I’m in Alaska, I have 4 DUIs. I have been sober since my last DUI which was a felony, in 2015. I completed a Therapeutic Wellness Court program after 27 months. I applied for and was granted a Limited License in Nov 2018, with the stipulation of having an Interlock device installed. It specifically states that I can apply for a Termination of Revocation after a minimum of three full years of successfully driving (with no violations) with the device. So, as soon as the three year mark hit, I was super excited to start the process of having the revocation lifted and then being able to have a real true valid drivers license for the first time in years. Unfortunately, my application was denied. And was informed I wouldn’t be eligible’ to even apply for the Termination of Revocation until 2028. So they are expecting me to continue driving with this device another 6 years. I have spoke with the Wellness Court coordinator and together we have tried to get and understanding from the DMV how they are coming to this conclusion. I have a spotless driving record since having the interlock. I don’t drink alcohol anymore. I learned my lesson. I paid my debt to society and just wish to move on with my life and be able to get into my car, start it and go. From what I have discovered, there seems to be some sort of misfiling, not on my part, but either with the court or the dmv. And I just keep being asked to be patient while they work on the ‘issue’ but won’t ever divulge the exact ‘issue’ that’s telling them I need to continue on for another 6 years. I completely see how the system makes it difficult for people to try and get their license back yet get the runaround, eventually just giving up, and drive without a license. I don’t want to give up, but I’m seriously on the verge.
Going thru a similar situation in Georgia. Everytime I complete the "last step" of reinstatement they come up with something else. Im about 5 grand deep in this now and it would have been much easier just to keep some bail money on hand and drive without a license.
MONEY! It’s a corporate cash cow, I was lucky and had 4 months with the interlock, I went longer in case there were “issues”, as I understood there are. Still have to have an SR22 until 2025, which is $124 for 6 months, negligible since I have no violations in 21 years. YES, 21 YEARS! I don’t drink alcohol anymore, I can see how much more difficult it can be for people starting from a dead start! You can get into the system and it can be very difficult to get out. I moved to another state and had no violations. Good luck.
It is impossible to not get a violation at some point. It's a scam. My device have me violations on its own. I didn't do the violations myself. I gave up. They make it impossible to be reinstated
My dui is from 2013 and I haven’t had a license since 2005. Not only do I have to have the device but the process for reinstatement in my state is set up for as you had just gotten a dui. I had to buy a car even though I couldn’t drive yet. Then the dmv takes so long to process the thing that I’ve already paid a car payment and insurance payment and can’t even drive yet. 🤷🏼♂️ hoops
Damn. Thats crazy. I got a dui and i had been driving for 1 year without a license risking it everyday i went to work. My car broke down and i havent had money to fix it up until now. Im gonna have to put this device in for 5 years! Im already pissed and i dont even have it yet. Theres gotta be another way!
I got a 2nd dui but they said if i did the alcohol classes it wouldnt go on my record. I seriously need to talk to my lawyer but i dont want to show up to his office with no money. Im already broke. Its hard out here. Fuuuuuuuk!
Me to I was happy af to get it just because I didn’t drive for almost 10 years! It’s annoying as shit and cost a lot of money but I am back on the road again after not driving for many years ! Btw I don’t drink at all and it never was an issue for me but I used to party a lot 10 years ago and do dumb shit obviously!. I hate it when ppl drink and drive I tell them take an Uber! I wish Uber was around when I got my DUI in 2012!
The truth about these interlocks is that it is a SCAM! Anyone who has had one knows. States make it insanely hard to reinstate to normal status. The one I had made violations ON ITS OWN. meaning I did not do anything wrong but the thing finds ways to violate anyway. $100 a month plus $50 for violations plus install. To top it off I wasn't driving impaired. I passed field sobriety but because I admitted to taking medication prescribed to me daily I got a dui
This is why you follow up with your reinstatement requirements right away and not wait. Your problems don’t just go away. You gotta face them at some point in life
There are so many attorneys who suggest waiting until court to get the ignition interlock device, but since this was my second dui and requires me to have it for 2 years. I installed mine within the first few days of my dui arrest. I know the DMV doesnt mess around and dont want the waiting game. Also considering the fact that I didnt blow at the police station, even if I'm found not guilty, the DMV will probobly still require me to have the device for a minimum of a year
I really don't understand how they make you blow a second time while you're driving it is illegal to have an electronic device in your hands while you're driving makes no sense
i mean it’s your phone but ok and it’s because people would blow, start driving, and then start drinking. or already be drunk and have someone else blow for them
Same. Just got approved last Monday. Registration and all my tests/ installation this week. I got lucky and got a time restriction. Btw. Michigan is my great state
Mine was 17. Stupid arizona never restricted my license so I just kept driving all these years until I decided to move to another state and the AZ dmv flagged it. Now I had to install this horrible device over something I did 17 years ago! Yes I paid all my fines and treatment classes and even went a couple days to jail over this. But unfortunately there is no statue of limitation for this😢

Idk about u guys but it just sounds like she delayed the requirement for it. Just because you aren’t driving doesn’t mean the clock keeps ticking. It’s supposed to be when ur behind the wheel that’s when they can determine whether your rehabilitated enough to drive. It’s not personal it’s to save lives of innocent passengers
Omg yes they take all my money for the smallest things, a fee here a fee there . In the end I’m paying $94 every 2 weeks to drive my car. It’s ridiculous and I’ve only had it for 3 months and it’s about to be winter here in Chicago and not sure what to do about the device getting to coke. How do you warm it up if you can’t start the vehicle and also you can’t detach the one I have to bring inside during bad weather, so I have to have this in my car for a year with a RDP I only drive to and from work M-T 3-11pm. So after the year is up I have to set up another hearing by myself ? Or would I go through my same lawyer as the one who got me my Restricted driving permit ? Why do they make this so hard ? I got my DUI in 2014 and I’m still dealing with it and paying so much damn money! I don’t drink at all period. I never drank a lot before when I even got the DUI I was just young and really fckn dumb!!! It’s been almost 10 years ! The shit is never ending I couldn’t tell you how much money I have paid for having a DUI I actually got 2 DUIs. I got one in 2012 for drinking and driving and then one in 2014 for marijuana! But Im not playing I have spent thousands of dollars 💵 paying for these DUIs. Please if your reading this don’t drink and drive! I would never do it again in my life!! 💯 I’ve even gone to jail over it twice ! I tell people all the time don’t drink and drive and to take an Uber ! I wish Uber was around when I got both of my DUIs but unfortunately it didn’t start Intill around 2015!
Call your attorney. Some attorneys charge one fee and they’ll represent you at hearings until full reinstatement so you might be covered still with your other attorney under the fee you previously paid. Others may charge per hearing or until you get a permit or until full reinstatement. Either way, you want an attorney again for the hearing on full reinstatement.
@@iTranscendx if you’ve never been through anything like this then shut your trap. Nobody said anyone that had even been through the system for that is going to do it again, or even drinks still for that matter. If they cared about drinking and driving all they would do is require the device and leave it at that. Instead they also restrict where you can drive, as if somehow if you drove anywhere else but to work, school, etc. even with the device that you would drink and drive. Ah yes, Sally has a BAIID but we want to make sure she doesn’t drink and drive so we also have to make her only able to drive to certain places, even though she has a Device in her car that would prevent drinking and driving regardless as to her destination. Instead, we need to restrict locations and also charge her $100’s of dollars to carry a permit that will allow her to do so. Some people have family members, kids or elderly family members that they need to be able to support. You can’t work if you can’t drive. Can’t take care of grandma and take her to medical appointments if you can’t drive. What does this mean? It means that people will and do still do it anyways, because you can’t pay for the device, or anything for that matter, unless you work. and if they get caught - they end up getting put back in jail and other punishments. Because that’ll teach them a lesson not to go to work and make money so they can pay the fines that were imposed and the additional fines that were just imposed from getting caught. Kindly, fuck off. Some people even get a DUI for doing the responsible thing and not driving. Instead they sleep in their car and still get arrested. So, like I said….fuck off.
@@mamsy1169 if you have people who depend on you maybe you shouldn't be out drunk driving? Take some responsibility and accept the consequences of YOUR actions. The audacity to complain about having kids to support while putting everyone else's kids in danger is astounding honestly.
@@dankvis You clearly did not read a word of what I said. But go ahead and think you've never driven legally drunk before, after having those 2 drinks at dinner. For smaller people 2 beers gets them to .08, and you can still get a DUI if you blow under that as well. You also need to educate yourself about the legal system. There are constitutional factors to punishments, and you cannot punish someone for their entire life for a mistake they made 30 years ago. Punishments must fit the crime and cannot be retroactive (ex post facto). There are also 2 purposes: Rehabilitation and to protect the public. Otherwise, it is considered excessive. If someone has the BAIID in their car, that takes care of that factor as they can't start their car if they have been drinking, and there is no rehabilitative purpose behind restricting someone's movements further while they have the BAIID in their car. Since it is not a matter of driving in general, it is drinking and driving, having the BAIID in their vehicle prevents someone from doing that, and completely fulfills the factor to protect the public, restricting movements does not further protect in any way. If someone has their license suspended or revoked and drives drunk again while revoked or suspended and outside of the terms of a BAIID permit, they're going to do it no matter what. Restricting movements in addition to a BAIID requirement only further hurts those who are actually trying to do the right thing, without any logical purpose to it being an addition to a BAIID requirement. Harsher and more restrictive retroactive requirements is not going to do anything except make things tougher on those doing the right thing and those who likely wouldn't drink and drive again. I work in an industry where I see ALL kinds of DUI offenders, but go ahead and criticize the person who decided to sleep in their car instead of drive drunk and still gets a DUI and say that a lifelong restriction is appropriate for them where they have to have a BAIID and can only drive to and from work for the rest of their life. Why do people think that the only people that get a DUI are the people who are so drunk they can't even stand up and then drive? Most people that get them are between the .08-.16 range. Which is not "can't stand up" drunk. "Can't stand up or walk" drunk is at .2 Just because someone got a DUI doesn't mean they were drunk or impaired. .08 is the legal limit. For some people, that's two beers. I would hardly call someone drunk after two beers. It's called tolerance. If someone has a high tolerance, they may not even be impaired at all at .08 to .12 BAC range - which is why many DUI's occur at this range...nobody knows what their actual BAC level is and how alcohol effects BAC levels (until they get a DUI) and all they have to go by is how they feel. And since they do not feel drunk or impaired, they get behind the wheel not even knowing that their BAC level is actually at .10
This sounds like an "ex post facto" law. Strangely, there are exceptions where US courts have allowed "ex post facto" laws. This sounds like a great place for an energetic, young attorney who wants to fight for this lady and others like her.
I disagree with this law in general, but they required her to install this to get her restricted license at the time that she applied for it. Did anyone involved with this story actually read the statute?
I got my first one this year. Didn't hit anybody, drove 500 feet, didn't break any traffic laws besides having alcohol in my system. My buddy was supposed to be my DD that night, but he was far too drunk. Drove his truck which was unregistered and uninsured ( which I didn't know). Facing 14 days - 3 months in jail. The consequences are absolutely abhorrent. And I live near downtown, so if it wasn't for him needing a ride home, I would've walked.
@@ghg789987 That was his problem, needing a ride home. Uber, Lyft or taxi was a better option or hell, calling another sober friend or family member. You deserve every punishment the courts have dished out on you. Not sorry. Learn from your mistake, citizen.
I got mine in 2006 and they just got around to suspending my license because I never did an interlock. Same shit as this gal except I have my license back for 15 years now. 1st DUI.
I only have 1 and I’m going through this same shit as this lady. I paid all my fines and everything. I had to go to a stupid alcoholic anonymous class for no reason since I’m not an alcoholic. The worst part is I can’t fly to Florida to visit my family because I have to babysit this car otherwise the battery dies and they consider it tampering. Another bad thing is barely any shops know how to work on a car with one of these installed so my car is falling apart and has become a death machine. It’s literally a jail cell on wheels and I understand why people say to hell with it and drive illegally. I don’t want to do the same, but each day I’m starting to consider it. I feel like actual criminals get treated better than us and get screwed over less than us.

@@calebh7902Bro is literally complaining that the thing that prevents him from driving drunk is working. Your life isn't messed up because you got pulled over. You're not stuck in a parking lot because of the device. All your problems are because of your drinking and bad decision making. You're lucky you didn't kill somebody and end up in prison. I'm sure that wouldn't have been your fault either, though. Just don't drink and drive. It's not rocket science. It's not even like saying "don't do drugs." You can still drink all you want, just not if you're going to drive. I genuinely hope you have to keep the device for the rest of your life. You're 100% going to re-offend if you don't. Both of you are "actual criminals," and what you did is a pretty serious crime, and you're treated so harshly because you don't think either of those are true and you'll do it again.
Hey all you righteous teetotalers. You must feel awesome casting your judgemental voices on these "drunk drivers." All of you clowns really gonna stand here and say you never drank and got behind the wheel? You never broke a speed limit? You know speed can kill as well...right? I hope the state never takes their pound of your flesh like they did to these "drunk drivers" but if the state ever does, don't look for compassion.
I will say, this kind-enough woman strikes me as the type to get a very occasional violation on her Intoxalock device. If she could avoid those incredibly rare moments and blow three zeroes regardless of the date/time, she would have had that device removed from her vehicle many years ago. Intoxalock is a shady company, but in my opinion, the woman's impulse level to drink alcohol is way too high. The device and the law are working as intended in this case.
I got a dui in AZ. My DD was too drunk, so I drove his truck 500ft, took one right turn. Facing 14 days to 3 months in jail. First offense, didn't hit anybody or break any traffic laws. The consequences here are absolutely abhorrent. His truck was unregistered and uninsured 🤦♂️. I've got an interlock now, hate it, makes driving stressful. Super distracting, won't drive more than a few miles anymore.
Stop fucking driving drunk, god damn it. Call a taxi, Uber or Lyft. It's a LOT cheaper and less stressful than losing your either losing your license and going through the process of getting them back eventually after paying thousands of dollars in fines or being ordered to use an Intoxalock for a length of time.
It's all a racket. Everyone involved makes tons of cash at your demise. It is complete overkill and they are so well protected it will never change. Hence why most rich folks are never convicted. They'd take down the whole system and they know it.

This girl paid her dues and took the punishment for her crime when it was committed. This is America and ex post facto pertains to this stuff too even though they created a loophole like this with “civil remedies”
The irony is the interlock devices force drivers to blow into them while driving which is a huge distraction and has caused many accidents that have lead to serious injuries and death. It's all about the money. Any distracted driving is impaired driving

Well, aren't you holier than thou. My DUI resulted from being .01 over the limit. That is easily explained by residual alcohol in your mouth - which does not reflect your blood alcohol level. I have to carry SR-22, have a blower in my vehicle for 2 years, and restricted to driving for work, education, or medical. They specifically ban driving to obtain groceries or other life necessities. I am 65, live alone and have no family. How am I supposed to live ???? @@user-rj4vr2sc2d
I can sympathize with this lady at some level, but at the same time do what you have to do what is required by law and the point is that it sticks and you don’t do it again. I’m not proud to say that I have one dui conviction, but I am proud to say that I learned my lesson, and I will not do it again because what you were going through does not compare to taking a life or ruining someone else’s life because of your personal choices.
The Punishment is applied to your license..not your car. If you get caught driving a vehicle without the system installed, you will be looking at new charges.

Btw I don’t drink at all and it never was an issue for me but I used to party a lot 10 years ago and do dumb shit obviously!. I hate it when ppl drink and drive I tell them take an Uber! I wish Uber was around when I got my DUI in 2012!
She did her time. She shouldn't have to do a single other thing. So stupid.
Also considering the fact that I didnt blow at the police station, even if I'm found not guilty, the DMV will probobly still require me to have the device for a minimum of a year
@@vikingstorm32 yup if any DUI case gets dropped the DMV still looks at it as a drug or alcohol offense
I really don't understand how they make you blow a second time while you're driving it is illegal to have an electronic device in your hands while you're driving makes no sense
You’re meant to pull over when you do the second test
i mean it’s your phone but ok and it’s because people would blow, start driving, and then start drinking. or already be drunk and have someone else blow for them
My interlock makes me stop literally every 8 to 10 minutes i rather walk at this point

But unfortunately there is no statue of limitation for this😢
It has to do with MVD like my state was never charged for DUI and I still have to have interlock through mother vehicle.
After the DUI conviction, people will now sell their cars to relatives who live in the same house, then continue to drive them. Without interlock.
That just happen to me here in California, 10 years ago I had a second DUI and my case just close last week and I’m order to have that for a year.
What lesson did ya learn, bro?

Yeah and you have to donate lung tissue every time for it to maybe work. By far the most distracting and dangerous device I ever had in my car.
They need to ban alcohol instead of ruining peoples lives
That didn’t go so well the last time they tried it.
Remember the 18th amendment? The thing that created al Capone, etc. they’re not banning Booze, you need to learn some self control
Uh…… no😒
They won't! Because it's money making business!
They make it so hard so that you don’t drink and drive’ it sucks
"Can't stand up or walk" drunk is at .2
Just because someone got a DUI doesn't mean they were drunk or impaired. .08 is the legal limit.
You gotta have fucked up pretty bad to go to prison for 3 years for a DUI. Addiction is a life long battle.
1st DUI.
What’s up with Bella?

So, it should only count if you smash into someone? The point is to stop people from ever driving drunk in the first place.
