I live in an apartment building. I'm on the bottom floor, and I have had to deal with water coming through the wall, and flooding my bedroom floor. This has happened a few times recently, because we've had some heavy rain storms this summer. So the first couple times, "maintenance" just pulled up my carpet, and plugged in a floor fan until it was dry. Luckily, they left the fan in my room for a week, because it rained a lot again after the 2nd notice, and more water came in, I did not see any work done on the outside of the building, to prevent the water from coming in. They just used a bunch of silicone on the inside along the wall, which was washed out before it could dry the first time, and they just put more goop along the bottom edge of the trim. Also, they did not even bother putting the carpet back in place. Which is actually still pulled up from a water heater failure last year that flooded my room WHAT DO I DO??? HELP!!!
Thank you so much. I have so many plumbing questions about my new home. Can you do a video about the water lines coming into condos. My HOA refuses to give me access to the water shut off value. There's a locked cabnit on the side of the building. In an emergency I have to wait for someone to shut off the water. I get the feeling that the reason I am not allowed access is the valves and pipes are old and need to be replaced. Definitely not get the full story.
Apartment below, no heat turned on, which caused pipes to freeze/burst, in turn causing us to have no heat or water. Utility Co won't repair, as thousands of $'s owed by owner and even if they did repair, it would happen again due to no heat being paid for or turned on. The downstairs apartment is a garbage tip and we are also getting mice come into our unit. Our homeowner's insurance won't do anything to help because problems caused by other unit. Property owner won't do anything as they have no money, due to numerous fines from HOA. HOA won't do anything because they state the homeowner is responsible. How do we deal with this?
Wow!! I would immediately hire a public adjuster and make sure you find a expert leak detection company that can write up a report supporting your claim.
Did you try contacting your insurance? Let us know. We have a situation too with downstairs unit leak from my kid's upstairs unit. Will find out where the leak if it HOA or us.
This doesn't give an answer who's gonna cover the expenses. Insurance company told me it will go on my policy even thos damage is caused by neighbor above me, that just doesn't make any sense!?!?
Hello, Water leaked into my living/kitchen and master bedroom. May have been caused by neighbor upstairs. Condo refused to pay anything. The other unit owner sold their condo unit and we can’t find them. My home owners insurance is giving me the run around. Im not sure what to do Please advice.

We have similar issue, unit downstairs below my kid's unit start to have leak and water dripping from a hole in drywall in her bathroom. HOA will send out a plumber to find out where the leak is, is it in common area, or actually come from us. Kid contacted insurance company but they said nothing to do now unless it is our fault. We also have a local plumber that we can use if needed. Hopefully it is an easy fix if it is our fault, but neighbor drywall will have to fix repaired as well. Will your be responsible to fix all damages in downstairs unit, or their insurance should cover what inside their unit? We will see. Any comments and tips?
I’m on top floor unit below got a drip from my shower drain can I repair the grout and seal it myself or have condo association send a plumber in and all they want to rip up the whole shower drain very costly when it’s just the grout and seal around the drain
We live in the very top floor of the building and our condo unit is experiencing water leak every time it rains and the water is coming through outside the wall, we had talked to the property manager a couple times but have nothing or committed to fix the problem. What should be our next step to do? Shall we hire a lawyer?
lots of documentation, contact HOA as the owner above you leak is damaging the common area crawl space creating mold, moisture, infrastructure damage, etc. and now the above you owner has damaged both HOA property and your unit. Contact your insurance company. Keep receipts to use in small claims. The Homeowner above you insurance should cover you but the above you owner will be hostile and reluctant to validate your issue. Eventually, the HOA will have to legally enter the offender's unit, fix the problem, remediate any mold if applicable, bill back the homeowner. If payment is not received the HOA should place a lien on their unit. Work with the HOA management company. Good luck.
Exactly what happened in my parents condo. It was never fixed because the HOA stated that the insurance didn’t pay enough. Wish you all were in Florida. If you have anyone you can recommend in the Miami area, PLEASE let me know. Thanks
The fireplace we have has a hole in the exhaust tube and HOA says is our responsibility and the person thar cleaned the chimney and saw that said probably was done when was installed, so?! What to do?
I have a leak in my condo and my neighbor upstairs is not opening door or responding to phone calls from the association. The association is telling me that I have to deal with the owner upstairs directly. My insurance is also telling me the same thing. Who is responsible in this situation? I’m feeling hopeless :(
Hello Mayra! Sorry, your having to deal with an issue like this. What type of damages are you suffering from? ( wet drywall, peeling paint, mold etc) Does the leak only happen when they use the bathroom above you?

Should be able to replace / repair it yourself if that is that source. Do you have an update?
Great details mine was shower value above my unit was leaking.

Hi going though a similar issue, what steps did you take?
If the condo is flooded because off aqueduc and sewage back up what is happening next?
Was this Condo in California? Do you work in the OC area?
How do I go after the owner of the condo above me if their toilet was over flowing for hours and caused a lot of ceiling and wall damage

If you have substantial damages, then call your insurance agent and see if you have coverage?
if so, your insurance will go after the HOA insurance.

I would read the bylaws and see what is considered a common area.
It does sound though like this would be a homeowners responsibility

Does the leak only happen when they use the bathroom above you?
Would a home warranty take care of that?
Bylaws and CC&R's are often open to interpretation... get an expert to review your bylaws!
I think my neighbors be intentionally letting water leak in my apartment for money idk but I will find out this the third time smh
So both 😣
