      Well, the FST is only administered after probable cause for alcohol consumption had been found, usually slurry speech and smell of alcohol. So at that point it's very probable that both FST and BAC will be positive for DUI.

      I was pulled over and did a FST & BAC, passed and was allowed on my merry way to drive home without a ticket or charges.

      People need to realize the dui tests aren't to decide whether you pass or fail right there, you're getting arrested no matter what, the tests are to give more evidence towards a dui

    That first cop's definitely pulled over pirates in the past. Asked about a glass eye, a wooden leg, all that was left was asking if he had a hook for his right hand.

    Usually the arrests on here are crazy, but the title of this is misleading because honestly these are some of the most chill DUI arrests I have seen lol.

    So Jasmin got the second chance of a lifetime. They didnt charge her with DUI or damaging her boyfriend's vehicle because she was trying to escape violence and 90 minutes later she drives back to her boyfriend's house? Unbelievable!

    the drunk cop... i don't think he was necessarily name dropping that he's a cop, the officer said to him "you look like you have done this before".. and he replied.. "I'm a union city officer" as if, he knows the routine because he's a cop, just my take

    - you were literally driving while intoxicated with them in the car. I’m sure the father doesnt want to lose his children either. Especially due to your selfish actions. This could have easily ended in tragedy.
    Hope she takes this opportunity as her “rock bottom” and learns from this

    I feel for the 21 year old girl who was so cooperative. Hopefully the Judge will view the video too and give her a break where possible. She handled it so well and was so polite to the policeman.

      Came here to say this. You can't FEEL a percentage but obviously passing the tests flawlessly should most definitely count for something. Tell her to think before climbing behind the wheel in the future and be more safe but a DUI for for not actually being impared is pretty f$cked up.

    I'm in Australia🇦🇺 and can't believe that the US police waste so much time doing these roadside tests... Our police do a breathalyser test whilst you sit in your car, they're super quick and easy. (2/3 minutes at most) They're incredibly accurate and if the driver blows over .05 which is the Australian limit, then they'll do a blood test for court evidence.

    That last woman is just infuriating! Trying to get special treatment and direct where things are going to happen. Lady, you are the one who drank and got behind the wheel. IF you are such good friends with those officers, you - more than anyone - should know better than that! Found her - Former State Prosecutor for this district in FL. Double shame on her!

      She seems deeply embarrassed more than anything. Panicky, under a huge load of stress. Don't get me wrong, she broke the law and deserves no special treatment, but she legitimately appears fearful and ashamed - not abusive or authoritative. Throughout the encounter she begs tearfully. She doesn't demand or threaten.
      There's a video of a drunk school teacher on this channel from a couple of days ago who exhibits a very similar behavior.

      Maybe too compassionate for the perp, and not for the people she could've hurt on the road. I was surprised the cops even had the legal right NOT to arrest the lady when they had ample evidence that she was driving drunk, despite the fact that she was supposedly fleeing domestic violence. (That she then immediately returned to. In her car. Drunk . . .) I agree that the cop's very good at establishing rapport with people. I just also think it'd be a liability nightmare for the municipality if the suspect here had killed someone while driving drunk immediately after NOT having been arrested while driving drunk. Plus, uh, dead person. 😂

    That 21 year old girl should have been given a little more leniency. She did great on her field sobriety tests, she was totally compliant and -barely- over the limit. I hope the judge goes easy on her and she learned her lesson. Of all the DUI's I have watched she is the first one I feel was worth it.

      @@noturcinderella I think that's how Vickie (?) interpreted "should have been given a little more leniency", as did I. As you acknowledged, the case hasn't been adjudicated, yet (gone to court), so the only leniency that could've already been exercised would've been by the cop. They can't legally exercise lenience in a DUI arrest, as Vickie stated. That's being illegally discriminatory. I felt bad for her, too, though. She dealt with the situation very maturely. (I'd guess she'll be one of the MANY people who get one DUI and learn their lesson. Hope so.) At the same time, it's insanely dangerous to drive drunk. The mortality stats are scary.

    Honestly, I feel bad for that 21 yr old girl with the speech impediment. She easily passed the roadside olympics, so she was probably telling the absolute truth... AND she probably wasn't impaired. If she knew her rights, and knew she had 2 drinks an hour prior, she should have declined the roadside breath test and opted to take the real ABA at the station.       One time I was riding with my friends and this guy flew by us doing 90/100 mph in a 45 mph zone. We caught up to him at a red light and he was passed out at the wheel (ngl it was funny af at the time). After the light turned green he stayed stopped at the light for like 30 seconds next thing we know he goes flying pass us again! We called the cops and we weren't the only ones, I'm sure they got him, that was crazy lol.

      Watching this stone sober in the evening. I'm a little older with less-than-great knees and back. Out of boredom and curiosity, tried the heel-to-toe perp walk, and I actually struggled a bit at first. I got better the more I did it, but geez, glad this wasn't me.

      I think the honest reason is sadism. They just love to order drunken fools around and humiliate them. I think DUIs are punished nowhere near severely enough, especially outside the US, but those crazy arrest hazing rituals are pretty insane.

      They need to establish enough probable cause to then go on to ask the driver to submit a breathalyzer. It's because a breathalyzer involves bodily exertion similar to bodily fluids, and the body is the most protected privacy an individual has under the law. If a individual refuses a breathalyzer then enough probable cause still exists for an arrest and that opens the door for the LEO to aquire a warrant for a blood draw or a refusal to a breathalyzer is also an automatic DUI since numerous tests, visual analysis of impairment, and other factors is established by the officer to pursue a DUI charge that will lead to a conviction.

      You probably wouldn't actually because very few things cause jerky eye movements. Reaction to light and accommodation is a pretty autonomous process. Nystagmus is typically induced.

Hopefully her case was solid and it's not a permanent stain on her record though because a DUI charge is no joke. And it's not like she committed some egregiously unsafe traffic violation anyways--plenty of people turn out to the second lane instead of the closest, even though it is illegal.

    Police say Rowland was pulled over after radar indicated she was driving 73 mph in a posted 55 mph zone. Her arrest report states her vehicle departed its lane, forcing the deputy to take evasive action by driving into grass to avoid an accident.
    Deputies report that while attempting to speak to her, she drove off and returned shortly thereafter with her child. Her arrests reports states she was directed to place the vehicle in park and turn off the ignition but neglected to do so and threatened to drive off again.

    With the 21 year old, I really don't think she seemed drunk. She's just so little. She probably can't hold as much alcohol as most of us. She's so sweet. I kind of feel bad for her. I honestly believe her that she thought she was ok to drive. But I guess we shouldn't drive at all if we've been drinking. I can't imagine hurting someone because your reflexes aren't as quick as they should be.

    I've never seen an officer do the "follow the pen" test for as long as the third guy did. It's like he was just trying to do it long enough for her to screw up. Then, on the heel-toe test, she was clearly taking 9 steps and then a 10th step to turn, and he said, "You took 10 down and 10 back," even if she miscounted, she was consistent and walked totally straight. And she stood on one foot for longer than I would have been able to do without wavering totally sober. I think it's gross that he made her do all the field tests when he was clearly planning on giving her the breathalyzer anyway. That guy had a quota to fill and she was a number. Poor girl.

      I truly think drinking in the hot tub had something to do with it. It amplifies the effect of alcohol plus both dehydrate. But I agree definitely should have waited longer. If you think your good to drive hang out for another 2 hrs or so or find a ride. I will never let anyone leave my house to drive home drunk. I have a comfy couch extra pillows and blankets plus packaged toothbrushes. No reason to take any chances not just for them but for other people on the road.

    It is beyond me that DUI leads to handcuffs and arrest. I mean where I live, you need to hand over your license immediately. You also have to organize someone who's gonna get you and your car. Arrest is only used if you're violent or very drunk, but then you end up in hospital because they actually care for your health. Pen and heel to heel walk test from the 50s aren't used since decades. You will blow into an inhaler immediately.

      Well we believe that DUI is an arrest worthy offense here because it kills people; it kills a lot of people. You're willfully putting everyone's lives at risk and for that, you're getting arrested. You say people only get arrested where you're from when they're violent but DUI is itself violent. Driving drunk is by itself a violent act.

    Amber is the definition of self snitching. Like, they didn’t even need to test her bc she repeatedly told on herself. Then she wanted sympathy about “losing her kids”. Lady, you’re wasted and going to pick up your kids!!! What the actual heck?! Those kids deserve better than that. She also tried using the fact that she knew the officer and tried to place him into a bad position. Just terrible. I hope she gets it together both for herself and her kids. Oh, and for the safety of others on the road.

      @@cityoftrees9953Drinking on an empty stomach as opposed to after a full meal most definitely affects the promille (unsure if it's the same word in English. 1 promille is like 1 percent but for mille, a thousand) of alcohol uptake.

    I don't think I would have done any better on the roadside sobriety tests than the 21 year old girl did, and I haven't had a drink in months. (Yeah, she did take 10 steps each way instead of 9, but man, she sure looked rock-solid, steady to me.)
    Drunk OR sober, does anybody ever actually PASS those tests, according to the officer? I think not, but then again, I guess that's what the blood test is for.
    I also think everybody "fails" because: Back in the '90's I was on my way home from a 12 hour job late on a Saturday night and was pulled over in the small town I lived in for "having a hard time staying within the lines", according to the officer. He performed the "watch the tip of my pen" test, and according to him, I failed. As he put it, "the muscles in your eye don't lie", and I was probably "just slightly over the limit". Only problem with that was, I hadn't had a single drink since the PREVIOUS weekend, a full week earlier. I told him I have all the time in the world, so let's go for a blood test, but of course he told me to just get home since I lived so close by. Go figure...

      I live in the Netherlands, we dont do the weird roadside subjective skillbased tests. They just breathalize you immediately and you get a 2nd try at the station if you fail the mobile breathalizer

      Europeans with a superiority complex aside - no. Nobody ever passes these, they are just used as affirmations if the defense attorney tries to argue faulty equipment. In the girls case her sobriety test being so solid might help her if shes charged but to be honest she might not get charged if its a first offense and so barely over the legal limit. She was honest and she had a BAC the equates to what she claimed to have drank. Depends on the state. But for the most part you should ALWAYS refuse these even if sober and ask if you are being detained. If yes, shut the f up time. Only talk to an attorney.

Another conclusion could have been that the secondary test at the police station I mentioned is done to prevent the defense arguing faulty equipment or equipment handling etc..

      @@KittyTink I do have to admit that after thinking about it, I do think that although nowhere near perfect, DUTCH laws and political system are superior to the US' but I don't think they're superior to i.e. Sweden. They are different countries with different laws by the way. Europe is not a country so how you would like to compare it to the US to be superior or not is not really clear to me. But if you would like to compare I would only ask by what measure?

      And btw, they say the field sobriety tests are "voluntary".....but if you DON'T agree to do them, you get arrested, so they're not really "voluntary". Gotta love the US!!!!!

      Because one of the many things impacted by alcohol is your ability to reason. You have a much harder time with seeing objective reality accurately.
