    My outsourced C&P exam was scheduled 30 days after I filed a F.D.C. EZ Claim on- line. The examiner said she included a sheet that my condition was "PRESUMPTIVE" that the VA Medical Center had been treating me for this condition for 15 years, and SHE asked me what else I wanted or needed in the report.. 10 days later I picked up a copy of the exam from my VA Hospital Medical Center. I am now awaiting the rating letter from the VA.

    If the Veteran has been seen by a VA doctor and/or in a VA facility then there should be a good explanation to have a C&P exam conducted by a contract doctor especially when the contract examiner is less qualified than the VA doctor. Additionally, since the courts have ruled that the VA is not responsible for the competency of the C&P examiner so would the reverse hold true? If a question of the C&P examiner qualifications then it should shift the burden to the VA to verify and explain why the VA has denied the Veterans assertion the examiner lack the necessary credentials to perform the exam. Moreover, some states require that a per a state statute or law that a C&P examiner provide the Veteran with a copy of any exam performed for disability purposes upon request. Alternatively, it is the impression of the federal DHHS, Civil Rights division that a C&P exam and records thereof require the doctor performing the exam to provide a copy of the exam results to the person who was examined, per HIPTA regs. Frankly, I see it as another layer (or Quality control) of protection both for the VA who pay for the exam and the Veteran whose benefits may be at stake. If a C&P examiner balk at providing a Vet with a copy of the exam then that should sound an alarm the examiner is hiding something. If the VA is notified that the C&P examiner is under investigation by any qualified agency to perform an investigation and the VA does not provide an explanation as to why the doctors' exam is being accepted without question then the VA is hiding something since if an investigation of that doctor discloses a violation of any law or worse the doctor is determined not to be qualified for the exam undertaken then that would taint every previous or future exams by that doctor. And, no one is better qualified to make such a determination than the agency which provides the doctor with a license to practice.

    How do I get a nexus letter? Do I tell my VA Dr or if I have a regular DR. Do I just make an appointment saying I need one?

    Should I be getting 100% for prostate cancer even after it has been removed . I receive infusions every 3- 6 months to keep it from growing ?

    Do not go!! I went from 50% to 100% never attending a single C&P exam. The law allows you to submit DBQs from your own doctor in place of a C&P exam and I’d encourage all veterans to do so. Come on now you’re a law firm, you should know better.

    Are C&P exams done solely by the VA or are they sometimes contracted through organizations like QTC for example?

      Compensation and Pension exams can be performed by the VA or physicians contracted with the VA. QTC is now included included in this and is able to perform C&P exams.

    Hello Ladies! I thought DBQ’s were discontinued a short while ago and then the VA was mandated to reinstate them about a month or so ago! Can you ladies talk about that?

      @@blake3606. So they’re still in play and your “Private” Doctor can use them to draw a medical nexus as opposed to writing a nexus letter? Or am I off on this?

      @@bustacapp359 they scheduled me with a contract doctor. I would say that the contract doctor was in my favor.

      DBQs are back on VA's site. Make sure you pull them from there because they just released an update effective Jan 2022

    Ok. I am interested in filing a secondary to tinnitus claim for sleep apnea. Are you saying that I can go to the VA trigger a duty to assist, schedule a c&P exam in place of a nexus? I have the sleep apnea diagnosed. So will the C&P exam connect my tinnitus to my sleep disorder?

Our website states "A veteran is not required to submit a nexus letter in connection with their disability claim, but the nexus letter can sometimes make the difference between an award and a denial on VA disability claims." In regards to your question about the C&P exam connecting the two conditions, we would not have a way to answer that. That would be determined by the C&P examiner and we cannot predict what they will conclude. If you need help filing your claim, your best resource would be a Veteran's Service Officer or Veteran's Advocacy Group. Thank you and we wish you the best.

    How soon should you request C & P exam for 1st time claim? What form to file if any?

      Hi Dwayne, the VA is typically the one who will notify you if they need a C&P exam to make a decision on your claim. Make sure to keep an eye out for mail, a phone call, or an email address.

      @@HillAndPonton My son is in jail. He already 90% disabled and getting benefits. He has an appointment June 1 for C&P. If he missed his appointment, what will happen?

      @@nickih2130 The medical examiner will just let VA know the veteran was not available and will not have the evidence needed. The condition will stay the same if asking for an increase or be deny if it a new one. Once he is out, file a Supplemental claim (0995 appeal) to reschedule the exams

    I received a notification of my C&P exam yesterday do to MST. It says that the examiner will be doing my DBQ and I do not have to be there. I have military police reports that says exactly what occurred as well as witnesses on the report. I have never been diagnosed with PTSD or any mental health condition. Has anyone ever heard of this and will I receive a good rating in a situation like this?

    Am scheduled for C&P exam for PTSD,
    Was in combat zone in Vietnam 69-70
    There were lots of mortors dropping around me, got shot at a lot, was truck driver for 501st signal group, then on last day incountry, was fixing to get on plane, and friend from another unit, at next camp, came and told me my unit got over run the night before, most everyone was killed. All my friends gone.
    Been carrying this around for 50 years, was able to bury it in my heart really deep, then worked for 43 years, break neck schedule, now retired, and that box of feelings is coming back up, causing issues, been married 50 years, and causing issues in my relationship, with wife.
    Am not sure what to expect, but I need help or resolution, this is making me sick, and worried.
    Thought I was normal, now finding out, my wife has been very tolerant and understanding, but she thinks I need help.
    My Question: will C&P examiner, try to focus on, you have kept it lock away for 50 years, why now?

    The VA full of it, I was sent to a LHI C & P exam & the medical opinion was very favorable for me & the VA said the exam wasn't warranted lol

      Hi there Anita, unfortunately it's hard to say - the VA has thousands of unresolved claims in their backlog. When the pandemic got bad in 2020, the backlog of claims grew even more.

      It’s a shame something can’t be done for the thousands and thousands of veterans to have their claims processed with more urgency. When state and federal unemployment agencies received enough backlash during Covid, along with issuing stimulus , those processes were changed, updated and funds released within weeks. It’s a crying shame veterans and our current servicemen and women gave to wait years snd years to be helped when they fought for our country! Many vets pass away years before their cases are “supposedly” being reviewed. So sad that something can’t be done to get the VA help to process these claims more expeditiously.

      Hi Michael, you can check with the VA regarding that. We do know in 2020, many veterans were having their C&P examinations done virtually with doctors (telehealth).
