what most people don't really realize is the ease of which you can get ammo/guns in the US means they are also smuggled into other countries that cannot so easily/cheaply get them... the thing is... all those guns could have been legally purchased on a clean record, personally sold to the individual who then decided to smuggle them meaning even if the original buyer was found, they did nothing wrong.

Right? I saw this a while back and I wondered about that. There was ammo in a truck. So what? Ammo is legal. For all intents and purposes, barring a few very specific exemptions (storing/transport under tunnels and airports and schools) there is absolutely no legal difference between what was there and, say, a flatbed full of bolts and screws. And since that ammo and the firearms weren't 'in' anyone's possession when it was seized (i.e. nobody was driving when a stop was made) you can't claim felon in possession of firearms which would be about the only other reason such items would be 'illegal' and subject to seizure like that.
Additionally, they waited until the dog alerted before they searched the car, suggesting they didn't have probable cause due to some previous event or a warrant - 'cause if they have that stuff you better believe they're gonna go ripping through it. A cop can ONLY get probable cause if the totality of the circumstances give an indication beyond even reasonable suspicion that suggest something illegal is going on. Dogs grant probable cause because they're trained to sniff out illegal stuff, and a dog alerting is considered good enough because it's considered a good indication that something illegal is present, and if something illegal is there, then it means a crime has/is being committed. But as discussed above...it alerted on legal items. So what?
It's like you're driving with a ham sammich and cops pull you over and you refuse consent to search, then they bring out their ham sammich dog who alerts to pork and use its alert to show probable cause of a crime and use that alert to force a search against your will. You can't use a dog's alert to legal items to indicate something illegal is going on, you know? Or else LITERALLY EVERYTHING anyone can do/own/say is probable cause.
Really hope this is just a fiction 'reality show' and this didn't really happen 'cause the 4th amendment implications alone are terrifying.

I think in this case it was still. From what they said in the beginning, apparently the truck was being held in a lot, where it was waiting for paperwork to be finished, before heading over the border. So it may have not crossed yet, but it also wasn't going to go back into the same country, because the only place it would have gone was across the border after it was released when the papers were done. As for who is to be charged, I'm not sure, but there might be an owners/driver's name associated with the customs paperwork that would point to who they would charge

The 7.62x39 was just one area of the truck bed. I'd say at the most that caliber probably comprised about 25% of the count. Most of the truck bed looked to be brass cased ammo.
