    A lot of jurisdictions merge assault and battery together. If the defendant is held liable (civil) or convicted (criminal) of assault, this means both assault and battery. Weird!

    Ok so ive always wondered, in 5th there was a girl at the tetherball court who wouldnt leave so i LIGHTLY put my hand on her shoulder and said “lets go” and she started screaming and got her little mean teacher friend who started ranting about it bwing assault and i could go to jail for it so me “being a SMALL CHILD” started crying and calling me a baby and idk if its assault but could someone tell me? Thank you

      No never touch anyone. That could be a big issue for you in the eyes of the law. Always call the police. Never take matters in your own hands.

    A teacher hits students heads with books if they don't read. And he pushed my head (I almost fell) because i didn't go to class 0.22 seconds after the bell went

      Yes. It can. If a reasonable person (and this person) would believe that they are about to suffer a harmful or offensive touching.

    I have a question is this assault or battery?
    A boyfriend is mad and takes a swing at his girlfriend he fails to make contact with her not actually punching her is that assault or battery?
    And if the same scenario took place but this time the bf made contact with his girlfriend would that be considered assault or battery?

      The first instance is an assault, if she is aware of his attempt. In the second instance, it is a battery, as he harmfully touched her. If she was aware of the harmful touching before it happened, it is assault followed by a battery.

    This is just terminology - provocation by a bullying mob is not assault according to the mob. Self defense when one of the bullies acts out against the victim is not considered assault or battery. What is the chances that one person who has been battered on a previous occasion is bullied by the same mob at a later stage? Battery is then justified by the mob, especially when the victim thought that the dust has settled and the work needs to get done, rather than be further upset by evil people , then the cowardly revengeful unjustified dark horse hits from the side.

      Self-defense is usually considered justified. This is the only way one can use violence against another without legal repercussions. The person must demonstrate both a credible and imminent physical attack/threat against you, for you to justify violence against them, to stop the attack. However, once the attack/threat from them ceases to be imminent, so does your right of self defense. You certainly can't physically move against them for annoying behavior, or making insulting hand gestures, facial expressions, or their words, etc.

    So this just happened to me tonight, I wanted to show my friend #1 a RUclips video, and my phone was connected to my Bluetooth speaker, so I turn on the video and friend #2 gets annoyed with the video and says turn that off, I don’t cuz I’m just harmlessly showing friend 1 a video but I did turn it down, so it continues on and friend 2 says the same thing a couple more times also he said “You know if by the end of the night everyone wants to kill you” then you’re annoying or something like that after the quotes. And by this time I have turned it down even more, friend 2 advances towards me and says “this is your last warning”, I give no response but turn it down even more, then friend 2 quickly grabs my phone and tries to rip it out of my hands knocking my Bluetooth speaker to the floor. He frighten me the whole time cuz I know he’s kinda unstable when he’s upset, and yes in hindsight I could have turned it off and just gone to a different room to show friend 1. Is this assault? Was I in the wrong, because literally I never said anything threatening or provoking to friend 2 the video had no swearing or offensive content. Btw this was all in a 30 second segment of the video, cuz that was the funny part. I was being threatened and he was scaring me. I was just trying to show a video and I was attacked.
