From my experience, I can vouch for the information given in this video. It's about 99.9% if not 100% accurate. You definitely do not want the average defense attorney representing you in a justified use of deadly force situation. Go with an attorney who's familiar with firearms and knows the self defense laws in your state, it can be the difference between getting your case dismissed or risking an expensive trial where you can lose everything - the average juror likely doesn't know anything about firearms besides what they see on TV and will likely be more bias towards the Prosecution.
I am a trial attorney in Massachusetts. In my opinion, each of the points in this video is absolutely correct. Criminal defense trial work generally focuses on cross-examining hostile witnesses, while keeping your own client away from the witness stand. But effectively presenting a "counter-story" (i.e., affirmative defense) requires different tactics. It's not enough to poke holes in somebody else's story. In that sense it's like civil trial work. It is an excellent idea to look for a lawyer who has defended police officers. If one of those isn't available, then I would look for an attorney who has a serious practice in both criminal and civil trials: it shows a range of talent, flexibility, and comfort with learning new things.
Do you also agree with his opinion of talking to the police and explaining yourself before having representation? He has taken this stance multiple times while on the Active Self Protection channel.

One is to make sure YOU are the one that notifies the police FIRST. That starts the indication you are indeed the victim. "Guilty" parties usually do NOT call the police. Another is stating the fact you were attacked and feared for your life. No where in his five things is there ANY "explaining". Only that you are the victim, you shot in self-defense, and you will talk further AFTER you talk with your lawyer. Not saying anything will give the indication you are trying to hide something. Say those five things, and ONLY those five things. It starts the thought process with the officers that you are the victim, not the guy you shot. It also shows you are willing to PROVE it... after you talk with your lawyer. There are some people out there that state say nothing. That hints that all is not well in your "self-defense" shooting. And, if the guy you shot has friends there that are willing to tell their side of the story (i.e. you didn't need to shoot at all), THEY are on record FIRST unless you step up to bat first. Be the FIRST to call 911, and be the FIRST to say your five things. Then shut the hell up until you talk to your lawyer. Some of the self-defense protection services have lawyers on call 24 hours a day. IF you pay for one of those services (I do), then make the call. You MIGHT have legal defense on the phone as you talk to the police. Oh and, his tips on a lawyer is spot on. You want a lawyer like the guy up north that killed two guys and shot another guy all in self-defense (can't type his "name", or YuckTube will delete the reply. Crazy huh???). They systematically destroyed every single trick the DA tried, without fan fair. THAT is the type of defense you want and need.

How many videos on his channel, and others, have I seen experienced police officers drop the mag out of their gun (both hand and rifle) in the excitement??? MANY MANY MANY TIMES And sometimes not just once, but MULTIPLE times during the same conflict. A "civilian" in the heat of the moment would be even more akin to making that mistake. And being a leftie, it would be even easier for me. The release is on the "primary" hand's side. Most of the time John has good advice. On the "extra mags" though, it is NOT good advise at all. Of course, the ONLY reason I carry two extra loaded 17 round mags is... with a shoulder holster it helps balance the weight of the full-size Beretta on the other side. :) I "travel" on a power scooter, so I am a prime target. But, If someone hits me up, I will pull my cell phone from under the left side of my sports coat and give it to them. Then reach for my "wallet" on the right side. Most people don't stop to think of someone drawing with the "wrong" left hand. At least I HOPE they don't...................................................

You are correct Massad. An attorney that not only knows the law but knows the great case law out there on important decisions. Your attorney only has 1 shot to get this right. I prosecuted a landmark case to the highest court in the country that gives all adults a new protected right in all 50 states. (Dutkiewicz v. Clean Harbors). Many city, urban lawyers want to clear cases quickly, smoothly. The old legal saying you have a 10% chance of a guilty verdict 📁 even if you are fully 💯 in the right, justified. Some DAs, SAOs want to settle or clear cases, plea quickly.
Absolutely agree. I can not at this time give personal details but I would advise that this is true in all cases of legal representation. So common is the attorney of "guilt mitigation" that so many of them do not know how to defend innocent men. Whatever reason you find yourself on defense in the justice system, an innocent man needs an attorney who knows how to defend innocent people. May seem like common sense, but it is not common in practice in any legal defense.

Great advise Mas. I would only add that the search for such an attorney should begin before the armed citizen is ever involved in a self defense shooting, not after it. Yes, most criminal defense attorneys are from the gun control side of the aisle, so how do you find one who is actually a defender of the 2nd Amendment and the right of Self Defense? One way is to join a network such as the one that you are on the board of. That will help with both the procurement and payment of legal services. A second way is to join local shooting clubs such as USPSA/IDPA/Steel Challenge affiliates and see if there are any attorneys who are members. The clubs that I belong to have several members like this, and I keep their business cards in my wallet at all times. Another benefit to joining and participating in these local clubs is the continued practice with your favorite firearms. Thanks for what you do.

He is exactly right. Sensationalism and attention is what dominates the direction of of how the majority of these cases might go south. Be low key, calm and collected, get ahead of it and take the "wind out of their sails". Be the dull "nothing to see here, folks".
3:39: Hopefully, the police union -- the entity that represents the organization that employs the very folks who might've just arrested you after a lawful self-defense event -- will be willing to provide you with the information that you're requesting. Possibly they'd view your request for a competent attorney to be in plain conflict with the officers' decision to place you under arrest. I'm surprised that Mr. Ayoob didn't at least acknowledge this particular and potential issue in the video.

Mas, I remember a piece of advice you gave the class, in an LFI course I attended years ago; I'm paraphrasing but it went something like this: "When you need an attorney in a self-defense case involving firearms, call the Second Amendment Foundation. They know who the attorneys are, in a lot of areas, who are willing to defend citizens who've defended themselves with firearms, who know the law in that area, AND are pro-gun." Good advice. I did that, got a recommendation and his phone number from SAF, called up the guy, talked to him, got a good vibe, then put his number into my phone to have, just in case I ever suddenly needed it.
All of these reasons are exactly why I am a member of CCW Safe. What I like about this insurance/membership program, is that you have the option of either using their go to attorney, who is the well known Don West. If you would rather use your own attorney you can but CCW Safe will vet that attorney and depending on what they find they may say no you’re not using that attorney. They do it that way because of every reason that Massad Ayoob is talking about in this video.

Greetings from Alaska. This may not be the best video to respond to, but in many ways it may be the perfect one. Earlier this evening I watched an older video of yours regarding "training drills", and I must say it has much merit, especially as I am a former marine and understand the importance of training. But now to the point. and you may have already done so, I would ask that you develop a drill for "seniors" that would involve an encounter "in town" where any form of retreat is not an option (due to medical disabilities) as well as responding to a home invasion. I realize that "stand you ground laws" vary from state to state, but us old people all to often simply do not enjoy the ability to leave a developing situation. All of these reasons are exactly why I am a member of CCW Safe. Greetings from Alaska. This may not be the best video to respond to, but in many ways it may be the perfect one. Earlier this evening I watched an older video of yours regarding "training drills", and I must say it has much merit, especially as I am a former marine and understand the importance of training. But now to the point. and you may have already done so, I would ask that you develop a drill for "seniors" that would involve an encounter "in town" where any form of retreat is not an option (due to medical disabilities) as well as responding to a home invasion. I realize that "stand you ground laws" vary from state to state, but us old people all to often simply do not enjoy the ability to leave a developing situation. Thanks in advance for all you offer and I look forward to your solution/recommendation to this issue. John Janik
