    It’s amazing how good this lawyer is. Every video I see, he picks out on the spot the moments and elements of the incident that are most significant and damning to the states case and just absolutely embarrasses the cops time after time after time

      ...I've tried it sober, 15 years sober. Many times I tried, can't do it. Most of us after a certain age have injuries, arthritis, can't see, can't hear lol. 😊

      Similarly I was going to say they must be asked "how often do these test produce false positives?" If they cant answer that then they CANT know how reliable the tests are. IOW in addition to you perfectly sensible idea that you cant know if this SPECIFIC person performed poorly if you have not seen hem perform sober, But also you cant know how well the performed if you don't know how the population at large performs

      Sadly, I have tried it once and it backfired. The cop said a sober person, based on the field studies done by NHTSA, would would exhibit fewer clues than an intoxicated person. Although in practice, your answer is spot on, some cops have this standard embedded in their brain. Even without it, it gives the officer too much wiggle room on cross examination, so I would avoid that question in court, unless you have your own expert to counter what the officer is saying.

    when a cop says im drunk and tells me i HAVE to do their dog and pony show i say NOPE give me a breath test i am NOT here for your amusement and when a cop says my name is officer jones or sergeant jones or chief of police jones from the point where they say that i then refer to them as employee jones i will say the same thing to a senator or congressman. they all seem to have forgotten WHO they work for. they ARE our employees until we break the law!

      I agree with you, but not fully.
      First, I would never refer to someone as "employee [name]", that's just disrespectful. If you want to do that from the start, that's up to you, but you're choosing to start an interaction with someone disrespectfully.
      Second, we vote Senators/Congressmen and other specified positions into office, as outlined by law and the constitution. Officers of the law for example are not voted upon positions, therefore they really don't work for you, but for the hierarchal body that you generally voted for to create/manage these types of systems. Referring to any Officer as "employee" again would just be disrespectful, that's like referring to any judge as "employee" rather than "your honor", they would not appreciate that and your court case would likely be a rough case.
      Third, who the people voted into office work for are the collective people that voted them in, not just any one person. For example, the Senator for your state represents your entire state, not just you. The representative for you in congress represents your entire district, not just you. While generally they should account for complaints and take those into consideration, there's more to it than just you.
      I otherwise fully agree with you, if you know you had not drank anything the whole day and an officer accuses of otherwise, I'd go straight to a breath test as well. At that point, it's just an improper stop and the officer has no other reason to investigate further once his or her original suspicions are no longer valid.

    i’m kind of lost here. I watched the whole video to the end and all I saw was him asking about the difference between September 23 and September 26. There was no end to the case nothing was said the video just ended. Did he win or lose this case? I don’t understand!

    I've tried doing the balance tests completely sober and on my own with no pressure and failed them, there's no way i could do them on the road in the cold at night with an arrest threatening me.

    Well, unopened bottles of alcohol aren’t illegal to carry. The opened empty bottles could have been drunk previously, and he put the trash in his vehicle. No way to tell when the bottles were opened and consumed.

    It is incomprehensible to me that a US police officer is allowed to take a medical sobriety test and that this is even recognized in court. As far as eyes are concerned, there are so many factors that a non-medical person can hardly tell the difference. Especially if you wave a flashlight in front of your face in the dark. These tests should be abolished for cops.

    Cops always testify FST’s are voluntary but they don’t pretend them to be in the field in most cases. Never do them in the field especially if you have consumed alcohol. If you have not consumed alcohol I would opt for a blood test if they offer that option as FST’s are very faulty and left to interpretation by sometimes poorly trained cops. Even the breathalyzers are faulty and can give a false positive reading. If you are DWI over the limit, you are going to lose your license anyway in most cases.The only difference is you aren’t helping the cop build a case against you by refusing FST’s, the best thing is to not drink and drive.

    This is a perfect example of why you record all police. This cop said he has no body cam or car cam. If you have camera evidence to present in court and he has none, it's his word against your video proof. He loses every time. They should lose if it's his word against ours.

      Police are allowed to lie in questioning during an Interrogation NOT sworn in on the stand in court. That's the whole raise your right hand bit they do at the beginning when they take the stand. Do some lie on the stand? Oh I'm sure. But they're not permitted to.

      @@TheChrisPineWorkshop the same thing was done at Idaho 4 case, the detective wrote " knife was placed beside victim on bed, later it was written knife was found under the blanket partially visible beside victim, so the detective wrote what he did, same as this dui officer done when he changed the paper or added to it but he Fd up with the date....LE is not your friend they are licensed liars and killers with QI

      @@PntsOnTheGround I feel like the courts should be able to be held liable for this. I know that my job immediately picked up the required technology to work remotely and we didn't miss a beat. We strangely become statistically more productive during that time period. The courts should have been able to do the same thing.

The IRS is 2 years behind now and our local DSSis JUST now telling employees, they can no longer work from home every one I know that works for the government, working from home, has had a 4 year vacation- paid well for it and the best health insurance ever.       What 😂 it just makes it easier to account for 24 hour days. I’m a vet and I promise it’s not for “dress up” or offensive. Cops, like military, can be expected to work strange hours outside of the typical 9-5 and it just makes for less confusion. If you’re told to be somewhere at 1930, you’re not going to accidentally show up at 7:30 am. It’s a more efficient system and police departments are working 24/7

      @@Nutnboujee thanks! And no worries! Definitely some cops try to be weirdly tactical, tbh it’s the same in the military.
      As for the difference in times, “military time” is just a 24 hour clock. There is no AM/PM like a 12 hour clock. 0000 is midnight/the start of the day and every minute it goes up by 0001 until 2359. The first two numbers are hours and the second two are minutes. So for example, if you wanted to indicate 7:30 AM, you’d say 0730. 7:30 PM would be 1930. You can think of it as 12 o’clock noon plus 7 hours=19, but eventually you just become used to automatically understanding it and not having to calculate.
      Don’t quote me but I’m also pretty sure that other 24 hour/emergency services use 24 hour clocks too, like hospitals for example.

    16:06 What I can tell the jury is the cop is not an ophthalmologist and nystagmus can appear for reasons otber than intoxication. Of course, if it doesn't appear, the cop will simply say that it did.

    I am struggling to find where exactly in the cross-examination did Larry break the officer's confidence. The officer was composed throughout his testimony, in my opinion. I've seen witnesses lose confidence on the stand...I don't see that here. To me, all Larry did was affirm the driver was in the truck at the convenience store with his foot on the brake in a truck cab full of mini bottles of Fireball. Is it because Larry caught a typo on the report regarding the date?

    Why are we arresting people who are sleeping in a properly parked vehicle? Do cops go to rest stops at night and arrest people sleeping in their cars there? A vehicle that is parked poses zero danger, running or not. In fact, it's better for a person who maybe doesn't feel up to driving for any reason to park. Arresting people in parked vehicles motivates potentially drunk or fatigued people to drive when they shouldn't. The goal isn't safety, it's to make arrests, because arrests generate money. With 1.5 million DUI arrests each year, MADD gets $50 to $100 or more from each person arrested in the form of "participation fees" for people forced to attend victim impact panels. MADD doesn't pay every cop, but they do present awards to the cops who made the most arrests. Sounds like bribery to me.

    The headline belongs more on a article at the times or post then this video which does not at all represent the officer being broken in half. If you're a drunk you want this guy....if you are a victim of a drunk driver you;ll be killed by one of the folks the DUI GUY helps to get off.

    35:09 - Yeah, I think they weaselled in what the caller said there. I was surprised he even mentioned what was told to him by someone else (I've seen too much Judge Judy, I noticed right away, btw).
    54:48 - The police officer for sure went from very confident to very humble in an instant here (by all means, he sounds like a great police officer, and I do trust that he does a great service to his community, he seems like he is very well mannered, not as in putting on a mask but as in it seems natural to him to be so).
    59:12 - he is now mumbling where he was speaking loudly and clearly before. Not confident any more.
    1:00:02 - the state attorney's posture also speaks volumes, btw.

    I am wondering if a public records request would produce some additional info that could identify a patter.
    How many FST has this deputy given. How many in each of the past five years. How many of these tests resulted in a "pass" and how many in a "fail". The FST is designed to not be passed, but offer sufficient evidence to allow anyone to conclude a "fail". So, how many times as the officer failed a person taking these FST? And if that info is not being sparsed by the dept, it should be pointed out they are concealing that data.

    Baffled at the change in attitude toward the defense right in front of the judge. The judge should have thrown the case out after his first 5 minutes of testimony when he admitted to arresting the guy on hearsay.

    Every jury of any DUI trial should be instructed that police officers lie, alter the record and “forget” important information on a regular basis and anything the officer says should be considered a lie until it is proven to be true.

    If you get a "not guilty" verdict, does that mean the arrest was unlawful? So would you have your solicitor fees paid?

      Sadly, there is no consequence to the prosecution when a defendant is vindicated - no reimbursed attorneys and other fees - nothing!! And usually, if there is an allegation that a witness committed perjury - or a prosecuting attorney - there are no consequences whatsoever.

    The objection on the 3rd taillight should have been sustained. His prior testimony was not about the defendant's vehicle, it was about "MOST VEHICLES".
    Even the judge fought you on this one, claiming that the witness had already testified about the defendant's vehicle having a 3rd taillight.

    Here's the problem with Field Sobriety tests. Even if you pass, they will still arrest you 99.9% of the time because the typical cop ego will not allow them to ever admit being wrong. (have you ever seen a video of a cop releasing someone after passing a Field Sobriety test?). The cop decided you were guilty before he pulled you over. That's why it's important to have a good lawyer and fight these tyrants.

    The officer was not telling the truth because he lied about a basic fact. When the prosecution asked him when he approached the vehicle was the driver side window up or down. He said he did not remember. Interesting enough, he said after he went around the truck and checked out the bed of the truck and saw the third brake light was on he came back around and asked the defendant to roll down his window. Which was it officer was the window up or down on your initial approach. You gave two conflicting answers. Were you lying the first time or when you said you asked the defendant to roll down his window? BUSTED!

    Field sobriety tests are agility based. They dont prove guilt or innocence. In one of my criminal law classes, we debated the legality of field sobriety admissiblity compared to the same standard of lie detectors in criminal court for beyond a reasonable doubt. The debate became heated , very heated. In the end, we determined that field sobriety tests are not inclusive enough to sobriety alone to survive scrutiny. Only breathalyzer or blood draw are fact based enough to be admissible in court.
