      I do investigations for accidents, injuries, near misses, and property damage as part of my work when called upon.
      I guess this showed up on my recommendations because of what my interests are.
      His commentary is very pleasing to listen to, especially since I hear mostly Texan, USA dialect.

    It is obvious that you have had considerable experience at sea and feel empathy with those involved. I was very pleased to see you come to the defence of the crew. It's always the captain/ train driver/ pilot that is blamed initially as they are an easy target and often used to deflect culpability from commercial failures. No wonder the channel is so popular, honesty, integrity and empathy are in short supply these days. 👍👍👍

      ​@@hb1338I don't think it's a differenc, exactly. I'd suggest it's more like a Venn diagram with one circle inside another. Culpability has a quite specific definition, even outside legal terminology. Responsibility, on the other hand, has a variety of quite wide definitions, in terms of popular usage, and as far as I know no legal or otherwise specialised narrower definition (feel free to correct me if you know of one).
      I can't think of a case where "culpability" wouldn't fall within one or another definition of "responsibility", but that's mainly because "responsibility" is a very vague term.
      I'd rather get rid of the term responsibility and replace it with"answerability", as etymologically they mean the same thing, but the latter is clearer to the average person.
      But back to my point to you - simply saying"too few people understand the difference " is a gross oversimplification. Have a good night/day (depending on your timezone)

      It is the standard of reporting rarely found. Having known a lot of facts behind stories on multiple occasions, the Financial Times is the most notable to stick to the facts. It seems the Yacht Report also achieves very high standards and flags where information is of a lower standard, for whatever reason.

    from a completely unrelated youtube set of videos of a missing person, they were found in a river with no water in their lungs which looked suspicious (like someone killed them and dumped the body) but various experts said that sometimes someone can drown but they won't have water in their lungs because of a reflex to close their passages and they die from that. but in this case if none of them had water then it seems unlikely that all suffered from this same scenario... it's amazing how a story can take various twists as interest collects more information from different sources, like staring at something under a bright light tiny details start becoming visible

      I wonder if the teen daughter also died of lack of oxygen, since she was in a room alone ( others were in a room of 5) and would’ve had more oxygen?

      Apparently, many people who drown experience a sense of peace and euphoria - this is a side-effect of the hypoxia that kills them.

      @@isaacchassman6453 They would have had to use it up first. They went into an air pocket hoping to get some time for a rescue. My thoughts are that it must have been agonizingly 'slow'. It depends on the size of the bubble how long it would have taken. Drowning would have been quicker.

    Thanks for another excellent report. The new information that the gyro heading AIS data was missing, and therefore the AIS reading incorrectly showed that the vessel turned, further reinforces the time-tested truism that you cannot draw conclusions about what happened in an accident before all the data is collected an properly analyzed. The CEO of Italian Sea Group suffered from so-called "motivated reasoning", i.e. that he was predisposed to believe that the vessel his company built was "unsinkable", and thus prematurely seized on preliminary data to blame the crew for the accident.

      Why didn’t they dive out of the boat. It’s not like they were trapped at the bottom of the titanic. Also, I mean friend one and group of friends two dying on the same weekend on opposite sides of the planet? Improbable. Friend one and group of friends two are billionaires who all collaborated in and won a court case pissing off some powerful people? Highly improbable. Friend one dying while on a run through a village using a fitness app tracking and predicting his location, group of friends two die of rare weather phenomeon pushing their luxury yacht down into the water from above? Sure. 👌The name of the vessel is bayesian as in bayesian probability as in reasonable outcome? Was there a glitch in the matrix or something?

      ​@@michelaborda4663 read somethimg that said the staircase would be hard or impossible to use if the boat was tipped in a certain direction at a certain angle. Some one more knowledgeable than me might have understood what I read. If the water was flooding in and it was dark, the passengers would be at a disadvantage even without the boat tipped.

(you put a question mark after it). 2) I'm a qualified and experienced audio engineer and I wouldn't be able to do either of those jobs (re "engineer is engineer") (although one of the two can involve Fourier analysis, as I've also studied - would you be able to tell me which one?) 3) To be clear I was asking how are they two sides of the same coin? I know as much as most lay people about what those two jobs entail, and I don't see any logical reason why you would say that.
      Anyway I'm off to bed, if you can formulate a logical response to all three questions I'll check it some time tomorrow (GMT); have fun in the meantime ;)

      2. Engineer is engineer, I forgot we had these audio "engineers" who are allowed the title without the degree. Sure you got your degree but it has nothing to do with engineering stuff, which both ocean and marine engineers do.
      You plug cables into mixers.
      While engineers make the stuff you use.
      Can you calculate the size needed for a cable running xA xP over distance through xTemp?
      Can you even use a calculator?
      Pretty basic stuff, so maybe you can.
      But like the engineer is engineer - I was saying engineers have the same base ground knowledge about how do technical stuff, except for audio engineers...
      I know where your title stems from, as you actually did need to hold knowledge of electrical engineering, which is not as much true in this day and age. Maybe some basic stuff.
      3. Thought you said you was an engineer? I'm sure you know audio engineers is not the same as engineers. You would know exactly what I was talking about if were an actual engineer, go back in time and then yes, you was an engineer, but now your title is basically "audio professional". not saying it's bad, you got a nice education, no doubt.
      I'm saying its not the same as real engineers because if it were, you would know.
      Ocean engineers focus more on installations, marine is more floating stuff. Both share a good few classes during education, so I'm saying two sides of the same coin because we meet in lectures all day long. I also share lectures with electrical engineers, and other engineers. But not with audio "engineers" ;)

    I drowned in a lake when I was 12. Was retrieved from bottom
    and resuscitated. I can tell you that drowning would not have
    been any less horrific that dying in an air pocket. You hold
    your breathe longer than you imagine you ever could. Time
    almost stands still and your life and thoughts pass like a movie
    in your brain. Then you breathe in the water. I won’t say more.

      Are you saved by Jesus Christ? I have had a similar experience when I flipped a tube and hit my head on a rock. I didn't drown but nearly lost consciousness and thought I was dying. I'm saved so I know where I will go when I do die. If you are not sure, let me know I'll give you the Gospel and you can decide.

      @@LiveFromLondon2 Indeed, I had a similar incident having my leg fixed under water. I struggled for a long time to get lose but not successful. I just cave in and came to complete rest. Not inhaling any water, just waiting for death. I guess people might only inhale after getting unconscious? Dunno. I was still fully conscious when I got lose by unexpected help. I was 10, maybe children are different.

    The difference between dry and wet drowning lies in the body's reaction and the associated physiological processes:
    1. Wet Drowning:
    In wet drowning, water enters the lungs.
    The individual inhales water, which blocks the airways, fills the lungs with fluid, and disrupts the gas exchange. This leads to a lack of oxygen in the blood, resulting in unconsciousness and, ultimately, death if no rescue measures are taken.
    Wet drowning is the most common form of drowning.
    2. Dry Drowning:
    In dry drowning, no water enters the lungs.
    When the body is submerged or comes into contact with water, it triggers a laryngospasm (a reflex spasm of the vocal cords), which closes the airways as a protective mechanism, preventing water from entering the lungs. However, this also stops air from being inhaled, leading to oxygen deprivation.
    In dry drowning, unconsciousness and death from a lack of oxygen can occur, even though no water enters the lungs.
    In both cases, oxygen deprivation is the critical factor, but the mechanisms differ.

      However there are now new criteria for medically declaring ‘drowning’ whereby the ‘wet’ and ‘dry’ distinctions are no longer current and multiple processes are included. Prior to this redefinition, there was not worldwide consensus as to what was and wasn’t considered as ‘drowning’. So the wet/dry dichotomy is no longer best practice. There are some other outdated terms that have been retired.

      The regulatory investigation is being conducted by MAIB (Marine Accident Investigation Board), a UK organisation with a very strong reputation for integrity.

    I’m not surprised some of the guest died from asphyxiation in an air pocket. As a diver i am dismayed by the long period of time before divers were on scene. The vessel sunk close to a big port just before sunrise and I’m sure there were police or commercial dive operations or even tech divers with trimix in the area. Within two hours you likely could have had divers in the water if that was made a priority. Even dragging down a HP air line and pumping in air would have kept them going.

      @@daversj it's going to take 2 hours minimum to locate divers at 4 am and get them in the water. That's an optimistic estimate. Those trapped in air pockets would likely already be dead by then. At 50m depth the volume of air available is just 3% what it is at the surface, so they would be up to their necks in water. The water is colder too at that depth so the question is, what kills you first? Drowning, asphyxiation, or hypothermia?

    Yes, there is a video (see among my videos here on YT) showing the ship drifting essentially "bow to the wind" for the entire duration of the video until it disappears (capsized?), in any case NEVER stern to the wind.
    We can confirm that in this case the AIS provided incorrect data.

      I have spent about 20 years of my life at anchor. If there is ever a movement while anchored, it is the anchor DRAGGING. Most times the bow stays pointed into the wind (or if the wind direction is changing, the bow will slowly turn into the wind). Sometimes, however, the anchor drags so fast that the bow "falls off" the wind until the anchor digs again.

      ​@@RayThackeray exactly, "until the anchor digs again". And if you watch my video carefully you will see the ship first bearing off (anchor is dragging) and then suddenly luffing (anchor digs). At that moment they are with the wind abeam and with the anchor acting as a constraint. If the gust of wind arrived at that very moment, it is easy to imagine how they could capsize.
      The anchor (dragging/digging) could be the main suspect in this tragedy.

      I think it is relevant that this was a tornado and not your typical storm. In a big storm like a hurricane the wind direction changes slowly as it passes over the vessel, it literally takes hours. This allows the crew plenty of time to reposition her into the wind, and when at anchor, it lets the yacht drift gradually to face the slow change in wind direction.
      The tornado or (waterspout) is such a compact storm that as it passes over you, the wind will suddenly change to the opposite direction in 30 seconds or less. This change is so fast that the crew have no time to react and they find themselves instantly facing the wrong way to weather the storm.
      One moment the vessel is facing the wind, the next thing they know she is beam on or stern on, which is not at all what you want to be in a storm.
      I also note that the forward lounge area had a "canvas" roof instead of a proper "hard" roof. It's quite possible this could have been ripped off by the tornado exposing this whole area to the storm. In any case, if she heeled over at 90 degrees the lack of a proper roof would have caused a lot of seawater to flood this area, and from there it would have easily entered the lower decks, wrecking her buoyancy and stopping her from righting herself. And of course the longer she was on her side the more seawater got in through this lounge deck roof, speeding her on her way to the bottom of the sea.

    I have heard of 'dry drowning'. where there's no water in the lungs. It is really sad to think that they were alive in an air pocket and died.

We as a family all got our yachtmastesr offshore to cruise along the whole of the southern coast of England from London to Penzance in the late seventies up to the mid eighties! Then due t a dear crew member, my uncle passing on we could not do boating anymore and sold her! R.I.P Uncle Alf!

      No. Both vessels dragged their anchors, so what? The Sir Robert Baden Powell got underway and was fine. It was a bad, sudden summer storm, but a properly built, properly maintained, properly crewed ship that was smaller and older had no difficulty overcoming the challenge the weather presented, and then conducting a rescue successfully.

    Hard to imagine what these people went thru in the last minutes... It's night, a huge storm hit the yacht, it capsises and it's on the side, so everything is messed up in the cabine, they stood on the wall and the yacht sinks. After a few minutes lights went off and wenn it settled on bottom of the sea. And just waiting, that someone comes to help before the oxygen runs out.... Sheer horror.

      If this were the guests first night on the ship they would have little chance of finding their way out through furniture clutter, passageways and stairs or knowing to open available emergency escape hatches in the ceiling. It is surprising that no mention has been made of available ceiling escape hatches.

    Wonderfully uplifting story about the crew who rescued the migrants "in peril on the sea", to use venerable old location. In an age of intergroup hatreds of many stripes and of vast and frankly unconscionable inequalities, poverty and vulnerability on the part of so many, it is deeply humbling and encouraging to be reminded that there are good people, and to be reminded of our common humanity. I salute Captain Kirby and his entire crew. These are peole to look up to, to honour and to emulate.❤❤❤

      Perini Navi Leadership: It wasn't our poorly designed ships fault, it was the crew who we immediately blamed with little to no actual evidence & the AIS data did not actually support & the position of the vessel on the sea floor indicates that what we accused the crew of doing did not happen, but it still isn't our fault & is somehow the crews. We are the Boring of Italian pleasure yachts, obviously like Boeing we'd never knowingly deliver defective products.

    Some many years ago we had the same problem passing the Azores , we had a 2nd yacht behind us , the same happened passing from Amsterdan to Rotterdam and where stopped by the water police and investigated. The result of this was that the AIS signal reflected against the mountains or to the high rise buildings from Scheveningen and Rotterdam so problem solved.

      It came as a great shock to me that the overwhelming majority of super yacht OWNERS do not have safety drills when their guests come aboard.
      Esysman did a video on this very thing following the sinking. I watched 3 other super yacht expert You Tubers say exactly the same thing. Clearly this is troubling to the captains who think safety first.
      If any guests wanted this info they would most likely not want to insult their host by requesting this of the captain too.
      As a person who is a natural risk accessor for myself and others safety this is amazing to me.
      I can't imagine "so many" corporate leaders who always access risk in their business dealings assume it's not necessary for them to due so on their super yachts.
      What I said was a logical and legitimate question which may or may not be answered in an (Italian) inquest.

    That missing heading data led to probably false theories that the anchor rode became entangled either the keel or the prop, and charges of crew negligence. Details matter. Thanks for clearing this up.

    Great job you and your support crew are doing. Unfortunately this story is just so tragic. I know for those of us in the yachting world at least me , honestly this could have happened to me , I don't think I would have had the yacht " buttoned up" in that place and time with that relatively non severe weather report.

    Balanced and informative reporting much appreciated, the Bayesian particularly sensitive subject. Curious about her anchored status following event and a reported missing tender. So much to glean from this, put blame aside from the survivors of a tragedy we can't comprehend. Constantino should retract his unprofessional and clumsy comments, he clearly has never experienced an event on this scale.

    I almost bought a 26.5 meter sailing yacht earlier this year, I backed out if the deal at a huge financial cost to myself as they didn't return the deposit after doing so, the yacht was to be refit with a new engine by the seller and 10 days before delivery the seller decided to chop up interior structural framework to try and make the bigger engine fit, basically ruining the yacht, I walked away immediately as I felt the yacht was no longer safe to take to sea. It was a CNB 87 Ketch fixed keel only one of it's kind in the world. Real unfortunate. It had me thinking on the larger yachts with the lowering keel, I am surprised there is not a mandatory emergency lowering system that say the yacht reaches a 30° or higher list that the system automatically kicks in and lowers the keel. I think this is something the industry should implement on all lowering ballast keel yachts. This could have very easily saved the yacht and everyone on board. Just my two cents on what could be done to prevent this in the future.

      Hmmmmm, I've got a slight problem with anything "automatic" on a vessel (hydrostatic release of liferaft and automatic activation of the EPIRB excepted). The harsh maritime environment is no friend for electronics. What works lovely from behind a desk in a well protected area on land fails after a short time at sea, the more sophisticated the faster it goes. Sometimes with dramatic consequences.
      With your example of the keel, as lovely as it might sound in one situation, it could be a complete disaster in different circumstances.

      ​@@dodystiller3718Nothing says that the auto release has to electronic. Hydrostatic release dystems are analogue and it's not the a big deal to make something that detects the angle of heel. An inclinometer for example.

      In this instance, according to the video footage, the Bayesian remained upright until it suddenly and catastrophically capsized. There wouldn't have been time to lower the 60 tonne keel but I agree had it been in place (lowered) it would have helped stabilise the vessel.

      Not sure the retracting lower part of the keel on the Bayesian was the major part of the ballast , more a foil to aid sailing to windward. If the lowering section doesn't contain the ballast section it has much less effect on the righting moment when lowered. In any case the yacht had no sail set so the force on the rigging would only be a fraction of that with sails up even with very high winds , I feel something else was going on in addition here.

      @@Gfc22 Okay. But, let's make up some quick real-life stories: the vessel has entered a port with 8 m of depth. While maneuvering she's getting hit by a proper gust ... Or suddenly another vessel appears out of nowhere and she's got to try a quick last-minute maneuver to avoid a collision ... Or, there is a hoolie blowing and she's entering this port to hide out for shelter. Something goes wrong with docking and she hits an obstacle. None of them really situations where you would like the keel to dig into the seabed and hinder you from any evasive actions.

    7:34 What was that Mr Constantino? Did I hear you say " The inevitable sinking of the boat"?
    That sounds a lot like a confession, seeing as you were able to state this with so much confidence before any investigation. Seeing as your company produced this vessel that was apparently compromised by design, it would be only fair to recognize your authority in matters of the vessel's shortcomings. This all has unveiled a massive design flaw. What matter of convenience would be so urgent as to ignore the risk associated with the engine room having a giant opening by the waterline? It only takes one wave. One.
    "Don't turn that way, she'll sink." Was that in the brochure?

      That isn't the problem with the Bayesian. She didn't sink to port, she sank to starboard. Two separate watertight doors in series would have to be left open for that scenario to occur and then both of them not closed in the multiple minutes they had before the capsize. In short, Constantino is using that as a device to accuse the crew of gross negligence, and it's absurd.

      Most of what we have heard from the crew have been snippets leaked to the press by the judicial investigation. I speculate - if the vessel was already heeling when it started to drag its anchor, steering it may not have been the highest priority task.
