I feel like this rule is very misunderstood. You’re not allowed to give African American Students IQ tests as a placement for special education. This is because of how biased the test questions can be regarding culture. Parents can sign a waiver to have their child tested for GATE., and there are a ton of other tests that can be used to test ability to learn, for special education purposes. The best answer is to update and change the IQ test questions removing the biased questions, but the protocol hasn’t been updated in a while. These tests aren’t just biased by race however, they also seem biased towards SES and experiences. If a student doesn’t have exposure to certain experiences they won’t score well on some of the questions.

If the Nazis used IQ tests to weed out inferior genes, the Jews would never have been persecuted. Ashkenazi jews have the highest IQ of any ethnic group in the world. This is proven and documented. Also, if the IQ tests were based on white and european culture, why do East Asians score so high? As nations, East Asians have the highest average IQ in the world.
