling the defense team objections.

    i think yhe hospital fails to recognize that just because they recommend a certain treatment or therapy does not mean someone HAS TO DO IT, it is their choice to or not. Also I feel the hospital had zero rights to be subpoenaing every doctor she did see after she was out of the hospital

    I feel so horrible for this family. The medical system is a giant. They mistreated this family in unimaginable ways. I hope they get compensated appropriately for it. However, I can’t help but think how wrong Beata was to kill herself. It hurt her family more than it helped. Imagine if she were here. They’d have a much easier time in court and the kids would have their mother, and Jack would have his wife.

      If she didn’t unfortunately they would have kept Maya once these accusations are made it takes years to resolve in court I think as a mom she truly believed this was the only way to get her daughter home.

    The court and the jury are not allowed to hear about Mayas treatment prior to any of this, she was on massive amounts of steroids and that caused her GI issues, poor girl was being over medicated and harmed for years and years, JHACH weaned her off all the meds in the 3 months she was inpatient. She was able to progress and walk within 6 months following. I suspect Maya has an eating disorder, it looks serious but I hope she has it under control.

      We have already had another doc talk about CRPS and ketamine to back up the treatment he gave her. And teachers and the family testified Maya was better after and with the ketamine treatment.

      Anderson’s lack of preparedness and professionalism is concerning. I hope he doesn’t cause the Kowalskis to lose this trial. Imho, his co-counsel should be lead attorney instead because he is much more affable, is able to swiftly rephrase questions that have been objected to and sustained, and places his focus on the witness testifying.

      It is a common question, and the defense is trying to say that the witnesses are advocates for the plaintiff, even though technically that is exactly what a Dr is supposed to do. But they're trying to make that argument, while there's 6 of them sitting over there for this major hospital organization, and just 2 for the plaintiff, with only 1 actually arguing. And honestly, my opinion, Mr Anderson is a horrible lawyer. I'm very surprised he pulled this off, but i won't be surprised if the defense wins in appeal for some of his pretty big mistakes, such as not turning over evidence in a timely manner

    Medical professional here, 20 years oncology.. This hospital saved this young lady's life. I know it's not the popular opinion. If she had been released to Mom, she would most likely be dead today. Hard wrap one's mind around that, but it happens. Thank God for people who stand their ground, despite popular 'opinion'.

      Yeah. I saw she was using a diaper and couldn’t walk when she arrived at the hospital. After getting off the mother’s “treatments,” she was able to regain function in her legs through physical therapy.

      There's footage of her swimming, doing activities prior to being isolated in hospital, she had a relapse. And she didn't need to be in hospital as long as she was, she could have gone home days after. She would have gotten better at home, like she has done many times. She still has relapses, she isn't cured.

      Ketamine has less negative effects than Xanax or oxicontin. And is 99% less addictive, as it comes to physical withdrawl anyway. There are more people who get addicted to Marijuana than ketamine, and Marijuana isn't addictive at all either. Haha.

    Am I the only one who feels Dr.K is selling his expensive treatment? Quick diagnosis of such a complex and rare illness. No concern for what multiple other docs said. Reinforcing mom’s diagnosis of her child. Feels misleading and dangerous to me. Especially since Maya walks and thrives today (without ketamine and after JH stay).

      I really don’t think this is the case at all. Ketamine treatment has now been FDA approved for CRPS and has helped and saved many CRPS pts.

      Also I would add, although maya was not a part of his study/research I think his interest in the outcome of patients with CRPS and use/benefit of K would outweigh his need or want for monetary gain from the treatments and subsequent visits. A lot of time researcher are far more interested and passionate about their study than quick cash. If he believed maya didn’t actually suffer from CRPS and just made a “quick diagnosis” it would be far less valuable for data collection.

      The prosecution starts, by making the case for their claim. They explain what they believe the evidence will show the jury, in their opening statements. The defense is also allowed an opening statement on what they believe the evidence will show. The prosecuting counsel then begins by calling witnesses, to make their case. And they are to have all of their witnesses and evidences ready, labeled and organized for the claim they are making, and they give an estimate to the judge about how long it will take for them to question their witnesses and produce the evidences before the jury. Their estimated time does not count the defenses cross examinations of their witnesses. After prosecution rests their case, as in calls all their witnesses, and produce all of their evidence, then the defense begins their defense case, where they gather all their witnesses and evidences, same as prosecution did, and give an estimate to the judge to how much time they believe it will take for them to make their case for defense, sometimes there's a counter suit, which makes it a bit more complex. Really, it just flips the sides after the first case rests. But that is not the case here. So the judge takes their estimates, usually adds a bit of time, for scheduling. Because judges are actually very busy, he may have another trial scheduled shortly after this one, or other obligations. Same with the lawyers. And then they also give the jurors the time estimate, because they have to take the time off of work and away from family, and they actually take that very seriously into consideration. This is very important in civil cases as this, as it's not a priority to the judge, compared to actual criminal trials where somebody's life and freedom is on the line.

    The mother altered a prescrition, assuming that it was her who put " terminal illnees" on the script! Unbelievable. Don't people think that was part of her fear? Being found out? It is a felony with prison time. Not only that, she would lose her nursing license. That is serious. It goes to her state of mind and manipulation of the medical community. If people overlook that, there is something wrong with their judgment.

    Has the good doc' ever really testified? He's not board certified(?), didn't bring his own 'homework' and doesn't know how to answer a question w/o going off on tangents, narratives it seems. But, in his favor, if the prosecuting attorney could articulate a concise question might help, but then again....what a long day.
    The longer he talks th more $ he makes.

      He’s not a designated expert witness 🤣 which means he doesn’t usually go to court proceedings let alone trials. He is most certainly not being paid nearly as much as a expert witness would. He was told his records were already in evidence which means he was not told by either defense or plaintiff to bring records. Which are usually not allowed anyways if they are not in evidence unless there is an exception to use it to refresh recollection.
