I wish I had discovered your channel sooner! I’ve been going through hell dealing with a collection agency that is going after me over a mistake Verizon made on an account that I never opened. I thought the collection agency was going to accept my receipts from Verizon saying that they made a mistake! Oh goodness, now I know I was not only wasting my time, I gave them my info! Thanks for explaining it to me.
I have talked with several of lawyers and you are correct that the creditor has the right to sell or transfer the debit, however, they have to sell it at pennies on the dollar which by law is .31. They usually always get more than one account and on a spreadsheet( The actual paperwork is not transferred) the actual paperwork the consumer signed stays with the creditor and because of that one fact I personally have been to dispute and remove these items successfully and not have any repost and none of the collection agencies have ever been able to collect. This is why I don't totally agree with you. So telling someone that they have to pay on a collection is not completely true to having it removed. Just refer to the FDCA( Fair Debit Collections Act).

I never signed a credit card application. So when I asked in court for the “signed contract” they looked at me like WTH are u talking about. Every credit application I’ve done was online. I agreed to the terms and was approved no signature ever requested.

They cannot garnish SS SSI or pensions. Cannot garnish UI income either. Furthermore Regulation F just went into effect. They cannot sue or THREATEN to sue on time-barred debts.
Yes Bobby your correct. Also the attorney has to prove they are license in the state to collect a or the debt. If they are not you can countersue them. I have done it. I won the case because they didn't have enough evidence to prove the debt was owed. Which it wasn't.

The statute of limitations trips up a lot of people-they don’t know that payments can extend it and they confuse it with the time limit for credit reporting. These prevented me from getting a montage until I started looking for help. After he finished working on my REPORT in just 7days, my CREDIT SCORE increased to 780, all the negatives items on my REPORT were deleted permanently and he added good trade-lines to boost my credit mix (Mortgage tradelines, installment tradelines and Auto tradelines) on my report, I got the mortgage and that was phenomenal!

Every time a collection agency has called in the past I would block their calls and eventually delete any message they left for me. Eventually, they stopped calling.
Why negotiate terms at all? If they claim that Jon Doe owes them $1000. Send them a notarized affidavit renegotiating the terms of the contract. Send it off with a $50-$100 Postal Money Order for Settlement of all claims. If they cash that Money order it's over. They have Accepted your offer. Send it certified return receipt. Better yet Send it Registered (Registered = $25k insurance policy).

So this is my situation: I've had a charge off for two yrs now. And on my credit report it says: Date opened: 3/13/2019 Last payment made:1/3/2020 But infact my last payment was 2/18/20 .I even have proof according to my bank statement. I assure you every company will reply back, and nothing will be removed...trust me. in addition, all the companies have to do is just verify 1 piece of information I.E. address, birthdate, anything and they have proved the debt is valid...not fair but true. these companies don't plat by the rules or the laws and NO ONE will do anything about it....they don't care!!
They have their own lawyers & do sue you. I was sued for 2000 dollars bill. from a debt collector. That was after I tried making payments to them & had to stop, because I couldn't afford to pay them. I had a part time job & they started to garnish my wages. then Covid 19 came & I no longer had the job. It ended. I'm also on Social Security . They can't garnish your Social Security Check. I'm not going to be going back to work, as I'm 70 years old . The job was very part time & I don't even miss the extra money. After they garnished the checks from the job, there was very little of the check left, so I'm not ever going to return to the job .Not worth it.....

Is the reporting on the 3 Credit Bureaus inaccurate, when Capital One is listed, even though Debt Collector purchased the debt from Capital One? Can a Charge Off be removed based on wrong Debtor listed? Thank you.
You would have to check the terms of service, but most lenders include a clause that says that in cases like this, the lender can choose the choice of venue. Meaning they will pick whichever state is most beneficial to the lender. So in the Fair Debt Collection Practice Act book, 809.[ 15 U.S.C. 1692g ] section C. The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer. Since the creditor doesn’t own the debt how do I delete the original creditor from my credit report showing a a charged off. Is that even possible?

Your videos have been so helpful! Really appreciate them! I have a question. I want to start disputing and I watched another video of yours just before this one. I called 1 Credit Bureau and they had me verify my name, DOB, SSN, and address. I was okay with this because they already have that information and I wanted to get rid of old and incorrect information. They then asked me to verify my phone number and I declined. They then said they will have to find another way to verify me and tried doing so with asking about my debt history, I also declined to answer and told them I was at risk of identity threat. The lady insisted and so did I so we transferred to the supervisor who was really defensive, and nothing got done. I stood my ground he stood his and told me send my request by mail. Should I have verified my phone number?

That sucks, as long as your name remains on the loan, you are still technically liable for payments. The first step is to get your name off that loan so you no longer need to worry about her making payments on time or not. I would contact your divorce lawyer as you may be able to file an action for partition. Most divorces might specify who gets the house, but them getting the house is usually contingent on them staying current on the loan, and then refinancing the property out of your name within XX number of days. Since her getting the house in divorce is contingent on these factors, which she did not uphold her end, an action for partition can be filed which essentially forces the sale of the house which would then remove your name from the loan. Once your off the loan you can then go back and start to work on repairing your credit. But first and foremost you need to get your name off that loan.

Has anyone had the problem of a marina address being a non-residential address therefore affecting their credit report? What do you do when you agree on an amount to settle a debt and they say they cannot email or mail you anything stating what you’re negotiating bc they are not aloud to do that (which I am fully aware that is BS). I’ve had this happen several times and they wouldn’t budge so nothing got settled.
Not much help. Have 4 charge off accounts from a bad year in 2018 and can't do anything. Accounts are over 2 years old and paying them off doesn't improve my credit. By the time I could pay off 3 years had passed. I owed on one account $900 and offered them 33% and they refused and would only take 50%. Trying to buy a truck and can't get a loan. NO ! Statute of limitations in most states is 4 yrs. Anyways it will drop off your report in 1.5 more years. Time-barred debts can no longer be sued to get the money. Regulation F went into effect 14 days ago.

Take a photo or scan the money order after you fill it out to the debt collector, keep the stub as well and send it by certified mail.
Certified mail IS NOT PROVE of anything, except you mailed them something. I can mail a page of the supermarket ad and get the letter certified.😮

Make sure in your agreement that they will send a pay to delete letter to you and credit bureaus once you pay them what you agree on

Question, If you call to settle, wouldn't that renew the account, whether or not you agree to the settlement amount?

So in the Fair Debt Collection Practice Act book, 809.[ 15 U.S.C. 1692g ] section C. The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer. So that does mean the not responding in 30 means it’s yours?

Two things, first even if you pay they may not remove the debt from your credit report. Secondly, if you pay it won't that renew the debt on you report and make it seem new again to someone reviewing your report?

I follow all the steps you recommend but the original creditor sent me proof and stated they sold the debt to Portofolio Recovery. Since the creditor doesn’t own the debt how do I delete the original creditor from my credit report showing a a charged off. Is that even possible?

I called 1 Credit Bureau and they had me verify my name, DOB, SSN, and address. I was okay with this because they already have that information and I wanted to get rid of old and incorrect information. They then asked me to verify my phone number and I declined.
They then said they will have to find another way to verify me and tried doing so with asking about my debt history, I also declined to answer and told them I was at risk of identity threat. The lady insisted and so did I so we transferred to the supervisor who was really defensive, and nothing got done. I stood my ground he stood his and told me send my request by mail.

That sucks, as long as your name remains on the loan, you are still technically liable for payments. The first step is to get your name off that loan so you no longer need to worry about her making payments on time or not.
I would contact your divorce lawyer as you may be able to file an action for partition. Most divorces might specify who gets the house, but them getting the house is usually contingent on them staying current on the loan, and then refinancing the property out of your name within XX number of days. Since her getting the house in divorce is contingent on these factors, which she did not uphold her end, an action for partition can be filed which essentially forces the sale of the house which would then remove your name from the loan. Once your off the loan you can then go back and start to work on repairing your credit. But first and foremost you need to get your name off that loan.

I have a question. Background: I have a hospital bill that’s been on and off my credit report for over 8yrs now. It’s removed and then gets re-reported by different collections company each time. a company was reporting different information to the three different bureaus . it told one that it was a charge off and another that it was In good standing .
i followed your advice and disputed the item with all three bureaus with proof of the differing information .
the bureaus then sent to the company for verification AND THE COMPANY CHANGED THE INFORMATION FOR ALL THREE BUREAUS SO THAT THEY MATCHED.
then the company verified with the three bureaus and the item was not removed .

Has anyone had the problem of a marina address being a non-residential address therefore affecting their credit report? What do you do when you agree on an amount to settle a debt and they say they cannot email or mail you anything stating what you’re negotiating bc they are not aloud to do that (which I am fully aware that is BS). I’ve had this happen several times and they wouldn’t budge so nothing got settled.
Not much help. Have 4 charge off accounts from a bad year in 2018 and can't do anything. Accounts are over 2 years old and paying them off doesn't improve my credit. By the time I could pay off 3 years had passed. I owed on one account $900 and offered them 33% and they refused and would only take 50%. Trying to buy a truck and can't get a loan. NO ! Statute of limitations in most states is 4 yrs. Anyways it will drop off your report in 1.5 more years.
Time-barred debts can no longer be sued to get the money. Regulation F went into effect 14 days ago.
