      The thing is they need reasonable articuable suspicion of a specific crime. Yes it's suspicious and warrants them looking into it. And asking for ID is fine. But detaining someone or forcing them to provide the ID if they refuse is not. If the suspicious person chooses to not identify or answer question then the cop needs to investigate another way. And if they can't get RAS of a specific crime there is nothing they can do.

    To me, this encounter exposes something much worse than a cop who is ignorant of the law. The officer’s behavior makes clear that he DOES know the law, but doesn’t care about the law, and so, is going to violate it just the same. Telling the citizen, you’ll just have to take me to court, because I’m going to knowingly violate your Constitutional rights. Ignorance can be fixed via education. A tyrannical mind-set, on the other hand, can’t be. It reveals this cop to be irredeemably unfit for the job of law enforcement officer, and he bears strong firing.

      Furthermore a "state" cannot superseded the constitution. It's a big argument over 2A because states are violating the constitution. But freedom of speech, press, etc is 1A and has yet to be fucked with. Speaking of 2A alot of states are "constitutional carry" now.

      @@mrca9344 reasonable suspension in anything that is out of baseline of normal, based on personal experience and training. People being different has nothing to do with that it's reasonable for people to be different which can be normal in a lot of cases. All I'm saying is it's not normal to film a sensitive location without a valid reason. Asking what the purpose of filming a sensitive location is just as legal as filming in public so if you don't give a valid and reasonable answer then expect to be watched right back. This type of activity is antagonising in nature and definitely calls for further investing to determine if a threat is imminent. Something that I think we can both agree on here is that cops do need more social training and proper ways to conduct counter surveillance and avoid escalating unnecessarily.

That's hill to die on I guess. Cops do not need to be tested by the public, they need to be held accountable for bad deeds and the qualified immunity needs to be rewritten or dropped not abbused. Actual bad cops that are imposing on your rights are out there but this isn't one of them, being questioned about your actions is not taking you into custody or harming your rights. If that were the case we would all be suing each other to oblivion. Can you imagine coming into work and your boss stopping you to ask why you're 15 minutes late and then you say "I PLEAD THE 5TH!" 😂, probably not a good example but it's close.
      Instead of causing more issues for our men and women in uniform how about we tactfully come up with solutions that work. Here's some, more funding for better equipment, longer more practical training, quarterly psychological testing, DROP QUALIFIED IMMUNITY, free and easy access to mental health care for everyone (cops, firefighters, paramedics, general public), Incentives to do more community services to better law enforcement and community relationships, a see something say something law that punishes public service members for not reporting corruption or bad deeds within their organisations. My list can go on and on.

      I had video of criminal activity by an officer. He and a court clerk who warned him got someone to get in thru my iCloud and alter the video by several seconds. Destruction of evidence… his Sargent, internal
      Affairs, fbi, sheriffs, Texas rangers, attorney general. Nobody sees a problem OR if I could tell them who, how, when, where, and the address of the person who did it then they might do something.

    That’s why you don’t wait to argue it out in court. You are forced to take a day off from work, pay for court costs only to have it dismissed. That’s a perfect example of why you ask for a supervisor. When they knowingly violate your rights, they do so because they were trained to always assert some perceived perception of authority in all situations. What they don’t teach them is the basic tenants of the constitution!

      Which is perfectly fine, but when you can give articulable reasons as to why the behavior is suspicious, police have every right per case law to stop and identify that person. It is perfectly logical for that officer to think that he could be planning an attack on the Jail to break someone out or plant explosives or what have you. Just because you can do it, doesn’t mean you can’t be stopped and identified. Read case law, bro.

    The cop needs retraining. It's not "a reasonable and articulable suspicion," it's "a reasonable and articulable suspicion OF A CRIME." He already admitted that it's not illegal to film. Should have been end of story.

      “Reasonable Articulable Suspicion” is not actual “suspicion” of a crime. It’s a standard of evidentiary proof of a crime required to detain a citizen. Just as “probable cause” is the evidentiary standard needed to make an arrest, reasonable suspicion is the standard directly below, and required for the less serious “action” of legal detainment.
      Quite honestly, it’s poorly worded legal jargon, for at its core, it’s a legal standard that requires a loftier level of proof/substantiation/evidence then mere “suspicion”, or even reasonable suspicion. That this clown of a cop tried the “my suspicion is high enough to meet the standards of articulable suspicion” displayed a complete and utter lack of understanding/knowledge of the policy. Essentially, this standard exists as a means of safeguarding citizens from legal detainment resulting from a cops or citizens mere suspicions with no supporting and/or corroborating proof.

The Law Dictionary defines RAS like this: Reasonable suspicion is a standard established by the Supreme Court in a 1968 case in which it ruled that police officer should be allowed to stop and briefly detain a person if, based upon the officer’s training and experience, there is reason to believe that the individual is engaging in criminal activity.
      So, you see. LEOs have to have some reason to believe criminal activity is occurring. You can't stop someone for filming from a public sidewalk. You can't just stop someone because a caller freaked out about guy with a holstered pistol in an open carry state. Now, if, 5 minutes earlier, there were reports of gun fire and there's a body on the road, a crime has been committed and you're within your rights to see if that person with the open carry pistol who is just 4 blocks away from the scene of the crime is involved. That would be a reasonable suspicion you could detain for. You might even be able to confiscate the firearm for testing due to the timing and proximity.

      Honestly, the cop was wrong, but he wasn't acting like a bully.He was trying to do his job and he was just incorrect about the law. As soon as the other officer told him he was within his rights, he said okay.And walked away ending the detainment. The guy also tried to provoke a reaction by dismissing the officer and the officer said "Yes, sir" quite respectfully, i might add.

    Venezuela should be investigated by the FBI for the amount of times that he's violated the first and Fourth amendment Constitution rights of American citizens. It found guilty of any charges he should receive the maximum penalty allowed by law. Just for the fact that he is a sworn law enforcement officer, so he should know the laws and the United States Constitution that he swore to uphold. So therefore he is willfully violating constitutional rights and should be criminally investigated and prosecuted for those actions.

I dont know if it is wrong training they are getting or they have NEVER read the law that they are stating in this video but I still go by Fire this cop. This is the same with anyone that enforces the law. If he wants to hold a weapon and push people around join the military but remember that is where the other guy has a weapon also and shots back.

Nowhere can you find the authority delegated to government that allows them to rule over man. The authority given to government comes from the consent of the governed meaning man or mankind.
