- Welcome to Part 2 of Introduction to Persons. In this episode, let's talk about the conclusive presumption laid down in Article 3 of the Civil Code of the Philippines, and other kinds of presumptions in the Civil Code. We will also take a look at Article 3 in relation to foreign laws. Today, we will also learn all about the doctrine of processual presumption or the presumed-identity approach.
We will also discuss the prospective and retroactive application of laws. These are fundamental concepts that if you learn now, will serve you well throughout all of your years in law school in the Philippines.

Not sure what happened towards the end, but here's the summary of the rules: The general rule is that laws must be applied prospectively, moving forward. The exception is that the laws may be given retroactive effect, moving backward. The exceptions are:
1. When the law so provides. The exceptions to this exception are ex post facto laws, and laws that impair the obligation of contracts;
2. When a penal law is more favorable or beneficial to the accused. The exception to this exception is when the convicted felon is a habitual delinquent.
3. When the law is remedial or procedural in nature.
4. When the law is curative in character.
5. When the law creates new substantive rights, so long as they do not prejudice, change or remove another right, from the same origin.

I'm an incoming sophomore trying to refresh the knowledge I stocked during my freshman year. The pandemic gave the toll of messing up with our learning process last year, so if we want to function as normal law students again, we will need to adjust for ourselves. Your videos were also very helpful even before my first year in law school. I'm in still in Part 2 and I must say the mini-lectures run smoothly. Salamat, kapatid. What I really want you to takeaway from the quizzes:
1. A single word can drastically change the meaning of the law. The law requires precision.
2. Past lessons are as important as present lessons. Law school is a battle of how well you remember what you know, that is of course, assuming you know what you know.
3. Test-taking is an underrated skill in law school. A lot of that is based on your ability to resist the element of surprise from the questions. By somewhat exposing yourself to quizzes on a regular basis, namamanhid tayo sa gulat. 😊❤️🙏🏻

Lex your video lecture/discussion is of great help to me..but i would like to ask ths question if a law graduate from a non existent school due to its closure about years after my graduation from the degree of Bachelor of Laws has still hope to make it in the bar exam which already i have taken twice first in 1990 where i had my review at the Sto. Tomas Law Review Center and, my second taking was last 2012 and had my review at the UP Law Review Center and this time i am planning for another retake because of the proposal or option that bar exam may be given in Cebu City plus the availability of review through video lecures like this hence had given me this interest for another a third time taking of the bar exam such that i would like to inquire or confirm if bar examination will be truly scheduled in Cebu..thank you and more power to you Atty.
