    Depending on your end goal, it's far better to go after unregistered land. Often the land registry cannot contact the legal title holder of such land, therefore it's allot more likely you will succeed in claiming freehold of the land. With registered land the registry will have the information they need to track the legal title holder. I have just started my own adverse possession of a piece of land.

      his not going for free hold is he there is a massive difference your way a local council rents it to you there fore always there's who the hell wants to make money for a council THEY MAKE FAR TO MUCH AS IT IS ALSO like the old acorn law yours for 100 years or less THEN ITS THERES AGAIN HELL NO! claim outright always or loose shed loads of time money and hard work to give a council or some other muppet by renting of them as yours lol it never will be yours as this lad knows if he rents it out to someone not realising it they have no rights or power on the land he owns its not the reason to claim land it is to use yourself not to rent if you do you will fail on gaining the land as you clearly dont need it fence it use it better it put a home on it 10 by 10 attached to the ground low impacted ie wood no wheels get an address on the gateway a mail box send yourself a few letters after telling the post office where it is helps your claim later

      @@KevinTalbotTV thank you for letting me know. I will be trying to do it myself and every time I hear the owner came forward is on the beginning of the process. Which I think it’s better than if they will show up after 9 years. But obviously you never know if you going to end up with land or not. I think it’s still worth to try.

    What's to stop someone coming along and claiming it as adverse possession from you?

      You can't. If you claimed my land, and you are not the legal owner, if I have evidence of times and dates that I claimed it first, then I go to the police/Court, and I would 100% win.

      In theory it is possible, however it will only be in situations where You have not taken factual possession of the land Ei building a fence if applicable, and locking any access to the land. If you claimed the land before anyone else then generally speaking you have the stronger claim to the land over who ever tried to claim it after you. However you would need to take them to court and prove you claimed the land before the other party. I recently had this happen to me, an angry woman took possession from me as such, by removing my signs were on a second claim I made, she never owned the land, not did she then take possession. I wondered if she could take such action, and it turned out because I have not yet taken control of the land, she could legally dispossess me of the land. The options I have going forward of course will be to fence the land, and lock it off, only then can she no longer take action. to have factual possession you need to control who can access the land conventionally EI using a gate. After leaning this I took steps on my slightly older claim and locked the gate, and documented it. among other things to stop anyone bar the paper title holder being able to dispossess me, even the title holder cannot without proving ownership.

    We claimed adverse possession 2 weeks ago as the land haf been left to rot away for 30+ years and today the owner rang and told us to get off his property. We did leave and took our sign. Is this game over ??? 😢

      @@OliverKuiz thanks for the reply. The sad thing is... this land has a grade 2 listed building on it which was set on fire 20 years ago. The owners done nothing to repair it and letting trees grow into the building and onto the barn roof destroying everything. We've been putting in hard work trying to save these buildings. I'm sure he could even get in trouble for not fencing off such a dangerous building as its falling down. Good point about he has to prove he's the owner. Thanks. And as its not residential and we aren't causing harm or damage. I don't think we have to leave ?

    Hi Oliver, I have a derelict land that no body wants and has been sitting there for around 80 years, that was until I put my sign up and the neighbours now want it, but I've had my land for a year. They've torn off my Private property sign, but can they steal my land from me that I've loving put money and time into? Police said it's not my property as it's unregistered so they can't help, but they've stolen my things, my sign and equipment!

    Is it registered to anyone? What if you got slapped a council order to clean up the mess. My worry is if you do all the work for say 6 years and it's all going well. Then an owner comes home from Spain and presents himself amd wants you off you'd have no rights? Would you just have to give it back and could he claim criminal damage if you've cleared it and cut trees etc?

    I think is not worth it to claim a land for free now cause by 2030, 100%of the lands has to be registered, so if you find a property now but in 2030 all of them are going to be registered so you couldn't own it?? Hope you can study this and make a video about it, I don't understand much this things. Tell me what do you thinking about it?

      The courts are looking for the owners atm as the was £1000s from them funnily enough. I've had to step back from this piece for a little bit because of this, but I was there the other day. Idk if I'll win the case on this piece, but I have other adverse possessed pieces so I'm not too bothered. I plan to rent it out once the courts are gone.

    thanks man. just a quick one. i got an abandoned house i have kept control of kept it for storage, The owner has been absent for like 20 years. Apparently he is an 80 yr old hong kong resident, so i doubt he even remembers any more. If i fill in for adv1 form and send it off, will i need to PROVE to the land registry that i have had it for 10 years, or will i need to retain proofs INCASE the owner objects? please whatever response would be appreciated.       YES YOU NEED PROOF!!! Dated photos, receipts, videos, neighbour testimonials, anything!! Ive setup an email, where I email myself everything. I have a private RUclips channel with documented videos of events with dates listed in the videos. I photograph for records, I email myself descriptions and details of my visits and works done because the emails are dated. Keep everything possible. Anything is usable; an old photo, a Facebook post etc. Gather as much as you can, even messages to friends and family about the property. Write out as much detail and dates that you remember, and things you have done to the property. Anything that that prove that you've done good for the community too ie. You purchased a lawn mower to cut the grass, or the postman saw you cleaning the windows. Spend a month gathering everything, write it all down and make a folder of it, then copies of everything (paper and digital). Start taking evidence down from today too.

    Any tips on how to cheaply fence land off? I looked at bareroot hedging and barbed wire, but I could easily spend £400-800 on something which could need to be removed if an owner comes forward. I've found some land which was last exchanged in 1965 and its registered to an address. I'm pretty sure the address its registered to is the wrong one. If the address registered is not up-to-date, do you think I stand a better chance of AP, and also is there any way I can easily track down if the registered owner is even still alive?

    I'm interested in making a claim for a land lot by adverse possession. My question is who can legally claim land in the UK? Anyone? Only British citizens? Permenant Residents? Foreigner with temporary stay?

      In the UK, you can purchase property as a foreigner so I see no issues with this. Unlike in Canada where you need to be a citizen to buy property.

    oh mate you forgot your claim objection notice to the public and you phone number so you DO NOT OWN THE LAND EVEN YET so the months past at null and void get it up fast before someone else does have you moved any tipping yet? have you set up a post box on that gate to claim your postal address there your still a tad green on doing this so best to listen when someone is giving YOU sound advice making a postal address there in your name strengthens your land ownership later on ok thats it am out of here try be a tad more polite you may fine things go better if your liked putting a fixed wood home there is only 4 years to wait better the land i.e clean and plant food in a area

      Not 100% but I think that only applies to residential, anything else like land or commercial they need to go to court to shift you

    HI , how does it stand if you find land that has not been touched for many years it has a lock on the gate and a bit of old machinery on the inside of the gate from stopping any vehicles entering it , could I cut the lock off and remove the machine ? or would it be better to look at the land registry first before doing anything ?

    by the way its also illegal to make yourself look like your from said council with the high vis waste team look alike top by making it look like your there to clean mate why did you remove the facts of the land after i posted it to help others and as I said the land as to be for your use only if your planning to live on the land you have to do so in view in a solid building with no wheels not a porta cabin a small ground tied 10 by 10 hut it must have a bed sink food wardrobe bed the basics of life in a low impact on the surroundings home, been bullish will get you nowhere at all mate you need to have that home there four years without complaint having woods on your land helps so you locked up a gate put no fly tipping and your number right that not claiming ownership mate
