On January 1, 1863, Abraham Lincoln legally changed the status of over 3 million people from “slave” to “free.” But his emancipation proclamation wasn’t a law - it was an executive order. The framers of the American Constitution made this power available to the executive branch. But what exactly is this tool, how does it work, and what’s the extent of its power? Christina Greer explains.

Derek Welk yes but apparently it is the responsibility of the government to make sure I know the sun is center of the solar system? No. Notice how you mention everything but school, as a place you have seen the topic. It’s not even a far fetched thing to teach. Wouldn’t it make sense for the government to sure you know everything about how the government works? Only reason I watched this vid was cuz, you guessed it, it hadn’t Been taught. This conversation wouldn’t even be happening if I was taught this in 12years of school.

Thank you for making a video about the presidency without any underhanded and shallow allusions to Trump or liberals. Just turns an educational video to a political agenda.
people are always gonna find a way to protest or criticize anything, no matter how "politics-free" it is. But what's more important is to understand that taking a position is not in and of itself incorrect. There's this bias for neutrality that a lot of people fall into, thinking that just because something is perceived as "neutral" it must be good. That's not always the case.
marianushn Are you saying this informational video should have had a political bias? I think it's just fine the way it is.
if you think taking a principled position is a "bias," then I'm afraid you have corrupted the meaning of that word in your mind. Standing against, say for example, discrimination, is not a bias. It's a correct position. This particular video did not have much political relevance, but I remember when Trump signed the travel ban, TED-Ed released a video describing the life of a refugee, and the reasons why they left and couldn't return. To me, that was praiseworthy video because it's a principled position against a quite evident discriminatory executive order. That is being principled, that is being correct, and it also happened to be educational.

"and what is the extend of its power?" - I don't think I heard the answer to that one in the video. What are the limits? How does the Supreme court considers it overreach?
if it is unconstitutional it is overreaching
If it is not a subject already authorized by Congress, the President cannot do it. Executive Orders are really just policies by the President. Contrary to the video, they never have the effect of law, although they may direct the administration to create regulations (another lengthy process) that interpret Congress' laws.
@@WeRallIndigenous Yep, that's exactly correct. With a small addition. They can only be enforced on or by the executive branch offices.

Saying an executive order is not a law depends on how vroadly you define law. In law school, we did call it a law. It is distinguished from what Congress does in that it in not a statute. What Courts do is also create law. All 3 branches, as well as the "administrative branch," which is a whole other discussion, create laws. Congress has the broadest power, but the hardest process. The President's law-making power is much narrower, but it is easy to do. The Court's power varies. In the areas where there are no written laws, they create new law by deciding cases based on first principals. That used to be common, but there are few areas still like that today. Niw, they usually interpret written laws, but since amy writing will have some vagueries, there is always room for them to exercise lawmaking power, restricted by the case in controversy requirement and subject to be overruled by changing the text they interpret, whether a stature, executive order, or the Constitution itself.

As a non-American, I had to look this up to understand what executive orders are, seeing as Biden are writing them out by the dozens..... thank you for explaining it clearly..... although I still have questions about this new flurry of orders.....??
I'd say the flurry is to try and get the ball rolling on getting America to its previous state before further thinking advancements can follow

One of the ways the Roman empire lasted for 1,000 years is when the ideas of the Senate weren't working the sitting emperor had the entire Senate removed and new Senators were brought in. Could you imagine if a sitting US president issuing an order like that? I'd personally would love to see it

"Without permission from Congress" -- That is not true usually. Most executive orders are drawn from President's delegated powers (rather than his expressed or inherent powers).

What is the purpose of an executive order at the state level? I have no idea!
if your system in the US is federal as it is in mine (Argentina), each state has its own three branches of power, and the governor would have the power to pass executive orders that have reach within his state.

4:16 Couldn't the president just keep making new executive orders that did the same thing and Congress would have to keep making new laws to invalidate the executive orders? Since it takes time for Congress to pass a bill the president could just keep signing different executive orders that did the same thing every time.

So if exctv orders are implemented w/o congress, how are they financed? Where I'm from (Denmark) everything the government does has to be financed through a "bill". How does the executive order circumvent congress' financial power?
I don't think it can do stuff with finances.
Congress does not usually give agencies the right amount of money any way. Those that get too much money loan it to others that get too little through the treasury. Most US debt is actually held by parts of the federal government against other parts.
I like to think that the dude who made the powerpuff girls is the president in this video.
