  • This case almost appears unreal, but it is 100% true.
    Is @WhatTheHales Judge Craig Constantine DeThomasis Next?! When he acted as Lynette Preston's Attorney in the earlier hearings with Mark Feather?
    A judge goes to a person's home to help the police in their search and threatened the occupant with arrest if he refuses to let her in. This is an unprecedented act by a judge.
    The judge argues she is immune from lawsuit because of "absolute judicial immunity." Here is what the Court of Appeals said:
    The facts:
    "Judge Louise Goldston went to Matthew Gibson’s residence to look for items he had failed to turn over to his ex-wife after their divorce. She entered his home over his objections after threatening him with arrest should he try to stop her. She then supervised the seizure of designated items in the house."
    The ruling:
    "The only question before us is whether judicial immunity shields these acts. We hold it does not. Judicial immunity protects only judicial acts. It does not shield the conduct of judges who step outside their judicial role, as Judge Goldston did when searching Gibson’s home."

    IT IS REFRESHING TO SEE A ATTORNEY GET RILED UP ABOUT INJUUSTICE AND REVEALS A CIRCUIT COURT JUDGE WENT BEYOND THE LAW, THE JUDGEMENT REVEAKED THE JUDGE HAD STEPPED OUTSIDE HIS JUDICIAL AUTHORITY.

      Separation of powers. Those who do a search operate under the executive branch - they execute a search warrant. When she's participating under a search she's ordered, she's no longer acting as part of the judicial branch, and that's how they got her.

    He was leading her, After denying Jeremy his own Restraining order in Florida. He also has not held her in contempt three times for declining Depositions. Or dodging them.

      I agree the judge is out of bounds but Jeremy showing those unredacted videos on his channel just cost attorney Mark Feather a 500 fine and charge of contempt. Maybe JH needs to let the court system play out as he says and be patient to wait u til he can display checked documents by courts to not get his attorneys charged.

      The absence of doing something he should do is covered by immunity. Judges are covered for being terrible judges, unlike doctors, who may be sued for medical malpractice if they suck at their jobs.
      Immunity doesn't apply when they perform activities that have never been in their job description - doing things they have _no business doing_ (as opposed to performing a typical judge's tasks unfairly or dishonestly.

    Yeah, that judge you better buckle up. I just sent an email to the bar association and Governor Ron DeSantis. Ask him to put a stop and remove him from the bench firmly and just spark him from any legal obligation. Any legal proceedings that he may want to do

    Lynette didn't sign her first complaint about purgery. Did the Judge swear her in? Then he told her what to say. None of it seems legal. Mistrial or dismissal seems appropriate.

    I live in Florida and John is 100% correct about Florida being a police state. They will harass you for no reason. You have to buy a permitt to do anything. It's ridiculous

    All the time GrudgeJudge spent in personal attacks is specifically prohibited. GrudgeJudge is required to gather the facts and make a decision QUICKLY. He has only taken limited testimony from the plaintiff, LIEnette, not required plaintiffs and witnesses to be deposed, and not allowed the respondents Jeremy to even state their facts or refute evidence. Since he did not perform the REQUIRED judicial duties, he should not get immunity.

      In layman's terms: Whatever judges _have a right to do,_ they have a right to do IMPROPERLY & can't be sued. Bad judges have immunity for being malicious, corrupt, biased, or improper while performing judge-duties, unlike doctors, who may be sued for medical malpractice if they are terrible doctors.
      Judicial absolute immunity no longer applies when a judge does something judges have no business doing. Things judges do not typically do & not part of their job description.
      If Detortoises spent his weekend contacting Jeremy's friends and extended family via phone in order to gather incriminating information about him, _THAT_ would be something judges never do and have no business doing. It would be outside the courtroom and a violation of Jeremy's right to privacy.

    Remember, a judge who ordered a bailiff to break the law was granted immunity because ordering bailiffs is something that judges are expected to do.

    De Thomases accepting a verbal version of evidence rather than asking to see the evidence from Ohio and ignoring "Full Faith and Credit". Getting Silverman to act as Lynettes lawyer when there is a conflict of interest, Silverman being a former colleague.

    $200,000 is a good award, if the judge paid it personally. But she didn't. And $200k is basically a pittance for any significant size of city or county. Could be less than any cop - or a judge - costs them in one year, for salary and benefits.

    I heard of a case of an appeal on sentencing and because the appeal went to the same judge as the sentencing judge they ruled that the judge couldn't be same judge on appeal. If someone can find the case it might help.
    Edit: It seems to me that the judge is committing official misconduct by the FL statues under 838 and/or 839.

      Yeah, that act was perjury. The attorney did not even pretend to offer her compensation/pay her off, and he removed himself from hales' defense counsel following the defamation.

    So the lawyers that were allowing this to happen were complicit in doing this the judge has no writes to immunity outside the court room

      If they did that to the wrong guy, you get KIA LEOs during a no-knock raid on an incorrect address. You might get convicted, but the judge should still feel lucky to be doing dialysis instead of time underground.
