    They absolutely ignore this directive. No one can make the healthcare providers complete a DBQ or NEXUS, it's their choice. So, the Directive has no teeth.

      Well that is the problem. The directive should be enforced and they should be required to do them. It is not their choice. It is their choice to provide a negative opinion if they choose but ignoring the directive and being insubordinate is not a choice they should be able to make without repercussions. The providers are partially to blame but the administration is also to blame for not enforcing it.

    thanks this was super helpful and especially at the end when you mentioned the secondary claims so I'm service connected for mdd and I have a cpap... to claim osa to mdd -- during the exam what should I be telling the examiner.... how can I relate that during the exam so I get a more than likely opinion?????

    I have filed my BDD claim and done my C&P exams. I discovered I should have claimed at least 2-3 other conditions. I have not yet received my VA rating. Should I file a supplemental claim now or wait until I receive my initial rating?

    So to let me have a full understanding, I am a 70% rated now, I had a heart attack that led to a x2 CABG in May '24, so I need to file a claim for heart issues and after care, that the VA will put me at 100% for 3 months after leaving hospital, then bring me down to whatever decided by raters for current after effects of event and intensive cardiac rehab?

    Thank you for what you do ma'am. I tried connecting OSA to allergic rhinitis thru PACT Act with diagnosis and even been seen while on active duty but was denied. On the same claim, I was s/c'd for asthma. Will the VA automatically try to s/c asthma to OSA? Thank you.

    If one suffer from female sexual disorder would it be filed as secondary to PTSD or for the medications taken (sertraline and MIRTAZAPINE). If it’s medication as secondary would a GYN need to link the condition (type of evidence) Never did a secondary claim so any info would greatly be appreciated 🙏.       Many veterans are service connected for this related to their mental health disorders. Every case is different. This diagnosis does not have to come from a gynecologist, many different types of doctors, nurse practioners and PA's are trained to diagnose the condition.       I am not quite sure what you are referencing but everything requires a nexus. It is part of the disability process. You must have an event in service or related to service, a current condition, and a nexus between the two. Simply having an event in service is not enough. For example, someone could have a back injury in 1974 documented in their service medical records, serve many more years with no complaints, have their exit physical be normal, then have 5 major car accidents after service and their injury would quite naturally not be related to service. The point is that simply having something in your medical records does not equate to always getting a service connection for the disability.

    I had previously applied for Sleep apnea with no evidence. Didn’t understand the process. Anyway i was denied. I just recently put in for Sleep apnea on an appeal. This time i have a letter from a VA doctor saying i did a sleep study i have moderate sleep apnea and i am REQUIRED to use a CPAP machine. I also got a buddy letter saying that while in service i had problems with sleep i would stop breathing and snore regularly. What are my chances of getting a 50% rating for sleep apnea with this evidence ?

      Well you would need to be able to show that the sleep apnea was the cause or contributed. Many people die in their sleep and have sleep apnea and the sleep apnea is not the cause.

    While in Viet Nam we had Multifuel truck engines that used JP4 most of the time. It ran cleaner and performed better than regular diesel. I have had problems with my gut (GURD), skin and others. We use ti wash our hands with it to get rid of old grease and dirt stains. Not as bad as some of these people but still exposed to it 12 hours a day6 and 1/2 days a week. Also respiretory problems.

    I used your guys service for a DBQ and Nexus letter. My sleep apnea was approved at 50%. I was diagnosed with sleep apnea by the VA in 2020. I had a NP do all my claims at my C& P exam. SA, hypertension, PFB, and hearing loss. I know they low balled me on my PFB. It was only 10%. I had a shave profile from 89 until I got out in 92. I'm very happy with your services. I got the results I wanted. Thank you!!

    During my sleep apnea c&p exam, which was done at a VA clinic, the examiner questioned why my sleep study that I had, was done at a sleep lab that is associated with a Cardiology clinic. The examiner kept questioning that and surmised that the Cardiology clinic had figured out they could make money doing sleep studies. The examiner even questioned the results, which stated that my sleep apnea was severe. She said that there's no such thing, you either have sleep apnea or you don't. She made comments about veterans filing claims for anything just to get free money. I was so frustrated and angry when I left that I didn't want to deal with it. It shouldn't be as difficult as it is. The lady at veterans services that filed the claim for me asked me to write down what happened but with a non service disability that I have, I can't write or use a computer or text for long. It can take me several days just to fill out paperwork. It's been over a year since that claim was denied but now I'm waiting for a different claim to be processed. I'm hoping to file a sleep apnea claim but as a secondary.

    I was just sent for a C&P for lumbar spine disability. I was sent to a Cardiologist for this exam. The examiner did not use a goniometer to measure range of motion (medical device necessary for taking precise measurements). I filed a complaint with the VA Hotline about it and received this in an email response: "Please note that under VA exam procedures the individual conducting an exam is not required to be a licensed doctor or specialist unless specifically instructed by the VA. Any certified medical professional, to include nurse practitioners, registered nurses, and physician assistants, and each are qualified to conduct a C&P examination as they have received the proper training and certifications from VA to conduct these exams. Moreover, these medical examiners have the competent medical authority to provide diagnoses and medical opinions regarding claimed conditions."

      A cardiologist is overtrained to provide this type of examination. They have more medical education then most and this is 100% within the scope of their training to provide this type of examination so I agree with the VA on this. As far as not using a goniometer that is a different issue and they should be using one

      That would depend on the examiner who is completing that DBQ. Since FAI is related to the hip I do not see any relevance to this particular DBQ

    I was wondering. I am currently rated 0% for GERD. But now i take meds daily and have trouble swallowing. I have no strictures. Is it now hopeless to apply for the increase to 10% based on my condition?

      @@cashamosleytv i watched the video. But found this statement somewhere else, “10% rating may be considered for symptoms and daily medication, in our opinion, on a case by case basis (ultimately the VA rater is the decision maker). But unfortunately, the absence of esophageal stricture will prevent much else in regards to getting more VA disability benefits.”

    Hi, I think you could possibly help me in increasing my disability rating. I have service connected for gout 90%. I also have high blood pressure but not service connected, taking meds daily same as for my gout. Could you possibly help me in claiming high blood pressure? Thanks
