Most jurisdictions in the US throw out prenups in favour of statutory rights. E.g. California. Also, it is incredibly easy for the woman to spin a sob story about having been "coerced". One basketballer wisely didn't go to his wedding because the woman put off signing the prenup until the wedding day. If he had said something like, "I won't marry you unless you sign the prenup", that would have counted as coercion.
In Canada where prenups rarely work, men are requiring women to sign the prenup on camera whilst issuing a statement that they are signing it of their own free will. Even so, it can still be argued if she lies (or tells the truth) that the man told her it was prenup or no marriage. Bam!
