    Good video. The only discrepancy I saw was the inadvertent display while concealed. As of 2013, the law changed from "failure to conceal" to "intentional display." Therefore, an intentional display was not a punishable offense.

    I'm from California, so if you can carry a weapon inside a car, are you in violation if you have to go inside a public establishment to use the restroom, or stop off to eat inside a restaurant

    I plan to send this letter to my elected officials and local law enforcement agencies. Constructive criticism is welcomed. Feel free to copy to send to your officials.
    Part 1
    I have been conducting a personal study of the laws of Texas and the United States. It appears to me the Texas Legislature has been in error on the matter of bearing arms.
    The Texas Bill of Rights states in the following two passages:
    • Sec. 1. FREEDOM AND SOVEREIGNTY OF STATE. Texas is a free and independent State, subject only to the Constitution of the United States...
    • Sec. 23. RIGHT TO KEEP AND BEAR ARMS. Every citizen shall have the right to keep and bear arms in the lawful defense of himself or the State; but the Legislature shall have power, by law, to regulate the wearing of arms, with a view to prevent crime.
    The 2nd Amendment to our Constitution for the United States reads:
    • A well regulated militia, being necessary to the security of a Free State, the Right of the People to keep and bear Arms, shall not be infringed.
    Sec. 23 above where it states “…the Legislature shall have power, by law, to regulate the wearing of arms, with a view to prevent crime” appears simple enough to interpret. However, when legislation is passed where rights are involved it can complicate matters.
    In 1878, when our post Civil War constitution came into effect, it was common for people to go about armed for protection of self & property. It was a necessity in many regions of our great Republic. As our society passed through the corridors of history this necessity has diminished to a great extent. The progresses made in technology, law enforcement & policing has played a large role in this. Unfortunately the pendulum has swung back in the direction of need. The legislature has recognized this and has made positive steps to allow people to get a permit to carry a sidearm, this being the preferred and most likely of choices when bearing arms for the lawful defense of self. Has the legislature done enough to preserve and secure our right to bear arms?
    My study has revealed that the Texas Legislature interprets and has applied Sec. 23 over the years as the power to restrict the law abiding People of Texas from exercising their right to bear arms. In our country there have been times when most people did not have a concern about going out into public unarmed. They even left their doors unlocked at night, or when not at home. On the other hand, there have always been places where it would be advisable to be armed. I believe many Texans have been hurt and killed because they were not allowed to legally bear a sidearm on their person due to the restrictions placed on them by the Texas Legislature. If these people would have been able to exercise their right, with impunity, to bear arms the crimes against them could and most probably would have been prevented.
    It seems the Texas Legislature has converted Sec. 23 into an oxymoron with its enactment of laws. Sec. 23 says you have the right and the Legislature says only if we let you. That sounds very much like a communist, or United Nations, practice in the application of law. I do not believe that was the intent of the framers of the Texas Constitution. I believe the intent was to secure the right and regulate the manner it can be exercised i.e. concealed, or open, where - (there are obviously places we shouldn’t be armed), be sober and of sound mind and body, no machine guns, amongst others, ALL without requiring a permit, or license, whether it is rifle, shotgun or pistol. I do not believe this right is difficult to legislate in a manner that secures the right and not limit it. I believe that was the intent of the framers of the Texas Bill of Rights.
    Obviously there are many federal laws regulating what types of arms that we can own. It clearly states in the 2nd Amendment that the right to bear these arms shall not be infringed. It is obvious the Texas Legislature has infringed upon the right to bear arms of the People of Texas and that the legislature has been derelict in their duty of securing this right by passing laws restricting the bearing of certain types of lawful arms and limiting the bearing of a sidearm to only those with a permit. Some may consider the permitting to bear a sidearm is good common sense legislation. I say it is gross violation of common right. It is like saying you are incompetent until proven otherwise. This is the opposite of what our whole system of government is about. Once someone shows incompetence, or irresponsible behavior toward others, then there is due process. If it be proven in a court of law and found guilty then rights are restricted. This is how our system is designed to work. It is the republican form of government we have.
    Many States have recognized that they have been infringing on People’s rights and now have what is commonly referred to as “Constitutional Carry”. Rightfully so in my opinion. I believe it is Vermont that has had it from the beginning. It is progressively getting more dangerous to be out in public and many people feel like they should be armed when doing so. It is our right and the government’s duty to secure that right. It is always better to have one and not need it, than to need it and not have one. However, people in Texas are still getting hurt and killed because they fear being arrested if caught doing so without a permit.
    Our Founding Fathers were very clear on the issue: “…the right to keep and bear arms shall not be infringed.” Their intent and reasoning is clear and there are vast amounts of historical documentation that states their intent. It is my belief that any & all carry permits amount to licensing of a right and is Unconstitutional. The U.S. Supreme Court has ruled that the licensing of rights is unconstitutional. Furthermore, they have ruled that citizens can ignore the licensing regulation and engage in the right with impunity. There is an obvious risk of being arrested if doing so when it applies to side arms in Texas. Mainly due to miss informed zealous, yet otherwise sincere police officers who can, have & will arrest people for the sole reason of exercising their right to bear arms in Texas. Even after those officers have taken an oath to protect & defend the Constitution for the United States of America as well as the Texas Constitution. I guess they don’t realize that means defending the rights of the People regardless of what their department tells them. That is what honoring your oath is all about. It is an oath to the People. It is not, nor is it supposed to be easy. Furthermore, they do not have an obligation to enforce unconstitutional laws enacted by the state legislature. I would not be surprised if officers and people have been killed and/or wounded during an arrest of someone for the sole reason of exercising their right to bear arms. These same officers are not even obligated to attempt to make such an arrest, by law.
    In my research I found U.S. Supreme Court decisions supporting my statements in the above paragraph. They are on the issue of states having required licensing to exercise a right. Here are two of them.
    “No state shall convert a liberty into a license, and charge a fee therefore.” (Murdock v. Pennsylvania, 319 U.S. 105)
    “If the State converts a right (liberty) into a privilege, the citizen can ignore the license and fee and engage in the right (liberty) with impunity.” (Shuttlesworth v. City of Birmingham, Alabama, 373 U.S. 262)
    Neither of these cases pertains to firearms, just rights being licensed. It seems to me the principle, of not licensing a right, would apply to bearing arms also.
    Please take the time to sincerely contemplate this matter and to please ponder the following questions.
    Is the right to bear arms in our 2nd Amendment a common law right?
    • Yes and there is case law to prove it.
    Can individuals, courts and government be sued by People for violation of a right?
    • Yes and there is case law to prove it.
    Can individuals holding office be criminally prosecuted for violating their oath of office when voting “aye” and passing legislation that is an infringement of the People’s rights?
    • I believe they can but do not know of any cases. Some say they have immunity because it is implied they are honorable and acting in good faith. This is becoming more & more questionable and the immunity is limited.
    • What about law enforcement officer’s arresting people exercising constitutional rights?
    o Yes, and have in the past because once they violate someone’s rights they are acting outside the law. However, many have done so with impunity.
    • What about judges for rendering decisions that are contrary with the People’s rights?
    o Yes, and have in the past. They do not have immunity when operating outside their jurisdiction.
    What checks and balances exist in our government that prevents overzealous, yet otherwise sincere, government officials from over stepping their appointed duties to secure the rights of the People they are sworn to serve?
    • Many and can be located by a diligent search.
    When government officials are wrong and exercises tyranny, is violence recourse?
    • Yes; there are SCOTUS decisions that state people can use force against police if their rights are being infringed upon. Our Revolutionary & Civil wars testify to this fact. In all cases it ends up being a very traumatic event for all involved.

    I didnt know about the class c misdemeanor, thats amazing, especially for those who might want to carry at their jobs when not allowed to so they can actually defend their lives and their employees lives. If we are the good guys then what right to businesses have to disarm us: are the governments’ laws not actually a higher power than mcdonalds laws?

      In the old days you had to have it in sight and unloaded. Now it can be loaded but must be concealed.

    You forgot open carry for a long gun or a sporting rifle and that no license required if it has a sling when you wear it! Hell I open carry my M&P15 sport 2 at Walgreens all the time. No Problem! Texas Rules Its a good idea to donate to the State troopers yearly that's why Texas is the best state! Don't forget the Border Patrol!

    I’m a Texan and idk why people call this a gun friendly state.
    We’ve established that here in Texas we don’t have constitutional carry. So if it’s not constitutional, then what kind of carry is it? Unconstitutional Carry; Anti-Constitutional Carry, that’s what. If you doubt that just ask yourself, in what language does “shall not be infringed” mean the same thing as “shall require one to pay a fee and ask permission first, and may easily be taken away from any individual for their entire life”?
    And what does that make the cops who enforce these laws? Well, they swore an oath to the US Constitution, which is the Supreme Law of the Land, which cannot be superseded or overruled by any other type of law. So that makes them oathbreakers if they enforce these laws.
    That’s why I don’t like police. I’m no leftie by any means, but they’re mindless order-followers (just like your average rank-and-file Nazi stormtrooper was an order-follower) and they’re oathbreakers.
    Defund. We Texans can look out for ourselves. We don’t need oathbreakers running around trampling people’s rights, victimizing the innocent along with the guilty, and enforcing the arbitrary unconstitutional decrees of political psychopaths, tyvm.
    I disavow Antifa and BLM by the way, before anyone tries to put me in one of those boxes.

    Texas laws need to be more clear. Why are carry license holders susceptible to being charged with having a firearm in plain view, while in their vehicles; in an OPEN CARRY state? There's nothing magical about a holster, if public, or officer safety is the supposed concern. Also, license holders should be near the bottom of the list of people cops need to worried about. I was recently warned that I could face a Class A misdemeanor, for having my handgun mounted in my car, via a gun magnet. In my opinion, there is NO WAY you could see my gun while I am sitting in the vehicle; while standing outside of the vehicle. Only by forcing me to exit the vehicle and searching, could you spot my black gun, against my black dash panel. Why is it okay to have a gun in a shoulder holster, or driving holster; but not mounted under your dashboard, if you have a license to open carry? It makes NO SENSE! The purpose of carrying a gun in your vehicle, is to be able to protect yourself. How is making it harder to access the weapon, achieving this purpose?

    Open carry doesn’t give any advantage. If someone was to shoot up a place, they would take out the man with the gun out first. Conceal carry is much more effective and harder to detect.

My question was really about the legallity of owning and carrying a shotgun, even if your a felon.They seem to state that a shotgun isn't a firearm, or atleast you don't need a permit for. I would do Open carry walks but not if I was illegal.

    He's talking fashtion not fact....it's as stupid as saying " it's ok to wear black shoes ...but you must wear white socks...I don't think the constitution says you gotta do this and that to exercise your " rights" the politicians don't seem to de able to read coz the rights are not to be infringed...period.

      Tommy Williams correct. Over 18, not a felon, not committing any crime other than a Class C misdemeanor, not a gang member and be the driver in a privately owned vehicle.
