I will never understand why courts believe community service is even remotely effective. I know so many people who commit crimes because they KNOW they'll get CS.
It does work for some people cause their giving back to the community it just depends on the person everyone deserves a second chance I don't really beleive in the whole prison this I think their should be a place for criminals to go but where they are still treated humanely and not like animals they need help therapists etc

I’m a naturalized US citizen; I know the US cases, but it’s typically RUclips and the BBC where I learn a lot more about UK news and the crimes. Mostly RUclips. Crimes That Shook Britain was a great series.

It was the early 2000's and since he had such light sentences b4, they probably didn't even have his DNA on record. And DNA come a long way in the 16 yrs since this happened.
@@ashalon8729 they used DNA in the Barbie and Ken case though. Granted, it took months to get results, and it was in America where they were probably advancing further with DNA than UK, but the technology was definitely available and reliable.

I made a statistical guess that America would be leading the way with DNA analysis, and given there were 5-3 years for the UK to decide looking into DNA was a good idea, American work could have easily inspired the idea.
My stepmum is from the town this happened in, she said she actually remembers walking past Mark Hobson in the street and he stepped aside to let her walk by him. She remembers him so well because she got a shiver up his spine when she looked in his eyes. A week or so later his picture was on the news after he had been arrested for these murders and she realised it was the same man that gave her the shivers and that he had already killed 4 people when he let her walk past. So scary!
My mum was actually very good friends with mark while he was in school. Mark was the year below my mum but it was them 2 and 2 others that always used to hang out. She was saying that their head teacher was talking about statistics and like 2 people would be murdered and 1 person would kill someone, and I guess that person would be mark. She was talking about what he did and then I realised it was mark Hobson. Mark lived just a couple of streets down from my grandma and grandads old house. I still can’t believe it 🙂

From a legal perspective: Mark was charged with Wounding with Intent to Cause GBH (which is the most serious offence under the Offence Against the Person Act 1861 which deals everything up until and before an actual death occurs) because to charge him with attempted murder would mean the prosecution would need to prove intention. Every crime under English and Welsh law, except strict liability laws (eg selling alcohol to under 18s) requires both 'actus reus' or 'the guilty act' and 'mens rea' or 'the guilty mind'. Basically, prosecution would have to prove that not only did Mark do the stabbing, but that he intended to kill his victim. That can be hard when there is a well established precedent where the courts recognise that sometimes when people are provoked or enraged, things can get out of hand. Ie, Mark never meant to kill the guy (despite him almost doing so) but during the fight he grew so enraged that he was unable to control himself. In criminal law, it MUST be proven beyond any reasonable doubt that he intended to kill the victim. So basically, the jury would have to be all but SURE of it, like if he invited the victim there and brought the knife, or if he showed any form of premeditation. Because the victim and Mark met by accident in the town centre, it is more likely that Mark did not plan it. While we might sit here and say "well, he could have decided to kill him when they got in the fight" we again, cannot prove this. So to prevent the defence from using this and letting this man on the street, the prosecution charged him with a lesser, but still very serious, crime. But wounding with intent carries up to a 25 year life sentence. While his crime lacks certain aggravating factors (ie, there was no prejudice, the victim wasn't a vulnerable persons, no premeditation) and it could be argued that the victim provoked him (like how the victim approached Mark in a hostile way, so holds a degree of culpability ect), I cannot fathom in anyway, why that judge only gave him community service. Perhaps Mark was acting in self defence which went way too far. Either way, this sentence should have been reviewed and brought up to national CPS guidelines which is at it's lowest, least culpable category, is a 3-6 year custodial sentence. Hope this helped anyone wondering. EDIT: yes, i did study A-Level law 6 years ago lol. I've actually been thinking about going back to uni and studying law recently as a career change and your positive comments have made me really take it more seriously as an option. Even if you don't study/want a career in law, it's still worth knowing the laws that govern your country and life. Especially in an age where there's so much divisve rhetoric and misinformation.
I agree and can understand why he didn't get attempted murder. I have had to use a knife in self defense and wasn't thinking about killing the person even though there were multiple wounds. It's difficult to describe and understand unless you've been in that situation before.

I think he wasn’t “blackout” drunk or high, ofc I’ve never drank and only smoke a bunch of pot but I personally really think he was dissociated. I have serious mental health problems and struggled with very serious self harm and had an “episode” (idk what to call it) where I was so upset from bullying I just left school, walked all the way to a store, stole razor blades, injured myself badly enough that when I got back to the school I was sent to the hospital and basically expelled because they knew they couldn’t keep me safe. And I don’t remember the act of actually harming myself. I know I did it but don’t remember it. I remember the entire time I was walking I felt like I was watching my own body. I have a strong feeling something made something in his brain snap and he just started “spectating” himself and at some point just “blacked out” idk what happens here I’m not a scientist but the brain just erases the memory. Sorry if I made no sense, mental illness is extremely complex. (Btw I’m in a really good place now and nothing like this has happened since)

That's really interesting, and I'm glad you're okay now. I've actually been blacked out on alcohol/drugs before (not voluntary) and I genuinely cannot remember what happened. I know that it did, but I just can't visualise it in my memory. It's a very weird feeling and I don't wish it on anyone. Horrible things can happen when you're not in control of your body :( That being said, it's difficult for me to believe he really did so many things while blacked out. It's not really and 'active' state to be in, in my experience
I dissociate regularly and it's honestly terrifying I can be walking and then all the sudden I don't know where I am or where I was going or why. And a lot of it, if I can remember the memories are super fucked up. I can't remember the events or situations directly leading up to dissociating. So I think it's definitely plausible that happened to him but still scary.

maybe he meant that he doesn't remember the moment of killing them. He was aware he did but was fine with it until later he run and hide because of it. But doesn't remember the assault itself which makes sense as he was the most violent when intoxicated
Basically he claims he came round from a blackout to realise hed killed his girlfriend. He then had to just deal with it however he could, until apparently he blacked out again and came round to see hed killed his girlfriends sister when she had come to visit. He then apparently knew he was in a lot of trouble and going to get caught so he left, only to apparently blackout again and come round to find hed killed the elderly couple. So, according to him, he remembers everything, besides actually committing the murders themselves.
the punishments for knife crimes are not strict enough at all, it’s insane. in recent years it has become harsher but definitely not enough in my opinion
Yousef Makkis killing happened near my house. His killer was found not guilty of both murder and manslaughter- and only got 8 months in a young offenders institution for possession of a knife. It’s heartbreaking
L S Helllo so I work for youth justice so I can’t comment on adult offenders but with young offenders the sentencing for knife crimes are now quite harsh. There are many steps you take before putting a young person in custody. Before sentencing every young person has a report written about them and the lead up to the offence. there are many things you don’t consider with young offenders such as abuse and trauma that lead a young person to offend and with this custody usually isn’t suitable. I agree knife crimes are very serious however most people don’t understand the lead up to sentencing

I used to baby sit for mark and his wife Kay. Lived opposite them for many years. Knew him well, even the week he killed he came into the pub I worked in at the time and we chatted as normal. Was a major shocker to see what he did.
I know from my own Dad how alcoholism changes who they really are. When he was sober he was the nicest guy ever, when he was drunk which became always, he was a violent abusive bully. But I still loved him because I remember what he was like when I was a young kid rather than when I was a teenager.

I believe all murderers are sickening, however, when their victims are vulnerable individuals it breaks my heart and brings fear upon me. They're so pathetic as a whole, but I can kind of understand when Individuals kill due to their mental health as often it isn't their fault even though it doesn't excuse the fact that they have killed someone...Also, I believe when mental health is involved and there have been so many signs..it's technically the people around the murderes fault as well, but this is my opinion.

My stepmum is from the town this happened in, she said she actually remembers walking past Mark Hobson in the street and he stepped aside to let her walk by him. She remembers him so well because she got a shiver up his spine when she looked in his eyes. A week or so later his picture was on the news after he had been arrested for these murders and she realised it was the same man that gave her the shivers and that he had already killed 4 people when he let her walk past. So scary!
My mum was actually very good friends with mark while he was in school. Mark was the year below my mum but it was them 2 and 2 others that always used to hang out. She was saying that their head teacher was talking about statistics and like 2 people would be murdered and 1 person would kill someone, and I guess that person would be mark. She was talking about what he did and then I realised it was mark Hobson. Mark lived just a couple of streets down from my grandma and grandads old house. I still can’t believe it 🙂

From a legal perspective: Mark was charged with Wounding with Intent to Cause GBH (which is the most serious offence under the Offence Against the Person Act 1861 which deals everything up until and before an actual death occurs) because to charge him with attempted murder would mean the prosecution would need to prove intention. Every crime under English and Welsh law, except strict liability laws (eg selling alcohol to under 18s) requires both 'actus reus' or 'the guilty act' and 'mens rea' or 'the guilty mind'. Basically, prosecution would have to prove that not only did Mark do the stabbing, but that he intended to kill his victim. That can be hard when there is a well established precedent where the courts recognise that sometimes when people are provoked or enraged, things can get out of hand. Ie, Mark never meant to kill the guy (despite him almost doing so) but during the fight he grew so enraged that he was unable to control himself. In criminal law, it MUST be proven beyond any reasonable doubt that he intended to kill the victim. So basically, the jury would have to be all but SURE of it, like if he invited the victim there and brought the knife, or if he showed any form of premeditation. Because the victim and Mark met by accident in the town centre, it is more likely that Mark did not plan it. While we might sit here and say "well, he could have decided to kill him when they got in the fight" we again, cannot prove this. So to prevent the defence from using this and letting this man on the street, the prosecution charged him with a lesser, but still very serious, crime. But wounding with intent carries up to a 25 year life sentence. While his crime lacks certain aggravating factors (ie, there was no prejudice, the victim wasn't a vulnerable persons, no premeditation) and it could be argued that the victim provoked him (like how the victim approached Mark in a hostile way, so holds a degree of culpability ect), I cannot fathom in anyway, why that judge only gave him community service. Perhaps Mark was acting in self defence which went way too far. Either way, this sentence should have been reviewed and brought up to national CPS guidelines which is at it's lowest, least culpable category, is a 3-6 year custodial sentence. Hope this helped anyone wondering.
EDIT: yes, i did study A-Level law 6 years ago lol. I've actually been thinking about going back to uni and studying law recently as a career change and your positive comments have made me really take it more seriously as an option. Even if you don't study/want a career in law, it's still worth knowing the laws that govern your country and life. Especially in an age where there's so much divisve rhetoric and misinformation.
I agree and can understand why he didn't get attempted murder. I have had to use a knife in self defense and wasn't thinking about killing the person even though there were multiple wounds. It's difficult to describe and understand unless you've been in that situation before.

I think he wasn’t “blackout” drunk or high, ofc I’ve never drank and only smoke a bunch of pot but I personally really think he was dissociated. I have serious mental health problems and struggled with very serious self harm and had an “episode” (idk what to call it) where I was so upset from bullying I just left school, walked all the way to a store, stole razor blades, injured myself badly enough that when I got back to the school I was sent to the hospital and basically expelled because they knew they couldn’t keep me safe. And I don’t remember the act of actually harming myself. I know I did it but don’t remember it. I remember the entire time I was walking I felt like I was watching my own body. I have a strong feeling something made something in his brain snap and he just started “spectating” himself and at some point just “blacked out” idk what happens here I’m not a scientist but the brain just erases the memory. Sorry if I made no sense, mental illness is extremely complex. (Btw I’m in a really good place now and nothing like this has happened since)

That's really interesting, and I'm glad you're okay now. I've actually been blacked out on alcohol/drugs before (not voluntary) and I genuinely cannot remember what happened. I know that it did, but I just can't visualise it in my memory. It's a very weird feeling and I don't wish it on anyone. Horrible things can happen when you're not in control of your body :(
That being said, it's difficult for me to believe he really did so many things while blacked out. It's not really and 'active' state to be in, in my experience

I dissociate regularly and it's honestly terrifying I can be walking and then all the sudden I don't know where I am or where I was going or why. And a lot of it, if I can remember the memories are super fucked up. I can't remember the events or situations directly leading up to dissociating. So I think it's definitely plausible that happened to him but still scary.

Basically he claims he came round from a blackout to realise hed killed his girlfriend. He then had to just deal with it however he could, until apparently he blacked out again and came round to see hed killed his girlfriends sister when she had come to visit. He then apparently knew he was in a lot of trouble and going to get caught so he left, only to apparently blackout again and come round to find hed killed the elderly couple. So, according to him, he remembers everything, besides actually committing the murders themselves.

the punishments for knife crimes are not strict enough at all, it’s insane. in recent years it has become harsher but definitely not enough in my opinion
Yousef Makkis killing happened near my house. His killer was found not guilty of both murder and manslaughter- and only got 8 months in a young offenders institution for possession of a knife. It’s heartbreaking

L S Helllo so I work for youth justice so I can’t comment on adult offenders but with young offenders the sentencing for knife crimes are now quite harsh. There are many steps you take before putting a young person in custody. Before sentencing every young person has a report written about them and the lead up to the offence. there are many things you don’t consider with young offenders such as abuse and trauma that lead a young person to offend and with this custody usually isn’t suitable. I agree knife crimes are very serious however most people don’t understand the lead up to sentencing

I used to baby sit for mark and his wife Kay. Lived opposite them for many years. Knew him well, even the week he killed he came into the pub I worked in at the time and we chatted as normal. Was a major shocker to see what he did.

I know from my own Dad how alcoholism changes who they really are. When he was sober he was the nicest guy ever, when he was drunk which became always, he was a violent abusive bully. But I still loved him because I remember what he was like when I was a young kid rather than when I was a teenager.

I just thought of this lol, why am I so pressed to watch a movie that's only like an hour, but have no issue BINGE WATCHING Elanore's videos which are upwards of 45 minutes? Like I feel so exhausted after a movie, but I'll let 3-4 hours breeze by while watching you and not even think twice? I love your videos so much, I listen to them doing literally anything, homework, house work, at school during down time, while I'm doing my makeup or getting ready, I even listen when I'm in the shower lol (TMI sorry). My mom couldn't show up to the funeral but my aunt did and it's so sad how my mom's cousin's daughter said at the funeral that she didn't want to see her mom because of how bloody she was.

I really love the way Eleanor researches and presents the case, many true crime channels Ive seen covering these type of cases always go for the juicy details like how twisted the killer was and all the gory ways they killed their victims, rarely talk about how the police investigation and how they crack the case.
But Eleanor just really dives deep and it shows considering how long it takes her to make these videos.
