- Welcome back to Part 3 of our ongoing series on INTRODUCTION TO PERSONS. In this video, we will talk about the obligatory and mandatory nature of our laws. This is laid down for us, under Article 5 of the Civil Code. This presents us with the perfect teaching moment on the most important rule in Statutory Construction - the verba legis or plain meaning rule.
Article 5 of the Civil Code admits of several exceptions. Learn all four of them here.

Carelessness is probably the most common culprit in the mistakes we make in law school. We become sloppy and careless when we’re overworked, tired and hungry.

Under our labor laws, when an employee is dismissed based on valid causes - just or authorized causes under our Labor Code - then the dismissal is valid. If in the process of making such dismissal, the employer misses a step or fails to afford the employee one, some or all of his rights, then the dismissal is still VALID but the law now imposes a penalty for the violation of the right.
Valid ang dismissal, kapatid dahil valid ang cause. Pero dahil hindi nasunod ang process, may penalty. However, the dismissal itself remains valid. I hope this makes sense, bro. Kind edit your comment, at baka may mango-ha.

For me, it’s an excellent platform not only to teach civil law but also to teach the principles that will become very important in other courses and later discussions.
