    Wow, this was pretty clear cut and forward. Thank you. I was just in an accident myself, and it’s very confusing. I do have medical as well as a property claim for my car… the other driver was at fault. I had ER visit, specialist for my arm, and ongoing chiropractor for at least a month. The hard part is to tell if I NEED a lawyer, or if they are doing what I can do myself.
    Do I take my bills and submit them to them? How do I know if I’m getting screwed?
    The lawyer option is great… but what if the total payout is 5000$ and the lawyer takes a third?

      Sometimes you need an attorney, and you need to be aware the process will be slow, and they will get paid 1/3 to 1/2 of the total.
      If you have injuries, you can file on your health coverage first or your employers workers compensation if employment related. Both case they will try to recover from the other party.
      On property damage, you can file on your collision if the other party is not accepting fault. You will have to pay your deductible, but the company will try to get that back for you too.
      To make sure you are not getting cheated:
      1. The other party should pay you your wages and other expense if it is a result of the claim
      2. They other party should pay all medical costs
      3. They should repair or replace your car with like and kind. Not new for old.
      4. They should provide a rental car while yours in not available.
      Understand this is all subject to the policy limits of the other party. All liability policies have a limit they will pay. This is something you decide how much you want to buy.
      Common limits are
      $25,000
      $50,000
      You can buy as high as several million.
      scenario:
      Policy limit is $25,000
      Your damage is $30,000
      The policy will pay $25,000
      you will need to try to get the other $5,000 from that person or pay it yourself. Yes, that sucks,

    This has definitely not been my experience, my wife was in an accident where someone rear-ended her 2021 MB GLC 300. We filed a claim through the other person's insurance who had Geico, they didn't give her the same style vehicle or similar because they said the state of TN doesn't have to so she was stuck with a compact car from a SUV. Next, they didn't cover the full cost of repairs for her vehicle claiming that the repair shop we chose has higher rates than what they pay out and the remainder of the bill is on us. I am currently still fighting this fight with Geico.

      I am sorry to say that Geico does not have the best reputation for claims. I do not, nor would I represent them. We are very selective about the companies we represent. Regarding the rental, most companies will try to put you in a similar vehicle, with limitations to availability and state law. Right now rental inventory is very low.
      Regarding the repairs. All companies will only pay what the "standardized" rates are. The industry provides a list of what those should be. Some body shops will not adhere to those, which does not bind the company to those rates.
      Keep in mind that most body shops accept these standardized rates and have a healthy profit margin.
      These standardized cost structures are there for the protection of you the consumer.
      It could be that the body shop you used is overcharging.

      @@bonmam9511 Not always, but in a not-at0fault accident, it is more likely. Don't go to that option to fast as you may slow the process down. Also, if you have Uninsured Motorist coverage, report to your company and they will represent you.

      ​@@joshs9066 it is a system where another person (insurance company) agrees to take on your financial responsibilities for a fee. There has to be limit and exceptions to what they are willing to pay or there would not be a way to price the product. It is a two way street.
      Any sort of property insurance is optional. You do not have to buy it.
      You can opt to buy a bond in many states to meet your insurance legal obligation or you can buy very low liability limits and then represent yourself legally and pay for financial obligations yourself.
      These are options.

      unfortunately, a few companies are very tight to pay. But this is not typical. Also, We do not work with companies that have unfair claim practices. If you work with an agency that does, you might need a new agent.

      You’ll almost need an attorney every time to get YOUR insurance company to pony up.. So in the end, you’ll likely be spending money on the policy + attorney fees + deductible of course.. This is why I strongly see auto insurance as a scam.. I live in FL and I stick to my basic PIP insurance.. I try my best to drive safely and I’m prepared to fix any minor damages on my own.. The only reason I have car insurance is because it’s required by law.. I likely minimize my expenses this. Convince me otherwise!

      Exactly! I got my corvette totaled by State Farm and they did a comp for 15k and then told me it they didn’t add mileage and it was worth 22k and then repairs came at 14k and still won’t repair it ! They’re trying to take the vehicle and make money off it !

    my son was rear ended. got police report and forwarded info to our provider. The gave 3 shops available for estimates. we chose one and dropped vehicle off. We called a week later and was told "we just had to order parts and we are waiting for them to arrive." Later that day we received an email from our provider stating that the vehicle is a total loss and we are being offered a settlement. Moments after receiving the email, we received a call from Copart stating they were ready to come tow the vehicle and needed the keys. This all seems shady and I don't want to learn the hard way. He still owes on the vehicle.

      I would talk with the adjuster to see what is the case. Also, they will have you sign a form releasing the auto before it is totaled. have you received this?

    Thanks for the informative video, it was clear & educational.
    However, a situation that did not seem to be covered is, what should someone do (who was in a vehicle accident that was not their fault) regarding a vehicle accident, where the vehicle (owned by the person who is not at fault) is determined a total loss by the insurance company (that insured the "at fault" individual), & that insurance company offers a "payout" for the "total loss" vehicle that doesn't meet established market value (determined by "Blue Book" valuation, & other reputable vehicle price guides) for the "total loss" vehicle?
    I suppose the answer probably is: "Obtain the services of a lawyer."

      That is where I am at. Hit while at the red light, waiting to turn ( 20-25 cars ahead of me ). 2004 truck 292k, great condition ( with receipts ) engine replaced. Claim advisor, ( mine ) said it would probably be a total loss once I mentioned that the rear differential was damaged ( along with bed, tire well ,tire ,leaf springs) , and all was well until that was mentioned. " Well that's another whole animal." was his reply . EVEN IF it is truly totalled , KBB is below the value of THIS truck ( based on the fact that the estimate is drawn from the condition of the vehicle PRIOR to the accident ). 7k in receipts that show in the performance and mileage (200 mi. IN CITY ! ) , and appearance. A paint job wasn't a priority. Yet , the paint is far from horrendous. Looking on how to dispute , what I am confident , will be a low low offering .

    My agent said it isn't their responsibility. I am dealing with a company who manages claims for a self-insured national corporation whose on duty driver hit me.
    Their adjuster finally decided to total my car (after 3 weeks). They only covered a rental for 2 weeks.
    They are not willing to pay an amount that I can use to actually replace my car. They told me to call my own insurance if I don't like their offer.
    I haven't even submitted medical bills yet. Absolutely a nightmare. My only option is to beg my insurance agent to get involved or file a complaint with my state insurance board and wait months for arbitration where I could still get the short end of the stick.

      Sorry to hear the claim is going so poorly.
      You can report to your insurance company directly and skip your agent. Then find a new agent.
      You need to report the medical bills to them to get them to take care of that.
      If the car it totalled, they will limit the time they will pay for rental. 2 weeks seems fair to me.
      Regarding the value, you can get a second opinion on the value and submit to the adjuster, but a better route may be to file under your collision coverage.

    I just had a DRUNK 18 year old hit 4 parked cars and 2 of them were mine. My insurance company is lowballing the value of my vehicles. I am not in a position to take out a loan nor incur thousands in expenses. I have no one to help me. Thanks for your video

    We talked to the adjuster 1 time of the other driver’s insurance about the crash. He has never returned a call. 4 people have tried to call him about getting a rental car. That includes car rental place, our insurance agent, and myself and wife. He said they don’t direct billing in the first call. He stated they only give us $30 a day. He will not return the car rental’s call about making a reservation. We’ve been waiting for 2 weeks. Our agent says he should just handle it since the other insurance won’t respond to anything. We sent this guy and his supervisor the police report. Still no response and the report shows their driver was at fault. The only thing the insurance company of other driver wanted us to get and agree to was a injury check for 2 of the passengers. That literally got to us. The crazy thing is that we did get a letter a week later from the adjuster that we would be responsible for the storage that we sent our car to until they picked it up after the accident. The funny thing is they towed it from the other wrecker service a couple of days after the wreck but sent us that letter. I called him and left a message of course letting the adjuster know that the car is no longer at the place since they took it to some car auction place. After the phone call, someone disabled the tracking device since I knew where it was. They have never updated us where our car is or if the car is totaled or not. Should I sue them?

    I recommend that EVERYONE gets gap insurance at the back so that they’ll never be upside down if their vehicle is totaled. My brand new motorcycle got totaled and I would be upside down if I didn’t get that gap insurance.

    How should you deal with diminished value in this situation? My car was a certain value before the accident but even if it is repaired the vehicle will be permanently less valuable and/or desirable for resale.

      There are some rare endoresements you can add to your collision insurance to help with this. But it is rare.
      If liability from another parties insurance is paying, then push for the diminished value from them.
      You can get your car appraised post accident and pre-accident then present those numbers to the company.

      @ maybe. This is going to depend on the insurance companies policy language. I think you should ask for it and try to provide something to prove the difference.
      I would ask for it and think you deserve it. You may not get it, but it does not hurt to ask for it.

    What about when you’re going through the other insurance company of the driver who hit my car and damaged a few others? It’s been a month and I have no rental and my car is still not fixed. They are saying they can’t do anything until they have all the amounts for each car or whatever saying they only have 25k for payout. I’m sure they have more they can dip into they are bugging. As of right now my damages are 5k - I was the first one to call and the first one to get an estimate. She said to get a rental and keep records but if they are saying they might not be able to pay how am I suppose to get a rental when they are saying they might not even cover all my costs. They want me to pay out of pocket and reimburse me later but they are saying they might now have enough. So wtf am I suppose to do. This is so frustrating.

      The company will want to speak to everyone first, but there has to be a limit to how long they will wait. It can't go forever and a month seems long enough to me.
      I would push them on this and the rental car.
      If you can't get anywhere with them and you have collision insurance on your policy, you can file there and let your insurance company take care of dealing with the other insurance company.
      If the limit is $25,000, that means the company will not pay more than $25,000 TOTAL for all damages for all parties. If your's are $5,000, I would think you should be okay.

      I was rear-ended by a Peter Built TRB ( 18 wheeler commercial truck), and I have experienced some soft muscle and cervical injuries. I use to work as an independent Catastrophe Property Adjuster for 20 years, and I don’t know much about vehicle insurance. It makes me feel like a fish out of water. This towing company has accepted liability. I have an attorney and the accident happened 3/25/24. I just want to get better and have my vehicle repaired. I was left with some residual PTSD because the truck hit me and it just continued. Thank God I had the wherewithal to turn my wheels as he moved my little chevy on the curb. The witness saw everything and told me that he was afraid for me because it appeared as if he was going to run over me. All I see is the large grill when I think about it. The vehicle is still drivable but the trunk will not close and the back is bent inwards like a soda can. I have my first chiropractor appointment tomorrow.

      Follow the advice of the attorney you have and make sure he understands any medical issues you are having. Make sure to have a good conversation with your doctor as well to make sure you will not have any prolonged health issues from this event.
      State laws are usually in place to ensure trucking companies have large liability limits, so your medial and property damages should all be taken care of.

    Love your channel, so informative! My car was totaled i wasn't at fault, and my adjuster has worked out a settlement and rental up until they reached sett. However the other persons insurance claim dept. Continues to call leaving messages curious about property damages or rental needs.. is it possible to recieve compensation & reimbursement from their party as well? Not sure if this is potential 'double dipping'?

      Sorry, I thought I replied. Yes, called subrogation. Potentially there may be money to be collected from the other part still. You want to check in with your company to be sure they recovered everything they paid, that they paid any deductibles you have on your collision or medical insurance. You nor your insurance companies should be out of pocket for anything. Then you can talk to the other company about diminished valued to your auto. since it was damaged, it will be worth less. They should pay for that. If you have any other expenses due to the claim (lost wages, fuel expense, etc) the other company should pay that too.

      you can; you will need the other party to collaborate or provide some other form of proof, though. Otherwise, it is your word against their word.

    I was in a wreck a few weeks ago. Other party is at fault. My car was totaled. My insurance is only willing to offer me about $10,500 for it. I've been trying to get more for it as I think that's a little low. It's a 2012 honda civic exl with only about 106k miles. Will the at fault insurance be responsible paying my insuarance back whatever they pay me for my totaled car? Will I also get back the 10k of my own money that I'm out now to get a used car. A 2016 Honda Civic EX with only 14k miles on it. I also had a rental car that my insurance paid for that's on my policy. Had that for 10 days until I was able to get my own car. My insurance paid 80% & I paid 20% per day to have that. I want back every penny & I hope my insurance gets it back for me.

      You will only get the value of the car. If it is low, check with some online dealers like autoteader.com and cars.com with the same vehicle, miles, year, etc. See what that comes up too.
      if this is different, present a few of them to the insurance company.
      If your company pays first, they will try to recover the money back as well as your deductible.
      If you are making payments on the car, the company is required to pay them first.

    How do people without insurance renew their plate and registration every year? Do their DMVs not ask for it at renewal? Also, if a cop spots them while driving and stops them for having an expired tag, do they impound the car and report it to the DMV? It seems to me that uninsured drivers always get away scott free no matter how much damage they cause and those of us responsible drivers are suckers for having insurance and paying outrageous rates to cover up for their recklessness! I think the system is rigged against the injured party and protects the reckless drivers who know that and that's why they disregard the law.

      Some states are better at regulating this than others. In Louisiana, insurance companies report to the state when a registered owner has an insurance lapse and then flags the persons registration and license as well as fines then. The fines are a lot in Louisiana.Then if they get stopped by police, their auto will get impounded. Also, they can not renew their their license plate or drivers license until they prove insurance and pay the fine.

      There are ways to get fake proof of insurance, that is what alot of people do. Honestly you can't blame some people especially young drivers because they want $400+ per month for car insurance. That is enough money to buy a brand new car

    Hi, I’m wondering what can be done when the accident occurred on “private property” (gas station lot), and the cops refused to come to the scene of the accident. I live in a fault state and the other driver who was at fault totalled my car. I am now not only left with a $500.00 deductible to my insurance company, but also not getting nearly as much as my vehicle is worth in a settlement. We have video surveillance footage that could be potentially accessible, is it worth contacting a lawyer?

      I am so sorry to hear about your accident. In some states, the police will file an "incident report". Not the same as a "police report". it has less data, but they may not do that there.
      I am assuming if you are paying a deductible that their insurance did not pay and your insurance did. . Can you clarify this for me?
      If that is the case, why did the at-fault driver's insurance not pay?

    Recently in a car accident, the at fault driver never reported te crash. My insurance has been trying reach her but to reply. Her OWN insurance has been try to contact her for a statement and Still nothing. I found out shes a deputy sheriff, what should i do now?

    Our car was a total loss after we had a car accident but it was not our fault. My insurance paid off the remaining balance on the car but that's it. That is not fair for me and my family!

      The insurance company for the person who hit you should have paid the value of your car based on market value. Did they not do this?
      You mentioned "my insurance paid". Did they just pay the loan balance after the other company paid the market value?

      ​@@ladjkaoz the only way you can get loan pay off is if you buy either GAP insurance from your dealer or Loan Payoff from your auto insurance company.
      Typically you can only do this at the time of purchase of the auto.

    I was involved in a accident 9/8/23. Due to a driver who didn’t stop a red turn light and as I crossed the intersection he pulled out with out stopping and hit me going over 50 and in the process turned into my lane with out a blinker and hit my passenger side. I laid into my horn but he didn’t even bother to move due to how fast he was going. The impact pushed me into the median in the shoulder lane and damaged my whole driver side. My air bag went off when he first hit me and my car stalled out when it got pushed to the median. My car was dragged along the median curb to a stop where he separated and kept driving down the road to where I though he leaving. I couldn’t get out of my car at first since my driver door was stuck or something. My head hit the side pillar by the seat belt retainer during the impact. The air bad blew out next to my right ear. My left leg and arm/elbow is still in pain. I still getting bad headaches and random gas smells. Not sure from fumes of airbags. I check the other driver was okay. We exchanged info.
    I called my insurance for tow but was before business hours. So I called AAA. When I got done UCI police showed up. Female cop asked me what happened, but then Irvine pd showed up. So when I asked for the police report. They said no took one since the property lines were undetermined whos agency it was. Newport? Uci? Irvine pd? So I was like what? Meanwhile the uci female cop was rushing the tow guy and me to leave the site. I wish I recorded it but my hearing was ringing so loud and my head was pounding alone with my adrenaline. I was in shock that was wasn’t seriously hurt. AAA guy said my car flipped then started to charge me 350$ to drop my car when I got home I said no, the agent said I’m covered since I have premium. He said told me because of broken axel. But put on the report the car flipped?? Hmm then as I’m on the phone he hands me his card and took my car to the yard. I said no out my car down. He said nope and took off even though the insurance agent said not that they have a private yard. But yeah. I guess this yard has issues and have my insurance adjuster a hard time even cussed him out and hurried him up.
    So now a month later. My rental time is up. Due to work I haven’t been able to go to chiropractic and I don’t have real health insurance just medical and every doctor place ask for charge and I literally can’t finance me to go since I’m already broke. Lol
    Ive never really been in a accident like this let alone a side movement accident. Man this really hurt and sucks man. The other insurance and my own insurance has Declared the other driver %100 at FAULT.
    Now I’m being told the other insurance wants to hear my story again while I’m still waiting for a check to go get another car because I need one to work and can NOT AFFORD TO MISS WORK.
    I feel like I’ve missed out some other info but yeah. That’s mostly it.
    Any ideas?
    I’ve been hesitant to get an attorney because I feel like I’m gonna get robbed like I’ve have in the past when I was a lot younger in my last accident over 10 years ago.
    Help?

    The insurance of the other found their insured at fault, came up with an estimate, and when i took to my car to the body shop got a different estimate. I requested a check for payment made out to me for the amount of the estimate of my preferred bodyshop and now they are refusing to pay.

      Many policies will provide for aftermarket parts as an alternative or required unless not available.
      I've never seen a policy that states you have to use "recycled parts". If this is what your body shop told you, they are mistaken or trying to mislead you. Again, I have never seen a policy require you to use used or recycled parts.
      Regardless, there is no harm in having that conversation with your adjuster. My advised is always ask, no harm in it and you might get a yes.

    My car was hit yesterday while it was parked in the parking lot. The culprit fled the scene. I noticed it when I came from work in the evening. I reported it to the police and they straight away told me that they would not bother to go through the whole 8 hours footage if there is any (as I could not see any cameras pointing towards my car) while it was parked. Also the insurance company is asking me to pay $1000 deductible even though I am not at fault. Please suggest what can be done on this. I am really frustrated.

      So sorry to hear it. Unfortunately, if you are filing under your insured, there will be a deductible.
      How large is the claim amount? if not very much, you may be better paying out of pocket. I am sorry to break that to you. Reply and let me know, I will give you advice on that.
      If you have Uninsured Motorist, you can file there and the deductible is usually $250.
      If there are cameras, maybe you can view the footage yourself. Worth an ask. I might also report the issue to the chief of police, I don't think they can't investigate a crime. Which is what you have.

      The parking lot authorities would not give the footage out to public. Its so pathetic, whats the point of having cameras when no one would bother to go through the footage. At this point, $1000 is a lot for me to pay out of pocket thats why trying my best to get a footage by looking around.

      That makes it tough. You may need to file under your insurance and hope that the insurance company can track down this person. If the person is an employee in a company car, contact that company. They should have a person that can handle the claim for you.

    Can you give me some insight on my situation. My truck is fully covered including gap and kbb only rated it as 56k however it’s not even two years old and I paid 84k for it. It’s a 2022 Silverado 2500HD LTZ Z71 fully loaded. My wife, kids, and I were involved in a traffic collision where the other driver is suspected to have been intoxicated and 100% ran his stop sign and we hit him in the intersection. We were on the highway and we did not have a stop sign. We were going the speed limit he was as well. I have obtained a lawyer because someone is going to be buying me a new truck to replace my 84K truck.

    If anything tell your insurer just so they know what is going on. They will have a much easier time defending you if the other driver tries to sue you or or tries to lie about what happened. Please don't think your agent is going to be annoyed with you for telling him about it. If anything not telling them is what might annoy them when they find out later. Also if you have any dash camera video showing it make a few backup copies and give one to your insurer. Maybe these days they have a special website it can be uploaded to and you just have to fill out a short form to tell them who is sending it. Also If they do they should ask for vehicle specific information on your vehicle or maybe some sort of PIN preset for this. This way someone can't send stuff claiming to be you for any reason.

      I think this depends on the severity of the accident. If you struck your head or had a jar that left you stiff or sore, then yes.
      The insurance company of the at-fault party would decide if they will pay or not, but they should.
      Also, your health insurance will pay upfront and will try to recoup from the other insurance company. If you go this route, you will have to pay your deductible, but your health insurance company will try to recoup that and the expenses.

    Police wont always come out or do a police report. 1/2024 - I was hit w/damage in back, called police, who balked at sending a cop out, but did. Even the 911 guy acted irritated! The guy from out of sdtate who hit me did not have an insur card & took him 1 hr to get it digitally! The cop said she'd only file a compalaint if he did nt find his insur info! I called his insur co & filed a claim. Germania Insur called the next day. He didnt even call them till 2 days later!

I have a lawyer and we have filed a claim thus far, waiting for the adjuster to call back. What really pisses me off is the drive clearly wasn’t sober but was let go 😢. I would have been badly injured if I was inside. He hit my parked car then his car flipped over. Ridiculous

      The tow company does not have the authority to decide that. The insurance company that accepts responsibility for the damages will. decide that.
      Understand it you have an attorney, the insurance company (adjuster) will not be able to talk with you since the attorney will require you to sign to accept them as your representative. This likely will slow down the process. I just want you to be aware.
      Is the other party's insurance company accepting responsibility for damages to your auto?

    Got blindsided with a T-bone accident, the other party has State Farm reached out to me and stated that their party is at fault. They are claiming that my car is totaled but haven’t physically assessed it yet and are lowballing me with a check to replace my car not to mention only approving me a rental for three days and stating that they would only start covering my medical expenses after the first $10,000 because of PIP. I feel like I’m getting the short end of the stick. What should I do?

      You can get a couple of estimates from dealerships or look up a car similar to yours on a site like Cars.com or Autotrader.com. State Farm is supposed to pay what it costs to buy another just like your car. If you can't find one, then prove it to them and they will need to adjust.
      Regarding medical, if they accept liability, then they have to may medical up to policy limits.
      The exceptions on medical are usually related to state laws that could be in place. Example: In Louisiana if you do not have insurance, you can not collect the first $15,000 in medical.
      Your state may have a similar law.

      Sorry, you will need to ask a NJ agent on this one. No fault could mean a lot of different things in the state.
      I suggest googling Auto Insurance and see who has the highest google ratings, call them, or call your agent.
      If you have a 800# agent, I would suggest calling a local agent, as they are usually more knowledgeable.

      It could be that one is not available depending on where you live, or the company may have some policy language that would limit them from doing so.
      If this is the case, the owner of the policy, the person at fault for your damage, has a responsibility to take care of this for you.
      If that is not the case, they have to provide you with something that can keep you able to do your job, as well as lost wages, if that is the case.
      Ask for the supervisor is my next suggestion. Then the other person's agent.

      it is your decision. But insurance companies make agreements with some body shops, they usually call them pro-shops or preferred shops. The benefits of using their preferred shop is greater warranty on the work being performed and if additional damage is found, the body shop can work directly with the insurance company without any hassle to you.

      That could be a real problem. If you are in an accident, try to take pictures of the scene of the accident as well as how the cars are at the time of impact. Also, pictures of driver's license, ID cards, and license plate.

      You not having insurance typically does not eliminated an insurance companies responsibility to pay.
      Only instances is if you are in a state that requires you to have insurance if you own a vehicle. In those states, if you own and auto but don't have insurance you may be limited on what you can collect.

      if the other party was at fault, them being drunk does not negate their responsibility.
      For vehicle damage, you can file under your collision and allow your company to pursue the other part.
      If you are seeking medical, your heath insurance company will try to recoup those costs from the other part.
      If you are seeking other damages, a lawyer is what you will need.
      If the attorneys you talked to are declining, then it is either because:
      1. There is not enough money in it
      2. They don't think there is a good enough case
      3. They don't understand the circumstances
      I would call the other insurance company back and demand they show me where the policy says they don't pay because the driver was drunk. I am pretty sure there is not an exclusion for that.
      Regardless, the other party, sill is at fault, it is just a matter of getting them to pay.

      If you have a police report, you can report to the other parties insurance regardless. That company will want to talk with both of you, but it is not necessary.
      It may not matter that the other person is not listed on that policy as long as she is not excluded.
      If that lady is excluded, there will be no coverage under that policy.
      Then you will need to do one of 2 things:
      1. fille under you insurance, or
      2. hire an attorney to file suit against that lady and the car owner.
      This is one of the few instances I suggest hiring an attorney.

But I just recently had installed birth sides axles kia brand 1,000 I paid from kia. I have proof. In the accident that’s exactly what they broke all How can i make them also cover my new axle and not just the value of the car. I had invested in my car Even after accident. Engine still turns on and no problems not heating. Can can be fixable.

      they should include the value of the axels is you provide proof, it will not be in addition to what the axel cost would have been for stock. They would pay the additional for the upgrade and the less age. A copy is going to pay the lessor of the repair or market value of your car. The value of your auto is greatly affected by age and miles.

I emailed them all details about the accident 3 weeks ago including pics and videos and I’ve called and emailed them 2-3 times a week only to get a response last week that they’re waiting to hear back from their insured client who’s at fault.

      In most states, 30 days is what is required by law.
      3 weeks is too long. We usually see a timeline of from when the claim starts to when the vehicle is in the shop is about 2 weeks. Then you are at the mercy of the shop.

      You need to get your agent involved. They can help you with this. The special seat and any other equipment would have had to be added to get paid for that. Otherwise, the policy will only pay for originally installed equipment.

    I was sick I let my friend drive my car, he dropped me off, and parked the car, when he went to get the car from the parking lot he got involved with the small accident hit the bumper from the back whic has small dent, I wasn't in the car in that moment.       Is Traveleres not renewing for this one incident? I am surprised, they are a very good company, but it could be that they are leaving for other reasons. They may be leaving that area or agent. Ask your agent to help with this and to explain this to you.
      It is best to file this with your insurance company and let them fight it for you. They have the best resources and will represent you.

My insurance provider said that I was on my own since I didnt have collision.       if you do not have collission insurance, then no, you can't sue your insurance provider. You don't have the coverage necessary.
      Your insurance agent can give you advice; there is nothing they can do past that.
      If you have any witnesses, if might be time to bring them into the claim.

They want to pay it out of pocket, however the person they chose is charging $550 and they say they would just fix the door panel and paint the rear door a little to match.       that is hard to say. Two things:
      1. If more than one auto body shop with strong reviews said you need a new door, then I would push for that.
      2. It is possible that the company would pay for a whole new door.
      I understand the other party wants to pay out of pocket; they do not want a liability claim on their insurance, but they need to be fair.

      Many times the company will put a "skin" over a door to repair it. If the integrity of the door or the function is really affected, then you need a new door and insurance should pay for that.

      You will have to wait on the legal process now since a lawyer is involved. Do not try to deal with the insurance company directly as they legally cannot. They have to deal with the lawyer. If the lawyer does not pursue the PIP, you will need to hire another lawyer.

      Call the adjuster back. It may be that he called but the number showed up as a robo call or something.
      Call them first. Adjusters spend a lot of time on the phone, so if you miss them, try again.

      Very sorry to hear of the difficulty. In your situation, you are doing the best thing you can do.
      Your insurance company will do their best to re-coup any cost and your deductible from the other part or other party insurance company.
      If you can't get anywhere and you know they are at fault, you could hire an attorney.
      Are there any witnesses or video footage available? Maybe a dash cam?

If you have a police report, you can report the claim yourself to the insurance company of the person that hit you. If you need help from there.       yes, it can. Potentially though, you may have an issue where the value of repairing the damage from the airbag is greater than the value of the car. In that case, the car would be considered a total loss. You then have the option to repair it still, but you would have to negotiate with the company to buy the auto as a "salvage auto".     A drunk driver hit my uninsured parked car. My brother n law bought it from me and was in the process of transferring the plates to his name to have it insured. It’s not an expensive vehicle but now he out of a car. Should he file the claim with the offenders insurance or should I, considering the vehicle is registered to me??

      If you can file against the offender, do that. That is who should pay. If you cannot, then your brother-in-law may be able to do so. If they have an auto policy now with another auto on that policy with Collision Insurance, then you may be able to file there. Your brother-in-law would have some automatic coverage oh his auto policy.

      No apologies needed.
      they will want to know who owns it as well as proof. If registered to you, you will need to state that and have you be paid.
      If their insurance pays it will not negatively impact your insurance.
      I am not sure if they will ask about your insurance. That is different from state to state. But it should not matter.
      To sum it up:
      * I would file a claim against the other persons insurance
      * tell them it is your auto, legally it is.
      * if they ask if you have insurance, just state who your liability insurance is on your other cars.
      * this claim will not affect your insurance.

      I think you will get something out of it, but historically speaking, you usually come out about the same with how much you recover.
      The total settlement will be more, but the attorney will get 33 - 50% of the total claim amount.
      It will also take longer. expect this to go for 3 - 9 months. depending on the case and legal climate of your area.

      A. The policy will pay the market value of the policy unless you have added additional coverage to your policy. Usually, this is called Loan Lease Payoff.
      If the at-fault driver has insurance, they will pay the market value of the auto, but both will not. if you have Loan Lease Payoff on your policy, you could file under your policy for that portion.
      B. The only way you will have money left over after the claim is settled is if you have equity in the car, meaning your car is worth more than your loan balance. The goal of insurance is to put you back where you were financially pre-claim.

      Some states you can represent yourself in court, but I would not suggest that. You would find yourself fighting against an attorney, and might not do well.
      You could file a complaint with the states insurance commissioners office.
      You can also file with your own insurance and let them fight for you. This would be contingent on you having collision insurance of your own.

      Only way then if if you can track them down or file under your insurance.
      Report to the police, maybe they can track the person down.
      Options under your insurance are going to be: Collission or Uninsured Motorist Property Damage
      Both have deductibles but would take care of paying to fix your car.
      Uninsured Motorist would also provide money for medical bills for you and anyone in your auto.

      However, it could be that they limits were maxed out on their policy. Every auto policy has a maximum limit that they will pay up to. You select this limit when you buy your insurance.
      If may be that the limits were used up. If this is the case, you may be able to file the additional property damage under your policy. Ask your agent.
      Also you can file the medical under your health insurance.
      Other option would be to pursue the person for the remainder of the money on your own or through an attorney.

      Great point. I need to make a video about that. One option is to do as you are and file on your own insurance then ask them to “surrogate” against the other insurance company. Meaning, your insurance company will pay for your damages then defend you try to recoup the cost from the other insurance company.

Would I have gave greater chance in winning in abritration? Since I didn't get a ticket nor was I found at fault before the police. Logically I'm innocent and they should pay up.

      Even though the officer gave the other part a ticket, the courts will not allow this to indicate guilt or innocence. I know this does not seem right, but the courts decided decades ago that this would not be giving people their right to “due process”. It is the court’s responsibility to prove guilt, and the police officer does not have that authority. I think most prudent people would arrive at the same “logical” conclusion you did. I know that does not solve your problem, I’m just explaining what the ticket itself does not decide fault. Some other options you have would be to see if you can find witnesses to the accident or also any video footage. Both of these could be used to help prove your innocence and their guilt. You can also review the accident report and verify it is accurate. If not accurate, you can ask for a correction. Your best option at this point would be if you have some witnesses that could collaborate your story. I hope this helps and I am sorry to see you having such a difficult time.

      For the video footage, I would suggest you bring this up to your claims adjuster with your insurance company to see how they suggest you to move forward. Each state will have different laws regarding using recordings of people as evidence without their permission.

      I would suggest getting some valuations on the Jeep. Try looking up the Jeep with same model, miles, package, etc at Autotrader.com and Cars.com. Show the company these numbers and tell them they need to pay more because the value is not right.
      Understand that in the scenario you mentioned, the company will pay off the 13k in debt, so she will not owe that anylonger. The company can't pay that $13,000 to her due to the lien against the car.

      If the other party is at fault, their insurance will provide the rental car. You pay for the option only for your own policy to provide this to you. Liability is always included.
      Part of your statement about 3 estimates is true. Only that it is not necessary.
      Insurance companies work with preferred shops that will fix your auto, these shops are typically independently owned shops and they work for you, the auto owner, not for the insurance company.
      You are not required to use the preferred shops.
      In some cases an adjuster will come inspect the car to write an estimate.
      Regardless, I encourage all claimants to get an estimate from at least one other shop. There is no law against this nor does the insurance company have a problem with a person do this.

      @@vir70eli72 I would suggest you check in with AllState. Even as a claimant, they do not pay it forward for rental, it works on reinbursement now. Rental or the lack of it, is easily the most often forgotten expense when involved in a repair. Most shops are not very interested in writing an estimate when they are not going to be doing the repair. Maybe in your state it is different? but in the Northeast, unless the vehicle is not driveable it is the youscan system. Claimants use the insureance app to take their own pictures and a desk review appraisal is done, usually missing much of the damage. The always overlooked challenge on the insurance and repair facility side as well as the owner, is THE CLOCK. Everyone wants it done asap at the lowest cost and no one allows for down time or supply issues or volume. What is the point of getting multiple estimates if the insurance company is only going to pay from the estimate under their protocol? All most likely will require supplements.

      so sorry to hear this. One thing you can do is present the police report to the other insurance company; this may speed it up. Next you can file under your collision coverage and allow your company to recover the money from the other insurance company or the other person. Lastly, you could contact an attorney. I would do this as a last resort. But it may be necessary. As a side note, potentially, there may be some camera footage somewhere that would validate that the person in question was driving.

      We identified the driver to the police, they questioned him and he lied saying his car was stolen.
      My boyfriend confronted him when he hit my car, he fled & his car was impounded to the police pound. It’s a horrible mess. I can’t even make my doctor appointments & I have health issues. This is soo stressful.😢

    What supposed to happen and what actually happens are tow entirely different things. My daughter was rear ended, ended up in the ER nad was hospitalised for 8 days. I had to call the at fault (progressive) adjuster and they began giving me the run around. Could not get a car rental , could not get an adjuster to come to do an estimate on the car, was bullied, coerced, screamed at etc. Wrote the CEO a firm email detailing what had been going on with names, dates and times and Conversations. They set up a time for their adjuster to show up and he simply never did. The CEO was sent a total of 4-5 emails within a 11 day period after which i hired an attorney. Now they are tying to send me information and call me. I refer all there emails to my attorney, i take none of their calls and I have filed a claim against them with the Insurance Commissioner. It’s a serious nightmare dealing with any insurance company. They have zero moral, tactic, ethics or value for anything besides screwing over people.

      @@BeauxKnowsInsurance this happened earlier this year after I was in an accident which wasn’t my fault but the other party took liability within 24 hours. all the at fault insurance did was reimburse me for rental receipts after rental was returned. I had to pay up front, they refused to book the car. So technically did they provide one? Genuine question
      I’m also dealing with this same issue now unfortunately after another accident, got hit from someone running through a stop sign. the at fault party won’t accept liability as of today, after 30 days because they can’t get in touch with their insured. Any suggestions? The driver for BOTH accidents didn’t have driver licenses but the vehicle was insured. Frustrating

      If you have an accident report from the police or sheriff report, this should help. Any witnesses would help, too.
      The company does need to give its customers an opportunity to give their side of the story, but 30 days is too long.
      You can push back on the company and ask them to move forward. It is not your fault that their customer will not respond. . The fact is you were involved in an accident with a vehicle insured by them.
      Another option would be to file under your collision insurance, and then your insurance company would deal with the other party and the other party's insurance company.
      Understand you will have to pay your deductible, but your company will take care of this for you.
      Another option would be to file under uninsured motorist property damage if you have this.

    They sent me to Enterprise. Enterprise took my credit card info. They then billed both State Farm and My Bank!!! I disputed it and lost. Thank you for being awful and greedy. Fascists, corporate greed.

      That should not have happened. That sounds like an issue with that Enterprise locations. Not the insurance company.

    do you work for an insurance company? adjustors are not your friend and are not trying to help you. they are trying to protect the company's bottom line by denying, delaying and defending all claims. full stop.

      I am an insurance agent. A go between the company and the customer. Unfortunately, there are companies that are difficult to deal with, but we do not work with companies like that. If you have had that type of experience it could be that you have a poor agent that does not value your relationship and therefore does not care about the quality of companies they represent.

      @@BeauxKnowsInsurance since you were talking about the process of dealing with insurance agents i just wanted to share what myself and many others are going through when it comes to a claim. i'm going through a lot of headaches from a guy that purposely hit my lexus and then drove away quickly. USAA is giving me a hard time with wanting to put aftermarket parts on my lexus suv.

    I have a issue where i got in a accident last month and it wasnt my fault. I got a claim # from the other party thinking they would pay for the damages they cause. I ask for a claim # through my insurance from this accident but they say that they dont have a claim since im going to get my car fixed from the other party. Anyone can answering me why my agent dont have a clue why i dont get a claim # from my agent to keep track of this accident???? I got my attorney on the phone with my insurance company and my insurance company agent say they dont give a claim number? My attorney needs a claim number so they can put a lawsuit against the other insurance company. The agent got upset and defensive and said that they will get there boss to resolved the issue i have. This claim number request is from my lawyer

      The claim number would be provided by the insurance company that is going to pay. If that is not your agent, then they would not have one.
      Agents do not produce claim numbers nor would they necessarily keep track of the claim status if another parties insurance company is taking care of the claim.
      That is how it is intended to work and there is no way for your agent to be aware without you updating them. The other insurance company will not communicate with your agent.
      The reason for this is the insurance company represents their customer, not anyone else. When the insurance company communicates with a claimant, it is on-behalf-of their client. This is the same thing your insurance company should do for you.
      If I am misunderstanding something here, please let me know.

    Im fighting liberty mutal they are refusing to come out to look at the car and i have a police report that shows the other driver at fault and they are giving me a run around talking about the other driver stating road rage there was no road rage the guy hit me and fled the scene i got the guys plate number the cops went to the guys home and the adjuster is refusing to come out to look at the car and the case is escalated to a pannel review board
