THANK YOU, THANK YOU, THANK YOU, Miss Leah!!!! Leah, I appreciate what you are doing for us. I have heard of VA Directive 1134 in March 2019 (checked my over 4k emails) from another veteran. I noticed the first revision was on November 28, 2016, which contained the same responsibilities for the VA Medical Facility Director, paragraph d. (1), (a). I requested my VA doctor to sign a DBQ in 2013 and she refused. It was OK. The VA Directive 1134 was not established. Instead of a DBQ, I requested a nexus letter from my private doctor and paid him $10, which I provided a sample nexus letter and rationale. I don't think my private doctor would have signed my letter without the sample copy because of his busy schedule. The BVA Judge gave me 60 days to provide a nexus letter and the doctor signed it on the 55th day. This nexus letter assisted me in getting my appeal granted from Feb 2007 to Aug 2015. God is always good! Thanks again!😅
That is outstanding news sir. It is tough because many veterans have a similar story when requesting these documents from their VA providers even with the directive in place. It is my hope that sheading more light on this will allow help bring this to light and perhaps some veterans will be able to get their VA healthcare providers to assist. Hopefully one day this directive will be enforced

Thank you so much for the VA Nexus letter information. My Doc told me that she was not allowed to give n IMO or Nexus letter for my diagnoses. I have gone to great lengths to find other providers that can help me and it has caused an extensive delay in completing and filing my claim. I am from Double Oak, TX and enjoy your RUclips videos.
Thank you soooo much for this video. I’m about to file several disability claims and was worrying about how i was going to come up the the money to pay for DBQ’s.
This is the year of 2024. I have been trying to get my husband service connection since 2019. The run around is crazy. This information is very helpful. God Bless and I pray he continues using you as a vessel for all Veterans.😊
My very first ear claim I brought my STRs to my VA appointments. I showed the ENT what happened to me. They were nice enough to write in my medical notes that "x condition in service is most likely the cause of X condition today". Some of my VA doctors I found would automatically write things in my medical notes that lined up with wording from the DBQ (GI and neurology). Asking for a DBQ appointment makes a lot of sense!
Thanks to this info, I was able to get an appt. with my PC doc. to fill all my dbq's and also educate my local VA hospital due to their lack of knowledge of this policy or regulations. They even told me that they were not "allowed" to fill dbq's for anyone before me. I politely got my message across as you advised and work out, so thanks alot!
That is awesome!! I am happy to hear this. I hope they start doing this more often going forward. Good work advocating for yourself and hopefully affecting change going forward!
Thank you for the great content Mrs/Ms Leah. This was awesome, it was truly. I enjoyed how you visualized the documents and subsections. I enjoy your videos. I refer you to everyone I know! Did anyone notice that she has gotten a country accent when she gets into her job? She said "YWAHLL" and "SOPPOSED TWO", ( around 12:00 ) yo, she dragged it out! Haha (instead of just plain 'yall'"). Actually, she's gotten more country over the years. Lol, I'm not even from the US and I can tell. Ok take care!
Thank you, Miss. I was denied twice for ptsd, headaches + after being assaulted by a fellow service-member and the pain and concussion that resulted. The VA said I didn't seek treatment while active-duty. I was so angry when I received the letters. My trauma is so bad, the judge had to cancel my SSDI hearing because my panic attack was so bad. I do have my hearing later this September and I am appealing the VA's denial. Will also request my VA psychiatrist for my Nexus letter. (I did submit two witness statements and I told my supervisors about the incident- I wasn't aware of Mental Health when I was 20 at the time).
I filed Sleep Apnea secondary to Allergic Rhinitis after being diagnosed with Sleep Apnea 3 years after active duty. I asked the nurse practitioner that was seeing me if she could fill out a DBQ and write a nexus statement connecting it to burn pits exposure. She did both and put all of the info in my medical record. I haven't been service connected yet, but I feel real confident.
Your information is such a great resource and such a great help. You mentioned you wanted to have feedback about how and when the outcome of a provider completing a DBQ and a Nexus letter. I contacted my provider and she told me that the National policy prevents her from filing out a nexus letter and a DBQ letter.
That is very curious. Did you ask her to provide you a copy of the policy? Did you show her this Policy that actually states she can and should fill out the forms? I mean at this point she probably will not be helpful so you really have little to lose by just correcting her and calling her out! I am sorry to hear this and thank you for the feedback
@@prestigeveteranmedical I have not yet received a response. I expect one tomorrow or Friday. I am fearful to ask or pursue it because I have to visit her for my health care. I don’t want to upset her. She is my only provider.
Thank you so much for this powerful information and I am trying to use it but they are fighting me tooth and nail I am using the White House hotline as well as the Patient Advocates office for leverage
Hi Leah You seem like the right person to ask this question. Have you ever seen a DBQ like form that request a C& P examiner to provide an internal Nexus like opinion if one has not been provided by the Veteran?
Hello fellow vets. So, I asked my PC doctor at the VA to assist me with paperwork in filing a claim. She immediately refused stating they were not allowed to get involved with that process. I mentioned VHA Directive 1134 but, she advised me to take it up with her CMO (Chief Medical Officer). I’ve left a message both at the clinic and over the phone for the CMO, have not yet heard back from her. I contacted the Patient Advocate and he was no help. He only regurgitated what my doctor said. I offered him to look up directive 1134 however, he didn’t seem interested and said he’d refer me to the CMO.
I love this - you are the first one whose videos feel real to me; you come across as actually caring about veterans versus just trying to make a buck like most of these men. I’m just saying… Jusr one question - does this apply to contracted Tricare and/or champ va providers (of which I am one - hubby is 30 yr retiree). I want to pass the word on to colleagues if so! Thanks!
Glad you enjoyed they video. Thank you for watching! I am not sure if they fall under that policy, I would bet not but they can certainly complete them if they would like to.
Thank you much LEAH, I have gotten all my medical care at VA facilities. When I asked for a NEXUS letter I was denied, So I went to a civilian Physician to review my medical records and give me a NEXUS letter, but, the VA would not release any information.
All my years out of service and I’ve never even heard so much information in one video. Thank you. If only the system was ethical, non of this would be necessary.
Thanks for sharing this! This is a game-changer. But there’s something to the “consistent with other VHA policy” issue. Neither of my VA podiatrists would write a DBQ or nexus letter. One told me he was told not to (internal policy for specialists, maybe?). But my primary care doctor has written one and has recently offered to write more. That message came as I was looking for a doctor to write a nexus. In my opinion, the VA is wasting money on these outside contractors. I had one “exam” my foot without even taking my shoe off. Of course I was denied that claim.
I have asked my Va doctors and they told me they don’t do it .I filed a second to my back for hips and was denied because I needed a nexus. So I file a appeal with the VA judge been waiting for 1-1/2 .
I am so sorry to hear this sir and best of luck with your BVA hearing. If you are interested in working with us on a nexus letter please reach out to info@prestigeveteranmctx.com
I’ve filed a claim for PTSD due to MST. Happened over 27 years ago and I’ve simply been unable to deal with it . My VA Psychologist who I see weekly agreed to write a nexus letter but stated that because of a potential conflict of interest, she can’t do the DBQ. She did, however, get my VA prescribing psychiatrist to agree to do the DBQ. Thank you for all your help and information…. Had I not seen this, I would have never asked .
The heading for your U Tube episode is “can my VA doctor write a nexus Letter..yes they can” most of your time was spent addressing the DBQ. Which one will they do? Or both????? Thank you for a very informative broadcast.
Maybe yes in some city and states. But here in the coastal bend in Texas most doctors shy away from this or don't want to get involved because (fill in the blank).
I was just awarded smc k for ED but my secondary conditions for anxiety, chronic kidney disease, sleep apnea, and gout was deferred.about how long does it take for claim to go through deferrmemt. all my medical records are with the VA
Thank you so much. It’s not like providers don’t want to fill out the DBQ. Because there’s so much turnover in the system that providers fall into the trap of listening to their superiors.
Good afternoon I loved your video. It was very informative. My doctor primary care at VA actually told me that my conditions could very well have been caused by my active duty service. When I asked about a DBQ or a nexus letter, she refused, said she could not do that. It was against the VA policy. And even the veteran service center who is helping me with my claims said the same thing that they are not able. To complete a nexus letter I would have to go to an outside Doctor Who has no idea about my medical situation in the military. What do you recommend I do?
I am so glad you enjoyed the video. Have you considered printing this policy out and bringing it to both locations and educating politely on their misinformation?
Is there a minimum amount of time I need to spend with the civilian doctor before he can write the nexus letter? I'm sure I can't ask that the first or second visit to the clinic....
Comment would be last year I took the 1134 policy to urology. I showed the P.A. ; P.A. referred me to a senior P.A. who told me he was too busy. I went to VA Director because it is Director's responsibility per 1134 to enforce 1134. Director refused to see me. New rule. Patient Advocate has to handle all Director complaints first. Advocate's door is always locked. Left messages. No return call. So much for Policy 1134.
"Advocate's door is always locked. Left messages. No return call." I was actually told by the best doctor I've ever had at the VA, to write your local congressman. If I did, I would go ahead and mail one to each, both the one for my home address and the one for the VA Center's address
How do you find out what your VA doctor has diagnosed you with..looking at your VA medical records? Is it everything in the "Problem List section" ? Thanks

My question can the VA Physician complete a medical summary in order for a veteran to get conseal carrying permit for
This is exciting as it is a tool for us!! Question for the mental health, as requesting for a DBQ is a conflict with the relationship, what do you recommend we can ask in place of a DBQ?
My case had been going nowhere for years. I was in an exam with my doctor, and he called a more experienced doctor in who said something about my issue that made it a slam dunk. I asked the Doctor who was doing the exam to notate what the other doctor had said and he did it. A week later I came back without an appointment and asked to speak to my doctor. I asked him to write a letter for me basically stating what the other doctor had said in the exam notes and he did it for me. I guess some doctors are okay doing it and some are not. All you can do is ask.
Problem: I just sat in a Video appointment between my husband and his Neurologist. He has never met the man in person. We discussed that he really should see my husband in person so he sees the symptoms of Parkinsonism (another hurdle) better than on a camera. He agreed but also let us know that he only goes into the office on Wednesdays so a face to face rarely has an open slot. I can't imagine how long we would have to wait to get one of those precious appointments for him to fill out a DBQ. I don't see it happening.
I would call tomorrow to set it up then. Even if it’s a few months from now. Better than nothing. Every Tuesday Call the office and see if anyone cancelled. Also call every Wednesday morning around 8am and see if anyone cancelled. I bet you get in sooner than you think. Stay positive.
@@valeriegriggs7888keep in mind that using VA Healthcare takes longer to provide a diagnosis. A private doctor/personal care doctor typically will provide a diagnosis much faster than the VA would. Sure it depends on your doctor and when you can get an appointment with them, but private/personal doctors are the better option (on average)

This is amazing I just got a message from my doctor saying he can’t write me a nexus letter. So I was looking for other alternatives some places charge up to $600 for one.
Thank you so very much for this great information! I understand your stance on the mental health issue, so how to we go about getting the proof that we need for our claims?
That is a very complex question and is really specific to the individual circumstances. Have you considered consulting with a VSO to discuss your case?
Leah , thank you for the video. You are correct that your primary doctor, mental health doctor whether its a psyciatrist or a psychologist can write a NEXUS letter for the veteran in support of your claim. Because it happened to me. I have 3 NEXUS letters written from my Mental health Doctor, and Primary doctors that helped me get my claim granted. Even though some doctors will say stuff like. Im not authorized to write one. or they will say its a conflict of interest or the VA doesnt do them any more and you must go to your VSO office. These are all false statements! any Physician as long as they are a MD can write one. If you have a outside doctor can write one to just as long as you are seeing them for possible service connection injuries. Here is something else you might want to do a video on. Its a VA diagnostic code that falls under "Reasonable Doubt Diagnostic code 3.102. And the 50/50 rule. Thanks
Question: I was told by VSO that having a VA doc write it in your medical record "more than likely" is enough for SC establishment. Would this assist in guiding that versus having them write a full-blown Nexus?
This video touched home with me. My VA Doctor is very arrogant and doesn't like writing letters. I'm service-connected for asthma and rated at 100% and am going through retirement disability with my employer. I asked her to write a letter stating my disabilities will last longer than 12 months which is obvious and she wouldn't do it. I've been seeing her for over 4 years now and she's not helping.
The VA dr told me yesterday, they (all examiner) Doctors have been instructed (given a class on) on why not to fill out any forms for us under any circumstances.
@prestigeveteranmedical sorry for the delay, I did. Several doctors actually. I spoke to patient adv (yesterday) at the main VA hospital, they did not know what a 1134 and did not know a DBQ was. (They're newly hired)

The C&P Dr. said if I get a Dr. to write a report that will prove that I had my injury within 1 year from my discharge date. My question is I can't find any Dr. who will look at the film and write a report, Will you, or will the VA doctors at my local hospital?
Is the film dated? That would be the first thing to understand. There should be a way for you to track the MRI report back to receive the write up on it.

They were nice enough to write in my medical notes that "x condition in service is most likely the cause of X condition today". Some of my VA doctors I found would automatically write things in my medical notes that lined up with wording from the DBQ (GI and neurology). Asking for a DBQ appointment makes a lot of sense!
Yes all of that sounds like it makes sense!
So does that, the medical notes act like a dbq or Nexus letter? My primary Is the my VA,doctor
It acts like a Nexus. If they include the symptoms the c&p examiner will use that to fill out the DBQ.@@codychavarria6088

I filed Sleep Apnea secondary to Allergic Rhinitis after being diagnosed with Sleep Apnea 3 years after active duty.

That is really terrible. Have you considered contacting your congressman?
Could you please give an update on how this turned out?

This is a game-changer. But there’s something to the “consistent with other VHA policy” issue.
Neither of my VA podiatrists would write a DBQ or nexus letter. One told me he was told not to (internal policy for specialists, maybe?). But my primary care doctor has written one and has recently offered to write more. That message came as I was looking for a doctor to write a nexus.
In my opinion, the VA is wasting money on these outside contractors. I had one “exam” my foot without even taking my shoe off. Of course I was denied that claim.

I gave the speech about serving me and providing a truthful diagnosis, which includes writing reports on the patients' behalf.
How did that work out for you?

There is no specific rule for this
Comment would be last year I took the 1134 policy to urology.
What a mess
"Advocate's door is always locked. Left messages.
No return call." I was actually told by the best doctor I've ever had at the VA, to write your local congressman. If I did, I would go ahead and mail one to each, both the one for my home address and the one for the VA Center's address

This is exciting as it is a tool for us!! Question for the mental health, as requesting for a DBQ is a conflict with the relationship, what do you recommend we can ask in place of a DBQ?

They are third party telemynd. I’ll ask. One more question it’s only my 3rd session with therapy, is it okay to ask now?
@@warren7642 It is totally up to you its just hard to say how they will respond

That is really tough I am sorry to hear this. A legal professional like a VSO or a VA attorney may be able to assist you in navigating that
I would call tomorrow to set it up then. Even if it’s a few months from now. Better than nothing. Every Tuesday Call the office and see if anyone cancelled. Also call every Wednesday morning around 8am and see if anyone cancelled. I bet you get in sooner than you think. Stay positive.
