  • Daniel Penny, 24, gave his thoughts in a series of videos released by his lawyers just days after an interview where he said he had a moral obligation to protect his fellow passengers. Neely, who had been struggling with mental illness and homelessness in recent years, died after being put in a chokehold by Penny, who restrained him with the help of other riders. The May 1 incident was captured on video. 'I wasn't trying to choke him to death' Penny claims in the video that aims to tell his side of the story.

      well, you are allowed to act, that much is true... as to whether those actions are legal or just will be determined in court.
      what i saw was a well crafted speech, likely by his lawyer.

      he'll get his day in court, that's about as objective as it gets... you on the otherhand have subjectively pardoned this man for his acitons, without even hearing testimony or seeing evidence, all based on your feelings.

    thank you everyone for your comments and opinions I still think that he applied to much pressure but what would I do if in that position fear is a horrible feeling .

    This dude should have exercised his 5th Amendment rights. For example, how does he know when the video recording(s) began? Does he have all of the recordings? And if the video recording didn't begin until "after things were under control", why the need to record at all? It would seem that if the video recording began AFTER Neely was placed in the chokehold, then someone must have believed that the chokehold actually escalated the situation and that it needed to be documented. Notice that it wasn't Neely's behavior itself that warranted video documentation, but the response chokehold, which suggests that Penny's actions where more egregious than Neely's behavior.

      As somebody who is trained in jujutsu and has used the RNC more than once that's simply not true. While it can kill somebody it's very easy not to kill somebody with it you can also just restrain someone with it or put them to sleep.

    people threaten to kill somebody alot so a verbal threat is words there was other men that could've jumped in a subdue this man also but this Mr. Penny should have realized that the pressure on the throat is dangerous and didn't need to hang on for 5 to 7 minutes when his body went limp time to stop

      @@avenue8822 Second degree manslaughter doesn't require proof of intent to kill. The point is that if he was going to subdue Neely there were less lethal methods to do so.

      My opinion is that he used reasonable force. Just my opinion.

    Chock hold someone for over 3minutes Is definitely Overkill,You only need 10-15 seconds if done properly.
