  • Judge Merchan held a hearing this morning in which prosecutors argued that Trump is in violation of his gag order due to several of his Truth Social posts. Merchan did not yet rule on the issue.

      That is exactly what Trump wants! He would be able to show his supporters that he is being literally silenced, and could cajole his worst militia types to storm the jail a la Jan. 6. The judge and the DA are doing all they can to AVOID putting him in jail.

      ​@@ChrisPyle...Yes, it's fair when you're the criminal defendant in a trial after you've been indicted by a Grand Jury of your peers. And Trump can defend himself. In fact, that's what he's doing at the table with his lawyers in the courtroom. That's the only place where what anybody says about Trump counts. He's not defending himself when he's ranting on the courthouse stairs or tweeting. Don't you understand how trials work?

    I hate to say it but Harry Litman is making this absurd situation seem normal. Put a poor black defendant in the same position and he will go off to Rikers Island for months. This system is totally disgusting.

      I think Harry did highlight a very important signal that the judge gave the defense team. By standing shoulder to shoulder with Trump in the courthouse public area as he fulminates, by allowing him to rant without interruption, and completely predictably commit criminal contempt (eg about witness Michael Cohen, someone Trump is expressly forbidden from mentioning in public) the defense team are lending a gloss of legality to a criminal act. (Criminal contempt of court.)
      In other words, the judge is reminding them they have a professional duty to detach themselves from visibly supporting his crime: there comes a point when it become aiding and abetting or colluding, for a lawyer to stand there mute as he predictably and repeatedly commits criminal contempt.

      The prosecutor said "he's not asking for incarceration because that's what the defendant is angling for".
      Why? You need to think.
      My bet is Merchan fires warning shots, but avoids looking trigger happy, fines first, then a final warning, so when Donaldict persists and he receives a courtesy taste of detention most people say "about time".

      objection. I don‘ t think he normalizes this defendant, on the contrary. Equlity in the legal sense requires different treatment for different circumstances. In principle. 🤔 It was in the Bush era (hope to get that right) that all these dubious presidential prerogatives in judicial proceedings started.

IF our criminal prosecution system is to be honored, criminal defendent trump should NOT be given special treatment.     It's the JUDGES that are making me angry. They keep allowing Trump multiple and obvious counts of contempt without doing anything meaningful to stop him. They are the ones that are destroying the credibility of their own courts.

      Just to interpose a counter argument. The appeals court is mostly concerned with process, not evidence. So, not so much "is he guilty?", but more like "did he get a fair trial?" So in that sense the judge is trying to close off any avenue that Trump might try to take in an appeal. He wants an appeals court to be able to look at the trial later and say "sure, he got a fair trial". But yeah, it sure is frustrating to watch Trump get EVERY consideration when he commits his crimes so openly. (sorry about your old username)

      I think, these judges have been told its hands off.
      US does not put ex presidents in jail.
      Meaning these trials will be a joke where trump's team goes for a mis trial due to contamination of jury and witnesses....Contaminated By trump himself.
      Its all he has to go on, he will be found guilty at every trial, but not if he can get the trial thrown out.

      @@toober1066 Or in other words the judge is so afraid of screwing up that he's screwing up royally (i.e. he's screwing up way worse than if he would just do his job). Fear is the only enemy here (as ever). The trial judge shouldn't be so worried about appeals, he needs to do HIS job not the other guy's job. And in my opinion the trial judge is not doing his job competently. Any other citizen would have been in jail by now for a tenth of Trump's inappropriate behavior. I repeat: it is the judge(s) that is/are destroying the public's trust in the judicial system, not Trump (Trump is just being Trump).

    If any one of us out here in the real world would have violated that gag order in the manner, even just once, we would go to jail. The amount of times that Trump has already ignored the judge is unbelievable but defying the judge after expanding the order-intimidation of witnesses-we would be sitting in jail until this trial was over with, and beyond. WTF JUDGE? Stop letting him get away with this and hold him accountable! You've allowed him to continue to believe that he's above the law.

      Totally agree! I think it could be because he’s a former president, and the judge is allowing Trump to add to the violations. His punishments will start off small and then get gradually worse. I believe it’s being addressed this way, so the judge can prove he’s being fair and reasonable. And, in this way, he is being careful not to be set up for arguments on appeal. It’s a very complex and complicated process to ensure the judge remains fair and impartial. Criminal cases have a heavier weight than civil cases.

    I know everyone is chomping at the bit to get him remanded into custody for violations but the unintended consequences could be worse and make him a martyr.

    New York law prohibits the Judge to charge more than $1000. Judge is trying to run a trial so clean that the appeals list is very short. Being a judge in a Dozing Don criminal case has got to be one of the hardest jobs in the world. Sending the judge, jury, staff and all truth-tellers in this case love and light!

      "Denying Infinite Security and Government Resources Allocated toward Convicted and Extremely Dishonorable Former Protectees Act” - the DISGRACED Act for short - and was introduced by Rep. Bennie Thompson, D-Miss., the former chairman of the House Jan. 6 committee.
      The DISGRACED Act would automatically strip Secret Service protections from anyone who was convicted of a federal or state felony carrying at least a one-year prison sentence.
      Trump is not named directly in the legislation, however, the stipulations would apply to the former president.
      Reactions from Republican lawmakers and legal analysts are making headlines and implying Democrats are trying to use this bill to kill Trump.
      “Democrats Want Donald Trump ‘Killed,’ Legal Analyst Warns,” one Newsweek headline reads.
      “Marjorie Taylor Greene Suggests Dems Plan to Have Trump ‘Murdered’ in Jail."

    $1000 is nothing to most in New York.
    All this does is set a precedent that mobsters can attack Witnesses and Jurors with a small fee.

    What I would do is sentence to 14 days in prison suspended for the duration of he trial. So the next time he breaches the order he would have to serve the 14 days plus what ever punishment he gets for the new breach.

      Yes, MeidasTouch Network and Legal AF’s Karen Friedman Agnifilo corrected him when they spoke about a month ago during a video together, she has been in the judge’s courtroom frequently, and his name is correctly pronounced mer SHON.

    Our justice system is so crazy. A 10k fine would devastate most people. For Trump it is nothing. Fines should be tied to some kind of income scale to be truly fair.
